Following the Capital Radio group's decision to dispense with the managing director's role at its local stations (M&M, June 22), it is under- stood that the GWR Group is also eliminating the local MD position at its stations. In addition, it has set up a new centralised programming and content department-GWR Cre- ation-and hopes to centralise its news operations by using a system of regional news centres. Although some of the changes are already understood to be in place, GWR was not prepared to confirm or comment on the moves, saying that full details of the restructure will be made public in late July. The amount of job losses involved in the process is unknown, al- though in its recent annual report the company allud- ed to the need to cut costs in the coming financial year, given the recent downturns in advertising revenue. "There will no longer be managing directors at GWR [local stations]," a GWR source tells M&M. It is understood that all local GWR station MDs are either leaving the'company altogether or are being reallocated to group -wide func- tions. Meanwhile, all those involved in programming and other content at GWR stations will all become part of GWR Creative, forming an indepen- dent business unit operat- ing along similar lines to GWR's London -based sales division Opus. LONDON - Another big radio group isslimming down in order to be fit forthe rigours of the UK's big post -Com-munications Bill shake -out.

Following the Capital Radiogroup's decision to dispense with themanaging director's role at its localstations (M&M, June 22), it is under-stood that the GWR Group is alsoeliminating the local MD position atits stations. In addition, it has set upa new centralised programming andcontent department-GWR Cre-ation-and hopes to centralise itsnews operations by using a system ofregional news centres.

Radio listeners are like most animals-they migrate. Andmaking sure they settle on your station has been the mostdifficult task programme directors have had to undertakeever since radio became a popular medium.

Back in the heyday of mainstream radio, Top 40 stationswere the most popular because, to put it simply, they wereplaying the hits-and that's what the listeners wanted.While the format has evolved to embrace different genresof music, Top 40 radio-or Contemporary Hit Radio(CHR)-has been on a roll for the past two decades, mostobviously in the US but also in Europe where CHR stations(like the UK's Capital of NRJ in France) are the marketleaders.

But in recent years, the format's dominance in the UShas been challenged by others, mostly AC in all its differ-ent incarnations. This trend is apparently now coming toEurope, as our Format Clinic reveals-European listenersseem to be migrating either to AC or to specialised formats.

In many European countries, CHR stations have beenre-evaluating their programming. This is largely due to theemerging popularity of conflicting musical genres. Top 40stations have mainly relied on pop records for the bulk oftheir programming, but these days, pop is no longer domi-nant. Instead, Top 40 programmers are tapping into R&B,

dance, and even rock, to join the dots between the popsongs.

The problem is these genres don't necessarily mix, andlisteners' tastes seem to be more niche than ever. There-fore, uniting all listeners under one single "hits" banner isno longer sufficient. A playlist featuring Mary J. Blige,Korn, Kylie, Wyclef, Oasis, Nelly, Shivaree, Alicia Keys,Moony, Slipknot and Shakira (to name just a few actswhose singles have recently received airplay) would be anaberration, tearing itself apart in the process of catering fortoo many different tastes. Music tends to be edgier now,with no sense of real direction, thus making programmer'slife a bit more difficult.

Programmers interviewed by M&M tend to believe thedownturn is cyclical and follows years of intense pop domi-nated by the Britneys and Backstreet Boys of this world.Some will be tempted to follow the kids' current liking fornoisy rock to spice up their playlists, while others will adda bit of AC seasoning in their CHR mix to reach a slightlyolder audience.

Ill -at -ease, but not dead, Top 40 isstill one of radio's most exciting for-mats because of its very simplepromise-to play nothing but thehits-but it is one of the most difficultto achieve.

But as long as artists keep makinghit music there will be an audience forit-and listeners will instinctivelymigrate back.

Zosimov parts ways with MTV Russiaby Aleksey Kruzin

Moscow - Boris Zosimov (pictured),the entrepreneur who brought boththe first major label, PolyGram, toRussia in 1994 and broughtthe first music TV channelto the country in 1998, isleaving MTV to concentrateon other music businessinterests.

As Zosimov steps downfrom managing the chan-nel at the height of its suc-cess, parent company Via-com becomes MTV Russia's con-trolling shareholder.

"First of all, I'm a businessman,"says Zosimov, "and as such I felt itwas the right moment for me to sellmy shares to Viacom, and I am glad

that my contribution to this channelhas been valued by them so highly."

Zosimov's departure co-incideswith several locally -produced pro-grammes being abandoned and key

personalities leaving thechannel. Despite that hesays "everything is goingsmoothly" and expresseshis faith in the people hehas employed and devel-oped over the 10 years.

Realising that he need-ed a platform to launchMTV in the post -Soviet

environment, Zosimov establishedthe country's first music channel in1995 before approaching the UScompany.

Bill Roedy, president of MTVNetworks International called

MTV Russia "one of the best, if notthe very best" of the 70 channelsexisting in 35 countries. Currently,MTV Russia's coverage isapproaching 61 million viewers in230 cities in Russia and the formerSoviet states.

Zosimov will now dedicate moretime to his entertainment empirewhich comprises music channel BizTV Ukraine, Moscow's leading CHRradio station Hit FM as well as con-cert and advertising agencies.

He is also working on setting upa Russian music awards show as anon-commercial project.

As well as planning the launchof another music station, Zosimovalso plans to increase his involve-ment with Universal Music Russiawhere he remains chairman.

RightsWatch to harmonise takedown proceduresby Juliana Koranteng

LONDON - European Union -fundedanti -piracy initiative RightsWatch isworking on a series of agreementsdesigned to harmonise EU proce-dures for promptly removing illegalmusic from the Internet.

The RightsWatch partners, led byUK copyright organisation MCPS-PRS Alliance, came together lastyear after realising that the EU'sJune 2000 e -commerce directivefailed to fully address Internet Ser-vice Providers' (ISPs') liability whenunlicensed material is distributedonline.

RightsWatch aims to enablerights holders, including those in themusic sector, to give ISPs adequatenotice for removing unauthorisedcontent. To do so, the affected indus-

tries need to pin down the provisionsfor a self -regulatory Notice andTakedown (NTD) procedure by thisNovember, when a report will be sub-mitted for the EU's review of thedirective next year.

Unlike the US's 1998 Digital Mil-lennium Copyright Act (DMCA), thee -commerce directive doesn't provideISPs a safe -harbour clause with spe-cific NTD rules. Because the e -com-merce legislation does not includesuch provisions, European ISPs havebeen uncertain on how to deal withunauthorised material on the Net.

"With the DMCA, if the ISP com-plies and takes the (infringing) mate-rial down, the safe harbour meansthe ISP can't be sued by the rightsowner, or by the ISP's customer forwrongfully taking down materialthat turns out to be legal," says

Richard Owens, international advi-sor to copyright group British MusicRights, London.

RightsWatch, which is also sup-ported by British ISP Thus, Swedishtelecommunications group Telia,British Telecommunications and con-sumer organisations, has formedthree European working groups todiscuss the issues and reach a con-sensus on what constitutes an NTDin Europe.

Mark Gracey, Thus' legal liaisonmanager, says: "As an ISP, we haveto deal with complaints of copyrightinfringement, not always knowingwhether our customers have theright to use the material or not.What is needed is a safe harbour pro-vision, where an ISP can be protect-ed from liability from both a rightsholder and from its customer."

Spellemannprisen's future in doubtby Kai R. Lofthus

OSLO - The Norwegianmusic industry is evaluatingthe future of its officialawards ceremony, Spelleman-nprisen, following publicbroadcaster NRK's reluctanceto continue financing theevent.

Industry sources tell M&Mthey believe the situation maylead to a revamp of Spelle-mannprisen, which for 30years has honoured Norwe-gian artists and composers fortheir creative-as opposed tocommercial-achievements.

In a letter dated May 3,NRK, which has traditionallyorganised the award show incollaboration with the IFPIand indies body FONO, statesit would now prefer itsinvolvement to be based on a"transmission", rather than a"co -production", model.

In a reply to NRK's head ofbroadcasting Hans -Tore

Bjerkaas, obtained by M&Mand dated May 13, Spelle-mannprisen secretarySmmund Fiskvik thanksNRK "for a long and pleasantco-operation", and says:"From our side we will consid-er NRK's invitation [to atransmission -based co-opera-tion], but first we will have todiscuss the situation inter-nally."

One record industry execu-tive comments: "This should-n't come as a surprise, givenall the budget cuts at NRKthroughout the past years."

Another executive says: "Ibelieve Spellemannprisenbecame a bit too expensive forNRK, maybe as a result oftheir internal invoicing proce-dures within the corpora-tion." While the executivebelieves the awards will goahead, he adds: "We will onlyneed to discuss in whichshape and form. Perhaps wehave set the standards too

high. We may not need tohave a grand TV show, ormaybe we should collaboratewith another TV channelrather than NRK. Or wecould just organise our ownparty at a café over a burgerand a coke."

When asked whether IFPIand FONO could afford tofinance the show on theirown, another executivereplies: "Yes, but we need tohave a TV partnership. Thequestion is rather if it'sworthwhile to put so muchmoney into the event. Themost natural thing would beto collaborate with NRK oranother TV station, andsecure sponsorship funds."

Meanwhile, the founder ofrival awards showHitawards, Nikolai Fasting,says that his ceremony-whose winners were based onairplay data from Music Con-trol-will not be held againthis year.

PUBUC LIBRARIES TO LEND OUT ONLINE MUSIC

COPENHAGEN - The Danish National Library Author-ity says it is working with the local arm of the IFPI tofind a means of providing the public with "borrowed"music via the Internet. The concept, still under devel-opment, would allow library users to go to a websiteand select tracks encrypted to prevent copying-which can be played online only. A fee, most likelylevied per track, will be charged and the borrower willbe able to listen to the music for either an allottedperiod or for a specific number of times. Initial testsare expected to begin in August in a suburb of Copen-hagen, with the Copenhagen library network expectedto follow suit. The experiment is intended to continueuntil the end of the year.

P4 PROVIDES NEWS ON THE PHONEOSLO - P4 launched on June 10 a phone service tar -getting Norwegians on summer holidays abroad whichfeatures up-to-date news bulletins from the commer-cial national AC station. The same service is likely toeventually also carry the FM feed of the station. Comms Bill: some fresh perspectivesEarlier this year, the UK government finally unveiled itsdraft proposals for the country's new CommunicationsBill, soon to be discussed in parliament. One of the mostunexpected-and controversial-clauses in the draftwas that the UK's historic ban on non-EU companiesowning majority shares in British broadcasters should belifted. M&M asked two radio experts from outside ofBritain-Robert E Richer, president of US companyInternational Media Consulting, and Alain Neuville, CEOof French media consultancy company A.N.I.M.A.-togive their views on the proposed bill, and how it is likelyto influence the radio landscape elsewhere in Europe.

'A very good compromise'by Robert E Richer

There have been two reasons why non-EU investors have avoided coming intothe UK radio market in the past:

1. Ownership Regulations.Although never absolutely spelled outnumerically, the ruleshave always stated that"control" by a non-EUparty is not allowed.Technically, that wouldmean that ownership byforeign investors wouldbe restricted to a maxi-mum of 49.9%. In reali-ty, however, "control"means whatever theregulators wish it tomean. If an investor

spook most American investors."holds 10% of the radio company, butthe UK's Radio Authority deems it tobe a controlling interest, then theinvestment will not be allowed.Witness the fact that Clear ChannelCommunications, an American corpo-ration, took only 30.8% of Jazz FM.It's not as though Clear Channelcould not have afforded to purchasemore.

2. Programming Restrictions.Very few investors-particularlyAmerican investors-want to be toldthat they cannot change programmingto meet the changing tastes of a sta-tion's listeners. This has been a veryeffective way to keep outsiders out. Ofcourse, it has also stifled programmecreativity by UK programmers.

The new recommendations effec-tively do away with much of the above.Non -European companies will now be

allowed to acquire radio stations in theUK. The fact that the Guardian MediaGroup has placed a value of £41 mil-lion on Jazz FM will continue to spookmost American investors, however.

But that is a business judgment,and not an ownership impediment.

The fact is that if non -European investors canrationalise the pricesthat these new rules aregenerating, they will beallowed to make an offer,and will not on the faceof it be rejected becauseof passport issues.

The ability to changeprogramming has beengreatly relaxed. Therewill be greater emphasisand scrutiny on the"localness" of radio, but

the rules nowstate that "...inwell -developedmajor markets,[new super -reg-ulator] Ofcomwill allow for-mat changes tomainstreamstations, to fac-

ilitate competition."Certainly in the US, the one area

that has suffered the most with con-solidation is the loss of localness.Many successful US stations don'teven have their own breakfast presen-ters, with the same presenter servingfive or more stations, broadcasting theshow from a distant market.

I think this is a very good compro-mise. My experience is that, in thecase of AM radio, the UK regulatorshave already presented a relaxedstance in this area. Sadly, most of thegroup operators that own AM stationshave not taken advantage of the flexi-bility that the Radio Authority offers.There is a very large part of the popu-lation that is not presently beingserved by the radio industry, and lib-eralised programming rules shouldcertainly be helpful in that area.

'A local earthquake'by Alain Neuuille

If the conditions for acquiring aradio station change in the UK, wecan expect a major change in theoverall European radio landscape.Consolidation and mergers are to beexpected in the domestic market,but they also open the way for newopportunities on the continent.

When one of themajor European coun-tries changes the rulesof its own game, it isnever without conse-quences for its neigh-bours. The publicationby the British govern-ment of its draftCommunications Billearly in May couldhave drastic conse-quences for the pan-European radio land-scape.

The jigsaw puzzlehas begun. Whatare the majorpoints of this pro-posal? Firstly, itopens the way forthe consolidationof the market asthe old "points"rule, limiting thecoverage of radiogroups to 15% of the total UK radiomarket, is being removed. In addi-tion, radio groups will be allowed toown more than one national licence.

Secondly, it allows cross -mediaconsolidation. National or localnewspapers with more than 20% ofthe market would also be allowedto own national or local radio sta-tions, and the ownership of anational or regional TV licencewould no longer be an obstacle tothe ownership of national orregional radio stations.

Some analysts are alreadyexpecting the Daily Mail newspa-per's parent company DMGT to

other European groups."take over GWR, a company in whichit already owns a substantial share-holding. Virgin Radio's owners SMGcould well merge with ScottishRadio Holdings. EMAP presented arather dull picture of its radio rev-enues when commenting on itsresults recently, which could lead tospeculation about a possible concen-tration of the publisher on its coremagazine business. Just a fewexamples of the jigsaw puzzle thatis only just beginning

Another significant item is that

the draft bill would allow non-EUcompanies to own TV and radiocompanies. So Rupert Murdochcould further extend his UK inter-ests into terrestrial TV, alongsidesome of the American majors whomight see a wonderful opportunityto come over with their enormousstocks of programmes.

But UK radio is still clearly ofsignificant interest,too, for otherEuropean groups. Thetakeover of Capital byRTL has beenrumoured so manytimes that it shouldnow be considered areal possibility. ButRTL will be moreimmeadiately con-cerned about theanswer to the keyquestion of whether itshould remain, or not,as part of UK terrestial

TV broadcaster Channel 5. Andwhat about the long-standing frus-tration of NRJ Group at not havingbeen able to enter the British mar-ket?

But this local earthquake maywell have shock waves on the rest ofthe continent. To get ready for thosemajor manoeuvres, British groups,as well as foreigners, need cash. Sothey are preparing to sell their over-seas holdings-GWR, for instance,has already indicated its willing-ness to get rid off its centralEuropean stations, such asDanubius in Hungary.

Disinvestments of this kind couldwell open the way tofurther concentra-tions in those coun-tries, where themarket and compet-itive conditions arebecoming tougher.

It should alsoopen the way for new acquisitionopportunities for internationalgroups. Some sharp operators couldwell take the opportunity of every oneelse focusing on the British market togo shopping under much morerelaxed conditions. It would not besuch a surprise, therefore, to see thearrival of some newcomers on theinternational radio landscape.

It is a good time to keep youreyes wide open for opportunities.

Queen of charts: isthe Britney Spearspop era drawing toa close?

Under siege: is CHR in crisis?Traditionally the dominant music radio format in mostEuropean countries, Contemporary Hit Radio (CHR) sta-tions are losing listeners to more specialist music formatsat the younger end of their demographics, while at theolder end their audiences are migrating to smoother,more familiar AC formats. In the latest of M&M's regularFormat Clinics, Jon Heasman takes a look at the issuescurrently facing the format, with additional reporting bySiri Stavenes Dove, Michael Lawton and Menno Visser.

Contemporary Hit Radio (ortop 40 radio, as theAmericans prefer) is thedaddy of all music radioformats, dating back to

the earliest days of rock n' roll in theUS when certain stations wanted toensure an eveness of rotation, andthat they played only the hits.

In Europe, the top 40 format hasalways been slightly wider than that(hence the different label appliedhere). Most European CHR stationshave always played substantialamounts of back -catalogue in additionto the current hits, and many-most-ly in the public radio sector-havealso had a strong commitment tobreaking new music rather than just"playing the hits."

however,life has got more complicated forCHR/top 40 on both sides of theAtlantic. The development of sophisti-cated music research, the practice of

record companiesmaking recordsavailable to radioseveral weeksbefore they appearin the shops (andtherefore thecharts), plus thedecline of singlessales, means thatCHR/top 40 sta-tions these daysare rarely builtaround the weeklytop 40 chart-thesales chart in eachterritory is now

just one barometer of taste amongmany other indices.

The new realityAnd now, in Europe, many CHR sta-tions could be facing up to a realitythat their American top 40 counter-parts had to accept some years ago-that, with the launch of many newradio stations with more specialistformats competing for audience atboth ends of CHR's audience spec-trum, CHR's days as the dominantmusic radio format are possibly num-bered. Indeed, in the US, top 40 lostits status as the most -listened -tomusic format in the late '80s, sincewhen that honour has gone (at vari-ous different times) to AC, countryand, just recently, urban/rhythmic.

"As markets become more andmore fragmented, it's difficult for

CHR stations to stay where it's at,being this quite wide appeal radiostation," says Jeff Smith, head ofmusic and strategy for the CHR-for-matted Capital FM Network in theUK. "It's a question of how mass

He believes thatratings for CHR stations in Europehave been artificially high in the pastbecause of a lack of competition. "It'snot so much the format is weaken-ing-the main reason is that the UKand many other parts of Europe hasbeen historically underserved byradio. All that's happening now is thatthe right amount of radio choice forlisteners is finally starting to emerge.But the established [CHR] stationsare obviously taking the brunt of thathit."

Anthony explains that the group'slocal stations remain loyal to CHRrather than moving into AC because"national advertisers want an environ-ment where there products fit, andthat would be a radio station with acontemporary feel. We're there becausethat's where the most cash is."

Decline of pop3FM's Houdijk's concerns about thecurrent strength of music that CHRcan "own" are shared by a number ofthe other CHR programmers wespoke to for this Format Clinic.Despite the growth of more specialistmusic formats in the late '90s, CHRcontinued to enjoy healthy audiencefigures thanks to a strong pop and

appeal can you be and still be effec-tive?

"There has been a dramatic loss [ofoverall radio audience] in the youngertarget group, aged 15-19," says DanielAkerman, programme director of theCHR-formatted NRJ network inSweden. "And that is the core groupfor CHR. Yes, there are older listenerswho listen to CHR and AC listenerswho are younger. But the kids are`ours,' and that's where the decline is.In Stockholm, [radio listeningamongst] the 15-19 age group hasgone down from 70% to 59% over thepast year."

"CHR listening has declined dra-matically over the past year," concursBen Houdijk, music director at publicCHR station Radio 3 FM , in theNetherlands. "There's not so much[CHR] format -exclusive music aroundat the moment. Lately, it's been rockand Eminem. In addition, theyounger listeners are into other activ-ities than listening to radio-so it'snot so much that they are going toother formats, they're moving awayfrom radio completely."

Come the new millennium, itseems the younger audience want

something a little harder. "I thinkthe big formats at the moment areon the extremes-dance, R&B, hiphop on one side, and modern/alter-native rock on the other," saysCapital's Smith. "I don't think peopleare exploiting those to any greatdegree at the moment, certainly notin the UK, but we're seeing it in theUS. In time, you'llget that [music]informing themainstream,which will widentop 40 again andwill take it back tobeing the predom-inant formatwhich I think it is.But it's been a bitof time bad timefor CHR musicrecently."

NRJ's Akermanagrees with Smiththat "The strong-est [music] at themoment is rockand R&B. The problem [for CHR] isthat pop is weak. And dance is incred-ibly weak. But dance will be back.The real problem is pop, which isexhausted after Britney and theBackstreet Boys. Three or four yearsago you would talk about boy -bandsas being teen -oriented, but today theyactually attract the 25 -plus demo-graphic. This is where the problemlies, as those acts and those listenershave gone from CHR to AC."

Continues Akerman: "There is atheory that CHR is weak when theextreme ends of the format are toofar apart. This can be true, so wehave to think about that and keepthe format together. The core ofCHR is pop, which always has to bethe focus. CHR had a down periodat the start of the '90s, and thenthere was a revival in the secondhalf of the decade with pop acts likeHanson and Spice Girls, who werepretty much format -exclusive. Buttoday, AC isn't that artist -drivenanymore, and they [the AC stations]

Eminem: once con-sidered the ultimateoutlaw, now a "no-brainer" for mostCHR programmers.

sive, more melodic," observes GWR'sAnthony. "Like all music genres,when it first starts it's more on thealternative side and then moves intothe mainstream. We play Eminem asa matter of course these days."

A rocky roadWhile most CHR programmers havefound that a lot of material from theurban sector can sit quite happilywith dance and dance -pop on theirradio stations, the rock revival hasbeen a little trickier to handle.

"We've played a bit of the Strokes, Ithe Hives and Puddle of Mudd in the

are taking on a lot of pop now, sothere are virtually no 'pure' CHRtracks."

Behind the trends?Norbert Grundei, programme head ofHamburg -based public CHR stationNDR N -Joy, says that a problem isthat CHR stations are always seen as"running behind the trends," com-pared to more specialist stations. "We

need our ownimage which isnot only depen-dent on themusic," he ar-gues. "We can'tbe constantlychanging our for-mat just becausethe chartschange."

Part of N -Joy'smission is to bethe station whichplays the hitsfirst. "Lots ofstations say that,but if you lookclosely, you'll seethey don't," says

Grundei. "But for us, it's a strategicimperative." Hence there's always alot of discussion at the station aboutwhether new tracks represent realtrends, and whether they will fit thestation's image. If the music teamcan't decide, they test the title,although Grundei admits it's hard totest tracks before there's any kind ofrecognition factor.

As noted in our recent DanceFormat Clinic (M&M, May 11) therelentless rise of urban music in thepast 18 months is a trend few pro-grammers have been able to ignore,particularly those at CHR. "Whowould have foreseen, even only twoyears ago, Ja Rule being a priorityartist for a station like Capital FM?"reflects Smith, who notes that R&Bhas "great female appeal, and is alsonot overly -divisive with blokes. It wasalways believed that rap was a turn-off for people over 25, but that's less ofa problem now, as people are gettingsteeped in it-after all, a record likeArrested Development's Everyday

evenings," says Capital's Smith. "Itmainly appeals to the 12-19 year -olds,who tolerate all kind of extremes. Butsome records, like Limp Bizkit, are alittle bit more difficult. It'll be out ofyour evening shows that these thatrecords cross over to mainstreamCHR."

Smith, however, is getting more joyat the poppier end of the rock wavewith the likes of Nickelback. "We'refinding we're getting great results [inmusic tests] for the first time in quitea while on pop -rock," he reveals.

GWR's Anthony believes the rockrevival is a purely cyclical trend thatwill have a limited lifespan in Europe."We've had about six or seven years ofgirl and boy bands and people are seek-ing an alternative. Whatever the audi-ence wants, we'll deliver. But they willultimately go back to what they're usedto and what they really want," he pre-dicts. "The UK has always been seen asa euro-pop market by Americans andAustralasians. That's the diet peoplehave grown up with here-you can'tget arrested with American pop -rock inthe same way that you can in otherparts of the world."

Music varietyAt the centre of the debate about thefuture prospects of the CHR format isthe question of whether listeners stillwant to hear a variety of music styleson one radio station, or whether mostof them will ultimately prefer to heara station that plays their particularfavourite type of music all day long.Crucially (and this is where both its

strength and weakness lies), CHR is aformat which is not genre-specific-although its cornerstone is pop, it alsoplays dance, rock, urban, even MOR;within reason, whatever is popularand in the charts. And AC, which likeCHR is also not genre -specific, inreality draws from less diverse genresin order to create a smoother, moreconsistent sound.

He adds: "In Europe until now,we've not really celebrated or talkedabout Top 40 or CHR radio in the waythat they do in the US. In Americathere are distinct trends to the ebband flow of top 40. I think we're on thecusp of a renaissance of CHR-we'reseeing the downturn before it allcomes through. The fact that we'regetting these fusions of sound-likethe Sugababes/Gary Numan record[Freak Like Me], or the rock -rapfusions-means that a broaderstretch of top 40 has a wider appealfor people which, in the longer term,will create a bigger top 40 market."

N -Joy's Grundei believes that, evennow, there is still a big desire on thepart of his audience to hear quite awide range of music, so he isn't overlyworried about the threat of niche musicbroadcasters. But, he says, "Many ofthe CHR stations which are not doingwell are trying to appeal to all ages andall tastes. The trick is to know precise-ly who your audience are."

This, of course, is sometimes easiersaid than done-even with research.N -Joy recently came a cropper itself

Capital's Smith believes that, interms of competing with the morespecialist music stations, "you've gotto lessen the losses. There are somepeople who will want to go toextremes of music. There's nothing wecan do about that, and they'll predom-inately be men. I hope that with theright mix of music we'll able to keepthe people we've got now. I don't thinkthis is going be any more or less of aproblem than it has been over thepast four or five years. Stations like[London dance station] Kiss and[London alternative rock station] Xfmwill get better at what they do, but inthe process might also lose credibility.And don't forget that it can also be aproblem for extreme stations whentheir music crosses over to top 40 andbecomes mainstream."

with the '80s -style pop duo ModernTalking's hit single Juliet. AlthoughN -Joy's programming team thought itwas quite a good record, after playlist-ing it they found that the deeplyuncredible reputation of the band wassimply too much for most of N -Joy'slisteners to stomach.

Time to deliverGWR's Anthony believes that "Our jobhas got to be understanding what ourrole is, and then delivering on it. Thecloser specialist stations like [UKdance network] Galaxy are to us, thebetter-why would you go to a poorerversion of the number one station? Onthe other hand, the more extremethey are, the more dangerous theybecome because they provide an alter -

Historically, high rotations havebeen a benchmark of the CHR format,and in an ever more competitive radioenvironment, this is likely to be thecase to an even greater extent.

"When listeners turn on CapitalFM they want to hear their favouritecontemporary songs," emphasisesSmith. 'We know people only listenfor a certain period of time, so it'd becrazy if, when they switched on theradio station, they didn't hear them.So we have a policy of always deliv-ering them."

"We've got to be sure that whenlisteners come to us, we grab thewindow of opportunity with bothhands," says GWR's Anthony. "That'sthe difference between a pretty aver-age radio programmer-and thereare plenty of those-and a reallygreat programmer, who really doesknow what rotations are workingfine for the audience given the avail-able music."

Smith points out that high rota-tion levels can also have the effect ofsmoothing out harsh -soundingsongs, simply because listenersbecome so familiar with the record.Citing the example of Nickelback'sHow You Remind Me, Smith saysthat people kept asking him whetherCapital was playing a softer, editedversion of the original (the stationwasn't). 'With high rotation, peoplebecome immune to any harshness-it just becomes a pop record with anice hook," he says.

While hot rotations of currentchart -toppers may still be a bywordfor CHR throughout Europe, theretends to be less uniformity about therole of recurrents and, in particular,back -catalogue gold tracks.

Smith says that too many goldtracks at CHR can be a problem "ifyou play too many songs that don't fitthe current sound of the station. It's aquestion of finding songs likeArrested Development and PM Dawnthat, even if people weren't around atthe time, they can hear the points ofreference in today's music."

GWR's Mix network varies itschoice of gold tracks, which date backto the late '80s. "Over a 12 monthperiod we'll highlight different songs,depending on the current materialthat's around," says Anthony. 'We gothrough a refreshing of the musiclibrary once every three months tomake sure the stations always have a

broad feel. But we'll tighten up a bit ifwe feel were getting a bit flabbyaround the edges."

Personality politicsHistorically, CHR broadcasters havebeen identified with some of radio'sbiggest personalities, somethingwhich has often helped to give thema clearer image in situations wheretheir music is less easily definablethan that of, say, rock, dance or softAC stations.

In the past decade, though, it's beenthe case at many CHR broadcastersthat personality presentation has beenlargely confined to the breakfast slot,with a "maximum music" approachtaken in other dayparts.

"Because of a definable lack of tal-

ent in the UK at the moment- andthis is partly radio's fault-there isless personality outside breakfast,"says Capital's Smith. "Stations like[BBC] Radio 1 and Capital havepicked up all the big talent andunfortunately there's a degree ofproduction and music taking overwhere DJs used to be in the day-time." But, cautions Smith,"Personality for personality's sake isnot what's required-what'srequired is a presenter that fits inwith the reason why the audiencelistens to the station. If there's toomuch deviation from that it can be aproblem-`personality' can be abyword for talking too much.Outside of breakfast and night-timepeople have got things to do, and

Top 40's American dream is overIf CHR formats are facingincreasing problems Eu-rope, the situation's evenmore serious in the US,where, as in Europe, top40 is having difficultiescoming to terms withsome of the new musicalextremes. Frank Saxereports from New York.Britney has been replaced by Pink,and Ricky Martin is a distant specon Eminem's rear-view mirror. Thebig revival of the top 40 format inAmerica has quickly come to an endjust two years after its peak.

First, some numbers: there are104 fewer top 40 radio stations inthe US in 2002, compared to 1992when the number peaked at 578. InMay, San Francisco top 40 Z95.7switched to classic rock-and bydoing so America's fourth largestradio market was left without apop/top 40 station.

Ratings wise, mainstream/pop-leaning top 40 stations have seentheir ratings slowly erode since thespring of 2000. At the same time,urban -leaning rhythmic top 40 sta-tions are seeing their ratings grow totheir highest ratings in years.

R&B/hip-hop stations are near theirhighs as well, as are AC stations-asthe upper -end of top 40's demos fleea format that is increasinglydepending uponharder sounding sin-gles from rock andurban acts.

"Unfortunately, it'snot the strongest timeto be in top 40," saysJim Richards, opera-tions manager forClear Channel's SanDiego cluster of sta-tions, which includestop 40 Channel 93.3,adult top 40 My 94.1,Z90. "Rock and urban crossover isdominating too much of the top 40playlist right now," he laments.

Top 40 consultant Guy Zapoleonsays there is a reason for that. "Wehave hit the doldrums phase of themusic cycle," he claims. Zapoleon'stheory is that music cycles last nineto 11 years, and at the end of eachphase is a doldrums-when thenumber of hits is cut by one-third.Instead of the 100 or so legitimatehit records that top 40 stations havehad at their fingertips in the pastfew years, they will have only 60 to70 this year and next, the theorygoes. That means big trouble for thetop 40 format. The last time thishappened was in 1991, when radio's

playlists looked a lot like they dotoday: heavy on rock, heavy onurban and rap. "The format is level-ling -off and losing momentum, but

it's not where I

would have expect-ed it. I would haveexpected it to be inworse shape than itis," he assesses.

Part of the rea-son top 40 stationsare hanging on aswell as they are, isthat programmersseem to be doing adecent job of finding

those few -and -far -between bridgerecords that can cross the dividebetween a Linkin Park and P. Diddy,says Zapoleon. "The hard part dur-ing the doldrums is finding popmusic which is the glue between theextremes of rock and rhythm."Whether it is Dirty Vegas' Days GoBy, or Kylie Minogue's Can't Get YouOut Of My Head, it seems there isstill some middle ground.

That said, most top 40 stationsare today focusing more on the ques-tion of whether or not to play themore extreme -sounding rock andrap records in all dayparts or noL.For the most part, few area Themajority are leaving those singles tothe late afternoon and night-timehours when younger demos make up

a larger share of listening.Yet by simply adding those edgier

tracks, it is opening the door for adulttop 40 stations that in many respectsare in a better position at themoment. First, a number of ageingpop acts have released new records-Alanis Morissette, Cheryl Crow, andJewel to name just a few. When top40s add more extreme tracks, theyare also sending "Generation X" lis-teners to adult top 40 stations. As onerecord executive explains, that allowsadult top 40 stations have their ownartists and their own sound for thefirst time in years.

"As rock and rhythm get harderwhile pop music fades, it becomesmore difficult to play both rock andrhythm on the same format," saysZapoleon. "That is when top 40'schange format to specialise in eitherrock or rhythm." Instead of going tothat extreme, some programmersare buffering with pop oldies anddance tracks. Hence the Dirty Vegassingle and the growing debate overwhether or not to add '90s oldies.

What does the top 40 format haveto look forward to in the comingmonths? More decline, say most. Ifyou are a believer of Zapoleon'smusic cycle theory, there is at leastanother year or two of top 40's down-turn. "It is important to rememberthat all formats have healthy andsick stages," he warns.

they choose music stations for thatreason. If they want talk they'll go toelsewhere. We play the maximumamount of music we can during day-time while still being a radio stationand not a music delivery system."

At NRJ in Sweden, DanielAkerman says: "I don't believe insuperstar DJs for every slot. Butthey shouldn't be confined to themorning show, either. We have tohave at least one more personality[on the station]."

GWR's Anthony recalls that inthe early '90s, his company "was pil-loried [by most of the industry] forasking DJs to think of their listenersand play their favourite songs with-out spending five minutes betweeneach record talking about what theydid on Saturday night. That deliv-ered for us some fantastic results."

Brain -powerAnthony says the ability of GWR'sCHR stations to be entertainingbetween the records "depends on thebrain power of the individual pre-senter. Some presenters can be com-pelling to listen to in 20 seconds, andthey are brilliant communicators.Then there are other presenters whohaven't got a hope in hell of beingable to articulate something in 20seconds, but they're the kind of per-son you'd want to stand next to in abar. Then there's a whole bunch ofpresenters who can't do a short link

that's entertaining, and can't do along link that's entertaining, either.They're the people that we need toease out of radio and bring in newtalent that has the ability to do oneor other of those two things. Thequestion is always: is what the pre-senter is saying more entertainingand compelling than the record? If itis, then let the presenter speak."

GWR aims to match suitable time -slots to the abilities of its presenters.For example, "In the weekday work-day, you don't want the long -link peo-ple," says Anthony.

One of the ways inwhich N-Joy-whichhas been accused ofbehaving like a com-mercial station in itsmusic policy-differ-entiates itself as apublic broadcaster isits attitude towardsspeech on the station."While the competi-tion's news is becom-ing more and moretabloid, we have realnews content," saysNorbert Grundei. "Wecover current affairs,and we don't restrictour news reports to 90seconds."

Predicting the futureSo, do the programmers attendingM&M's Format Clinic believe CHR's

current difficultiesare structural ormerely cyclical?

3FM's Houdijkbelieves that, as inthe US, it's a perfect-ly logical progressionthat AC shouldbecome the biggestformat. "3FM should-n't have to be thebiggest station like itonce was," he says."If you grow older it islogical that you loseyour lust to discovernew music. When yougrow up, you like aparticular sort ofradio and you like

your heroes from a certain time."NRJ's Akerman believes that the

format's future lies firmly in thefickle hands of music trends. "The

day dance comes back and works forCHR, that's something AC doesn'tdo," he says. "The same thing withrock. It's always going to swing withthe music trends. The format is flex-ible to an extent, but the ratings godown when the trends are not in theformat's favour."

GWR's Anthony believes that theability of individual CHR stations toretain their market leaderships willultimately depend on how manyother CHR and Hot AC stations inthe market are fighting the battle."CHR stations will cannibalise eachother," he predicts, "and so other for-mats will come through the middle -that's exactly what's happened inthe UK with [national BBC AC/MORstation] Radio 2."

"[CHR] stations shouldn't runafter every trend," says N -Joy'sGrundei in his assessment. "The mostimportant thing is a clear musicimage and good presenters, togetherwith good creative promotion whichdoesn't get on the listeners' nerves."

Capital's Smith concludes that"There's always an appetite for vari-ety. People out there want a range ofmusic, and it's important for CHR togive it to them. Unfortunately,recently that hasn't been available,but now there are signs that, comingover the hill, there are things likeLinkin Park becoming a mainstay ofCHR. I think people will really like itwhen top 40 gets it completely right."

t is fast becoming the case that mostmusic with cross -over potential isobliged to take the dancefloor routeto the charts. A lack of 'starter' radiostations, the expense of making a

video, unreliable or unscientific maga-zine 'charts' and the nascent nature ofthe Internet mean that clubs are stillthe place where the majority of dancewith a pop future gets that crucialearly exposure.

Charts in crisis?The value of the UK's best-knownClub Charts is currently under themicroscope. "Two or three yearsago, a number one in the SevenMagazine chart or in DJ Mag orMuzik meant that you had achance of getting plays on [UKCHR] Radio 1 because they werescouring those lists every week,"says Positiva's A&R director BenCherrill. "It is debatable how muchthat works these days."

At the root of the problem is thedifficulty in quantifying what thereturn is, if anything, from mailingout 1,500-2,000 records, at a cost ofseveral thousand pounds, to pro-mote a release. "You have to dosomething, because records do notpromote themselves," saysCherrill. "The promotion compa-nies who take care of the majority'',of this type of specialised mailiaare lobbying to have an ot4bi3chart, which is definitely a stenanthe right direction."

April 29 release, the group's secondsingle At Night is currently in the UKtop 10, a situation that was partlybrought about by two remixes, one byMousse T and another by Alan Braxe.Each have been turning heads inEuropean clubs since being debutedat the Winter Music Conference inMiami in March. "Shakedown playeda DJ set at the WMC which reallyhelped to start the ball rolling," saysRebet. "Since then there has been realmomentum behind the track which

we are now attempting to translate tothe album You Think You Know."

At Night, a former European DanceTraxx chart topper, was released firstin the UK in order to capitalise on thepost -Miami buzz. The track is nowstarting to pick up radio play inFrance and is also on rotation atSpain's powerful Los 40 Principalesnetwork. The track, which is distrib-uted by Sony in Europe, was releasedin France on June 17.

According to German RebelSuperstar Recordings founder andmanaging director Markus Wenzel, thedancefloor is not only the most costeffective way to promote a cross -over

track, it is more or less the only way."There is a window of opportunity inGermany through starter stations suchas N -Joy in Hamburg, Sunshine Livein Karlsruhe, Frankfurt's HR -)0(1.,plus Kiss FM and Jam FM in Berlin,but they have limited space on theirplaylists," he says. "The only nationalradio in Germany is on cable. Thismeans that the shows on these stationscannot be anywhere near as influentialas equivalent UK mix shows by DJslike Pete Ibng and Judge Jules."

Commercial melodyWenzel is currently working Mosquitoby Kenny Takito, a trance tune thatstarted its life as a pure club track twomonths ago. "Although it is a clubtrance track, the melody is very com-mercial and it has already topped theDDC Chart," says Wenzel. "We arecurrently preparing a radio edit and avideo. The CD will be out in three tofour weeks."

Radio support may well be limited inGermany but there is, at least, a smallchance of tracks being picked up by oneof the networks. The same, however,cannot be said for Italy. Complaintsabout both the hegemony and the music

choice of market leader Radio Deejayhave recently come to a head with EMIItaly's sub -label Dance Factory manag-ing director Nico Spinosa writing tostation co-owner.

"I just wanted to let him know thathis playlist is rubbish and that hisstation is consistently ignoring thebest music produced in this country,"says Spinosa. "It is four or five yearssince Italy was regarded as any sortof force in the global dance scene andnothing will change until importantstations like Radio Deejay put theirsupport behind quality dance tunes."

Love Solution's I'll Be Over You, acover of an old Ibto hit, is a good exam-ple of the situation that Spinosa is fac-ing. The track is picking up radio playsin Scandinavia and across NorthernEurope, with a remix by Bini (of Bini &

Martini) already a dance -floor hit. Butneither version is getting much atten-tion in Italy. "It's always been the casethat the acts I sign work better abroad,so in a way rm used to it," adds Spinosa."But if Italy wants to regain its centralplace in the market, attitudes amongstprogrammers need to change."

European successAnother artist currently being workedby Spinosa and doing well aroundEurope is R&B artist Tiziano Ferro(Capitol/Italy). The debut singlePerdono, out in Europe with French,Spanish and English versions, hasalready shipped over 700,000 units. Ithas also recently started to take off inGermany. "Tiziano's album RossoRelativo is due out this month,"reports Spinosa. "We've also pressedup several hundred white labels of theCarlos Jean remix of Perdono whichwill be promoted around the islandsand coastal resorts this summer."

There are undeniably few genuine-ly new options for promotion, butSouthern European resorts offer onearea that has so far remained rela-tively unexploited-the Club 18-30circuit. Angie Brown, who has justfinished recording Clearing My Mindfor Ruff n Tumble Productions, will bedoing several dates around theMediterranean this summer to pro-mote the track.

"We started the groundwork inLondon by distributing 300. whitelabels to DJs and specialist retail,"says Andy Monoyos, a member of theRuff n Tumble production team. "Nowthe track is on pirate radio and thebuzz is growing in the clubs. At themoment the important thing is to putthe initial pressings out slowly to fos-ter the feeling of exclusivity that clubDJs want. We are being cautious."

Janeiro, by Solid Session(Positiva/UK) is a classic example of atrack that has been around for sometime-it was initially released 18months ago-and is now enjoying asecond life with a vocal. "The track wasreleased initially on Additive as a coolinstrumental and it did well on the ter-races," says Positiva A&R managerBen Cherrill. "Pronti & Kalmani, theproduction team behind Alice Deejay,wrote a topline for it and now it's a fullblown song." Promos, with remixes byArmin van Buuren and James Holden,are now in the clubs.

Broad appealIn & Out by XPY (Bigstar/ Denmark),a gold record in Denmark in 2000, hasbeen re-recorded by Safri Duo produc-er Michael Parsberg with the singerMarie Holm. There will also be an asyet undecided name change for thegroup. "It's already been signed by[Polydor subsidiary] Zeitgeist forGSA," says Bigstar managing directorOliver Zahringer. "In its first incarna-tion, it was a pure pop/dance tune, butthere is an opportunity to broaden theappeal with some new mixes. Zeitgeistare also planning to promote the trackin the coastal resorts."

There is already considerableinternational interest in licensing In& Out, but Zahringer is waiting to seewhat happens when the track isreleased in Germany. "The vinyl is outin Germany at the beginning of Julywith further mixes two or three weekslater," says Zahringer. "The RadioEdit will be out there in late summer."

Marc Maris' Lost In Love(Bigfoot/Germany) is another trackthat has been signed to Bigstar forthe UK, Scandinavia, Italy and SouthEast Asia plus the US and Canada,and looks set to be filling dancefloorsand climbing charts. "It's a classicpop/dance track, not at all cheesy andvery atmospheric," says Zahringer."Not only is it a great summer track,it appeals to an unusually broad audi-ence, starting with 10 -year -olds. Italso has five different mixes. We arecurrently considering using a special-ist resort promoter to get a buzz goingin Spain and Greece."

Milky (Motivo)"We've just licensed The Way YouAre by Milky from Italian labelMotivo," says Markus Wenzel ofGerman label SuperstarRecordings. "It's in the samemould as Db Boulevard-that is tosay it's a 'commercial house tunewith vocals." There are alreadytwo strong remixes, by LiquidPeople and Full Intention, thatwere originally commissioned byUK label Multiply, but Germanylikes its beats a bit harder.

"We are discussing commis-sioning something a bit morepumping and funky for theGerman market," says Wenzel."And I'm pretty sure that there'llbe a video co -financed by thevarious licencees."

Yuyu (New Music)Yuyu's Mon Petit Garcon (NewMusic/Italy), currently in the Top 20in the Italian singles chart, has nowbeen remixed by Dario Caminitaand Christian Piccinelli. The track,which in its original form is a poptune with little in the way of a dancefeel, is now set for release throughSony Music in France, Canada,Benelux, Greece and Spain in earlysummer. First to release was Greeceon June 17. "Spain will be doingsome special promotion in thecoastal resorts plus the Balearicresorts," reports Paola Macchi,international manager, New Music."Sony Music France [have already]sent the original version to radio.The French are very confident thatthey have a hit on their hands!" Thetrack also features in the currentadvertising campaign for Lanciacars.

Copyshop (Blackjack)Fred Berthet is better known asone third of French trioTroublemakers, who have, overthe last two years, established aninternational reputation as pro-ducers of quality downtempomusic. Under the name Copyshopand recording for the Aix-en-Provence label Blackjack (home ofSuperfunk and Sinema), Berthethas produced Adultery, a house -influenced tune. "The track wasinspired by minimalist, German -produced house music from labelslike Playhouse," says Berthet.

"The white labels of Adulteryare already out there and we arenow waiting to see what sort ofreactions we get. If they're strongenough, we will be putting a fullvocal over the existing track atthe end of the summer."

The Gospel according to GallagherOn July 1, Oasis release their fifthalbum, Heathen Chemistry. In one ofonly a handful of interviews given topromote the record, band leaderNoel Gallagher speaks to M&Mmusic editor Adam Howorth.

t's far and away the best record since DefinitelyMaybe-I'd probably say the whole thing will bean eight out of 10." There a few if any releases inthe UK that generate the same level of hype andanticipation as a new Oasis record, and with

album number five, Heathen Chemistry (BigBrother/Epic)-out internationally July 1-theband, and particularly leader Noel Gallagher, areas bullish as ever.

Recorded at the band's own studios on the out-skirts of London, work on the new Oasis albumbegan in March 2001 and was concluded thisFebruary "In between that we went on the road fora couple of weeks to celebrate 10 years being in theband, with two weeks rehearsal, and we went onthe road with the Black Crowes for six weeks-thatwas three weeks rehearsal, so that was almostthree months," Gallagher says. "That's quite longfor us. We had to wait three months for Liam to dothe vocals. We'd have finished a long time ago-it'dbe out and rockin' by now but 'Elvis' decided he wasgoing to sing and re -sing and re -sing and re -singuntil we'd use the one he did in the first place!"

In this instance, "Elvis" is of course the youngerGallagher brother Liam, whose commitment to giving aflawless vocal performance caused tension in the studio,Noel explains. "He sings it once and it's great-and thenhe says, 'I can get it better'. And I was sat there going,But why do you want it perfect? You're not fuckin'Ronan Keating. You're a rock'n'roll singer-rock'n'roll'snot perfect. Just give it some, and leave it."'

Songwriting frameworkOne of the characteristics of Oasis is the division ofduties between the brothers-Noel writes the songsthat Liam sings. So does Noel always write with hisbrother in mind? "I try not to, 'cos if I do that it lim-its what I do. I just write songs that I like. And if it'sin a key that he can't reach then we try and fit it tomatch him. But if we can't do it, then fuck it, we can'tdo it-I'll sing it. Luckily for us I can pretty muchlook after the songs he can't sing."

One notable change in the making of HeathenChemistry from previous Oasis records is songwrit-ing contributions from other members of the bandsuch as Liam and bass player Andy Bell.

When he's not at the reins of the Oasis jugger-naut, Noel Gallagher runs his own record company,Sour Mash, based in the same building as hisband's label Big Brother and management companyIgnition. "It's probably the last true remainingrecord company in England-it's all my money," hesays of Sour Mash. "I don't take donations from anycorporate people at all-it's my record label. I doeverything: open the mail, sign and produce the

bands." Candidly, Gallagher admits, "It's turned the blame for music piracy at the doors of theinto the biggest waste of money I've ever had the record companies and, incidentally, the UK'sdispleasure of being involved in. It's like gambling trade body BPI. "There was some rumour that

[our songs] were leaked on the Internet thensome fucking knobhead from the BPI goes on[BBC] Radio 1 (CHR) and says, 'Oh yes, there isa leak on the Internet'. So then within an instantthere's half a million people on the Internet look-ing for it. So they fucked it up big time. Once yousend your master tapes to a factory for reproduc-tion, there's always somebody who's on 250 quid(euros 387) a week who's willing to get 10 grand(euros 150,000) for an Oasis CD. I understandthat, I'd be doing it myself.

"I've spoken to [Sony] when they've come to gigsand said, 'You invented the CD burner so it's yourfucking problem. If you didn't invent the CD burn-er there wouldn't be any of this, and if you didn'tinvent an MP3 player-it has Sony written on thefucking front of it. So you're to blame."'

To Gallagher, the solution to piracy is verysimple. "If Sony make a fucking CD that's non -recordable, then yeah. Now they're assuring usthat's gonna be the way forward and I'm like,`Why couldn't you have done that five flickingyears ago?' We're doing this thing for theSunday Times (British newspaper) wherethey're putting a covermount on the paper witha free CD and after the CD's been played fourtimes it wipes itself. Which makes me think,what's to stop a record company ie Sony or

in a way. We've had one album out (Proud Mary'sThe Same Old Blues), but the press won't touch itwith a bargepole because it's something to do withme and vaguely country, but we've sold 18,000records-and not one column inch and not one radio[play]. I was hoping we'd get a bit of a shortcut withthe association with me because if they wereAmerican and had funny surnames they'd be huge."

Major plansOasis were originally signed to Alan McGee's influen-tial UK indie Creation Records. When McGee sold offthe remaining 51% of the label to Sony in 2000, the

major took over the license for Oasis. "They're nicenice people [at Sony] but I've hardly been in theiroffices in the last 10 years," admits Gallagher. "Isigned my deal there and that was it. I don't have togo to them cap in hand. We've sold 38 million fuckingrecords in six and a half years. It's more the other wayround if anything-we're fucking keeping them injobs. I make the records, you sell them. That's whereit ends. It's not that I don't like them; I don't need anymore friends in my life. I think the more friendly youget with people at record labels the harder it is to givethem a fucking bollocking when they need one."

"We're out of contract after the next album-the sixalbum deal is up," Gallagher continues. "After that itmight not be worth our while signing a record dealwith the advent of the Internet and all that stuff-we're already half a million record sales down appar-ently because of the songs that were leaked on the Netoff the new album. So somebody's got an awful flickinglong way to go to convince me record companies areworth anything these days-they're just a bank. Andcreatively they don't get involved so I'm quite lookingforward to sitting down with all of them from themajors and saying, 'What are you gonna do for me?Because you know what I can do for you'. We don'tneed a record deal to be honest. I've got more moneythan Sony Records has in England so maybe I'll buythem out and get rid of Jamiroquai and Toploader!"

Online securityNever one to remain tight-lipped in the face ofwhat he considers an injustice, Gallagher lays

EMI, making a CD that wipes itself after 200times? You wouldn't know about it. If you wentto play the White Album and there was nothingon it you'd think hang on it's started jumpingand scratching and the music's quieter-what'sto stop them doing that? If they can do it-itwould just regenerate back catalogue, wouldn'tit? So I look at these people and think, it's avery sinister thing that they're trying to do atthe minute."

Looking back in triumph1994 - The band's debut album Definitely Maybegoes straight to number 1 in the UK as the fastestselling debut in British history. Now triple platinum ithas also sold over three million copies outside the UK.

1995 - (What's The Story) Morning Glory becomesthe biggest selling British album since The Beatles'Sergeant Pepper's Lonely Hearts Club Band.

1997 - Be Here Now also makes it to number 1despite poor reviews.

2000 - Standing On The Shoulder Of Giantsnotches up their fourth number 1 in a row.

2002 -Heathen Chemistry - preceded by two hitsingles, The Hindu Times and Don't Cry YourHeart Out-is widely hailed as a return to form byboth record label and commentators.

Two years ago he won the won an Echo forBest Newcomer. Viel Zu Spat is the first track onthe EP of the same name and is a dynamic hip -hoprecord with a party energy to it. As predicted, Moony's Dove (I'll Be Loving You)(Airplane!) makes it to the number one spotthis week, ensuring a second European DanceTraxx number one for the vocalist. Just 11weeks ago, she spent three weeks at the top ofthe chart as the vocalist on DB Boulevard'sPoint Of View (Airplane!).

While two former chart -toppers,Mad'House and Shakedown, are slowly slid-ing back down the chart, Kylie Minogue isemerging as a prime candidate for a top threeplacing. Her latest release Love At First Sight(Parlophone) has shot up from 17 to numberseven on this week's list. Providing a massiveretail boost to the track is the inclusion of theremix of Can't Get You Out Of My Head, fea-turing New Order's classic '80s instrumentalBlue Monday (London). The track was firstaired publicly at the Brit Awards earlier thisyear, and is an example of the increasinglycommercially popular bootleg format, wheretwo tracks, often from different musical genres, are mixed together.

Another successful example of the practice(also referred to as "mash -ups" or "soundclash-es") is Sugababes' Freak Like Me (Island), whichutilises Tubeway Army's Are Friends Electric?

Back to the chart, and the highest top 100debut of the week is Junkie XL's reworking ofElvis Presley's A Little Less Conversation(RCA). The track from the Dutch DJ-set to bethe first in a number of remixed Presley cuts-comes in at 20 largely thanks to its popularityin the UK, Scandinavia and Benelux.

Dance Nation's Dance! (In Trance We Trust)returns to its former number nine position aftera week outside the top 10, while Show Me Love2002 (Stereophonic/BMG Germany) by Robin Sis a new entry in the top 10, up from 21. Theclassic dance track was a hit 10 years ago, butreturns in a revamped, remixed form.

Finally one to watch is Paul Oakenfold'sSouthern Sun /Ready Steady Go (Perfecto),which has already made a huge jump fromnumber 79 to 16. The track is garnering a lot ofsupport in Oakenfold's native UK, as well as inIreland, Germany and Belgium.

Summer is here and inevitably it's time forthose Latin rhythms.

As predicted lastweek, Jennifer Lopez(pictured) is back in theEuropean Radio Top 50with her new track fea-turing US rapper Nas.I'm Gonna Be Alright(Epic) enters the chartsat number 42, havingbeen added by 21 sta-tions across all territo-ries.

Philippe Martin, program director at CHRstation Radio Framboise in Lausanne,Switzerland, picked up the tune this weekbut has reservations: "I don't like this trackso much. I think the previous single with JaRule, Ain't It Funny, was better-it wasmore melodious and had all the qualitiesrequired to make it a hit. Maybe the collabo-ration with Ja Rule just worked better thanwith Nas. The reaction of people inSwitzerland was much better to Ain't ItFunny than to this one."

Still on the Latin tip,Enrique Iglesias (pictured) isclosely following Lopez'sassault on the chart with hisnew, softer number Love ToSee You Cry (Interscope), in

49. Martin feelsmore positive about this one:"Love To See You Cry is defi-nitely a hit. We play it 20times a week, which is a normal daytime rota-tion for us. I'm sure that the track will be assuccessful as the previous singles of his album.It's a catchy, dancy pop -tune. We have alwaysplayed Enrique's music, I like it a lot."

The third new entry this week at number50 is Germany -signed UK veteran singer -songwriter Joe Cocker with his idiosyncraticcover of INXS hit Never Tear Us Apart(Parlophone). Michael Brett, station managerat AC station 103FM in Cork, Ireland is veryenthusiastic about the new Cocker single. "Weplay this track because it's a brilliant song andalso the older people that listen to our stationcan relate to it. Joe Cocker would be one of ourcore artists anyway. We play a lot of his stuffand it is a great version of this song.

As far as its appeal goes, Brett says: "It isdefinitely a song for AC stations as it has thiskind of older feel to it, but I think this track isspecial because it appeals to both men andwomen. Also, normally Cocker tends to be a`female' artist, but with this song, because it isan INXS track, I think you get a lot of malesappreciating it as well. It also has the poten-tial to bridge the generation gap."

Brett has a hot tip on some local talent."The next strong contender coming out ofIreland will be Six, the winners of the IrishPop Idol" he says. "Their new track is calledLet Me Be The One and has been picked up byradio stations all over Ireland. The Irish PopIdol show will also be shown soon on ITV inthe UK, which will hopefully get them airplayand greater exposure there. Their debut singleThere Is A Whole Lot Of Lovin' Going On' shotstraight to number one of the Irish Airplaycharts."

Torsten Luth, VP marketing atSony International Network Europe(SINE) in London, certainly consid-ers it a return to form. "I think it'sgot some of the greatest Oasistracks in the last seven years on it,"he tells M&M, "and the reactionswe get both in the UK and interna-tionally seem to confirm that."

With sophomore release (What'sThe Story) Morning Glory in 1995,Oasis achieved the biggest -sellingBritish record since The Beatles'Sergeant Pepper's Lonely HeartsClub Band. But subsequentalbums, Be Here Now (1997) andStanding On The Shoulder OfGiants (2000) were poorly receivedin the press and failed to come closeto the sales of Morning Glory. Inmaking Heathen Chemistry, Oasisdecided to get back to basics andproduce the album themselves attheir own studio just outside Lon-don.

The first cut off the album, TheHindu Times, debuted on M&M'sEurochart Hot 100 Singles at num-ber three following its April 15release-although MTV NetworksEurope's London -based VP musicprogramming, Hans Hagman,points out this was probably asmuch to do with their legion of fansas the merit of the track. "Theyhave a very strong, loyal fanbaseand they'll always have it-thequestion is, can they cross overagain like they did with Wonder -wall?" he asks.

London rock station VirginRadio's programme controller, PaulJackson, thinks it unlikely Oasiswill ever replicate the success theyhad with Wonderwall-taken from(What's The Story) Morning Glory-but supports Luth's assertion thatthe band are back "doing what theydo best-making anthemic, rousingrecords".

Jackson continues: "In places itreaches the heights of Morning Glo-ry, with Hindu Times, Songbird,and Stop Crying, but overall it isn'tas strong. First time around it wasground -breaking. But this is still aquality record." He adds: "I don'tthink anyone will equal Wonder -wall for a long time to come-noteven Oasis!"

Encouragingly for both Oasisand Sony, the band's new single,Stop Crying Your Heart Out hasalso proved a hit, debuting at num-ber two in the UK singles chart fol-lowing its release on June 17 andcurrently sitting at number nine inthe Eurochart Hot 100.

"People have now heard twogreat tracks off the album andshould realise that, if [Oasis] everlost it, they are now back on form,"says Luth. "We are getting plenty ofpromo time. They have done promo-tion nearly every day for over twomonths and [recently completed] aone -week promo trip to Japanwhere they played at the first everJapanese MTV awards. This isbeing followed by a few promotionalevents in Europe in June."

VAT rises to the top of industry agendaBolkestein (pictured), who is incharge of Internal Market, just acouple of hours before the IFPIPlatinum Europe Awards dinner,during which key policymakersfrom Brussels, such asEC vice-president NeilKinnock, are expectedto be present. Impala,which represents indielabels in Europe, plansto have a meeting withBolkestein in Septem-ber.

The IFPI delegationwill use the July 10meeting to present theCommissioner with themusic industry's viewsregarding VAT, as theEC is preparing to harmonise itstax rates across Europe in 2003."We will certainly push the issue ofa VAT reduction on music," saysFrances Moore, managing directorof IFPI's office in Brussels.

"This issue will come up soonand we'll be very active on that sub-ject," explains EMI Recorded Musicsenior VP Rupert Perry, who is alsochairman of IFPI's executive com-mittee for Europe. "The issue isthat we're constantly referred to asa cultural industry, which we are,but they put us in a different cate-gory when it comes to taxation.Why are we discriminated against?"

Impala general secretaryPhilippe Kern welcomes what hecalls "the late entry" of IFPI in thefight for a lower VAT rate and saysImpala wishes to group togetherother sectors of the music communi-

ty to address the issue. He saysImpala is already talking to somekey retailers and retailers' organi-sations, as well as the InternationalManager's Forum (IMF), with a

view to enlisting themin a broad coalition."There is still a sense ofscepticism when thisissue is raised, butthings are moving for-ward in a good direc-tion-it's time to gofull -speed ahead," saysKern, who notes that,at an EU level, Com-missioner for CultureViviane Reding hasalready pledged hersupport for the

demands.Currently, the VAT on recorded

music is set at a minimum rate of15% across Europe, subject to coun-try -by -country variations. IFPIbelieves this rate is "unfair" as itputs recorded music in a differentcategory to other cultural goods,such as books, films and newspa-pers, which are subject to a lowerVAT rate. In 1992, the goods andservices subject to a VAT rate aslow as 5% were placed in Annex Hof the VAT Directive.

"Our concern is that music is notlisted in Annex H and therefore noteligible for a lower rate," saysMoore. IFPI and Impala's aim is toget the Commission, backed by EUstate members, to move recordedmusic to Annex H. However, such amove would require unanimity byEU finance ministers on the matter.

At least two European countrieshave decided to go their own way onVAT. As reported last week in M&M,Italy might unilaterally lower its ratefrom 20% to 15%, going against EUrules, while France's new governmentis said to be contemplating a similarmeasure to comply with promisesmade by then -presidential candidateJacques Chirac.

"These moves are not reallyapproved by EU regulations andmight be challenged by the Commis-sion, but both France and Italy couldgain one or two years, awaiting for aresolution of the issue at a Europeanlevel," says an expert on EU proce-dures.

Some in the industry doubt thatthe process will be successful because,as one industry insider puts it: "In theend, it's the finance ministers whodecide-and we all know they don'tlike to lose revenues."

According to a memorandum fromImpala seen by M&M, a lower VATrate could result in a shortfall of taxrevenues for EU member states, butthat would be compensated for byincome from other tax sources, as CDsales would rise following a decreasein consumer prices.

"Since 1995, the industry hasasked music to be added to Annex Hand the internal market adminis-tration has always been reluctant todo so," says Kern. "This time,France and Italy are committed tomake some noise about this issue,so we don't start empty-handed."

It is understood, however, thatGWR stations in the bigger urbanmarkets-such as GWR FM in Bris-tol and Beacon FM in Wolverhamp-

ton-will continue to have their owndedicated programme controllersresponsible purely for the output oftheir own station.

M&Munderstands that, in the future, thecompany plans to have at least onelocal news journalist at every GWRlocal station, who will provide localmaterial for tailored local news bul-letins for their particular station,which will be produced and readfrom a regional group news centre

AOL Time Warner is believed to haveapproached Vivendi Universal regarding its15.3% shareholding in German music TVchannel Viva. The reported move follows AOLTime Warner's acquisition of EMI's 15.3%shares in the broadcaster, for which it paideuros 52 million, adding to its own 15.3%shareholding. AOL Time Warner is also believedto be talking to four investor consortia whichbetween them own a further 18.2% of Viva.

Hotline understands that EuropeanCommission president Romano Prodi(pictured) has given his conditional approval toattend the IFPI Platinum Europe awardsshow in Brussels on July 10. Hisschedule permitting, Prodi willattend the opening cocktails, duringwhich he would meet the artistsand music industry executivespresent.

As anticipated, a major overhaul is takingplace at Warner Music in the Nordic countries,with the departures of the company's managingdirectors in Sweden (Sanji Tandan), Norway(Mats Nilsson), and Denmark (Finn Work).From July 1, Warner Music Europe executivevice-president Gero Caccia will assume directresponsibility for all three companies. Tandan isbelieved to be in discussions with Warner Musicto set up a Stockholm -based joint venture label,provisionally named S56 Recordings. Atpresstime, Warner sources confirmed that thediscussions were ongoing, but that the deal stillneeded to be finalised.

Gilles Bressand,CEO of indie label XIII bis Records-who hasbeen serving as interim SNEP president for thepast 10 months-was elected with a two-yearmandate. Warner Music France CEO Yan-Philippe Blanc was elected SNEP vicepresident.

Speaking to journalists last week, VivendiUniversal (VU) chairman and CEO Jean-Marie Messier declared that he "would be veryhappy to continue to be managing VU for thenext 15 years." This declaration contrasts withthe mood at the at the company's June 25 AGMduring which, according to French daily LeMonde, the group's biggest shareholders-theBronfman family-asked for Messier to beremoved and replaced by current board vice-chairman Edgar Bronfman Jr.

Finally, London AC/talk station LibertyRadio's licence re -advertisement is proving tobe one of the most hotly -contested AM licencesin the UK for some years. Among the eightgroups vying for the frequency is children'sstation Abracadabra, Asian Talk Radio (anew service from existing London Asian serviceSunrise Radio), and MOR/talk station SagaRadio.
