ADMINISTRATIVE LAW - LWU 3311/LLU 5709 (ACADEMIC YEAR 2016/2017)

COURSE PLAN

OBJECTIVE OF THE COURSE

Administrative law is relating to Administrative agencies and it is a very important and interesting

subject as it affects the day to day life of all citizens who have dealings with the State and its officers.

This area of law deals with the conduct expected from Public officials in performing their duties and

also the rights available to ordinary citizen when they are affected by an arbitrary decision of a public

authority. Special attention is given to the scope of judicial review and access to judicial review.

COURSE CONTENT:

The course will cover the following areas:

1. An Introduction to Administrative Law

2. Legal Nature of Powers

3. Judicial Control of Administrative Action

4. Doctrine of Ultra Vires

5. Control of Discretionary Powers

6. Natural Justice

7. Remedies

8. Writ of Mandamus

9. Statutory Restriction of Judicial Review.

10. Effect of the Interpretation Ordinance

11. Delegated Legislation

12. Declaratory order

DAY SCHOOLS AND COURSE MATERIALS

Ten day schools of two hour duration will be held during this academic year. Your course material

consists of two blocks. Block I contains 6 lessons from 1-6 and the Block II also contains 6 lessons from

7-12. Although day schools are not compulsory, please attend day schools as you will find it very

difficult to understand the fundamental principles of Administrative Law without the help of a teacher.

METHOD OF ASSESSMENT

You will be tested on the following lessons at each of the two assignment tests. Please note that this

programme is primarily a self study programme. You should study these lessons even if they have not

been discussed at the day school.

• CA component - There will be 2 class room tests. In addition to class room tests students are

expected to make take home assignment. (Weight age for CAT- 30%)

• Final Examination - There will be a 3 hour paper on this subject. (Weight age for final

examination -70%)

Take Home Assignment question and instructions will be given at the time of registration. Getting

eligibility to sit for the final examination is a must and at CA tests you can earn up to 30% of your

examination marks before you sit for the final examination.

If you have not received your admission card for the Assignment test and the Final examination please contact the department/Assistant Registrar (0112881377) – Faculty of HSS /Senior Assistant Registrar

Examination (0112881350) at least one week prior to the test.

MOODLE

LWU 3311 is being offered through Moodle as a supplementary course. Please read case law and

legislation through this on line facility. This will be useful to update your knowledge and obtain higher

grades in the examination. For further information please see the attached document on Moodle.

LEARNING OUTCOME

Upon completion of this course, you will

OBJECTIVE OF THE COURSE

This course investigates some basic principles and concepts pertaining to mode of acquisition

of property rights, classification of property, modifications of these principles by court of Law

and legislature, historical evolution of land tenures and etc. Also it focuses on the relevancy

LAND LAW ORAL PRESENTATION

You are required to present for an oral presentation in Land Law on the date and time

given in the admission form. This presentation is a compulsory element of your course in

Land Law. This means that you will not be eligible to sit the final examination for this

course unless you present yourself for this test and obtain a pass mark for it, i.e. 20 out

of 50 marks.

ENVIRONMENTAL LAW- LWU 3314/LLU 5811 (ACADEMIC YEAR 2016/2017)

COURSE PLAN

OBJECTIVE OF THE COURSE

The aim of this course is to provide students with a wide knowledge of environmental

and development issues, in Sri Lanka and globally. Students will be studying

environmental laws and policies contained in Sri Lankan legislation as well as in

international agreements. After completing this course students should have a

knowledge of national and global environmental problems, the fundamental principles

of environmental law, the linkages between environment and development, and a

range of environmental issues.

DELIVERY MODE Day Schools

Ten day schools of two hours duration each will be held during this academic year. The time

table for day schools has already been given to you together with the registration package.

Although day schools are not compulsory but you are strongly advised to attend these as it

provides you an opportunity to discuss any issues and problems with your day school

academic.

METHOD OF ASSESSMENT The method of assessment is made up of the following components:

• Two Continuous Assignment Tests

• Environmental Law Project Report (Compulsory)

• Final Examination

CONTINUOUS ASSIGNMENTS TESTS

These tests will be held under examination conditions. Please note that since this is a self-study

programme you will be tested on the assigned lessons even if they have not been discussed in the

day school.

1st Assignment test

24th November 2017– you will be tested on Lessons 1 – 5.

2nd Assignment test

26th January 2018 – you will be tested on Lessons 1 - 10

ENVIRONMENTAL LAW PROJECT REPORT

You are expected to submit a Project Report as a Take Home Assignment in this course. It is important to note that the Environmental Law Project Report is a compulsory component of the course and

students must obtain a pass mark in the project report to be eligible to sit the final examination.

You will be notified of the guidelines and question for the project report.

The last date of submission for the project report is 1th February 2018. An additional grace period of

one week will be given for hand delivered project reports only. Please note that any project report submitted after the grace period will not be accepted by the department, for any reason whatsoever.

Your project report should be enclosed in the folders provided. You could fix it at the beginning of the

report.

FINAL EXAMINATION

Confirmed dates will be notified later.

SUPPLEMENTARY MATERIALS This course has two blocks of written study materials and several power point presentations which will

be posted to students on the Moodle platform. You will be issued with instructions at registration on

how to register for Moodle and log in. There is a discussion forum on Moodle which we hope you will use to keep in touch with your fellow students and your teachers. In particular this will help students

in the centers to keep in touch with teachers.

PUBLIC INTERNATIONAL LAW –LWU 3315/LLU5712 (ACADEMIC YEAR 2016/2017)

OBJECTIVE OF THE COURSE

• To study the subject of international law and its, history, scope and application

• To understand the relationship between international law and domestic (national or

municipal) law.

• To understand the primary and secondary sources of international law and their application

under different circumstances.

• To understand the traditional bases of jurisdiction under international law and their

comparative importance.

• To understand the concepts of state immunity and diplomatic immunity.

• To understand the organization, structure and the work of the United Nations.

• To study the modes of peaceful settlement of international disputes, judicial and non-judicial.

• To understand the international treaty making process, interpretation of the provisions and the termination of treaties

• To understand the relevant importance of the methods and the work of International Court of

Justice.

LWU 3315 is being offered through Moodle as a supplementary course.

METHOD OF ASSESSMENT

Course assessment is formative and consists of continuous assessments as well as an end of

year final examination. While your performance at the end of year examination will make a

70% contribution towards your final overall mark the balance 30% comes from your

performance at the continuous assessments, which comprise of two closed-book assignment

tests and a Take Home Assignment.

STRUCTURE OF THE QUESTION PAPERS

Questions are set either as theory or problem questions and each question could cover

one or more lessons prescribed.

• Final Examination – Eight questions will be given and out of which five to be

answered. Questions are set either as theory or problem questions and each question

could cover one or more lessons in the syllabus.

• Duration for Assignment Tests - One hour each

• Duration for Final Examination – Three hours.

registered in the current academic year.

5. Answers should be written in your own words and any direct quotations should be

written within quotation marks and the source of the quote indicated.

6. Case law and statutes should be cited in your answers. These could be obtained from

any material including course books and other reference material.

expected in an answer.

14. Examination Offences

Please note the following clause in the Examination Regulations of the Open University

Of Sri Lanka. In respect of evaluation other than those conducted in accordance with the

provisions of this ‘Examinations Procedure’ no student shall,

i. Copy or attempt to copy from another student’s project report,

Dissertation, take home assignment, field work or any other form of

Evaluation which may be determinate by the university.

ii. In his project reports, dissertation , take home assignments , field work or

any other form of evaluation which may be determinate by the university

include any material from any other source without due acknowledgement and

which inclusion , in the opinion of the university amount to plagiarism.

Therefore all students are advised to indicate clearly when material is obtained from other
