"I just spoke with a guy from Dixon, Billy Null, who was complaining about his neighbor who burns debris from home demolitions he does as a side job. They’re burning the debris about 30-40 feet from his house and about 80 feet from the neighbor’s property. But they’ve been burning the debris at night and all the ash is covering the neighbor’s (concerned party) property. The responsible party is named Randy Rule and his address is 12769 Highway N, Dixon, MO 65459. Let me know if there is anything else I can help you with. If you need to reach Billy Null, is number is 573-528-7648."

Concern Info

I investigated this concern on 8/23/19. There was no one home at the time of investigation. A burn site was observed with recently added construction/demolition waste it appeared. I left PUB 02047 'Facts on Open Burning Under Missouri Regulations' at the mailbox.

On 8/27/19, the CP called and he stated the neighbor does demo jobs on the side and brings the debris back to his residence to burn. He's not worried about him taking jobs from him, as CP is also a demo contractor, but the burning causes black smoke into his neighboring residence.

On 8/29/19, I attempted to investigate the concern a second time. There was no one at the residence at the time of investigation and the burn site appeared the same.

On 9/4/19, a letter was mailed to Mr. Rule informing him of the open burning regulation. The letter also included an Open Burning Fact sheet.

A letter will be mailed to the RP to make sure he is aware of the open burning regulations.

Concern No. 40184 A metal recycler at the end of Twitty Drive in Rolla, Missouri has a bunch of chemicals outside and the odors were very caustic in nature to the point of significant irritation.

I investigated this concern on September 12, 2019 and met with an employee of Catalytic Innovations. I discussed the odor concern and walked around the premises. There were no major odors of concern at the time of investigation. Shop doors were open and I couldn't smell anything until almost walking into the shop area of the building. There was an ammonia smell but not of major concern. Ammonia and reactors are stored inside the building. Some dry storage is outside and product is in the tank farm next to the building.

This business is the last building at the end of Twitty Drive in Rolla. There are no close businesses or residents. Anonymous concern.

Concern No. 39814 CP called concerned about chicken litter that has been piling up on a neighboring farm. According to CP, the odor is unbearable and the piles just keep getting bigger. CP said that the RP had told the sheriff that it was an accidental dump, but CP has seen this dumping happen several times in the past month. CP said that the litter is supposedly coming from a farm in Arkansas and is concerned about that as well. CP also said that the litter pile is positioned so that when it rains it will run into the creek.

I told CP that there is not a whole lot we can do about chicken litter except make sure it does not enter the waterways. We can give guidance and recommendation to the farmer, but we can't force them to do much. I recommended that the CP contact the Department of Agriculture about the litter crossing state border since we don't regulate that. I also told the CP that I would give the odor information to our Air Pollution unit, but I told her that they may not be able to do much either. CPsaid that she has already had a Platte County Sheriff Deputy speak with the farmer, but the deputy was unable to do much. The Platte County Sheriff Deputy that was handling the CP's case is Catherine Brown. The case # is 192919. CP recommended calling the deputy if we needed more information about the RP.

After visiting the site I found there to be no manure anywhere. All nearby stream banks were completely dried up and not contributing to WOTS incursions.

Concern No. 40058 Caller reports he can currently see a plum of dust over the quarry (Thursday, August 29, 2019, at 2:30 p.m.). The plum was readily visible from Highway 69. Caller claims he can barely see across Cameron Road from his house due to the dust.

Concern No. 40162 CP says neighbor, Austin Berg, is burning prohibited materials such as plastic, rubber, medicine bottles, etc. and it makes an awful smell. CP has called the fire department many times but it is difficult to get them to come out because the Ray County Sheriff's office won't send anyone with them.

He said the Lawson Fire Department did come out this past Saturday (9/7/19) and put out the fire and told Mr. Berg he couldn't burn those items. A report should be available from the Lawson Fire Chief. CP says the neighbor was burning again the next day anyway.

Mr. Berg does not own the property. The property is on the southwest corner of Bailey and Elmo St. There is a trailer home and 2 camping trailers on the property, and Mr. Berg stays in the camper 3-4 days a week.

Concern No. 40199 CP reports that we investigated an individual a few years ago out on O Hwy for open burning. He has moved his location to 169 Hwy (north of Trimble; south of State Route Z) and has started burning again. This morning the smoke was so bad that is was drifting across 169 and making it difficult to see.

Burning usually occurs 2 - 3 times a month, starting around 7:30 a.m. and getting done by around noon.

The RP brings in junk and burns it. What doesn't burn is taken off for recycling.

CP did not know who the RP is, but I was able to find the previous concerns to populate the information. Previous concern listed RP as Tyson Dezling; but information from the business listing on the Secretary of State's website suggests the last name is actually Devling. On the articles of organization, Mr. Devling's address is listed as 2789 SW 169 Highway, Trimble MO 64492. Using street view in Google Earth, I saw a sign in the yard that has the same phone number from the previous concerns (816-985-5959).

Concern No. 40252 On September 4, 2019, I received a call alleging that Mr. Kyle Koeller is salvaging cars on his property in the Monsees Lake Development. According to the caller, Mr. Koeller is parking cars right next to the lake and draining fluids onto the shore and into the water. The caller stated that Mr. Koeller has less than 50 cars on site, but that he is salvaging the vehicles. The caller states that Mr. Koeller is draining vehicle fluids on the ground and into the lake intentionally. The caller also stated that Mr. Koeller has a burn barrel and is burning the plastic off of copper wire for scrap metal.

During previous communications with the maintenance director, Jamie Armontrout on July 17, 2019, it was stated that floor tile removal had not begun and that if the sample test showed asbestos the project would be moved to next year for funding reasons. At that time he agreed to provide a copy of the asbestos report, but has not done so yet (as of August 16, 2019).

Concern No. 40001 Caller reports that Harvey Gifford empties freon/refrigerant from vehicles into the air; gasoline, diesel and transmission fluid out of vehicles onto the ground; as well as pressure washing wastes. He primarily does this in the main shop (first building you come to, on the NE corner of the 3 shop buildings) but it also occurs throughout the junkyard. Caller reports the main shop has floor drains that drain to a main drain down the middle of the building which drains outside underground. Caller reports the drains do not have an oil catch. The pressure washing occurs on inside (engine)/outside of vehicles in wash bays inside that goes to the floor drains also.

Caller also reports burning of garbage started with old oil. Burning occurs in an old truck cab and oil for the burning is stored in an old box off of a moving truck. The oil is in jugs and the floor of the moving truck box is rusted and in poor condition. Burning occurs down the lane to the south, on the NW corner of the very large horse barn (situated just NW of Mr. Gifford's house onsite).

Start of demolition activity was assumed to have begun on 09/09/2019, with one of the six homes have already been partially demolished.

I spoke with Mr. Richard Goode, Charleston City Manager, who stated that the Rocking Chair building had been out of commission for about 18 months because of a partial roof collapse and subsequent water damage. There had also been a big storm with 70 mile per hour winds one Friday in June.

I noted probable storm damage of occupied buildings. Some of the vacant buildings are in a state of disrepair. This includes The Russell building and the Theater McCutchen. The Russell building windows and parts of a wall missing. The McCutchen has apparent roof problems. I noted an additional building that no longer had a roof but was just four standing walls.

The Missouri Department of Natural Resources' Air Pollution Control Program has the delegated authority to enforce Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos. Subpart M regulates renovation, demolition, and disposal activities that involve asbestos-containing materials. However, each of these activities are defined by what people are doing and not what people have failed to do. In other words failure to conduct routine repair and maintenance causing a building to collapse is not regulated by Subpart M; but a resulting cleanup of the demolition debris would be regulated.

I plan to be in Crawford County for an inspection of the nearby landfill during the first part of October. At that time I will stop by this location for a follow-up visit.

This school building was inspected for the presence of asbestos on March 21, 2019, by Terracon Consultants, Inc., notified as an abatement project to Missouri Department of Natural Resources on June 26, 2019, and abated of asbestos by Midwest Service Group as project A7918-2019 beginning on July 11, 2019. This abatement project by Midwest Service Group was inspected on July 11, 2019, by the Southeast Regional Office of Missouri Department of Natural Resources. The demolition project was notified to Missouri Department of Natural Resources and assigned the project number D9991-2019. Kevin Williams is the demolition contractor. Since the asbestos has been removed, it is no longer an issue for this demolition project. The pertinent part of this concern becomes dust crossing property lines, however, while this is a dusty time of year the dust generated by the demolition was not seen to be crossing property lines at the time of this project. The East Prairie Junior High School was contacted told of this concern and it was recommended that they consider the application of water to the dusty area(s) of this demolition project. However, no violation of 10 Code of State Regulations 10-6.170 Restriction of Particulate Matter to the Ambient Air Beyond the Premises of Origin since dust (particulate matter) was not leaving the property.

Concern No. 40467 Dixon ?Councilwoman called with concerns on open burning of a resident named Randy Roberson near the alleyway of his residence at the NE corner of E 4th & Pearl in Dixon.

Burn pile consists of vegetative waste with construction and demolition wastes included in the pile. Waste came from the house which burned before this.

The pile is less than 200 yards from the properly line (within 15 ft according the the Councilwoman) and is about 2 ft tall x 5 ft long and 25 ft wide. RP used about 5 gallons of gasoline to start the fire. The fire caused problems for nearby residents.

The CP mentioned that they did not get approval from neighbors but asked the fire marshall. CP said the name of the fire marshall is Dennis Lacowitz.

CP said the council wants a call back regarding this case as they are voicing concern of the residents.

9-11: I contacted Dixon Councilwoman Diane Shultz and she stated that she was not sure if the city would enforce their city ordinances that prohibit open burning of demolition waste. A city official was involved in allowing the demolition wastes to be burned. She is aware that state law prohibits burning of demolition wastes.

I explained to her that it is routine for our office to ask any incorporated area to enforce their ordinances. We can become involved if for some reason the applicable ordinances will not be locally enforced.

Diane Shultz stated that she would contact me if the city was not able to enforce their ordinances.No further action necessary at this time.

On Wednesday, September 11, 2019 I spoke to Kevin Knight with Smith and Company Engineers. Mr. Knights team is remediating the site of the Sinclair Terminal Facility in New Madrid. This facility was a gasoline and diesel terminal. This terminal closed over 25 years ago. There are monitoring wells on site for the remediation. Mr. Knight informed me they were working at the facility on Monday and Tuesday (9/9-10) pumping the wells and taking samples. They did not have any type of flame or open burning equipment at the site.

On Friday, September 13, 2019 I spoke with Chris Veit, Hazardous Waste remediation unit about this issue. Chis informed me Smith and Company have a remediation plan in place and are implementing the plan. They do not have any plans for a flame or open burning of any fuel at the site.

On Monday Mr. Jesse Evans, Environmental Specialist I and I investigated the concern from Mr. Pfuehler. Mr. Pfuehler was not home at the time of the investigation. I called Mr. Pfuehler to request permission to enter his property yard and observe his truck. Mr. Pfuehler gave permission to us. We observed his truck and yard.

The truck was covered in black spots. The black spots did not appear to be sticky or could not be removed by rubbing. The vegetation had some spots and also could not be removed by rubbing. The origin of the spots is unknown. There has not been any rainfall for over 25 days.

I spoke to the neighbor across the street from Mr. Pfuehlers home and she informed me she has not observed any open burning occurring nor has she had any black spots on her property, cars, or yard.

I did not observe any activity at the Sinclair site. I did not find any evidence of open burning occurring at the site.

Concern No. 40105 Concerned party stated that they often find ashes accumulated on their vehicles from the nearby animal cremation facility. Have washed vehicles, parked, them, and found ashes the next morning. Have seen ashes falling from the sky on several occasions early in the morning. Concerned party explained that they have lived on the property since 2002 and that the ashes have not been an issue until this year. Said that they know the owners, the Foys, and that the son Tommy recently took over. The concerned party suspects that the son is burning trash in paper in the incinerators.

Concern Info

Animal Care Service operates under several construction permits, limiting opacity to 10%. A compliance inspection was recently conducted on May 31, 2019, and no violations were found.

I visited the site on Thursday afternoon, 8/22 and again on Friday morning, 8/23. During both visits, the plant was emitting only a very small amount (<5% opacity). I spoke with Mr. Callahan on the phone and again during my Friday morning visit. I explained to Mr. Callahan that the fugitive emissions regulations do not apply to emissions that are vented out of a stack, so finding ash accumulated off site would not warrant a violation. I told him that we would need to observe an opacity greater than 10% to issue a violation. Mr. Callahan told me that since he called, the facility has not been emitting nearly as much as before. I told him that if he observes a significant amount of smoke coming from the stacks, to report another concern.

I called and spoke with Mr. Tom Foy Jr. on 8/27/19 and informed him of the concern and subsequent investigation. Mr. Foy said that a neighbor to the west of the facility burns trash occasionally, which was likely the cause of any foul odor. He assured me that he follows proper operation and maintenance procedures for the incinerators and never sees high opacity, except for the rare occasion when they are undergoing maintenance. I explained to Mr. Foy that as long as the facility keeps opacity and odor low, the facility would not be receiving violations for these types of concerns, but that we would continue to investigate each instance.

The trailer bakes in the sun all day, and the smell has been absolutely terrible. There have been many days where we could actually smell the manure inside our house. Walking outside, the smell can be overwhelming some days and literally makes you feel nauseous. He was asked to please wash out the trailer because of the smell. My father in law is 74 years old and has beaten cancer twice. My mother in law is 72 and had open heart surgery a couple years ago and now has a pacemaker/defibrillator. They don't need this level of stress. They enjoy sitting outside on the evenings, and they cannot because of the smell. We enjoy taking our dogs for walks around the pond in the evenings, and there are some days where the smell is just too strong. Apparently, Sam decided he didn't care if the smell was bothering us because he continued to not wash his trailer. My father-in-law, Jim Day, who lives at 508 S Highway 19 New Florence, MO 63363, called the sheriff's department and they came out and observed the strong smell. They made contact with Sam and Daniel Malloy. This angered Sam Malloy and he went around town (it's a small town), and said "Well, if Jim Day doesn't like the smell of pig manure (he used a more colorful word), then I am going to get my skid loader and dump of big pile of cow manure next to the fence just for him to smell." Well, he kept his word and a couple days ago, he dumped a big pile of manure next to the fence. Again, the sheriff was called. They made contact with Sam and Daniel. Sam Malloy said that he has a license to "sell" manure. My in-laws, Jim and Linda Day, have lived on this property for over 30 years, and Sam and Daniel Malloy have never sold manure from that property. The large pile of manure is 10 feet, maybe less, from our property line and fairly close to our pond. The pile sits uphill from our pond. We are concerned not only about the smell but also of manure running into our pond when it rains. We had a very, very hard rain here last night. We'd rather our pond not become contaminated. 8/29: Discussed with Air unit how we would go about the concern. Tom Sims, the environmental supervisor for the air unit, and he stated that he spoke with the property owner who stated he was using the manure as compost fertilizer for his garden he was putting in next season. Tom told him that, if this were true, he would have an agricultural exemption for permit requirements.

The department does not have any regulatory authority over private ponds and the manure was not getting into the creek either.

Left a message stating we have no regulatory authority over these issues and left the office phone number and my name telling him to call me back if he has questions or concerns.

8/30: Mr. Day called and asked why the state had not been out to the manure pile yet. I asked if he had gotten our message and he stated that the number we called and left messages on were his sons phone. I re-explained that we did not have regulatory authority and he stated that the county told the property owner that he needed to obtain county permits that he did not have. I recommended he call the city and asked them about the permit requirements they have for his neighbor.

I explained that under Missouri Open Burning rules, which were updated in May, burning of household trash (including plastic waste) is allowable as long as the materials are burned on the property they are generated on. However, Jefferson County has local ordinances that restrict the open burning of solid waste. I gave her the number for the Jefferson County Dept. of County Services and Code Enforcement, Div. of Solid Waste (636-797-5036) and told her to report the concern here for investigation and enforcement.

I called Mr. Sam Malloy at 636-237-3287 at approximately 9 AM on 8-27-19 about the concern. He said that he parks his trailer about 75 to 100 feet north of the fence line with the neighbor and his current protocol is to wash out the manure from trailer after every two livestock deliveries. Mr. Malloy said he hasn't changed any operations since he has been parking his truck on the site, which will be for 5 years in November. I asked about the manure pile dumped near the fence next to his neighbor to the south. He said that it was about 10 to 12 cubic yards of compost that he will be using to start a garden as a part of the plan to open a roadside fruit and vegetable stand. He said that he still needed to clear a couple of trees but planned to incorporate the compost into the garden this Fall and that the compost shouldn't smell that much since it had been composting about 6 months prior to it being transported there. He said the compost was a mixture of mainly corn stalks and cow manure. I then informed Mr. Malloy that, for his information, although the MACC odor rule exempts odors related to raising crops, dumping a pile of manure out of vindictiveness would not be covered by this exemption. Mr. Malloy said that the contour of the land where the compost pile is located directs any runoff away from the neighbor's pond, adding that there is sort of a ridge at the fence line with his neighbor to the south.

I left a voicemail message for Mr. Jim Day at 636-297-4953 with my return call number at about 10:37 a.m. on 8-27-19.

Concern No. 40153 The caller (Ms. Carol Cubulka) called at about 8:30 Am today. She stated Mr. Anthony Glover residing next to her residence house on the other side of the street is open burning trees. Mr. Glover puts trees and shrubs he cleared to build a house. He lights the pile and leaves the area. The fire is unattended .It is in a wooded area and fire could easily go out of control. She told me that they are recording on video as it happens.

She contacted the High Ridge Fire Department. Mr. Robert Jaycox the deputy fire marshal told her that it is legal to open burn in our state and there is nothing he can do to stop the fire other than put fire out if they believe it is going to be out of control or a fire hazard. I called the fire department and talked to Fire Marshal Ron Tisius. He told me that he is aware of the situation. He has already sent two of his officers to put out the fire. But the person continues to burn again and again. The Fire Marshal told me that he has no regulation or ordinance he can use to prevent these kinds burnings in the open. All he can do is put out the fire if determined to be a fire hazard.

In Missouri, open burning of tree trunks, tree limbs, and vegetation from land clearing operations is allowed without an air curtain incinerator if the burning takes place outside the city limits and is greater than 200 yards from the nearest occupied structure. The location is not in the city limits. There are no requirements if noncommercial.

I called Ms. Cubulka at about 3 PM and told her that the fire marshal is following the situation closely to make sure things do not get out of control. I also indicated to her that the MoDNR no longer issues permits for open burn where conditions were imposed to prevent air pollution. Ms. Cubulka told me that she and her husband might consider going away from the area and stay in their RV until the burning is completed.

Fire Marshal Ron Tisius called me at 4:15PM on August 4, 2019. He told me that after he visited the site this afternoon, the Fire Department decided to instruct Mr. Glover to stop the open burning at this location. They called a contractor to put the fire out and haul away all the leftover wood burned or unburned. I called Ms. Cubulka and left a message and let her know that the fire will be no more and the Fire Department is not going to allow the open burning at this location.

"Since April 2014, my family and I have been residents at the Lofts at Lafayette Square (Lofts) in St. Louis, MO (1119 Mississippi Ave.).

From April 2014 to May 2019, the Lofts’ property management company acted in ways that never made us fear for our health and safety. In fact, they consistently notified us of ongoing routine building operations such as fire alarm tests. I do not recall, and was not able to find any report of an asbestos, mold, or other hazardous waste issue in the Lofts during this time.

In May 2019, 2B Residential (2B) took over as the Lofts’ property manager. 2B is a division of Balke Brown Transwestern. 2B’s personnel have engaged in multiple deceptive practices against Lofts occupants which, while not relevant to this complaint, have shown occupants that 2B personnel see them at best with indifference, and, at worst, with contempt.

Through discussions with and evidence gathered from other occupants, I have learned that 2B’s personnel have:

1. Risked or actually caused harm to the health and safety of Lofts occupants:a. St. Louis City personnel confirmed that 2B personnel disturbed asbestos in at least two units:i. 2B personnel failed to provide immediate notice to occupants of the existence of disturbed asbestos or the location

thereof prior to beginning cleanup efforts. ii. As a result, it is currently unknown when the disturbance occurred, how much was spread, how much occupants

breathed, and how long 2B waited to begin cleanup efforts.b. Placed or allowed to be placed in front of the Lofts for multiple days a open container of asbestos debris that, at least for

a time, included visible uncovered debris:i. 2B personnel failed to provide immediate notice and warnings to occupants or neighborhood residents of the contents of

the container and the health risks of getting in the area of the container without respiratory equipment and protective clothing.ii. As a result, the extent of the risks or actual harm caused by leaving an open container of asbestos debris next to a

On 9/9/19, I investigated the above concern.

I reviewed our asbestos notifications and found courtesy notification C-19-3150 (Attachment #1), submitted 8-6-19 by BlueSky Restoration Contractors for the cleaning of asbestos debris from the Lofts, Unit 316. Attached was air sampling and bulk sampling data and an e-mail chain that determined the abatement was below regulated threshold, meaning that only a courtesy notification was required. From this, and my conversation with Denise Krager (outlined later) I put together a timeline of events:

Early July: carpet was replaced in Unit 416. The hammering of tack strips shook the floors and disturbed the ceiling of the unit below, Unit 316, causing white powder to fall.

7/19/19: Air sampling was conducted by Environmental Consultants, LLC in and outside of Units 416 and 316. The air sampling was conducted by Jeffry M. Faust, Missouri Certified Air Sampling Professional MOAS2705. Airborne asbestos fibers were identified in Unit 316. No fibers were detected in Unit 416 or in the hallway outside of either room. A bulk sample of debris in Unit 316 was sampled and found to contain 3% chrysotile asbestos.

8/6/19: An abatement notification was submitted to the Department of Natural Resources. The project was to clean up asbestos dust in Unit 316 with hepa vac, negative air machine, and wet wipes. The carpet in the unit was to be removed and critical barriers would be established. It was determined that only the asbestos debris from the ceiling was considered RACM, and since it was under 35 cubic feet, this was not a regulated project. The abatement notification was filed as a courtesy notification.

8/29/19 (approximate date): The cleaning of Unit 316 was completed.

9/9/19: Hani Hamzeh, environmental engineer, drove by the property. He reported that the dumpster and environmental remediation truck, seen in photos sent by the concerned party, were no longer at the site.

9/9/19: I called and spoke with Denise Krager, Community Manager. I explained that issues identified in the concern. I gathered more information about the timeline of events and the activity that caused the debris to fall. Ms. Krager explained that they were looking at options to cover/encapsulate the ceiling material, so that it does not fall and cause exposure risks in the future. Ms. Krager also told me that the material in the photographed dumpster was contained in plastic bags. I confirmed with Ms. Krager that each unit has an isolated HVAC system. I confirmed that the references to Units 314 and 414 in the asbestos inspection were errors; they should be 316 and 416. I recommended having an asbestos inspection conducted on the entire building

to determine the severity and scope of the problem. I explained the threshold quantities for regulated asbestos abatement projects, and the requirements attached. I also explained that the City of St. Louis would be running their own asbestos program starting October 1st, that would be stricter than state requirements, and to make sure to contact the city program before doing any future renovations. I recommended that tenants be told ahead of time of asbestos projects in the building, as there are a lot of fears and misconceptions surrounding asbestos.

9/9/19: I called and spoke with the concerned party. I explained the timeline of events and my conversation with Ms. Krager. I explained that since this was not a regulated activity, due to the amount of RACM being below threshold quantities, that our state NESHAP requirements did not apply. I explained that the city's requirements would be stricter and to contact the city for future concerns. I reassured Mr. Hodge that the air sampling around the contaminated room was negative, and that each unit was isolated, but that I understood his concerns. I recommended that he be cautious with the ceilings to his unit and watch for and report any falling debris.

It sounds like there is some construction going on in her neighborhood (Briarwood Lake Estates,approximately 100 homes) that included the removal of a bridge, which served at the primary entrance, and the construction of a gravel road on the back side of the neighborhood to serve as a temporary entrance. She stated the road dust from the gravel road is so bad that visibility is very limited, the dust is getting into their house, coating their trees and plants to extent plants are dying, and she and her husband have also been to the doctor who indicated their illness was due to dustexposure.

Concern No. 40006 ADM Deerfield - soybeans rotted in the silos and the company has removed the rotten soybeans and placed them on the ground. The beans have been piled on the ground for at least 6 months and the odor is horrendous as well as the run-off causing a water pollution issue. There are creeks near the facility and caller is concerned that the stormwater is causing an impact to the creek.

Evaporation ponds have not been evaporating, ponds are overfilling. Trucks are contantly running to send black water to Fort Scott but the ponds are still overfilling. Caller is concerned that with the amount of rain these ponds are causing an impact to the creek.

As for odors, it is not consistent and although it is not bad today, it may be tomorrow. Caller lives 1 mile NE of plant and stated that the SW prevailing winds will bring the odors to his home. He is aware that there may not be an odor violation but wishes for us to check to see if the odors are at violation level.

Caller Wants a call back!!

He is insistent that he be informed of the results of this issue and is very concerned that the facility is a large company and would be allowed to pollute due to the size and dollars in relation to the company. I assured him that we do not consider the size or the money involved that we are only concerned with the environment and making sure we can help the facility to rectify the issue.

Concern No. 40017 ADM Deerfield - soybeans rotted in the silos and the company has removed the rotten soybeans and placed them on the ground. The beans have been piled on the ground for at least 6 months and the odor is horrendous as well as the run-off causing a water pollution issue. There are creeks near the facility and caller is concerned that the stormwater is causing an impact to the creek.

Evaporation ponds have not been evaporating, ponds are overfilling. Trucks are contantly running to send black water to Fort Scott but the ponds are still overfilling. Caller is concerned that with the amount of rain these ponds are causing an impact to the creek.

As for odors, it is not consistent and although it is not bad today, it may be tomorrow. Caller lives 1 mile NE of plant and stated that the SW prevailing winds will bring the odors to his home. He is aware that there may not be an odor violation but wishes for us to check to see if the odors are at violation level.

Caller Wants a call back!!

He is insistent that he be informed of the results of this issue and is very concerned that the facility is a large company and would be allowed to pollute due to the size and dollars in relation to the company. I assured him that we do not consider the size or the money involved that we are only concerned with the environment and making sure we can help the facility to rectify the issue.
