At MIS and MJHS, we strive for excellence in all we do!  It is our primary focus to provide your child with a challenging curriculum in a safe and fun environment.  As a team, our staff is excited about the upcoming year and the opportunity to work with your child.  We invite you to be a part of the experience by being informed and involved.  Our handbook is a resource that provides you with information regarding rules, procedures, and regulations.  Please take the time to review it with your child.  As always, we encourage you to visit the school, communicate with teachers, ask questions, and be involved!  When the school, parents, and community form a partnership ­ everyone benefits!  Please contact the school if we can assist you in any way.

GENERAL INFORMATION  

Assemblies School assemblies are a privilege. Each student will be respectful and give complete attention to the program. Any unruly student                                       will be removed and taken to the office. Dismissal to and from the assembly will be done in an orderly fashion and will be handled                                                 by the principal or his/her designee.  Book Bags/Backpacks/Purses/String Bags Students will not be permitted to carry book bags/backpacks with them during the school day. Book bags/back packs must be left in                                           the students' lockers. Female students will be permitted to carry a hand (clutch type) or shoulder purse. Students are permitted to                                         use string bags to carry books and classroom supplies between classes.    Bus Passes Bus passes will only be approved in “emergency cases”, allowing there are seats available on the bus. Students wishing to ride a                                           bus other than their assigned bus must submit a note to the office prior to the beginning of lunch. The note should include the day’s                                                 date, the alternate drop­off address, and a number where the parent can be reached during school hours. If a student is going                                           home with another student, both students will be required to provide a note from a parent with the above information. Approved                                         students will be issued a bus pass to give to the bus driver acknowledging permission to ride the bus on the approved date/s.   

Cafeteria Rules 1. Treat everyone respectfully. 2. Speak quietly at all times. 3. All students will assist in picking up all trash and placing it in the proper receptacles. 4. Ask permission to leave your seat or to leave the cafeteria. Students are not permitted in the hallways or restrooms without                                         

a pass. 5. Food or drink items are not permitted in the hallways, gym, or classrooms, unless permitted by a  classroom teacher. 6. Students are not permitted to drink pop or energy drinks during lunch time. Parents are not permitted to bring fast food                                         

items during lunch time. 7. Students will use proper procedures when moving throughout the cafeteria. 

Cell Phones/Electronic Devices Cell phones and other electronic devices should not been seen or heard during the school day. Lockers are emphasized for the                                         storage of all electronic devices that should remain OFF and not heard or seen throughout the school day. A parent wishing to                                           contact a student should do so through that student's school office. Students who are using cellular phones or other electronic                                       devices unauthorized during the school day will have the device confiscated and will be subject to disciplinary consequences. Cell                                     phones that are taken will have to be retrieved by a parent. Confiscated cell phones/electronic devices may be subject to search,                                         including the device, battery, all interior hardware, and/or data. Contents found to be inappropriate and/or illegal may be referred to                                       legal authorities. The District assumes no liability if these items are broken, lost or stolen. Use of cell phones/electronic devices that                                         contain a built­in camera are strictly prohibited in locker rooms and changing areas of Massillon City Schools ­ or at any other locker                                             room/changing area our team(s) may be visiting for an athletic or extracurricular event. Students may use their electronic devices in                                       class as instructed by school personnel.   Consequences may include:   

1. First offense ­ Confiscated and returned to the student at the end of the day. 2. Second offense ­ Confiscated and retrieved by parent/detention. 3. Third offense ­  Confiscated and retrieved by parent/administrative discretion.

Massillon Junior High & Intermediate Schools  2016/2017  Note: Students needing to contact a parent should report to the office where they will be assisted. Students are not permitted to                                           call for pickup from a teacher’s classroom or from their cell phones/electronic devices. Students who are not feeling well are                                       required to report to the clinic for medical assistance.  Change of Address or Phone Number The school must be able to contact a parent or guardian in the event of an emergency involving your child. Please notify the office                                               when you have had a change of address, phone number, or if you have any other changes to information included on an emergency                                             medical form so that is can be entered into our current district database. Also, as revisions to addresses/phone numbers are made                                         online, please contact the office(s) so that accurate information is verified.   Custody If one (1) parent has been awarded custody of the student in a divorce settlement, the parent in custody as defined in statute shall                                               inform the school in writing of any limitations in the rights of the non­custodial parent. Absent such notice, the school will presume                                           that the student may be released into the care of either parent.  Drills/Emergency Procedures: All safety drills are completed following the guidelines in the buildings’ Emergency Operations Plans in coordination with                                 the Director of Safety and Security. Examples of drills are located on page 11 of the Emergency Operations Plan.   Fire Drills In case of a fire drill, fire, or any other reason which causes mass movement of students and personnel from the building, the                                             following procedure will be used: 1.  Upon the sound of the alarm, move quickly and quietly to the indicated exits. 2.  Once outside, students will remain with their classroom teachers so that attendance can be taken. 3.  Once the drill has been completed, a signal will be given and students are to return to classes quietly. 

Tornado Drills 1.  Everyone must remain silent so that directions can be heard. 2.  Close your classroom doors. (This will decrease the amount of glass and debris that would enter the hallway in case of an actual       tornado.) 3.  Everyone is to proceed to their designated area for the drill and assume the correct position by kneeling on the floor, lowering       their head, and covering their neck and head with their hands. 4.  Students are not to be positioned near glass windows or cases. 5.  An administrator, indicating that students and teachers can return to class quietly, will give the all clear. Field Trips/ Athletic Trips Field trips will be taken for various educational purposes. Parent permission slips will be signed in advance. Students will travel by                                         school vehicles whenever possible. A field trip is an extension of the school and students are expected to behave accordingly.                                       Students will not be released to a parent from a field trip or away athletic event without prior written approval from the administration.  Gum, Food, and Drinks In order to maintain a safe and healthy school no gum chewing will be allowed in the building. Each student must be respectful                               of the school environment and follow the building rules pertaining to food, candy, and drinks.

Massillon Junior High & Intermediate Schools  2016/2017  Hall Passes Students must have a hall pass in their possession when in the hallway during instructional time. Students will surrender their hall                                         pass for review to any staff member requesting to see it. Students are required to use the school approved hallpass that indicates                                           time, date, location, provided by the classroom teacher/administration. One student should be out of the room with the pass.  Hall Traffic When walking in the halls and on the stairs, students are to walk to the right side. Running and roughhousing will not be tolerated.  Head Lice Policy Students who have head lice and/or nits will be sent home from school with instructions for proper treatment. Students who have                                         been sent home with head lice will be readmitted to school only after proper treatment has been administered by the parents or                                           guardians and the student has been examined by the school nurse.   Lockers Lockers will be assigned to each student. Students are expected to keep them neat and clean at all times. Lockers are the property                                             of the Board of Education and may be searched at any time. Lockers may be inspected by administrators or designee following                                         adopted Board Policy, under guidelines outlined by Ohio law. Lockers must be locked at all times. No permanent items may be                                         attached to lockers.    Lunch/Breakfast Breakfast and lunch is provided for all students at no cost to students/parents. Our cafeteria provides the opportunity for students to                                         buy additional items, such as a nutritionally balanced snack or additional milk. Individual "hot" lunches may also be purchased                                     daily for extra cost. The price of lunch is subject to change. We observe a closed lunch period. This means that all students are                                             expected to remain at school during the lunch period. Lunch prices will be announced at the beginning of the school year.                                         Parents/guardians may not bring in fast food items for their child to eat nor are students permitted to bring pop or energy drinks.                              Students are responsible for their own tray, plates, utensils, and disposable materials, and also for the general cleanliness of the                                       area in which they sit. Instructions of the cafeteria monitors must be followed at all times. Breakfast is served for MJHS students at                                             7:45 AM and at 8:10 AM for MIS students.  Medications A written request from a physician that is signed by a parent must be turned in before any medication can be given at school. This                                                 form is available from your physician as well as from the school office. All medication will be held in the clinic and students will report                                                 at the appropriate time to receive it. At no time should a student have any medication in their possession. Cough drops, throat                     lozenges and medicated gum may not be taken at school without parent permission. A note from the parent/guardian must be                                       approved in the clinic.Questions/concerns that pertain to the medical needs of students should be referred to the nurse of                                     MJHS/MIS.   School Pictures School pictures are taken in the fall and spring. All pictures are prepaid. Parents will receive picture information approximately two                                       weeks prior to pictures being taken. Picture dates for this year are as follows: Monday, September 26, 2016 with retakes                                       November 2, 2016. Spring pictures TBA. Spring pictures will be announced in advance of the picture date. Student athletes will                                         receive information about sports pictures from their specific coaches.

Massillon Junior High & Intermediate Schools  2016/2017   Search and Seizure The Board of Education recognizes that the privacy of students or his/her belongings may not be violated by unreasonable search                                       and seizure and directs that no student be searched without reasonable suspicion or in an unreasonable manner.  The Board acknowledges the need for in­school storage of student possessions and shall provide storage places, including desks                                   and lockers, for that purpose. Where locks are provided for such place, students may lock them against incursion by other students,                                         but in no such places shall students have such an expectation of privacy as to prevent examination by a school official. The Board                                             directs the school principals to conduct a regular search at least annually of all such storage places.    School authorities are charged with the responsibility of safeguarding the safety and well­being of the students in their care. In the                                         discharge of that responsibility, school authorities may search the person or property, including vehicles, of a student, with or without                                       the student's consent, whenever they reasonably suspect that the search is required to discover evidence of a violation of law or of                                           school rules. The extent of the search will be governed by the seriousness of the alleged infraction and the student's age. 

This authorization to search shall also apply to all situations in which the student is under the jurisdiction of the Board. 

Administrators are authorized to arrange for the use of a breath­test instrument for the purpose of determining if a student has                                         consumed an alcoholic beverage. It is not necessary for the test to determine blood­alcohol level, since the Board has established a                                         zero tolerance for alcohol use. 

Search of a student's person or intimate personal belongings shall be conducted by a person of the student's gender, in the                                         presence of another staff member of the same gender, and only in exceptional circumstances when the health or safety of the                                         student or of others is immediately threatened. 

The Board also authorizes the use of canines, trained in detecting the presence of drugs, when the Superintendent has reasonable                                       suspicion that illegal drugs may be present in a school. This means of detection shall be used only to determine the presence of                                             drugs in locker areas and other places on school property where such substances could be concealed. Canine detection must be                                       conducted in collaboration with law enforcement authorities or with organizations certified in canine detection and is not to be used                                       to search individual students unless a warrant has been obtained prior to the search. 

Except as provided below, a request for the search of a student or a student's possessions will be directed to the building principal                                             or those specifically designated, who shall seek the freely offered consent of the student to the inspection. Whenever possible, a                                       search will be conducted by the principal in the presence of the student and a staff member other than the principal. A search                                             prompted by the reasonable belief that health and safety are immediately threatened will be conducted with as much speed and                                       dispatch as may be required to protect persons and property.  The principal shall be responsible for the prompt recording in writing of each student search, including the reasons for the search;                                         information received that established the need for the search was conducted; any substances or objects found; and the disposition                                     made of them. The principal shall be responsible for the custody, control, and disposition of any illegal or dangerous substance or                                         object taken from a student.  Administrative Option: Study Room (MJHS/MIS Policy) We believe that all assignments are relevant and therefore must be completed in a timely fashion. Administrators (with teacher                                     input) may assign students to Study Room during their lunch period, where students will be given an opportunity to complete                                       incomplete homework assignments for full or partial credit. A call home will be made by the end of the day informing parents that                                             their child was assigned to Study Room for not having homework completed. Failure to report to Study Room or refusal to complete                                           8

Massillon Junior High & Intermediate Schools  2016/2017  assignments in Study Room may result in disciplinary action or the assigning of zero in the grade book. Generally, every 3 times a                                             student is assigned to Study Room in a grading period s/he will be assigned after­school detention. Office staff will notify parents                                         any time a student has been assigned after school detention for being assigned to Study Room 3 times. We believe that giving a                                             student a “zero” on any assignment should be the “grade of last resort.”   Late/Tardy to Class Policy   Late to Class (less than 5 Minutes) If a student was detained by a teacher, send the student back to that teacher for a pass. No passes will be given from the office                                                   except for ‘Tardy to School’.

Use of the Telephone The telephones in unit offices are not available for personal student use. These phones are reserved for emergencies such as                                       illness or the last minute cancellation of a school sponsored activity. Teachers may allow students to use classroom phones to                                       contact parents to bring supplies, projects and/or materials needed for class. Students who remain at school for detentions or after                                       school activities are to make transportation arrangements prior to the activity.  

Trading Cards Students are not permitted to bring trading cards to school during school hours unless permitted by administration. Examples include Pokemon, Yu­Gi­Oh!, etc.

ATTENDANCE PROCEDURES

School Attendance Policy The educational program offered by this District is predicated upon the presence of the student and requires continuity of instruction and classroom participation. Attendance shall be required of all students enrolled in the schools during the days and hours that the school is in session or during the attendance sessions to which s/he has been assigned. Regular attendance is a significant student responsibility at all grade levels.  Many studies correlate regular attendance with success in school.  Regular attendance means that the academic learning process is not interrupted, less time is spent on make­up assignments, and students benefit from participation and interaction with others in class. Attendance need not always be within the school facilities, but a student will be considered to be in attendance if present at any place where school is in session by authority of the Board.

Massillon Junior High & Intermediate Schools  2016/2017   Notification of Absence If a student will be absent, the parent/guardian must notify the school at 330.830­SICK (7425) prior to the start of the school day and                                               provide an explanation. Voicemail is available. When voicemail is reached, please record the name of the student, the person                                     calling, and the reason for the absence.    In accordance with statute, the Superintendent shall require, from the parent of each student of compulsory school age or from an                                         adult student who has been absent from school or from class for any reason, a (written) statement of the cause for such absence.                                             The Board of Education reserves the right to verify such statements and to investigate the cause of each single absence or                                         prolonged absence. When no excuse is provided, the absence will be unexcused and the student will be identified as truant for that school day. If the                                               excuse for a student’s absence is questionable or if the number of student absences is excessive, the school staff will notify the                                           parents of the need for improvement in the student’s attendance. A skipped class or part of the school day will be identified as an                                               unexcused absence and students will not be permitted to make up class work. The student will also be subject to disciplinary                                         action.   Students with a health condition that causes repeated absences must provide the principal with a written explanation of the                                     condition from a registered physician.   

Repeated infractions of Board policy on attendance may result in suspension or expulsion.

Excused Absences  The Board considers the following factors to be reasonable excuses for time missed at school: 

A.    Personal illness (a written physician's statement verifying the illness may be required). B.    Illness in the family necessitating the presence of the child. C.    Quarantine of the home. D.    Death in the family. E.    Necessary work at home due to absence or incapacity of parent(s)/guardian(s). F.    Observation or celebration of a bona fide religious holiday. G.  Out­of­State travel (up to a maximum of four (4) days per school year) to participate in a District­          approved enrichment or extracurricular activity H.   Such good cause as may be acceptable to the Superintendent. I.    Service as a precinct officer at a primary, special or general election in accordance with the program set         forth in Policy 5725. 

The Superintendent may excuse a student over fourteen (14) years of age from attendance at school for a future limited period for                                           the purpose of performing essential work directly or exclusively for his/her parents or guardians. Such excuse should not exceed five                                       (5) days and may at the discretion of the Superintendent be renewed for five (5) additional days. At no time, however, shall such                                             excuse cause a student to be absent from school for a period of more than ten (10) consecutive days. 

At the discretion of the Superintendent or his/her designee, a student may be excused for a longer period of time than ten (10) days                                               if a child's parent or guardian has recently died or become totally or partially incapacitated and there is no older brother or sister                                             living in the home who is out of school. (The Superintendent may request a certificate of a physician attesting to the physical                                           condition of the parent or guardian.)

Massillon Junior High & Intermediate Schools  2016/2017  Unexcused Absences Any student who is absent from school for all or any part of the day without a legitimate excuse (see Excused Absences) shall be                                               considered truant and the student and his/her parents shall be subject to the truancy laws of the State. Note: A parent may be                                             aware and consent to the absence, yet the absence may not be legitimate as defined above. Examples of non­legitimate,                                     unexcused absences include: unapproved vacations, oversleeping, car trouble, missing a ride, shopping, non­medical                         appointments, skip day, jobs, etc.    Truancy  A student will be considered habitually truant if the student is absent without a legitimate excuse for five (5) or more consecutive school days, for seven (7) or more school days in one (1) month, or twelve (12) or more school days in one (1) school year. 

A student will be considered chronically truant if the student is absent without a legitimate excuse for seven (7) or more consecutive                                           school days, for ten (10) or more school days in one (1) month, or for fifteen (15) or more school days in one (1) year. 

Legitimate excuses for the absence of a student who is otherwise habitually or chronically truant, include, but are not limited to:      A. The student was enrolled in another school district;      B. The student was excused from attendance in accordance with R.C. 3321.04; or      C. The student has received an age and schooling certificate.  If a student is habitually truant and the student's parent has failed to cause the student's attendance, the Board authorizes the                                         Superintendent to file a complaint with the Prosecutor of the Juvenile Court and/or to take any other appropriate intervention actions                                       as set forth in this Board's policy. 

If a student is chronically truant and the student's parent has failed to cause the student's attendance, the Board authorizes the                                         Superintendent to file a complaint with the Judge of the Juvenile Court. 

In order to address the attendance practices of a student who is habitually truant, the Board authorizes the Superintendent to take                                         any of the following intervention actions:      A.         Assign the student to a truancy intervention program.      B.  Provide counseling to the student.      C.  Request or require the student's parent to attend a parental involvement program.      D.         Request or require a parent to attend a truancy prevention mediation program.      E.         Notify the Registrar of Motor Vehicles of the student’s absence      F.         Take appropriate legal action  

The Superintendent is authorized to establish an educational program for parents of truant students which is designed to encourage                                     parents to ensure that their children attend school regularly. Any parent who does not complete the program is to be reported to law                                             enforcement authorities for parental education neglect, a fourth class misdemeanor if found guilty. 

The Superintendent shall develop administrative guidelines that:      A.  Establish  proper procedures so the student and his/her parents are provided the opportunity to challenge the             attendance  record prior to notification and that such notification complies with R.C. 3321.13 (B)(2)       B.  Establish  a school session which is in conformity with the requirements of the rules of the State Board.      C.  Govern the keeping of attendance records in accordance with the rules of the State Board      D.  Identify the habitual truant, investigate the cause(s) of his/her behavior, and consider modification of his/her             educational program to meet particular needs and interests.

Massillon Junior High & Intermediate Schools  2016/2017       E.  Provide students whose absence has been excused an opportunity to make up work they missed and receive            credit for the work, if completed.      F.  Refer for evaluation  any student who, due to a specifically identifiable physical or mental impairment, exceeds            or may exceed the District's limit on excused absence  to determine eligibility either under the Individuals with            Disabilities   Education Act (IDEA) or Section 504 of the Rehabilitation Act of 1973, or other appropriate            accommodation.  MJHS/MIS: In order to assert the importance of regular, daily attendance, the following policies are in effect for the school year: 

1. Students are permitted 8 days where a parent/guardian may call them off for excused reasons (listed under excused                                   absences) or vacation. 

2. Any absences after 8 will be considered unexcused unless the school is provided documentation from a physician. 3. The following notifications will take place when addressing unexcused absences: 

a. When a student has accumulated 5 unexcused absences, the school will notify the parent/guardian via warning                               letter. 

b. When a student has accumulated 7 unexcused absences, the school will contact the parent/guardian via                             phone/electronic automated message. 

c. When a student has accumulated 10 unexcused absences, the school will request an Informal Truancy Hearing                               through the Stark County Courts. 

d. When a student has accumulated 15 unexcused absences, the school will file truancy charges through the Stark                                 County Courts.  

Tardy to School Policy Each student is expected to be in his/her assigned location throughout the school day. A student who is not in his/her assigned                                           location by 8:00 AM (MJHS) or 8:30 AM (MIS) shall be considered tardy, until the end of first period (8:40 AM (MJHS) or 9:50 AM                                                 (MIS)). Any student arriving after first period will be marked absent for one­half day; after 11:25 AM (MJHS) or 12:00 PM (MIS),                                           the student will be marked as absent for the full day. Any student arriving late to school must report to the office to get a pass                                                   before reporting to class. Consequences for excessive tardiness are listed below. Administrative discretion may apply on case by                                   case bases.   Note: Students who ride a bus that arrives late to school should report to the office and get a pass before proceeding to class.                                               Students will not be counted tardy in this circumstance. If a teacher or the office detains a student, a pass will be issued to admit                                                 the student to class without being considered tardy.  Consequences for Excessive Tardiness to School The principal may use discretion when administering consequences for tardiness. In general, consequences for tardiness per                               semester are as follows:   

1 – 3 tardies:  No Penalty.  Parent will receive a phone call on 3rd unexcused tardy to school. 6th  tardy:  Student is assigned an after school detention and a parent meeting will be scheduled. 9th  tardy:  Student is assigned an after school detention and a mandatory parent meeting will be scheduled. 10+ tardies:  Administrative Discretion

Students may be excused for family vacations for no                                             more than 5 days per school year. Parents must complete the vacation request form from the office well in advance of the planned                                             vacation for administrative review. No vacations will be granted the week prior to and the week of mandated state testing.    Vacation Request Procedures 1. A written request must be provided to the school office by the parent/guardian at least 5 school days prior to the                date(s) requested.  This may be waived by the principal in extenuating circumstances.   2. If approved, a vacation form will be issued.  The student or parent is responsible for contacting teachers and                obtaining missed work/assignments prior to the vacation.  It is the responsibility of the teacher(s) to establish the                due date(s) for missed work/assignments.   3. Completed vacation forms must be returned to the main office before leaving on vacation  Note: Any student with excessive absences (8 or more) will not be excused for vacation. When a student accumulates 8 excused                                         days, any vacation days over this amount will be considered unexcused. Failure to submit a vacation request may result in the                                         absence being considered “unexcused.” Vacation requests will not be approved for parents/guardians of other students unless                               there are extenuating circumstances deemed appropriate and approved by the principal prior to the vacation. Doctor/Dentist Appointments Appointments should be scheduled for before or after school whenever possible. If it should become necessary to be excused from school for an appointment, a student must be signed out in the main office by a parent/guardian. Upon his/her return an excuse signed by the doctor, dentist, etc. is needed.  Under normal circumstances no more than 1/2 day will be excused for appointments.  Picking up Students We offer our students many unique and varied educational opportunities at Massillon Jr. High and Intermediate Schools. Many of                                     these opportunities may have students in areas of the building other than their regular classroom. For this reason, we request that                                         parents call the school at least 15 minutes prior to picking up their child so that we have ample time to get the student to the office.   Pickup­ID required. After drop off, cars should leave                                             using the north exit. All students must cross from the parking lot to the building using the designated crosswalk. Cars are not                                           permitted to drop off students in the bus lane, directly in front of the school.  P.M. Pick­Up: Cars will enter the north entrance and drive around to the back. Students will exit Door # 19. Please stay along the                                               curb for pick­up; we do not want students walking through the parking lot with moving traffic. Once students are picked up, cars may                                             leave using the south exit.  Going Home Sick If a student becomes ill during the school day, he/she must report to the clinic or office. The student's parent, guardian or relative                               must be notified and grant permission before the student can go home. Only the person(s) on the release form can designate who                                           may pick up and sign out the student. Students are not permitted to call from their cell phones or classroom to arrange pickup due                                               to illness.  Students must report any illness to a staff member for assistance.  School Delays/Closings School delays/closings will be announced as promptly as possible. ACADEMIC INFORMATION Absent Work When a student is absent from class, s/he can never entirely make up those planned learning experiences as well as those                                         spontaneous learning situations that are brought about by audio­visual presentations, class discussions, and hands­on activities. A                               parent may request absent work during the student’s absence. This work may be picked up, completed at home, and returned with                                         the student. Parents may call the school and request homework when their student is ill or out of school for 2 or more days.                                               Homework requested by 9:30 AM can be picked up after 2:30 PM that day. Any requests after 9:30 AM will be available for pick­up                                               the following day. Previously announced assignments, tests and quizzes must be taken or submitted upon the student's return to                                     school. No additional days will be granted for these planned activities. Upon return, it is the student’s responsibility to request                                       missed work. This work is to be completed in as many days as the student was absent (i.e. a 2 day absence allows for 2 days to                                                     make up missed assignments). Students will receive a zero (eschoolplus ‘Z’) as a grade when absent from class for any reason. A                                           grade for make­up work will replace the zero upon completion. In the event that the student does not complete the missed work, the                                             grade of zero will remain.  Academic Misconduct Academic misconduct is the unauthorized use of any source to improve academic performance (plagiarism, cheating, internet                               sources/access, falsifying or modifying documents/information). Academic misconduct may result in the student being assigned a                             zero, as well as other disciplinary consequences.  Generally, the office will document all academic misconduct infractions.  Counselors It is the goal of our guidance staff to teach students strategies and guide them toward solving their own problems. A student desiring                                             to talk with his/her guidance counselor should request a referral from a teacher or contact the counselor through the student's unit                                         office.

This program allows both parent and                                     student internet access to individual grades. New accounts and passwords will be established early in the fall and will be            available for pickup at the school. If a number is lost or misplaced, the number can be resent only when a written request from the parent is received by the student’s guidance counselor. Parents should feel free to contact the school at any time if                        they have a concern about their child's academic progress. Appointments to meet with individual teachers or teams can be made                                       through your child's guidance counselor.  Grading Scale

 Those students who achieve at an exceptional level are given special recognition at Massillon Junior High and Intermediate                                   Schools. Students earning a 3.50 ­ 4.00 grade point average will earn Honor Roll recognition. Students earning a 4.00 earn Select                                         Honor Roll recognition. 

Progress Reports/Retention Grades indicating student progress are given 4 times each year. A report card is sent home with the student at the end of each                                               grading period. Conference days are available during the first and third marking periods. Parents are encouraged to attend the                                     conferences to talk about their child's progress. 

Grades are one of the most significant factors in determining placement the following year. It is the policy of Massillon Intermediate                                         and Junior High Schools to consider retention of any student who is failing two or more of the core academic subjects. Parents will                                             receive notification that their child is in danger of retention at the end of the first semester and at the end of the third marking period.

Massillon Junior High & Intermediate Schools  2016/2017  Suspension Work When a student is suspended from school, a parent may request class work during the student’s suspension period. 

Textbooks/Fees and Fines Textbooks for classes are provided by the Board of Education. Once a book is assigned to a student, the student is responsible for                                             the book regardless of what may happen to it. We expect a reasonable amount of wear and tear on textbooks. Students will be                                             charged for lost or damaged textbooks. All books will be covered in order to decrease the normal wear and tear. In many cases                                             only a classroom set are available.  Students may sign a book out as deemed necessary by the teacher.    Families are responsible for taking care of all fees and fines in a timely manner. Students will not be permitted to participate in                                             extracurricular games and activities until all fees and fines are paid. Families who are experiencing financial difficulties should                                   contact administration. 

EXTRA­CURRICULAR ACTIVITIES Listed below are activities available to Massillon Intermediate and Junior High School students who meet eligibility requirements.                                 Students should be alert during the school year for announcements of meetings for these activities. Students may be removed from                                       these activities for violations of the student code of conduct. The student and the parent/guardian must sign an athletic code of                                         conduct form before the student may participate in any school­sponsored athletic activities. The following activities will be offered at                                     Massillon Jr. High and Intermediate Schools:

For athletic                                 teams, eligibility requires that students be enrolled at Massillon Junior High School and maintain a 1.50 GPA (Grade Point Average)                                       in ALL subjects and receive no more than one failing grade per grading period. Good citizenship at school and in the community is                                             also taken into consideration for participation.  Eligibility requirements must be maintained on a weekly basis.  

Requirements for Participation in Athletics In order to participate in any interscholastic athletic tryout, practice, scrimmage or contest, the student athlete MUST submit the                                     following (4) four forms and information: 

1. Physical Examination An official OHSAA (Ohio High School Athletic Association) Student Participation, Parental Approval and Physical                           Examination Form properly signed by a licensed physician, the student, and the legal parent or guardian must be on file in                                         the athletic office prior to participation. Athletic physicals may be provided to the student athletes of Massillon City Schools,

for a nominal charge. Any student not attending the physical date must secure a physical exam from his/her own physical                                       at his/her own expense.

2. Emergency Medical Authorization Before a student athlete may participate in any athletic activity, the parent or legal guardian shall complete an Emergency                                     Medical Authorization Form. This completed form will be kept by the head coach or athletic trainer at all practices and                                       contests and is used only in the event of any injury requiring a doctor and/or hospital attention when the parent or guardian                                           is unavailable. 

3. Insurance The Massillon Board of education requires that all athletes be insured against accident or injury before they may                                   participate. If an athlete is injured under a family insurance plan, the Insurance Waiver Form must be completed by the                                       parent or guardian and filed in the athletic office. The waiver form must include the name of the insurance company and                                         policy number. Should the athlete not be covered under a family plan, school accident insurance must be purchased                                   through the school. Insurance registration forms are available through the athletic office.  4. OHSAA Eligibility  The Ohio High School Athletic Association has guidelines for eligibility, which outlines the major rules and regulations                                 governing interscholastic athletics in Ohio, as well as a mandatory preseason video for athletes and parents. Preseason                                 information regarding player/parent code of conduct, safety, concussions, and other pertinent information is to be signed by                                 both the athlete and parent and returned prior to participation. 

STUDENT DISCIPLINE 

The Board of Education acknowledges that conduct is closely related to learning. An effective instructional program requires an                                   orderly school environment and the effectiveness of the educational program is, in part, reflected in the behavior of students. 

The Board believes that the best discipline is self­imposed and that students should learn to assume responsibility for their own                                       behavior and the consequences of their actions. The Board has zero tolerance of violent, disruptive or inappropriate behavior by                                     its students. 

The Board shall require each student of this District to adhere to the Student Code of Conduct/Student Discipline Code                           adopted by the Board and to submit to such disciplinary measures as are appropriately assigned for infraction of those rules. Such                                         rules shall require that students: 

A. conform to reasonable standards of socially acceptable behavior, B. respect the person and property of others, C. preserve the degree of order necessary to the educational program in which they are engaged, D. respect the rights of others, and E. obey constituted authority and respond to those who hold that authority. 

 The Student Code of Conduct/Student Discipline Code designates sanctions for the infractions of rules, excluding corporal                               punishment, which shall: 

A. relate in kind and degree to the infraction, B. help the student learn to take responsibility for his/her actions, and

C. be directed, where possible, to reduce the effects of any harm which may have been caused by the student's misconduct. Students may be prohibited by authorized school personnel from participating in all, or part of co­curricular and/or extra­curricular                                   activities without further notice, hearing or appeal rights. A student who has been disorderly on a school bus may be suspended                                         from transportation services consistent with Board policy and the Student Code of Conduct/Student Discipline Code. 

The Superintendent shall publish to all students and their parents the rules of this District regarding student conduct and the                                       sanctions which may be imposed for breach of those rules. 

The Superintendent shall inform the Board periodically of the methods of discipline imposed by this District and the incidence of                                       student misconduct in such degree of specificity as shall be required by the Board. 

The Superintendent, principals, and other administrators shall have the authority to assign discipline to students, subject to the                                   Student Code of Conduct/Student Discipline Code and, where required by law, to the student's due process right to notice, hearing,                                       and appeal. 

Teachers, school bus drivers, and other employees of this Board having authority over students may take such action as may be                                         necessary to control the disorderly conduct of students in all situations and in all places where such students are within the                                         jurisdiction of this Board and when such conduct interferes with the educational program of the schools or threatens the health and                                         safety of others. 

Discipline on Board vehicles shall be the responsibility of the driver on regular bus runs. When Board vehicles are used for field trips                                             and other Board activities, the teacher, coach, advisor, or other Board employee shall be responsible for student discipline. If a                                       student becomes a serious discipline problem on a vehicle, the Superintendent and/or his/her designee may suspend the                                 transportation privileges of the student providing such suspension conforms with due process. The procedures for suspension are                                 set forth in the Student Code of Conduct/Student Discipline Code and Board Policy 5611 ­ Due Process Rights. 

No student is to be detained after the close of the regular school day unless the student's parent has been contacted and informed                                             that the student will be detained. If a parent cannot be contacted, the student will be detained on another day.  MJHS/MIS teachers will employ a discipline continuum when addressing inappropriate student behavior during the school day.  The behaviors listed below are examples of conduct that would initiate an immediate referral to the office.  • Weapons  • Drugs and Alcohol • Fighting • Stealing • Threatening/Vulgar language to staff/student • Destruction of property • Gross/Blatant/extreme refusal • Repeated acts of misconduct • Violent Act of Rage • Assault

Massillon Junior High & Intermediate Schools  2016/2017  Behavior Program During the 2016­2017 school year MJHS/MIS staff will be implementing a behavior program targeting expected behaviors. The                                 behavior program revolves around four common goals which are expected of all MJHS/MIS students; BE KIND, BE SAFE, BE                                     RESPECTFUL, and BE RESPONSIBLE. Each goal has expectations clearly defined and charted so that students know exactly                                 what is expected (please refer to the charts on previous pages).  When a student’s behavior does not adhere to the established rules, the student is advised that an offense has taken place.                                         Students receive immediate verbal notification of their consequence. Consequences are generally: 1. First offense  – verbal warning from teacher 2. Second offense  – redirection from teacher 3. Third offense  – written reprimand 4. Fourth offense  – detention by teacher 5. Students accumulating 27 points or more during the school year may not be permitted to attend field trips, school dances, and other                                           special activity days. Parents may notified and a letter will be sent home when a student has accumulated 15 discipline points, as                                           well as the creation of a behavior contract with the student, teachers, administration, and parents/guardians. When a student                                   accumulates 55 or more discipline points, the student and/or parent may be required to meet with school officials to determine the                                         terms and conditions of a ‘behavior contract.’ Students with excessive points may be placed in an alternative educational                                   environment.  While in the Alternative Educational Placement, students will have the opportunity to complete academic courses.   Students will be rewarded quarterly for meeting a predetermined goal. Students that have less than the target number of                                     disciplinary points will be permitted to participate in an activity promoting positive behavior. Students that fail to meet the goal will                                         not attend the activity and will participate in character­related activities/classes during this time.  Parent/Guardian Notification Parents/Guardians will be notified via letter when their student accumulates a total of 15 and 27 points. When a student                                       accumulates 27 points, parents will receive a letter of field trip denial.

STUDENT DRESS CODE Student Dress Code The Board of Education recognizes that each student's mode of dress and grooming is a manifestation of personal style and                                       individual preference. The Board will not interfere with the right of students and their parents to make decisions regarding their                                       appearance, except when their choices interfere with the educational program of the schools.  Accordingly, the Superintendent shall establish such grooming guidelines as are necessary to promote discipline, maintain order,                               secure the safety of students, and provide a healthy environment conducive to academic purposes. Such guidelines shall prohibit                                   student dress or grooming practices which: 

A. Presents a hazard to the health or safety of the student himself/herself or to others in the school. B. Materially interferes with school work, create disorder, or disrupts the learning process. C. Cause excessive wear or damage to school property. D. Prevents the student from achieving his/her own educational objectives because of blocked vision or restricted                             

movement.  A neat, clean appearance is important to your future. A bath and use of deodorant should be a daily necessity . It is important                                             that you can form good personal grooming habits and also because other students and adults are forming opinions about you based                                         on your appearance.   Clothing in General

1. Emblems, insignias or lettering that suggest improper acts or contain obscenities, alcohol, drugs or tobacco products are                                 not permitted. 

2. Clothing with holes which expose an excessive amount of skin or are in a location on the upper legs is not permitted. 3. Body writing on exposed areas of skin, such as hands and arms is not permitted. 

Pants

1. Sagging of pants and shorts is not permitted. Undergarments may not be visible at any time (sitting, bending over, getting                                       in locker, etc.).  All pants must be worn at the waist. 

2. Pajamas and sleep pants are not permitted. 

Shorts/Skirts/Capris/Dresses 1. Length of dresses, skirts and shorts must be no shorter than 4” above the knee. 2. Spandex, body­glove shorts, and bike pants/shorts are not permitted. 

Shirts/Blouses

1. Low cut and see­through tops, halters, or midriff tops are not permitted. 2. Undergarments should not be visible.   3. Shirts, tops, and dresses without sleeves are not permitted. Shirts, tops, and dresses that come to the end of the shoulder                                         

are permitted. Tank tops, halter tops, and shirts in which the sleeves and arm pits have been cut are not permitted. Shirts                                           that expose a student’s side, back, or midriff are not permitted.  

4. Necklines should not be revealing. Shirts/tops shall not reveal bare midriff, side, or back whether sitting, standing, reaching,                                   or bending.

1. Outer apparel including jackets, coats, head coverings (ball caps, sweatbands, hats, bandanas, do­rags) gloves, and                             sunglasses must be kept in school locker during the school day. 

Jewelry and Makeup

1. Use of make­up, combs, brushes, hair picks, body sprays, lotions, powders, and cologne in the classroom, hallways, study                                   halls, or cafeteria is not permitted (such items will be confiscated).   These items are to be used only in the restrooms.  

2. Wristbands, necklaces, belts with metal spikes or studs are not permitted. Chains, key chains, decorative chains to wallets                                   are not permitted.

Shoes 1. Footwear that has rollers in the heels is not permitted. (Rollers will be confiscated.) 2. Students are not permitted to wear slippers to school. 

Since fashions and styles change so quickly, any dress code cannot speak to all possibilities. Students who violate the Student                                       Dress Code will be referred to the Principal’s Office. Attempts to secure appropriate clothing from home or borrow from the office                                         will be made. According to the discretion of the administrator in charge, students dressed inappropriately may be assigned ISC for                                       the day if appropriate attire cannot be arranged.  Repeat offenders will face more serious consequences.

STUDENT CODE OF CONDUCT Misconduct for which Suspension or Expulsion may be imposed Unless otherwise noted in the individual section, this code shall be applicable to any conduct: on school grounds, during and                                       immediately before or after school hours, on school grounds at any other time when the school is being used by a group, off                                             grounds at a school sponsored activity, function, or event, on a school bus or conveyance, or at any other time when the student is                                               subject to the authority of the school. 

Rule 1: Weapons, Dangerous Instruments, Fireworks, and Explosives a. A student shall not use, possess, handle, transmit, sell, or conceal any object that can be classified as a weapon                                       

or dangerous instrument. Weapons and dangerous instruments shall include any object, which is used or may be                                 used to inflict physical harm or property damage or to threaten to inflict such harm or damage. 

b. Students shall not possess, handle, transmit, sell, conceal, or bring upon school grounds any fireworks,                             explosives, or munitions, nor shall students ignite, explode, or detonate or attempt to ignite, explode or detonate                                 fireworks, explosives, or munitions. 

 Rule 2: Disruption of School

a. A student shall not, by use of violence, force, noise, coercion, threat, harassment, intimidation, fear, passive                               resistance, or any other conduct, cause, attempt or threaten to cause the disruption or obstruction of any lawful                                   mission, process, or function of the school. 

b. Neither shall s/he urge other students to engage in such conduct for the purpose of causing, attempting or                                   threatening to cause the disruption or obstruction of any lawful mission, process, or function of the school.

c. While this list is not intended to be all­inclusive, the following acts illustrate the kinds of misconduct                                 prohibited by this rule. 1.  Occupying any school building, school grounds, or part thereof, 2. Blocking the entrance or exit of any school building or corridor or room herein, 3. Setting fire or attempting to set fire to or damaging or attempting to damage or defacing or attempting to                                     

deface any school building or property, 4. Making, by telephone call, letter, or other means, a threat to damage or destroy any school property or to                                     

disrupt any school­sponsored or related activity, function, or event on or off school grounds, 5. Activating or attempting to activate an emergency alarm system or procedure in the absence of such                               

emergency, 6. Preventing or attempting to prevent by physical act or verbal utterance, the convening or continued                             

functioning of any school, class or activity, or any lawful school meeting or assembly on or off school                                   property, 

7. Preventing or attempting to prevent students from attending a class or any school­sponsored or                           related activity or event, 

8. Blocking pedestrian or vehicular traffic on school property or at the site of any school­sponsored or related                                   activity or event (except under the direct instruction of the principal or other authorized school personnel), 

9. Continuously and intentionally making noise or acting in a manner so as to interfere with a teacher's                                   ability to conduct a class or an extracurricular activity. 

10.  A behavior or action that affects the learning of others and creates an environment in which no learning                                   can take place. 

  Rule 3: Assault on or Abusive Language Towards Students, Staff and Others

A student shall not cause or attempt to cause physical injury or behave in such a way as could reasonably threaten to                                           cause physical injury to a school employee, authorized school visitor, or another student. 

 Rule 4: Drugs of Abuse, Counterfeit Drugs of Abuse, and Paraphernalia

Drugs of abuse are all intoxicants or other substances that could modify behavior including, but not limited to, all                                     narcotics, hallucinogens, stimulants, depressants, and alcoholic beverages. Examples include marijuana,                   amphetamines, barbiturates, glue, cocaine, PCP, beer, wine, and liquor. Counterfeit drugs of abuse include any                             substance that is directly or indirectly represented to be a drug of abuse, whether by communication, marking, labeling,                                   packaging, distribution, or similarity in shape, size, color, or price.  Use of drugs authorized by a medical prescription from a licensed physician and registered with the school office shall                                     not be considered in violation of this rule.  A student, while at school or at any school function, whether or not on school premises, shall not: 1. Possess, use, sell and offer to sell, deliver, conceal, consume, or be under the influence of any drugs of abuse                                       

including alcoholic beverages or any counterfeit drugs of abuse. 2. Instigate or conspire with others to possess, use, sell and offer to sell, deliver, conceal, consume, or be under the                                       

influence of any drugs of abuse including alcoholic beverages of any counterfeit drugs of abuse. 3. Directly or indirectly represent a substance as a drug of abuse by describing its effects as the physical or                                     

psychological effects associated with the use of a drug of abuse. 4. Possess, use, sell and offer to sell, deliver, or conceal any instrument or paraphernalia for use with drugs of                                     

abuse (for example, hypodermic needle, syringe, water pipe, roach clip).

A student, prior to the student's arrival at school or any school function, whether or not on school                                   premises, shall not use or consume any drugs of abuse including alcoholic beverages or counterfeit                             drugs of abuse. 

Rule 5: Tobacco A student shall not possess, use, transmit, or sell cigarettes or tobacco.  

  Rule 6: Truancy, Tardiness, or Skipping Class A student shall not be absent from all or any portion of the regularly scheduled classes or other mandatory activities                                       without school authorization and parental consent.  

Rule 7: Damage, Destruction, Theft, or Unauthorized Removal of School Property A student shall not cause or attempt to cause damage to school property or steal or attempt to steal school property or                                           engage in or attempt to engage in or participate in or attempt to participate in the unauthorized removal of school                                       property.  

Rule 8: Damage, Destruction, Theft, or Unauthorized Removal of Private Property a. A student shall not cause or attempt to cause damage to private property of students, teachers, school personnel,                                   

or other persons or steal or attempt to steal private property or, b. Engage or attempt to engage in or participate or attempt to participate in the unauthorized removal of private                                   

property. 

Rule 9: Arson A student shall not knowingly burn or attempt to burn any property public or private.  

     Rule 10: Trespass 

A student shall not enter upon school grounds or premises of a school building to which the student is not assigned                                         during school hours of that building; likewise, a student already under suspension shall not enter upon the grounds or                                     premises of the student's regularly assigned school building or any other school building without the express                               permission of the principal. 

 Rule 11: Dress and Appearance

A student shall not violate school rules relating to dress and appearance. Students shall attend school dressed in a                                     manner which is clean, not hazardous to their safety or the safety of others, and which does not detract from the                                         educational environment. 

 Rule 12: Profane, Vulgar, or Improper Language or Gestures

A student shall not speak or write profane, vulgar, derogatory, demeaning or other improper or inappropriate language,                                 or use profane, vulgar, or other improper or inappropriate gestures or signs or engage or attempt to engage in profane,                                       vulgar, or other improper or inappropriate actions toward any school employee, authorized school visitor, or another.  

Rule 13: Hazing A student shall not threaten, act, or participate in or attempt to threaten, act or participate in any act or acts that injure,                                             degrade, disgrace, or tends to injure, degrade, or disgrace any student.

Rule 14: Violation of School Bus Conduct Requirement a. A student shall not act or participate in any act or acts or attempt to act or participate in any act which poses or                                               

tends to pose a danger to the safe operation of a school bus or conveyance, including, but not limited to: failing to                                           remain seated; throwing objects at passengers, the driver, or out the windows; extending arms or objects out of                                   the windows; fighting; and shouting and other disorderly conduct which could cause physical harm, emotional                             stress, or diversion of the driver's attention. 

b. A student shall not ride on an unassigned school bus without prior approval of an appropriate school official. 

Rule 15: Disrespect

A student shall not act so as to intimidate, insult, or otherwise abuse, orally or in writing, any member of the school staff                                             or student body. 

 Rule 16: Forgery

A student shall not forge the writing of another or falsely use the name of another person or falsify times, dates,                                         grades, addresses, or other data on school forms or school­related correspondence. Students shall not falsely                             represent information given to a school official. 

   Rule 17: Gambling

A student shall not engage in or promote games of chance, placing of bets, or risk anything of value.  

Rule 18: Failure to Comply with Directives A student shall comply with directives, requests, and orders of teachers, student teachers, substitute teachers,                             educational aides, bus drivers, principals, or other appropriate school personnel.  

Rule 19: Failure to Accept Discipline or Punishment A student shall not refuse to accept discipline or punishment from teachers, student teachers, substitute teachers,                               educational aides, bus drivers, principals, or other appropriate school personnel.  

Rule 20: Violation of Rules A student shall not violate the policies of the Board of Education or school rules and regulations. Such policies and                                       rules and regulations will be posted on school bulletin boards. Each student is responsible for becoming familiar with                                   these items. 

Rule 21: Misconduct during Extra­Curricular Activity

A student who has been accepted or qualified for membership in a school sponsored or related extra­curricular activity                                   shall not behave in any way that disrupts or tends to interfere with the conduct of that activity and shall not violate the                                             rules, regulations, or policies that govern participation in an extracurricular activity.    

   Rule 22: Deliberate Failure to do Required Classwork

a. A student who deliberately refuses to do required work that has been assigned may have credit forfeited for a                                     course regardless of the previous marks that have been earned in the course.

b. A student with the attitude that s/he has accumulated enough grade points to pass a course and who refuses to do daily work may also forfeit credit. 

 Every case must be discussed with the principal and the parent before the incomplete "F" is assigned. Adequate time                                     for makeup work must be given after the parents have been notified. 

  Rule 23: Bullying and/or Harassment of Students, Staff, and Others

It is the policy of MJHS/MIS to maintain an education and work environment free from all forms of bullying and unlawful                                         harassment, including sexual harassment. This commitment applies to all MJHS/MIS operation, programs, and                         activities. Students shall not intentionally perform acts or cause harm (mentally, physically, or emotionally) to others.                               Students shall not direct to a school employee or employee’s family member(s) words, phrases, gestures, graffiti, etc.                                 considered slanderous, degrading in nature, obscene or profane. 

   Rule 24: Cell Phones and Electronic Devices 

Cell phones and other electronic devices are permitted on a student’s person during the school day, but should remain                                     OFF and/or in the student’s locker during the school day. A parent wishing to contact a student should do so through                                         that student's school office. Students who are using cellular phones or other electronic devices unauthorized during the                                 school day will have the device confiscated and will be subject to disciplinary consequences. Cell phones that are                                   taken will have to be retrieved by a parent. Confiscated cell phones/electronic devices may be subject to search,                                   including the device, battery, all interior hardware, and/or data. Contents found to be inappropriate and/or illegal may                                 be referred to legal authorities. The District assumes no liability if these items are broken, lost or stolen. Use of cell                                         phones/electronic devices that contain built­in camera is strictly prohibited in locker rooms and changing areas of                               Massillon City Schools ­ or at any other locker room/changing area our team(s) may be visiting for an athletic or                                       extracurricular event.  

Rule 25: Insubordination Insubordination is defined as “A student refuses to follow a staff member's directions and/or school­wide expectations                               and policies.” Students are expected to comply with the reasonable directions and expectations of the staff. Willful                                 refusal or failure to follow or comply with an appropriate direction given by a staff member, or act in defiance of staff, is                                             unacceptable. 

 Rule 26: Repeated Violations

 A student shall not repeatedly fail to comply with school rules.

Massillon Junior High & Intermediate Schools  2016/2017  Students on a bus or other authorized Board of Education transportation vehicles are under the authority of and directly responsible                                       to the bus/vehicle driver. The driver has the authority to enforce the established regulations for bus/vehicle conduct. Disorderly                                   conduct or refusal to submit to the authority of the driver will be sufficient reason for refusing transportation service to any student.  A student may be suspended from school bus/vehicle riding privileges for all or part of a school year for any violation of established                                             regulations for bus conduct and/or for conduct occurring on the bus/vehicle in violation of the Student Code of Conduct/Student                                     Discipline Code. Before a suspension from bus/vehicle riding privileges is imposed, the Superintendent or other designated District                                 personnel will provide a student with notice of an intended suspension and an opportunity to appear before the Superintendent or                                       other designated District personnel. Disciplinary suspension periods will be commensurate with the infraction(s) committed as                             determined by the Superintendent or designated District personnel. 

Any additional guidelines regarding conduct on school buses/vehicles, as well as general information about the school                               transportation program, will be made available to all parents and students and posted in a central location. 

Removal, Suspension, Expulsion and Permanent Exclusion of Students The Board of Education recognizes that exclusion from the educational program of the schools, whether by emergency removal,                                   out­of­school suspension, expulsion, or permanent exclusion is the most severe sanction that can be imposed on a student in this                                       District, and one that cannot be imposed without due process. However, the Board has zero tolerance of violent, disruptive or                                       inappropriate behavior by its students. 

No student is to be removed, suspended out­of­school, expelled and/or permanently excluded unless his/her behavior represents                               misconduct as specified in the Student Code of Conduct/Student Discipline Code approved by the Board. The Code shall also                                     specify the procedures to be followed by school officials when implementing such discipline. In addition to the procedural                                   safeguards and definitions set forth in this policy and the student/parent handbook, additional procedures and considerations shall                                 apply to students identified as disabled under the IDEA, ADA, and/or Section 504 of the Rehabilitation Act of 1973. [See Policy                                         2465, "Suspension/Expulsion of Disabled Students."] 

Students may be subject to discipline for violation of the Student Code of Conduct/Student Discipline Code even if that conduct                                       occurs on property not owned or controlled by the Board but where such conduct is connected to activities or incidents that have                                           occurred on property owned or controlled by the Board, or conduct that, regardless of where it occurs, is directed at a District official                                             or employee, or the property of such official or employee. 

For purposes of this policy and the Student Code of Conduct/Student Discipline Code, the following shall apply: ● “Emergency removal" shall be the exclusion of a student who poses a continuing danger to District property or persons in                                       

the District or whose behavior presents an on­going threat of disrupting the educational process provided by the District.                                   [See Policy 5610.03 "Emergency Removal"] 

● "Suspension" shall be the temporary exclusion of a student by the Superintendent, principal, assistant principal, or any                                 other administrator from the District's instructional program for a period not to exceed ten (10) school days. Suspension                                   may extend beyond the current school year, if at the time a suspension is imposed, fewer than ten (10) days remain in the                                             school year The Superintendent may apply any or all of the period of suspension to the following year. The procedures for                                         suspension are set forth in the Student Code of Conduct/Student Discipline Code and Board Policy 5611 "Due Process                                   Rights". 

● "Expulsion" shall be the exclusion of a student from the schools of this District for a period not to exceed the greater of                                             eighty (80) school days or the number of school days remaining in a semester or term in which the incident that gives rise                                             to the expulsion takes place or for one (1) year as specifically provided in this policy and the Student Code of

Conduct/Student Discipline Code. Only the Superintendent may expel a student. The procedures for expulsion are set forth                                 in the Student Code of Conduct/Student Discipline Code and Board Policy 5611 "Due Process Rights". 

 Unless a student is permanently excluded from school, the Superintendent may expel a student from school for a period of one (1)                                           year for bringing a firearm or knife to a school building or on to any other property (including a school vehicle) owned, controlled, or                                               operated by the Board, to an interscholastic competition, an extracurricular event, or to any other school program or activity that is                                         not located in a school or on property that is owned or controlled by the Board, except that the Superintendent may reduce this                                             punishment on a case­by­case basis in accordance with this policy. Similarly, the Superintendent may expel a student from school                                     for a period of one (1) year for possessing a firearm or knife at school or on any other property (including a school vehicle) owned,                                                 controlled, or operated by the Board, at interscholastic competition, an extracurricular event, or at any other school program or                                     activity that is not located in a school or on property that is owned or controlled by the Board, except the Superintendent may reduce                                               this punishment on a case­by­case basis in accordance with this policy. The expulsion may extend, as necessary, into the school                                       year following the school year in which the incident that gives rise to the expulsion takes place. The Superintendent shall refer any                                           student expelled for bringing a firearm (as defined in 18 U.S.C. 92(l)(a)(3)) or weapon to school to the criminal justice or juvenile                                           delinquency system serving the District. 

A firearm is defined as any weapon, including a starter gun, which will or is designed to or may readily be converted to expel a                                                 projectile, the frame or receiver of any such weapon, any firearm muffler or silencer, or any destructive device. A destructive device                                         includes, but is not limited to, any explosive, incendiary or poison gas, bomb, grenade, rocket having a propellant charge of more                                         than four (4) ounces, missile having an explosive or incendiary charge of more than one­quarter ounce, mine, or other similar                                       device. A firearm is also defined as a "look­alike" weapon that is indistinguishable from a firearm to include b­b guns. A knife is defined as any weapon or cutting instrument consisting of a blade fastened to a handle; a razor blade; or any similar                                               device (including sharp, metal martial arts weapons such a ninja throwing stars) that is used for, or is readily capable of, causing                                           death or serious bodily injury.  The Superintendent may expel the student for a period of up to one (1) year. The Superintendent may extend the expulsion into the                                             next school year or reduce the expulsion as necessary on a case­by­case basis.    Due Process Rights The Board of Education recognizes that students waive certain constitutional rights, regarding their education.  Student subject to suspension When the Superintendent, principal, or other administrator is considering a student for an out­of­school suspension, the student will                                   be informed in writing of the potential suspension and the reasons for the proposed action. The student will be provided an                                         opportunity for an informal hearing to challenge the reason for the intended suspension and to explain his/her actions. An attempt                                       will be made to notify parents or guardians by telephone if a suspension is issued.  Within one (1) school day of the suspension the Superintendent, principal, or other administrator will notify the parents, guardians, or                                       custodians of the student and the Treasurer of the Board. The notice will include the reasons for the suspension and the right of the                                               student, parent, guardian, or custodian to appeal to the Board or its designee; the right to be represented at the appeal; and the right                                               to request the hearing be held in executive session if before the Board. If the offense is one for which the District may seek                                               permanent exclusion, then the notice will contain that information.

Notice of intent to                                       appeal must be filed within ten (10) school days of the Superintendent's decision to expel to the Board directly or through the                                           Superintendent's office.  Appeal of Expulsion to the Board A student who is eighteen (18) or older or a student's parent(s) or guardian(s) may appeal the expulsion by the Superintendent to                                           the Board or its designee. The procedure to pursue such appeal will be in accordance with regulations approved by the Superintendent.                                     Notice of intent to appeal must be filed within ten (10) school days of the Superintendent's decision to expel to the Board directly or                                               through the Superintendent's office.  While a hearing before the Board may occur in executive session, the Board must act in public.  Weapons The Board of Education prohibits students from possessing, storing, making, or using a weapon in any setting that is under the                                         control and supervision of the Board for the purpose of school activities approved and authorized by the Board including, but not                                         limited to, property leased, owned, or contracted for by the Board, a school­sponsored event, or in a Board­owned vehicle.  The term "weapon" means any object which, in the manner in which it is used, is intended to be used, or is represented, is capable                                                 of inflicting serious bodily harm or property damage, as well as endangering the health and safety of persons. Weapons include, but                                         are not limited to, firearms, guns of any type whatsoever, including air and gas­powered guns (whether loaded or unloaded), knives,                                       razors, clubs, electric weapons, metallic knuckles, martial arts weapons, ammunition, and explosives. 

Policy exceptions include: ● Items pre­approved by the building principal as part of a class or individual presentation under adult supervision, if used for                                       

the purpose and in the manner approved (working firearms and any ammunition will never be approved as a part of a                                         presentation); 

● Theatrical props used in appropriate settings.

Massillon Junior High & Intermediate Schools  2016/2017  The teachers and students of MJHS/MIS have the obligation and right to teach and learn in a safe, positive, and orderly                                         environment. Teachers institute a discipline plan for their classroom that clearly states rules/expectations to be followed and                                 consequences for infractions.  Students are expected to adhere to posted classroom expectations.  Lunch Detention Students will arrive prior to the tardy bell ringing with school­related materials and work where they will complete an assigned task.  Community Service Students can be requested to perform acts of community service as part of the discipline plan. These acts must have approval of                                           the parent and the principal. It is the responsibility of the student to have these acts verified in writing by a person in charge of this                                                   community organization.  After­School Detention Detentions will take place in an assigned area on a specified day. MJHS detention will be from 2:45 to 3:30 and MIS detention will                                               be from 3:15 – 4:15. Students are responsible for and required to bring schoolwork or reading materials. Students may be                                       assigned work by the school such as character education­related work. Students and families must arrange transportation home                                 from detention. Transportation problems are not considered acceptable reasons for missing a detention. Students serving an                               after­school detention will be available for pick­up in front of door 2 (MJHS) and door 31 (MIS).  Improving School Choices (ISC) Students may be assigned to ISC for repeated offenses or major offenses. While in ISC students will be required to complete the                                           following tasks: academic course work assigned by teachers, online curriculum­based lessons, reflective assignments, and other                             school related assignments as required by MJHS/MIS administration.   Alternative Educational Placement (TIER III Support) Students may be placed in an Alternative Education Placement for behavior related offenses for an indefinite period of time. While                                       in the Alternative Educational Placement, students will be required to complete all academic courses, related character education                                 assignments and study skills activities. Students may earn the opportunity to be moved out of the Alternative Educational                                   Placement setting.
