2. PROJECT STANDARD CONDITIONS OF TENDER

2.1 PROJECT REFERENCE

The Project Reference is stated in the Tender data schedule.

2.2 SUBMISSION OF TENDER DOCUMENTS

A Tender may not be regarded as bona fide and complete unless it comprises the return of all information required for adjudication purposes as set out in the Tender Returnables volume II of the set of Tender Enquiry documents.

Failure to submit and complete all of the information required for Tender adjudication purposes, may render the Tender liable to rejection.

Tenderers are advised that Tenders submitted by telegram, telex or fax will not be considered.

2.3 ACQUAINTANCE WITH TENDER DOCUMENTS

By submission of a Tender, the Tenderers will be deemed to have acquainted themselves fully with the documents and all aspects of work envisaged in the documents prior to pricing and submission of this Tender.

2.4 EXPENSES INCURRED IN PREPARATION OF TENDER DOCUMENTS

The Employer or its Agents will not be responsible to pay any expenses or losses, which the Tenderer may incur in the preparation of this Tender.

2.5 CONFIDENTIALITY OF TENDER DOCUMENTS

All the recipients of the Tender documents shall, whether they submit a Tender or not, treat the details of the documents as private and confidential and their general content shall not be disclosed or discussed with third parties without the prior approval of the Quantity Surveyor and/or Procurement Agent.

2.6 QUERIES

Any queries, which Tenderers wish to raise on this tender, must be addressed in writing to the relevant Agent as per the details stated in the Tender data schedule. In this regard, the latest date for receipt of queries shall be no later than the 16H00 on the date stated in the Tender data schedule. No queries shall be addressed after this date and time.

2.7 COMPUTERISED TENDER DOCUMENTS

Submission of reproduced computer printouts of the Tender Returnables WILL NOT

be accepted.

2.8 BRIEFING MEETING

A compulsory briefing meeting will take place as per the details stated in the Tender data schedule.

2.9 COMMUNICATION WITH MEMBERS OF THE TENDER/BID ADJUDICATION PANEL

2.9.1 A Tenderer shall not in any way communicate with a member of the Tender Adjudication Panel or with any officer, agent, consultant, or representative of the Adjudication Panel on a question affecting any contract for the supply of goods or for any work, undertaking or service which, is the subject of a Tender during the period between the closing date for receipt of Tenders and the despatch of the written notification of the decision on the award of the contract provided that a Tender shall not hereby be precluded:

 At the request of the Adjudication Panel or its authorised representative, from furnishing him with additional information or with a sample or specimen for testing purposes or otherwise or from giving a demonstration so as to enable the recommendation on the award of the contract to be formulated;

 A request from obtaining from the Adjudication Panel or its authorised representative information as to the date upon which the award of the contract is likely to be made or, after the decision upon the award has been made by the Tender Adjudication Panel to which the Employer had delegated its powers, information as to the nature of the decision or such information as was publicly disclosed at the opening of Tenders or from submitting to the Employer in writing any communication relating to this Tender or the award of the contract or for leave to withdraw the Tender;

 And provided further that nothing contained herein shall be construed so as to prevent information being sought and obtained from a Tender Adjudication Panel member with regard to any decision taken at an open Tender Panel meeting.

2.9.2 A contravention of sub-clause 2.9.1 or any attempt to contravene such sub-clause shall be reported to the Employer which may, on receipt of such report, disqualify the Tenderer concerned.

2.10 COMMUNICATION, MEDIA RELEASES, ETC.

Tenderer shall not in any way communicate with the press, or any representative of the written or electronic media, on a question affecting this Tender during the period between the closing date for receipt of Tenders and the despatch of the written notification of the decision of the award of the contract. A contravention of this clause shall be reported to the Employer, which on receipt of such report may, at its discretion, disqualify the Tenderer concerned.

All rights of publication of articles in the media, together with any advertising relating to, or in any way concerned with this project shall vest in the Employer.

2.11 COPYRIGHT

No part of this document and any document enclosed with this enquiry may be copied, photographed or repeated in any manner or by any process without the written consent of the Quantity Surveyor and/or Procurement Agent. Copyright is reserved on all designs, specifications, patents and patentable designs, systems and processes contained in the documents and drawings. The person, firm, body, supplier, contractor, sub-contractor or any other contracting party is to be responsible jointly and severally, in their personal and corporate capacities for any contravention of this requirement for Tendering and/or copyright clause contained in the documents.

2.12 FALSE DECLARATION

All information requested in this document and provided by the Respondent is accepted in good faith as being true and accurate. Any false declaration or intentional omission of relevant facts shall be reported to the Employer, which on receipt of such report may disqualify the Tenderer concerned.

2.13 ACCEPTANCE OF TENDER

Neither the Employer, nor its Agents are bound to accept the lowest or any portion of any Tender nor are they required to give reasons for selecting one Tenderer in favour of another.

2.14 TENDER CLOSING

The details of Tender closing are stated in the Tender data schedule.
