Se conoce como fouling1 la acumulación y depósitode material biológico en una superficie inmersa enagua, como pueden ser los cascos de los barcos.

Los cascos de los barcos que no están tratados consistemas antifouling pueden llegar a almacenargrandes cantidades de material a los pocos meses deestar en servicio. Una pequeña cantidad de foulingdepositada en el casco de un barco puede hacerincrementar el consumo de combustible hasta en un50% debido a que la resistencia hidrodinámica almovimiento aumenta, a la vez que la velocidaddisminuye. Un casco limpio hace que la velocidad seamayor a la vez que el consumo inferior.

Un buen sistema antifouling hace que el consumo seamenor a la vez que el mantenimiento del buquedisminuye y el tiempo de operación aumenta

Durante los años 60, la industria química desarrollopinturas antifouling eficaces y baratas, usandocompuestos organoestánicos, en concreto TBT(tributilo de estaño o en inglés TriButylTin).

Cuando el uso de TBT se extendió, se vio que lasconcentraciones de este compuesto en zonas con altadensidad de barcos eran muy elevadas. Pronto sevieron los efectos medioambientalmente adversosque tenía este compuesto al liberarse esta pintura alagua y distribuirse en el medio marino.

Estos compuestos organoestánicos muestran unaelevada toxicidad a niveles de concentración muybajos. Se acumulan en los sedimentos del fondo y sehan observado sus efectos adversos principalmenteen moluscos marinos, entre los cuales un caso muyestudiado fue el efecto en caracoles marinos en losque estos compuestos actúan como disruptorendocrino (alterando el sistema hormonal de los seresvivos). En mamíferos marinos se acumulan en grandesconcentraciones en sistemas hepáticos.

En 1988 éste problema fue tratado por el Comité deprotección medioambiental marino (MEPC) de laOrganización Marítima Internacional (IMO) y en19902 se adopto una resolución recomendando a losestados el tomar medidas para eliminar pinturas anti-fouling con TBT. En 2001 se adoptó una resoluciónque instaba al MEPC a desarrollar un instrumento deobligado cumplimiento a nivel mundial queprohibiera el uso de TBT a partir de Enero de 2003 yla prohibición de su presencia a partir de Enero de2008 (Convenio AFS). Este convenio entraría en vigordoce meses después de que lo hayan ratificado almenos veinticinco Estados cuyas flotas mercantescombinadas representen no menos del 25% deltonelaje bruto de la marina mercante mundial.

En Europa, varios países establecieron una regulaciónpara los compuestos biocidas anterior a la primeradirectiva que regulaba el marketing de especiespeligrosas (76/769/ECC), sin embargo no seestablecieron las bases comunes de evaluación yautorización de biocidas homogéneas hasta ladirectiva de productos biocidas de 1998 (98/8/EC).

En 2002 la Comisión Europea adoptó la regulaciónrelativa a la prohibición de la aplicación, uso y ventade compuestos organoestánicos (2002/62/EC). Laprohibición de los estos compuestos en barcos debandera de países miembros de la UE, así como laprohibición de entrada de barcos en puertos de la UEque contengan estos compuestos, se estableció bajoel Reglamento (CE) nº 782/2003,(http://europa.eu/scadplus/leg/es/lvb/l24256.htm)

El 17 de Septiembre de 2007, 25 estadosrepresentando el 38,11% del tonelaje bruto mundial,habían ratificado el convenio, por lo que el convenioentrará en funcionamiento el 17 de Septiembre de20083.

RESUMEN:The use of antifouling paints is the only trulyeffective method for the protection of underwaterstructures from the development of foulingorganisms. In the present study, the surface tovolume concept constitutes the basis for thedevelopment of a new and improved method fordetermining the toxicity of antifouling paints onmarine organisms. Particular emphasis is placed onthe attainment of a standardized uniformity ofcoated surfaces. Failure to control the thickness ofthe coat of paint in previous, studies of this type, hasled to inaccurate evaluation of the relative toxicity ofsamples. Herein, an attempt is made to solve thisproblem using a simple technique which givescompletely uniform and smooth surfaces. Theeffectiveness of this technique is assessed throughtwo series of experiments using two different typesof test containers: 50 ml modified syringes and 7 mlmultiwells. The results of the toxicity experimentsfollow a normal distribution around the averagevalue which allows to consider these values asreliable for comparison of the level of toxic effectdetected with the two types of test containers. Themean lethal concentration L(S/V)(50) in the test seriesconducted in the multiwells (20.38 mm(2) ml(-1)) doesnot differ significantly from that obtained in the testseries using modified syringes (20.065 mm(2) ml(-1)).It can thus be concluded from this preliminary studythat the new method and the two different ways ofexposing the test organisms to the antifouling paintsand their leachates gave reliable and replicableresults.

TÍTULO: The effects of a copper-based antifouling paint onmortality and enzymatic activity of a non-targetmarine organism

RESUMEN: Antifouling paints are used on a wide range ofunderwater structures in order to protect them fromthe development of fouling organisms. The leachingof the toxic substances from the matrix of the paintcauses toxic effects not only to the fouling organismsbut also on other “non-target” biota. The presentstudy addresses the impact of the antifouling paintFlexgard VI-II on brine shrimp nauplii selected asconvenient test organisms. The surface to volume(S/V) concept developed by Persoone and Castritsi-Catharios (1989) was used to determine S/V-LC50s forthe test biota exposed to PVC test panels of 400-1000mm 2 surface coated with the antifouling paint intest vessels containing 20 ml seawater. Total ATPaseand Mg2+-ATPase were also analyzed for coatedsurface areas inducing less than 50% mortality in thebrine shrimp nauplii. The calculated S/V-LC50(24 h)was 24.6 mm(2)/ml, which shows the high toxiccharacter of the antifouling paint. Decreasedenzymatic activities were noted in the brine shrimpnauplii exposed to test panels of 50 and 100 mm 2 in20 ml seawater. The present study indicates that the“surface to volume” concept is an interestingmethodology that can be applied with both lethaland sublethal effect criteria for the determination oftoxic stress from leaches of painted surfaces.

Este indicador enuncia las principales compañíascompetidoras y el tanto porcentual que representacada una de ellas en función de la cantidad deregistros encontrados, es decir, en base a lascompañías con mayor número de patentes. Seseleccionan aquellas que representan el porcentajemás alto del total de los registros de patenteencontrados.

La información anterior muestra los ochodesarrolladores más prolíficos de pinturas yrecubrimientos antisuciedad e incrustaciones paracascos de buques. Sólo la labor de este grupo suponeprácticamente la mitad de las invencionesconseguidas en el área tecnológica de estudio. Aparte de este conjunto de innovadores, se handetectado otra treintena de empresas e institucionesque han obtenido una o dos patentes en este mismocampo. Una cantidad pequeña de resultados peroque advierte ya de una importante actividadinvestigadora.

Evolución Tecnológica

Este indicador introduce la secuencia anual delnúmero de solicitudes de registro. Este datoproporciona información relativa a la inversiónpotencial realizada por las compañías del presenteestudio, tanto en el año de solicitud, como en losinmediatamente posteriores.

Se debe señalar que el descenso del año 2007 no essignificativo puesto que recoge innovacionespublicadas únicamente durante el primer semestredel año. Faltarían, no sólo el resto de patentes que seconsigan durante la segunda mitad sinoprobablemente también invenciones cuya solicitud deprotección aún no ha sido concedida. Análogorazonamiento se puede tener en cuenta para el 2006,por lo que se puede esperar un mayor número deregistros para ese período.

En cualquier caso, la información de la tabla anteriorno muestra una tendencia clara y el número deresultados se mantiene bajo durante el intervalo deestudio. No se puede decir que se trate de unatecnología incipiente, pues se ha comprobado laexistencia de resultados antifouling desde la décadade los ochenta, pero sí parece tratarse de técnicas envías de desarrollo.

Liderazgo Tecnológico

El indicador de Liderazgo Tecnológico introduce lascompañías concretas con la tecnología másconsolidada y más desarrollada en el campoespecífico considerado. Está basado en aquellosdocumentos de patente que reciben un mayornúmero de citaciones y, por lo tanto, con un mayorimpacto tecnológico o con un mayor grado de avancey evolución tecnológica.

En primer lugar, se puede observar que el número decitaciones es bajo. Se debe tener en cuenta que setrata de patentes relativamente recientes (la másantigua, del año 2001), lo que explica, en parte, quela cantidad de menciones sea pequeña.

Desde hace años, la eliminación y prevención de losproblemas originados por las comunidades deorganismos incrustantes, ha sido objeto de estudio denumerosos investigadores. En particular, se haprestado atención a la formulación de pinturasantiincrustantes o antifouling, las cuales, junto con laprotección catódica y los recubrimientos aricorrosivos,forman un sistema de aplicación para la protecciónde los cascos de las embarcaciones.

A lo largo del presente informe se ha podidocomprobar que, si bien el número de invencionesprotegido vía patente no resulta elevado (al menosen términos absolutos, o si se compara con otro tipode tecnologías), no sucede lo mismo con losproductos comerciales derivados de éstas. Losproveedores de este tipo de artículos han sabidocomunicar y participan activamente por todo tipo devías, como pueda ser, a modo de ejemplo, el SalónNáutico Virtual (http://www.nauticexpo.es).

Dentro de las compañías e instituciones queintervienen en estas innovaciones, aparece en unaposición de liderazgo CHUGOKU MARINE PAINTS.

Con un capital de 11.600 millones de yenes a finalesde marzo de 2007, esta empresa se ocupa, además dela fabricación y venta de pinturas marinas, pinturasindustriales y adhesivos, de la venta de equiposrelacionados con la pintura, la gestión y el contratodel trabajo de recubrimiento así como la inspeccióndel recubrimiento y tratamiento de superficies, entreotros.

Dichos resultados no están taninfluenciados por el tipo de resina utilizada como porla composición y concentración de los tóxiciosempleados.

1. PATENTE : Una patente de invención es underecho exclusivo que el Estado otorga alinventor, a cambio de que éste brinde a lasociedad el fruto de su investigación. La solicitudde patente se publica a partir de los 18 meses,dejando de ser secreta para pasar al estado depúblico conocimiento.Las enseñanzas técnicas derivadas de esa solicitud,pueden servir de base para que tercerosdesarrollen perfeccionamientos sucesivos,contribuyendo a un mayor avance en el estado dela técnica. El derecho exclusivo tiene una duraciónde 20 años, durante los cuales el titular puedejustamente, impedir que terceros exploten suinvención. Pasado ese lapso, la patente pasa a ser dedominio público, ello significa que cualquierpersona puede hacer uso de la misma sin tenerque abonar regalías al titular de la patente.

2. NOVEDAD: Se dice que una creación poseenovedad cuando no existe en el Estado de laTécnica, entendiendo este último como todoaquello que ha sido hecho accesible al públicomediante cualquier forma de utilización opublicación, antes de la fecha de primerapresentación de la solicitud de patente.

3. ACTIVIDAD INVENTIVA: La actividad inventivaes el segundo de los requisitos necesarios paradeterminar la patentabilidad de una invención. Suapreciación, es subsidiaria de la concurrencia delrequisito de novedad. Así, si bien la falta denovedad conllevará la inexistencia de actividadinventiva a los efectos de patentabilidad, lasrealizaciones tecnológicas que resulten novedosaspueden ser o no inventivas. Para ello resultanecesario, en primer lugar, analizar el conceptode actividad inventiva. Posteriormente, y una vezrealizada esta labor previa de definición,podremos analizar la positivación del requisito enlos textos legales y acercarnos a los criteriosutilizados en el enjuiciamiento de la actividadinventiva.

4. APLICACIÓN INDUSTRIAL: exige que el objeto aproteger por la solicitud de patente, deberá serfactible de reproducir o utilizar en la industria,entendiendo ésta en su más amplio sentido,incluyendo actividades como la manufactura,minería, agricultura, etc.

5. CLASIFICACIÓN INTERNACIONAL DEPATENTES (CIP) : Sistema de clasificaciónjerárquica utilizado para la clasificación ybúsqueda de los documentos de patente(solicitudes de patentes, patentes concedidas,modelos de utilidad, etc.). También se utilizacomo instrumento para ordenar los documentosde patente, como base para la difusión selectivade información y para el estudio del estado de latécnica en un campo dado de la tecnología. Elesquema de la clasificación contiene 70.000entradas. La oficina Europea de patentes disponede su propio esquema de clasificación basado enla CIP, denominado Clasificación Europea dePatentes (ECLA).

6. ESTADO DE LA TÉCNICA: Se refiere al nivel dedesarrollo alcanzado por un área particular deuna materia técnica en una fecha dada. Estáconstituida por todo lo que antes de esta fecha seha hecho accesible al público en cualquier partedel mundo y por cualquier medio. Para unainvención dada, el estado de la técnica es decisivopara la determinación del cumplimiento de losrequisitos de patentabilidad en cuanto a novedady actividad inventiva. La fecha que delimita esteestado es la de presentación de la solicitud, queserá la de prioridad en los casos correspondientes.

7. ANÁLISIS DE PATENTES: El análisis de patentesde un sector permite ver el grado de madurez deuna tecnología y quiénes son los sectores quedominan o emergentes. Puede analizarse laposición de un país, de una determinada empresao región, las alianzas entre ellos y, de acuerdo conesto, establecer estrategias de futuro.

Se desea indicar que la clasificación internacional delas patentes se realiza en base a criterios objetivos.No obstante, la interpretación de documentossiempre implica un cierto grado de subjetividad, y elhecho de que la clasificación la realicen distintosExaminadores, procedentes de diferentes sectorestécnicos y de diferentes países de origen (y por tantodiferentes idiomas), deja un cierto margen a lasubjetividad y a la interpretación de algunosconceptos. Por lo tanto, siempre debe tenerse encuenta que hay que aceptar cierto margen de error.

Es sabido que durante las investigaciones sólo sepueden detectar aquellos expedientes (sea patentes omodelos de utilidad) que ya han sido publicados. EnEspaña (como en la mayoría de los países), lassolicitudes de modelos de utilidad no se publicanhasta un mínimo de 6 meses desde la fecha desolicitud, y las patentes hasta un mínimo de 18 mesesdesde la fecha de solicitud. Por ello, las solicitudes de

modelo de utilidad presentadas en los últimos 6meses y las de patente de los últimos 18 meses no son“detectables” durante las investigaciones. En algunospaíses, las solicitudes de patente no se publican hastaque no se conceden, por lo que en tales casos, elperiodo durante el cual no son detectables es de 2-3años o incluso más. En otros países, existe un retrasoenorme en la Oficina de Patentes, y las solicitudes depatente pueden tardar varios años en publicarse. Decualquier forma, indicar que es conveniente tener encuenta que las solicitudes de patente no se publican,en la mayoría de los casos, hasta pasados 18 mesesdesde la fecha de solicitud o de la fecha de prioridad(si se reivindica).

Por otro lado, es conveniente indicar que muchasempresas no solicitan las patentes y/o modelos deutilidad a su nombre, sino que utilizan otrasempresas o personas físicas para hacer las solicitudes.
