NOTICE INVITING TENDER for Maintaining, servicing of Gym equipments & providing a Physical fitness trainer.

MMTC Limited invites sealed quotations from eligible interested Parties based at Delhi / NCR having experience in maintaining, servicing of gym equipments & providing a Physical fitness trainer who have successfully done the above jobs during the last three years. The work shall be executed at MMTC Housing Colony, Sri Aurobindo Marg, Adchini, New Delhi – 110017. Details of the services required and other terms and conditions relating to the award of Contract are as follows : 1. Validity of Contract : The contract shall be valid for a period of Two years from the date of commencement of the contract. However, the contract may be extended for a further period of One year on mutual consent, subject to satisfactory completion of the contract. 2. Eligibility conditions

i) The bidder shall have an experience of at least three years or more in this field. In this regard copies of performance certificate / completion certificate / work order should be submitted.

ii) Copy of VAT/Sales Tax/Service Tax Registration Certificates, Pan card and ITR for the last three years should be submitted.

iii) List of customers along with details of contact persons / Telephone Nos. and complete address.

4. Earnest Money Deposit (EMD) :

The bidder shall furnish Earnest Money Deposit of an amount of Rs. 25000/- (Rupees Twenty five thousand only) by way of Demand Draft / Banker’s Cheque drawn in favour of “MMTC Limited” payable at New Delhi. The EMD of unsuccessful bidder shall be returned / discharged subsequently to the award of Contract without any interest. Failure on the part of successful bidder to undertake the work within prescribed time limit shall amount to forfeiture of EMD. 5. Submission of Tenders :

i) All interested service providers are requested to submit tenders in e- mode as well as in physical form in two separate sealed envelopes comprising (A) Technical Bid (Annexure I) with prescribed EMD & documents and (B) PRICE BID (Annexure II), bearing the name & address of the bidders in both bids, should be dropped in the Tender Box kept in the office of the General Manager (Estate) on 2nd Floor, Core I, SCOPE Complex, New Delhi -110 003 on or before 1500 hrs of 25-05-2016.

ii) Tender document is available on the website of the MMTC Limited i.e.

www.mmtclimited.com and http://eprocure.gov.in. The interested bidders may download the tender document containing the terms and conditions and submit the same at the office of General Manager (Estate), MMTC Limited, 2nd Floor, Core-I, Scope Complex Lodi Road, New Delhi – 110 003.

iii) The sealed tender should superscribe “Tender for maintaining, servicing of gym

equipments & providing of a Physical fitness trainer”. Late / delayed tender due to any reason, whatsoever, will not be accepted beyond the notified time and date under any circumstances.

iv) Technical bids shall be opened on 26-05-2016 at 1100 hrs in the presence of

authorized representatives of bidders who wish to be present. v) The technical Bids shall be scrutinized / verified by MMTC in terms of the tender and

subsequently the eligible PRICE BIDS shall be opened in respect of technically qualified bidders only. The date, time and venue for opening of Price Bids shall be informed to the eligible tenderers separately.

The Parties / agencies are advised to visit the place of work for assessing / acquainting themselves with the nature and volume of work realistically before quoting the rates. The rate should be mentioned in figures as well as in words inclusive of all charges, taxes and levies. Service Tax, if applicable, shall be at extra on actuals.

6. The earnest money will be forfeited in the event of :

i) if a tenderer withdraws its tender during the period of tender’s validity. ii) In case of successful tenders, if the tenderer fails to commence the work as required.

7. Security Deposit :

i) For successful bidder, the EMD shall be retained as Security Deposit for the total period of validity of the agreement.

ii) Security shall be discharged after successful completion of contract.

If the Contractor fails or neglects any of his obligations under the contract, MMTC reserve the right to forfeit either whole or any part of security furnished by the bidder as penalty for such failure. 8. Payment : Payment to the successful bidder shall be released on monthly basis through e-mode within 15 days from the date of receipt of bills. 9. Validity of Tender :

Rates quoted by the firm shall remain valid for a period of 60 days.

TDS and any other applicable taxes levied by the Government shall be deducted from the bill amount as per Government of India instructions issued from time to time. Agency will

be liable for any statutory payments payable and shall immune MMTC from any such present or future liability.

The contractor shall be responsible for any injury caused to persons, property of MMTC etc., which may arise from the operations or on account of negligence by any person of the tenderer / contractors team or any person engaged by them for any purpose related to the execution of this contract. The tenderer / contractor shall indemnify MMTC of all liabilities arising out of his operations in any way under any acts of the Government and also in award of any compensation or damaged consequent upon any claim arising out of the above.

It is expressly understood and agreed to between the parties to this tender that the persons deployed by the contractor for the above work shall be employee of the contractor for all intents and purposes and in no case, shall a relationship of employers & employee between the said person & MMTC shall accrue implicitly and explicitly.

The successful tenderers shall have to execute an agreement with MMTC. The agreement shall remain valid initially for a period of Two years with a provision of an extension/renewal for a period of another one year on mutually agreed terms & conditions. No escalation is permitted during the tenancy of the agreement.

Terms & condition of the tender shall form the part of agreement.

10. Technical bid should include the following :

11. Submission of Tender :-

(i) Parties may send their “Technical” & “Price Bids” in separate sealed cover put into another

sealed envelop, superscribing “QUOTATION FOR MAINTAINING, SERVICING OF

GYM EQUIPMENTS & PROVIDING A PHYSICAL FITNESS TRAINER” to reach

latest by 1500 hrs on 25-05-2016 at the following address :

(ii) Quotation received after due date & time will not be considered.

(iii) Rate should be quoted in “PRICE BID” (Annexure-II) both in figures and words without any

over writing.

(iv) All the pages of offer should be initialed and a copy of Terms and Conditions must be returned

duly signed as a token of acceptance alongwith Technical bid.

(v) The successful tenderer shall not sub-let the part or complete work without written permission

of MMTC. The tenderer is fully responsible to MMTC for the work if awarded to him.

vii) MMTC reserves its right to cancel the contract by serving 30 days advance notice in writing

during the currency of the Contract without assigning any reasons, whatsoever, if the services

provided by the firm are found to be unsatisfactory.

(viii) MMTC Limited reserves its right to accept or reject any tender at its sole discretion without

assigning any reason whatsoever.

General Terms & Conditions for Annual Maintenance Contract (AMC) for Gym Equipments &

Providing a Physical Fitness Trainer at MMTC Housing Colony, Aurobindo Marg, New Delhi

1. Type of AMC is non-comprehensive (without parts).

2. Scope of work includes preventive, periodical and routine maintenance apart from attending

to specific complaints. In order to attend to our specific complaints, it shall be binding on

the contractor that they depute service mechanic in our office premises within a period of

24 hrs. during the validity period of AMC.

3. Compulsory visit per month shall be one, besides attending specific complaints, as and

when needed.

4. Gym equipment covered under this AMC are in working condition. It therefore, shall be

binding on the contractor that they maintain them thorough out the tenancy of AMC and

had over the same in good running condition at the time of expiry of this contract .

5. Tools, tackles and consumables required for servicing the gym equipment shall be the

responsibility of the successful bidder. Minor repairs with nominal value of parts shall be

to party’s account.

6. During the period of this maintenance contract if MMTC disposes of any of the Gym

equipment(s) covered by the AMC, the AMC amount will be reduced proportionately.

7. If any of the parts found defective during the AMC period, the party shall inform the

MMTC in writing alongwith its estimated cost and after conveying MMTC’s approval, the

party shall replace the defective parts and submit the bills.

8. The services which are felt essential for the effective working of Gym equipment shall also

be rendered by the contractor during the period of this AMC.

9. In case the party is not attending to the problem and situation compels, MMTC to get the

work done through some other agency, the cost thus incurred shall be recovered from

payment due or shall be adjusted against security deposit.

10. The party need to provide before hand machine wise list of components alongwith their

prices, which becomes defective or likely to worn out very often. Gym equipment

presently available along with its type & Numbers are hereunder:-

1. Tread mill 2 Nos

2. Cross Trainer 1 No.

3. Recumbent Bike 2 Nos.

4. Multi Gym (4 stationed) 1 No.

5. Rowing Machine 1 No.

11. Physical Trainer :

1. Physical fitness trainer should have certificate from a reputed and accredited Institution. He

should possess the required skill and must be conversant with the Gym equipment and safety

measures etc.

2. Agency to provide a Physical fitness trainer prepared to work in break-shift of 4 hours each in

the morning & evening, 6 days a week i.e 6 AM to 10 AM & 5 PM to 9 PM.

3. The Agency may rotate the certified trainer every three months or early so that members of

gym can share the experience of different trainers.

4. If the trainer referred by the Agency leaves or stops working, free replacement forthwith shall

be provided by the Agency, failing which MMTC has the option to make necessary

arrangements including hiring of new trainer at the risk and cost of the Agency.

5. For any additions of Gym equipment, in future, no additional payment on account of providing

training shall be given.

12. The bidder shall fill up Mandatory Information Form duly signed and stamped (Annexure-III)

13. Statuatory Liabilities

1. Agency shall have valid service tax registration, required license, PAN etc.

2. Service tax payable, if any, shall be made against proof of valid service tax registration number

and subject to submission of proof of service tax paid to be submitted to MMTC alongwith

bills.

3. MMTC will make payment directly to the Agency, limited to finalized amount only as

mentioned in the agreement. Agency will be liable for any statutory payment payable and shall

immune MMTC from any such present or future liability.

14. TERMINATION OF AGRREMENT / ARBITRATION

The Agreement may be terminated by serving 30 days prior notice in writing by either Party.

In the event of any dispute or difference arising under or out of relating to the construction meaning,

operation or effect of this agreement or breach thereof the matters dispute shall be referred to the Sole

arbitration of Chairman-cum-Managing Director of MMTC Limited or a person nominated by him.

The decision / award of the Arbitrator shall be final and binding on the parties. The venue of

arbitration shall be New Delhi.

फोरीदाता को ‘‘एभएभटीसी तरतभटेड’’ के ऩऺ भें नई ददर‍्री भें देम दडभांड ड्राफ्ट/फैंकसस चैक द्वाया रूऩए 25000/- (ऩच‍्चीस हजाय रुऩए) फमाना यातश के रूऩ भें जभा कयाने होंगे। संबवदा ददए जाने के ऩश‍्चात असपर फोरीदाताओं को बफना दकसी फ‍्माज के ईएभडी वाऩस/दडस‍्चाजस कय दी जाएगी। सपर तनधासरयत सभम सीभा के अंदय कामस आयंब कयन ेसे फोरीदाता की असपरता ऩय ईएभडी जफ‍्त की जाएगी। 5. लनर्वदा जभा कयना : i ) सबी इच‍्छुक सेवा प्रदाताओं से तनवेदन है दक वे अऩनी तनबवदाएं ई-भोड के साथ-साथ दपजजकर रूऩ से दो अरग भुहय फंद तरपापों भें जभा कयें। इनभें क) तनधासरयत ईएभडी के साथ दस‍्तावेजों सदहत तकनीकी फोरी (अनुरग‍्नक-I) तथा ख) भूर‍्म फोरी (अनुरग‍्नक-II) होनी चादहए। दोनों फोतरमों ऩय फोरीदाता का नाभ व ऩता तरखकय ददनांक 25.05.2016 अऩयाह्न 1500 फजे तक भहाप्रफंधक (संऩदा) दद्वतीम तर, कोय-I, स‍्कोऩ काभ‍्ऩरेक्‍स नई ददर‍्री – 110003 के कामासरम भें यख ेतनबवदा फक्‍से भें डारना होगा।

ii) तनबवदा दस‍्तावेज एभएभटीसी की वेफसाइट www.mmtclimited.com तथा http://eprocure.gov.in. ऩय उऩरफ‍्ध है। इच‍्छुक फोरीदाता शतों एव ंअनुफंधों सदहत तनबवदा दस‍्तावेज को डाउनरोड कय सकत ेहैं तथा इन‍्हें भहाप्रफंधक (संऩदा) एभएभटीसी तरतभटेड, दद्वतीम तर, कोय-I, स‍्कोऩ काभ‍्ऩरैक्‍स, रोदी योड, नई ददर‍्री - 110003 के कामासरम को बेज सकत ेहैं।

iii) भुहयफंद तनबवदा ऩय ‘‘जजभ के उऩकयणों के यखयखाव, सबवसतसंग तथा एक दपजीकर दपटनेस टे्रनय उऩरफ‍्ध कयवाना’’ स‍्ऩष‍्ट शफ‍्दों भें अंदकत होने चादहए। दकसी बी कायण स ेदेय/बवंरबफत तनबवदा को, दकन‍्हीं बी ऩरयजथथतत भें अतधसूतचत सभम एवं तततथ के ऩश‍्चात स‍्वीकाय नहीं दकमा जाएगा। iv) ददनांक 26.05.2016 को 11:00 फजे तकनीकी फोतरमों को फोरीदाता के उऩजथथत यहने के इच‍्छुक अतधकृत प्रतततनतधमों की उऩजथथतत भें खोरा जाएगा। v) एभएभटीसी द्वाया तनबवदा की शतों के अनुसाय तकनीकी फोतरमों की जांच-ऩड़तार/सत‍्माऩन दकए जाने के ऩश‍्चात तकनीकी रूऩ से मोग‍्म फोरीदाताओं के तरए ही ऩात्र भूर‍्म फोतरमां खोरी जाएगी। भूर फोतरमां खोरने के तरए तततथ, सभम तथा स‍्थान के बवषम भें ऩात्र तनबवदाकतासओं को अरग से सूतचत दकमा जाएगा।

ऩादटसमों/एजेंतसमों को ऩयाभशस ददमा जाता है दक वे दये कोट कयने से ऩहरे वास‍्तबवक रूऩ से कामस की प्रकृतत एवं भात्रा के तनधासयण से बरीबांतत ऩरयतचत होने के तरए कामसस‍्थर का दौया कय रें।

सबी प्रबायों, कयों तथा रेवीज़ सदहत दयों को अंकों एव ंशफ‍्दों दोनों भें उदधतृ कयें। सेवा कय, मदद राग ूहोंग,े तो वास‍्तबवक के अततरयक्‍त होंगे।

6. लनभ‍्नलरजखत के होने ऩय फमाना यालश जफ‍्त कय री जाएगी :

i ) मदद तनबवदा की वैधता अवतध के दौयान तनबवदाकतास अऩनी तनबवदा को वाऩस रेता है ।

i i ) सपर तनबवदाकतास के भाभरे भें मदद तनबवदाकतास अऩेजऺत रूऩ भें कामस आयंब कयन ेभें असपर यहता है।

7. सुयऺा जभा :

i) सपर फोरीदाता हेत,ु कयाय की वैधता की कुर अवतध के तरए ईएभडी को सुयऺा जभा के रूऩ भें यखा जाएगा।

ii संबवदा के सपरताऩूवसक सभाऩन के ऩश‍्चात सुयऺा यातश दडस‍्चाजस की जाएगी।

मदद ठेकेदाय संबवदा के अंतगसत अऩने दकसी दातमत‍्व को ऩूया कयने भें असपर यहता है अथवा अनदेखी कयता है तो एभएभटीसी के ऩास फोरीदाता द्वाया दी गई संऩूणस सुयऺा यातश अथवा इसके दकसी बाग को उक्‍त असपरता के कायण दण‍्ड स‍्वरूऩ जफ‍्त कयने का अतधकाय होगा।

8. बुगतान

सपर फोरीदाता को बफर प्राप्त होने की तततथ स े15 ददन के अंदय ई-भोड से भातसक आधाय ऩय बुगतान जायी दकमा जाएगा।

9. लनर्वदा की वैधता

पभस द्वाया उदधतृ दयें 60 ददन की अवतध के तरए वैध होगी।

सभम-सभम ऩय बायत सयकाय द्वाया जायी अनुदेशों के अनुसाय टीडीएस तथा सयकाय द्वाया रगाए गए अन‍्म कयों की कटौती बफर यातश से की जाएगी। दकसी बी प्रकाय के वैधातनक बुगतान का दातमत‍्व एजेंसी का होगा तथा एभएभटीसी को इस प्रकाय के दकसी बी वतसभान अथवा बावी दातमत‍्व से भुक्‍त यहेगी।

व‍्मबिमों, एभएभटीसी की संऩबि को होने वारी दकसी बी प्रकाय की ऺतत/चोट के प्रतत ठेकेदाय की जजभ‍्भेदायी होगी, मह ऺतत/चोट ऩरयचारन से अथवा इस ठेके के तनष‍्ऩादन के तरए टेंडयकतास/ठेकेदाय द्वाया कामस भें रगाई गई टीभ अथवा दकसी व‍्मबि की राऩयवाही स ेहो सकती है। टेंडयकतास/ठेकेदाय अऩने ऩरयचारन कामस स ेएभएभटीसी के प्रतत उत‍्ऩन‍्न होने वारी देमताओं की ऺततऩूततस बायत सयकाय के अतधतनमभों के तहत कयनी होगी। इसके अरावा उऩयोक्‍त के तहत दकए गए दकसी क्‍रेभ के भुआवजे अथवा ऺततऩतूतस की बी देमता वहन कयनी होगी।

इस टेंडय की ऩादटसमों के फीच भें स‍्ऩष‍्ट रूऩ से सहभतत तथा सभझ है दक उऩयोक्‍त कामस के तरए ठेकेदाय द्वाया तैनात दकए गए व‍्मबि सबी उदे्दश‍्मों एवं आशमों के तरए ठेकेदाय के कभसचायी होंगे तथा इनका एभएभटीसी के साथ दकसी बी रूऩ भें तनमोक्‍ता व कभसचायी का संफंध नहीं होगा।‍

सपर टेंडयकतास को एभएभटीसी के साथ एक कयाय कयना होगा। मह कयाय प्रायंब भें 2 वषस के तरए वैध होगा जजसभें ऩयस‍्ऩय सहभत शतों के अनुसाय आगे एक औय वषस के तरए फढाने/नवीनीकयण कयन ेका प्रावधान होगा।

टेंडय की शतें व तनफंधन कयाय का दहस‍्सा होंगी।

11. टेंडय प्रस‍्तुत कयना :

(i) ऩाटी अऩनी ‘’टेक्‍नीकर’’ तथा ‘’प्राइस बफड’’ अरग-अरग सीर‍्ड कवय भें डारकय उन‍्हें भुहयफंद तरपापे भें बेजें जजस ऩय ‘’जजभ के यखयखाव, उऩकयणों की सर्विलसंग तथा एक दपजीकर दपटनेस टे्रनय उऩरफ‍्ध कयाने

के लरए कोटेशन’’ तरखा हो तथा वह तनभ‍्नतरजखत ऩते ऩय ददनांक 25.05.2016 को 1500 फजे तक ऩहंुच जाना चादहए :

(iii) येट ‘’प्राइस बफड’’ (अनुरग‍्नक-II) भें अंकों व शफ‍्दों भें ददए जाएं तथा दकसी बी प्रकाय की ओवययाइदटंग नहीं होनी चादहए।

(iv) ऑपय के सबी ऩेजों ऩय हस‍्ताऺय दकए जाएं तथा शतों व तनफंधनों की एक काऩी टेक्‍नीकर बफड सदहत बवतधवत रूऩ स ेहस‍्ताऺरयत स‍्वीकृतत के रूऩ भें रौटा दी जाए।

(v) सपर टेंडयकतास एभएभटीसी की तरजखत अन‍ुभतत के बफना कामस के दकसी बी बाग अथवा ऩूये बाग को सफ-रेट नहीं कयेगा। टेंडयकतास उसको अवाडस दकए गए कामस के तरए ऩूणस रूऩ स े एभएभटीसी के प्रतत जजभ‍्भेदाय होगा।

(vi) टेंडय दस‍्तावेज के संफंध भें दकसी बी प्रकाय के प्रश‍्न तथा स‍्ऩष‍्टीकयण के तरए टेरीपोन नंफय 011- 24381338 ऩय श्री एस.के. दत‍्ता, वरयष‍्ठ प्रफंधक, एभएभटीसी तरतभटेड, संऩदा प्रबाग, दसूया तर, स‍्कोऩ काभ‍्ऩरेक्‍स, नई ददर‍्री-110003 से संऩकस कयें।

(vii) मदद पभस द्वाया दी जा यही सेवाओ ंको संतोषजनक नहीं ऩामा जाता है तो एभएभटीसी को मह अतधकाय होगा दक वह ठेके की वैध अवतध के दौयान बी बफना कोई कायण फताए 30 ददनों का तरजखत एडवांस नोदटस देकय ठेके को यद्द कय दे।

(viii) एभएभटीसी को अतधकाय होगा दक वह अऩने ऩूणस बववेक से बफना कोई कायण फताए दकसी बी टेंडय को स‍्वीकाय अथवा अस‍्वीकाय कय दे।

एभएभटीसी हाउलसंग कारोनी नई ददर‍्री भें जजभ के उऩकयणों के ययखाव, सर्विलसंग तथा एक दपजीकर दपटनेस टे्रनय उऩरब्ध कयाने हेत ुएएभसी की साभान‍्म शतें व लनफंधन

1. वाबषसक यखयखाव संबवदा(एएभसी) नॉन-कंप्रीहेंतसव है।(बफना ऩार्टसस के)

2. कामस ऺेत्र(स‍्कोऩ) भें बवतशष‍्ट तशकामतों को सुनने के साथ ही बप्रवेंदटव बऩरयमोदडकर एवं दैतनक यखयखाव का कामस बी शातभर है। हभायी बवतशष‍्ट तशकामतों को सुरझाने के तरए ठेकेदाय ऩय मह फाध‍्मकायी होगा दक वह एएभसी की भान‍्म अवतध के दौयान हभाये कामासरम ऩरयसय भें सबवसस भेकेतनक को 24 घंटे के अंदय तनमुक्‍त कये।

3. आवश‍्मकता होने ऩय बवतशष‍्ट तशकामतों ऩय कायसवाई कयने के अततरयक्‍त प्रत‍्मेक भाह अतनवामस रूऩ से बवजजट कयनी होगी।

4. इस एएभसी के अंतगसत कवय होने वारे जजभ उऩकयण कामस कयन ेकी जथथतत भें होने चादहए। अत: ठेकेदाय की जजभ‍्भेदायी होगी दक वह एएभसी की अवतध के दौयान जजभ उऩकयणों को चारू हारत भें तथा व‍्मवजथथत यखें तथा उन‍्हें इस संबवदा की सभातप्त के सभम अच‍्छी चारू जथथतत भें वाबऩस सौंऩ।े

5. जजभ उऩकयणों की सबवसतसंग के तरए आवश‍्मक टूर‍्स औजाय व उऩमोगी साभान उऩरफ‍्ध कयाने की जजभ‍्भेदायी सपर फोरीकतास की होगी। ऩाटी को नातभनर यातश से होने वारी भाइनय रयऩेमसस अऩनी ओय से कयानी होगी।

6. इस यखयखाव संबवदा की अवतध के दौयान मदद एभएभटीसी एएभसी के अंतगसत दकसी बी जजभ उऩकयण(णों) का प्रमोग कयना फंद कयती है तो एएभसी यातश आनुऩाततक रूऩ स ेकभ कय दी जाएगी।

7. मदद एएभसी अवतध के दौयान उऩकयण का कोई दहस‍्सा खयाफ ऩामा गमा तो ऩाटी अनुभातनत रागत से साथ तरजखत भें एभएभटीसी को सूचना देगी एवं एभएभटीसी का अनभुोदन प्राऩ‍्त कयन ेके फाद, खयाफ ऩार्टसस को रयऩ‍्रेस कयेगी तथा इसके बफर प्रस‍्तुत कयेगी ।

8. एएभसी की अवतध के दौयान मदद जजभ के उऩकयण के प्रबावी कामस के तरए आवश‍्मक सबवसस की आवश‍्मकता प्रतीत होती है, होती है तो वह ठेकेदाय द्वाया प्रदान की जाएगी ।

9. ऩाटी द्वाया सभस‍्मा एवं जथथतत की तशकामत को न सुने जाने की अवस‍्था भें एभएभटीसी दकसी अन‍्म संस‍्था के द्वाया कामस कयवा सकती है, व‍्मम रागत फच ेहुए बुगतान अथवा सुयजऺत जभा से सभामोजजत की जाएगी।

10. ऩाटी को कंऩोनेंट की भशीनवाय सूची उनके भूर‍्म के साथ ऩहरे उऩरफ‍्ध कयानी होगी जो फहुधा खयाफ मा सभ‍्बाव‍्मता तघस-बऩट जाती है। जजभ साभग्री (व‍्मवासातमक) वतसभान भें अऩने प्रकाय एवं संख‍्मा के साथ नीचे उऩरफ‍्ध कया ददए गए हैं :-

2. एजेंसी को सऩ‍्ताह भें 6 ददनों हेत ुप्रात: 6 फजे स े10 फजे एवं सांम 5 फजे स े9 फज,े प्रात: एवं सामं प्रत‍्मेक 4 घंटे ऩय अवकाश भें कामस कयन ेके तरए एक दपजीकर दपटनेस टे्रनय उऩरफ‍्ध कयाना होगा।

3. एजेंसी को प्रत‍्मेक तीन भाह भें मा उसस ेऩहरे प्रतशऺक को फदरत े यहना चादहए तादक जजभ के सदस‍्म बवतबन‍्न प्रतशऺातथसमों का अनुबव आऩस भें फांट सकें ।

4. मदद एजेंसी द्वाया तैनात टे्रनय कामस छोड़़़ता अथवा योकता है, तो एजेंसी द्वाया इसके स‍्थान ऩय बफना शुर‍्क का प्रततस‍्थाऩन(रयऩ‍्रेसभेंट) उऩरफ‍्ध कयाना होगा, ऐसा न कयन ेऩय एभएभटीसी के ऩास मह बवकर‍्ऩ होगा दक वह आवश‍्मक प्रफंधन के अंतगसत जजसभें एजेंसी के दातमत‍्व एवं रागत ऩय नमे प्रतशऺक को रेना शातभर हैं।

5. बबवष‍्म भें, जजभ साभग्री की फढोतयी की दशा भें, उऩरफ‍्ध प्रतशऺक को कोई बी अततरयक्‍त बुगतान नहीं दकमा जाएगा।

11. अलनवामि सूचना पाभि

फोरीकतास को बवतधवत रूऩ स ेहस‍्ताऺरयत एवं स‍्टाभ‍्ऩ रगे हुए अतनवामस सूचना पाभस को बयना होगा

12. सांर्वलधक देमता

1. एजेंसी के ऩास भान‍्म सेवा कय ऩंजीकयण, आवश‍्मक राइसेंस, ऩेन काडस इत‍्मादद होना चादहए।

2. मदद कोई सेवाकय देम होगा तो उसका बुगतान प्रभाण के तरए वैध सेवाकय यजजस‍्टे्रशन नंफय के बवरूद्ध कयना

होगा तथा बुगतान दकए गए सेवाकय का प्रभाण एभएभटीसी को बफरों के साथ प्रस‍्तुत कयना होगा। 3. एभएभटीसी एजेंसी को सीधे बुगतान कयेगा तथा बुगतान यातश की सीभा कयाय भें दकए गए उर‍्रेख के अनुसाय

होगी। दकसी बी प्रकाय के देम सांबवतधक बुगतान का दातमत‍्व एजेंसी का होगा तथा एभएभटीसी दकसी बी

वतसभान एवं बबवष‍्म देमता से भुक्‍त होगी।

14. सभझौते/भध‍्मस‍्थता की सभालि

सभझौता दकसी बी ऩाटी द्वाया 30 कामस ददवस के ऩूवस तरजखत नोदटस के आधाय ऩय सभाऩ‍्त दकमा जा सकता है।

दकसी बववाद अथवा तनभासण संचारन अथवा अनुफद्ध के प्रबाग से अथवा बववाद अथवा उसके उर‍्रंघन के भाभरों के अंतगसत आने वार बववाद मा अंतय की जथथतत भें एभएभटीसी के अध‍्मऺ-सह-प्रफंध तनदेशक अथवा उनके द्वाया नातभत व‍्मबि एकभात्र भध‍्मस‍्थ होगा। भध‍्मस‍्थ का तनणसम/पैसरा(अवाडस) दोनों ऩादटसमों ऩय अंततभ एवं फाध‍्म होगा। भध‍्मस‍्थता की जगह नई ददर‍्री होगी।
