PaymentMethodsAllNefcohouseaccountsreceivethesameterms&conditionsandwillnotbesubjecttoequipmentdepositsanddamagewaiv-ers;howeverthedamagewaiverisavailablewhenrequested.ForourcustomerswhodonothaveaNefcohouseaccount,thefollowingformsofpaymentareaccepted:Cash,PersonalorBusi-nessCheck(withproperI.D)ormajorcreditcard.Ournon-houseaccountsareaskedtopayfortheirrentalfeesandequipmentdepositatthetimeofequipmentacceptancebycustomer.Depos-itsarereturnedwhenequipmenthasbeenreturnedandwithoutexception.

1)CusToMer'sgenerAlresPonsiBiliTyUndertheNEFCORENTALS(Agreement),theCustomerrentingtheEquipment(asthattermisdefinedintheRentalAgreement)isresponsibletoforanylossordamagetotheEquipmentandforitsreturninthesameconditioninwhichreceived,exceptforor-dinarywear.SuchresponsibilityshallamounttothereplacementorrepaircostoftheEquipmentatthetimeitislostordamaged,plusanadministrativefeeandNEFCORENTALSrelatedlosses,suchas,butnotlimitedto,lossofuse,appraisalfeesorcostsofrecovery.IntheeventthattheCustomerisresponsiblefordam-agetotheEquipment,suchEquipmentmayberepairedeitherbyNEFCORENTALSorarepairerofchoosing.Thecostoflaborforsuchrepairsshallbethethenprevailinghourlyrateforlaborattherepairfacilitywhererepairsareeffectuated.TheCustomerwillbechargedforpartsattheprevailinglistpriceestablishedbythemanufacturerorsupplierinvolvedoraschargedtoNEFCORENT-ALSbythesupplierorrepairfacility.

2)ProoFoFinsurAnCeAsapreconditionofrentingEquipmentfromNEFCORENTALS,CustomermustproduceevidenceofinsuranceinaccordancewiththeRentalAgreement,orCustomershallberequiredtopurchasetheLDWAssurancePlan,whichisNOTINSURANCE.ThechargefortheLDWAssurancePlanshallbeequalto14percentoftherentalamount.

3)WAiverIftheCustomerpurchasestheLDWAssurancePlan,andiftheEquipmentisusedincompliancewiththisplan,thenNEFCORENTALSagreestowaive,totheextentspecifiedhereinandintheRentalAgreement,itsrighttoholdCustomerliableforanydamagesgreaterthan25percentoftheEquipment'sreplacementcost.

4)WAivereXCePTionsnoTWiTHsTAnDingTHeCusToMer'sPAyMenToFTHelDWAssurAnCePlAnCHArge,THeCusToMerWillBeliABleToneFCorenTAlsForAlllossoForDAMAgeToTHeeQuiPMenTAnDrelATeDeXPensesinCurreDByneFCorenTAls,resultingfromanyofthefollowingcircumstances:

A)TheuseoroperationoftheEquipmentwithoutNEFCORENT-ALSpermission,orinamannerthatwouldconstituteadefaultundertheRentalAgreement.

B)ThefailureoftheCustomertoperformorpayforallnormalperiodicandotherrequiredorrecommendedservice,adjustmentsandlubricationoftheEquipment.

C)Negligent,reckless,orabusiveuseoroperationof,orinten-tionaldamagetotheEquipmentwhiletheEquipmentisunderthecareorcontroloftheCustomer(e.g.,Equipmentrolloverorupset,alteringtheEquipmentforuseinamannerforwhichitwasnotdesigned,comingincontactwithanoverheadelectricpowerline).

D)TheuseoroperationoftheEquipmentwithaloadexceedingthemanufacturer'sratedcapacity,orasaresultofimproperload-ing,unloading,ortransportationoftheEquipment.

E)Alllossordamageassociatedwithvandalism,maliciousmischief,disappearance,theftorconversionoftheEquipment,notdocumentedbytheCustomer'sfilingaformalwrittenreportwiththeapplicablepublicauthorities(withanimmediatecopytoNEFCORENTALS)within24hoursoftheevent.

F)Customer'sfailuretoproperlysecuretheEquipmentand/orbymakingitavailabletoanyunauthorizedand/oruntrainedoperator,orbynotreasonablyrestrictingaccesstotheEquipment.

G)DamagethatoccurswhileCustomeruses,allowstheuseof,ordirectsanotherpartytousetheEquipmentinthecommissionofacrime.

H)Customer'sfailuretonotifyNEFCORENTALSwithin24hoursofanaccidentthathasresultedinlossordamagetotheEquipment.

I)CustomerprovidesmisleadingorfalseinformationtorenttheEquipment.

J)TheEquipmentisusedbyanoperatorwhileundertheinfluenceofanintoxicantorotherillegalorcontrolledsubstance.

K)Customer’sfailuretopayallinvoicesincludingtheLDWwithinNEFCORENTALSpaymentterms.

5)suBrogATionIfCustomerpurchasestheLDWAssurancePlan,thenNEFCORENTALSwillbesubrogatedtoanyrightoftheCustomertorecoveragainstanyperson,firmorcorporation.Customerwillexecuteanddeliveranyinstrumentsandpapersthatarerequiredanddowhateverelseisnecessarytosecuresuchrights.CustomerwillcooperatefullywithNEFCORENTALSand/oritsinsurer(s)intheprosecutionofthoserightsandwillneithertakenorpermitanyactiontoprejudiceNEFCORENTALSrightswithrespectthereto.

6)TirerePAirsAnDrePlACeMenTA)ThecustomerisresponsibleforALLtirerepairsorreplacement.Itisthecustomersresponsibilitytoinspectalltiresatthetimeofdelivery.
