“SCOPE OF WORK-I” Name of work: Work of repairing of beater wheel, replacement of beater plates, web liners, outer ring & static balancing of the beater wheel unit#1 & 2 at KLTPS on as and when required basis.

Scope of work consist of the following but not limited to the same.

1. The works is very essential and have to be completed in least time. So on receipt of the instruction from the EIC, the contractor has to mobilize his resources and commence the work within 03 Hours.

2. The work is emergency nature hence party should have to complete the work within 05 days as and when required from the date of commencement of work as per the instruction given by EIC. However the validity of the contract shall be 18 months overall and may be extended for further 06 (six) months at same rate terms and condition if required by GSECL subject to quantity available.

3. The contractor has to start the work after getting clearance from the engineer in charge and commence the work immediately after intimation. However the work should be carried out round the clock and complete in least possible time.

4. Work should be carried out according to the specification, instruction and satisfaction of Engineer in charge.

5. After completion of work, party shall have to offer inspection to the EIC.

6. Workshop facility if required provided by GSECL free of cost if possible.

7. All the faulty work after repair will have to carry out by the contractor without any extra charges. After completion of work, any modification as per direction of EIC given is done in his quoted rate.

8. All Necessary tools, tackles and O2, D.A and all kind of welding electrode for the job & other job related consumables materials required to carry out the job shall be arrange by the contractor at his own cost.

9. The welding rods for the aforesaid work should be credited to the BMD sub store and same to be issued to the party, the submitted welding rod should be approved by EIC. The purchase proof of the welding rod is also mandatory requirement. No extra cost will be paid for the welding rod.

10. Contractor will have to take care to avoid damage of plant auxiliaries or equipments any damage occurs to the Plant auxiliary of the party will have the responsibility to correct or replace it. 11. Steel material required for the work will be issued by the GSECL Free of cost.

12. Constrains to the job should be intimated to the EIC and same should be removed as per the instruction of EIC in the quoted rates.

13. Contractor must be obeyed all general safety rules and regulation to avoid any accident or fire hazard.

14. Sample material and bulk material checking should be carried out by party with EIC, Also Collection of sample material and fitment checking in party’s scope in the quoted rates, hydra will be provided only for checking the material at site free of cost by GSECL.

15. Electricity required for lighting and welding purpose will be treated as non chargeable and shall be provided free of cost.

16. Transportation of new and old dismantled / removed material from location to departmental store or main store as directed by EIC without any extra charges. Same is to be credited in the departmental store/ or main store Hydra crane shall be provided for loading and unloading with transportation of new material from main store to required location and for old dismantled/ removed material from site to main store on chargeable basis on written demand of contractor

17. Transportation of beater wheel to and fro from mill area to beater wheel work shop is in party’s scope as per instruction of EIC and site requirement. No extra cost will be paid for that in any case.

18. Agency must appoint qualified persons for the job & confirm to GSECL EIC for their qualification for the same. Daily progress report is to be submitted by him in the morning @8:30 am with details of the job.

19. The party shall clean the working area and remove all the generated scrap from the work site after completion of work.

20. Many agencies are working in parallel in Boiler Maintenance Section during annual overhauling of Boiler or forced outage of the unit. As all the works are to be completed with in stipulated time period, contractor will have to work in accordance with requirement of situation and provide full co-operation and co- ordination with other agencies such that time and energy consumed in co-ordination can be saved and work can be attended in time.

21. Contractor shall also work in harmony with BMD staff and operation staff and try to avoid unnecessary disputes and delays to maintain healthy atmosphere.

22. Party shall indemnify the GSECL against any injury to their workers during execution of work for which contractor shall be responsible.

23. The contractor has to follow the general safety rules & regulations.

24. Other terms and conditions of the GSECL for the work will be binding to the contractor.

25. In case of dispute decision of CE (G) will be final and binding to the contractor.

SCOPE OF WORK-II

NAME OF WORK: Work of repairing of beater wheel, replacement of beater plates, web liners, outer ring & static balancing of the beater wheel unit#1 & 2 at KLTPS on as and when required basis Repairing and balancing of the beater wheel is very skillful job. It includes the following activities but not limited to the same. (01) Removal of the beater plates The worn out beater plates are required to be replaced by new beater plates. All Side liner plates are welded and bolted with the ring and the head of the bolt are Covered with the blanking disc. All these beater plates and side liner plate are to be making free from bolting by unscrewing and heating/cutting etc and thus old worn out beater plates are to be removed. (02) Repairing and dressing of the web liners The web liners which supports the beater plates gets worn out and it to be built up and redressed by welding and grinding very carefully. Preheating of web is to be carried out if required prior built up the web. The web liners are required to be Replaced if required (03) Removal and replacement of old worn out fan ledges Fan ledges develops air pressure behind the wheel and mill body which does not allow ingress of flue gas and leakages of flue gas of pulverized lignite through shaft of the mill and body. These fan ledges got worn out frequently and required to be replaced along with the beater plates. The blanking disc is to be removed and re-tape the holes and replace the worn out fan ledges by providing new fan ledges. The blanking discs are to be welded after providing the fan ledges. (04) Repairing of the protection disc After successful running of the beater wheel, the protection disc is found worn out Condition. The contractor has to repair the protection disc as per requirement and instruction of the EIC. (05) Re-balancing of the beater wheel. After removal of the retainer and mounting of the fan ledges the beater wheel is to be mounted on the beater wheel-balancing fixture. It is necessary to carry out pre-balancing of the beater wheel for perfect balancing after assembly of the wheel. Static balancing is to be carried out very carefully and should be offer for inspection to concern EIC. (06) Replacement of the worn out parts weighing about 3000 Kg. (07) Transportation of material from Departmental store OR main store to the work site. (08) Required M.S. & S.S. Welding rod (Standard make) ,O2,DA cylinders etc. and all tools &

tackles required for the work shall be arranged by the contractor in its quoted rates. (09) If required Party shall have to cut the protection ring, beater plate supporting liner (Patta),

side casing part-II liners, Fan ledges etc as per existing from MS plate of required size, pertain to the repairing work of beater wheel #1&2 as per instruction of EIC in his quoted rate in emergency when the spares are not available with GSECL.

(10) Contractor shall have do the minor rectification /modification work in liners, B.plates, protection ring, web liners, welding of support piece to protection ring etc to cope up with the site requirement.

(11) If beater wheel unbalanced due to any reason while in service, any liners, locking or any parts of beater wheel fallen down during running in mill, contractor shall have to attend

the same in situ as directed by the EIC without any extra cost. (Within 2000 to 2200 running Hrs.)

(12) Transportation of old dismantled / removed material (With segregation) from location to departmental store or main store as directed by EIC. Same is to be credited in the departmental store/ or main store.

(13) Work shop facility will be provided free of cost if possible and available. (14) Party shall have to obey the general safety rules and regulation for avoiding the accident. (15) All miscellaneous work pertains to repairing of the beater wheel falls in the scope of the

contractor and shall be carried out as per instruction of EIC in quoted rate.

GENERAL TERMS & CONDITION FOR WORK CONTRACT

1. “Contract” means the documents forming tender and the subsequent agreement that may be entered into.

2. Works’ means “Work of repairing of beater wheel, replacement of beater plates, web liners, outer ring & static balancing of the beater wheel unit#1 & 2 at KLTPS on as and when required basis.”

3. “Contractor” means a firm or an individual undertaking of these works or offers the rates for this work.

04 The general rules and regulations of the GSECL for tender and contract for works will apply to the extent of the same and not modified herein. The contractor is deemed to have gone through and considered to be fully aware of the conditions mentioned therein.

05 Earnest Money Deposit:

Tender should be submitted along with Earnest Money Deposit (EMD) at the rate of one percentage of estimated cost of the tender, without which tender is liable to be rejected.

06 Security Deposit:

Successful bidder shall have to pay Security Deposit (SD) equivalent to 5% of the ordered value. Out of this SD, 2.5% should be paid in cash or demand draft of scheduled bank payable at KLTPS within seven days of acceptance of order, and balance 2.5% of the SD will be recovered from first two RA Bills. Failure to deposit the SD will entail forfeiture of EMD and the contract shall be treated as terminated. The contractor shall not be allowed to start the work if SD is not paid before the stipulated period. Any loss to the GSECL due to late start of work because of late payment SD shall be the contractor’s liability.

07. The amount of Security Deposit will be refunded after the satisfactory completion of the contract after certification by the concerned Superintending Engineer and after deducting any dues of the GSECL.

08 To sublet or to transfer the contract without prior approval of the GSECL shall be treated, as breach of contract and it shall be punishable by forfeiting the SD as well as termination of contract.

09 The GSECL reserves the right to forfeit the SD in case of any breach of contract and in case of disputes. The decision of Chief Engineer, KLTPS shall be final, binding and acceptable to the contractor. If the contractor fails to start the work as stipulated, the EMD and the SD shall be forfeited.

10. The monthly payment to the labourers must be paid in the presence of Labour Welfare Officer, KLTPS. A copy of the same must be submitted along with monthly RA Bill, duly certified by the Labour Welfare Officer. The certificate should contain details of average no. of labours deployed, total wages/salaries paid and overtime amount separately.

11. Submission of the bill by the contractor:

Bills shall be submitted by the contractor for all works, executed and the Engineer-in-charge shall take or cause to be taken the requisite measurement for the purpose or having the same verified and the claim so far as it is admissible, shall be adjusted, if possible within ten days from the presentation of the bills. If the contractor does not submit the bill, within the time fixed, as aforesaid, the Engineer-in-charge may depute a subordinate to measure up the said work in the presence of the contractor or his duly authorised agent, whose countersignature in the measurement list shall

be sufficient warrant and the Engineer-in-charge may prepare a bill from such list which shall be binding on the contractor in all respect.

Along with the R.A Bill, the contractor should submit Material Account wherever applicable, proof of payment of provident fund and other statutory dues, certificate issued by IRO/Labour Welfare officer certifying average number of labours deployed during the month and total amount of wages and salaries paid to labours.

The R.A. Bills along with the supporting documents will be paid after 30 days on recording of Bill.

12. Income Tax:

Income tax will be deducted at source from each bill as per statutory requirements. The TDS @ 2% as per Sections 57A and 57B of GST Act shall be deducted from the contractor’s bills.

13.The GSECL will be entitled to deduct directly from the bills to be paid to the contractor any sum or sums payable by the contractor and which sum/sums the GSECL is required to pay as a principal employer on account of contractor’s default in respect of all liabilities referred to in above clauses.

14. No sales tax, professional tax or any other taxes, cess or levy, excise duty, octroi, royalty or other duties will be payable by the GSECL against this contract. Only service tax is payable extra on production of valid documentary proof of having paid the service tax.

15. The quantities mentioned in the Schedule-B are approximate only and may vary widely. The contractor shall be paid for the actual works carried out at the rates quoted by him.

16. Documents required to be submitted by the Bidders along with technical bid: a). Experience Certificates:

At the time of submitting the tender, the contractor shall attach experience certificate(s) of having carried out such/similar type of work either in GSECL or in any other organization without which the offer is liable to be ignored.

b). Special Tools & Tackles:

The bidder shall have to submit along with the offer, the details of all the tools, tackles & equipment in possession relevant to the job.

c). Provident Fund Code Number:

The contractor shall have to submit along with the offer the details of PF Code Number from appropriate authorities, without which the offer is liable to be ignored.

d). Service Tax Registration certificate:-

The contractor shall have to submit copy of the service Tax registration certificate issued by appropriate authority.

e). Solvency:

The contractor shall have to submit a copy of the bank solvency certificate of minimum 20% of the estimated cost of the tender of any Schedule Bank. The offer without Solvency certificate is liable to be rejected.

f). Audited Annual Accounts: The contractor shall have to attach along with the tender last three years audited annual accounts (i.e. Profit and Loss account statement and Balance Sheet), if the tender estimated value is Rs. 50.00 Lacs or more for one year contract and Rs. 1.00 Crore or more for two years contract, otherwise the offer will be liable to be rejected.

g.) Partnership Deed/Memorandum of Association & Articles of Association

If the contractor is not a sole proprietor, then the contractor shall have to furnish a copy of the Partnership Deed along with the offer. In case of a Company, the M/A & A/A is required to be

submitted without which the offer is likely to be ignored. The contractor shall also submit power of Attorney.

h).Labour License for Labour Contract:

The contractor shall have to furnish the copy of Labour License under the Contract Labour (R&A) from the appropriate authorities, without which the contract order is liable to be terminated.

17. Penalty clause:

Any delay in activities of contract out of date /stipulated period in the order shall be subjected to penalty (Not liquidated damages) at the rate of ½% of order value per week and subject to maximum of 10% of the order value (i.e. End cost including taxes & duties)

18. Wages to be paid, time of payment, etc., by the contractor:

The payment shall be disbursed in presence of the GSECL representative during the working hours in the factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GSECL. Any default will result in cancellation of contract forthwith or else the contractor shall be punishable to the extent of Rs.100/- per day by way of fine. The contractor shall give his telephone number, address to the GSECL, so that in case of labour unrest etc., the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present throughout the working hours. It is absolutely necessary that the contractor either himself and/or a fully authorised representative having full power or authority concerning the contract shall have to remain present at KLTPS. He must also contact Executive Engineer & EIC of concern section daily at 08.00 hours, so that necessary instruction can be passed on to him. Also, he must be available during working hours (general shift) and during failure of any equipment at any time, so that he can be immediately contacted for any emergency work. The contractor and/or his authorised representative shall not leave KLTPS without specific permission from the Executive Engineer of concern section. If the period of absence from KLTPS is more than three days, an alternative arrangement shall be made and to be informed to the sectional head in writing.

19. Labour Laws:

The labour laws applicable and amended from time to time have to be followed scrupulously. A few of them for information are as under:

i). Person below the age of eighteen years shall not be employed for the works.

ii). No female worker shall be employed in the night shift between 19:00 hrs and 06:00 hrs.

iii).Contractor shall maintain a valid labour license under the Contract Labour (Regulation & Abolition) Act for employing necessary manpower to be required by him. In the absence of such license, the contract shall be liable to be terminated without assigning any reasons thereof.

iv).The contractor shall, at his own expense, comply with all labour laws and keep the GSECL indemnified in respect thereof. Some of the major liabilities under various labour and industrial laws, which the contractor shall comply with, are as under:

a) Payment of contribution of employees (contract labour) as well as employer’s (contractor’s) contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administration charges, inspection charges, etc., at the rates applicable from time to time by the Government of Gujarat/Government of India or other statutory authorities.

b) Payment of deposit in respect of each contract labour at the rate as revised by the Government from time to time with the Office of the Commissioner of Labour as per the Contract Labour (R&A) Act.

c) License fee as prescribed under the Contract Labour (R&A) Act and rules framed therein, depending upon the number of workers employed by the contractor.

d) Identity cards as prescribed under the Factories Act or by the Thermal power station with photograph affixed thereon, for identification.

e) Payment of retrenchment compensation, notice pay and other liabilities as per Industrial Disputes Act, 1947. Any payment to the contractor’s employees arising out of any claim or disputes under the Industrial Disputes Act, 1947 or any other labour laws.

f) Payment of compensation in case of accidental injury, under Workmen’s Compensation Act.

g) Provision of crèche if the female labour employed is more than 30.

h) Maternity leave as per the provision of the Maternity Benefits Act.

The above are some of the major liabilities of the contractor in addition to other liabilities prescribed under the various labour laws in force from time to time by the statutory authorities, like State Government/Government of India, which the contractor shall have to comply with.

20. Provident Fund and Family Pension Scheme:

The contractor shall submit along with his bill (month-wise) a statement regarding deductions against Employees Provident Fund (EPF) and Family Pension Scheme (FPS) in respect of each concerned employee at the rate of 10%, or at the rates made applicable by the government from to time, of wages. The contractor’s contribution and the worker’s contribution towards PF and FPS shall be deposited by the contractor with the Regional Provident Fund Commissioner, Ahmedabad, or to the authority prescribed under the Act along with the other charges.

21.Deposit Linked Insurance Scheme:

The contractor shall have to deposit 0.50% (half percent) or the rate applicable from time to time of the wages in respect of employees who are members of the PF, as the contribution to the Deposit Linked Insurance Scheme, with the Regional Provident Fund Commissioner, Ahmedabad.

22.Minimum Wages Act:

The contractor shall pay prevailing minimum wages as applicable from time to time to the labourers engaged by him as per the Minimum Wages Act, in presence of the GSECL’s officer or representative.

23.Administrative Charges:

Administrative charges for maintaining Provident Fund account shall be deposited by the contractor with the Regional Provident Fund Commissioner, Ahmedabad, at the rates applicable.

24.Paid Leave Facility:

Paid leave facility at the rate of one day for every twenty days of actual work by the contract labour shall be provided by the contractor to his workers. He shall maintain leave records/verified and approved/certified by the authorised officer of the GSECL.

25.Safety:

The contractor shall strictly observe all safety rules and provide safety equipment to the contract labourers as per the Factories Act, 1948, and whatever amendments made from time to time to avoid any chance of accident. The contractor shall strictly observe all instructions of Safety Officer and Factory Inspector to avoid any chance of accident.

26. Workmen’s Compensation Fund and Employer’s Liability Insurance:

Insurance shall be affected for all the contract employees engaged in the performance of this contract. If any of the work is sublet after due permission in writing from the GSECL, the contractor shall require the sub-contractor to provide workmen’s compensation and employer’s liability insurance for the later

employees, unless such employees are covered under the contractor’s insurance. It shall be the liability of contractor for employees of his sub-contractor.

27. Compliance to Security Matters:

The power station being a restricted/prohibited area, all the formalities as required by the Security and Vigilance staff of GSECL should be complied with, to whom the contractor should contact.

28. Submission of Returns & Maintenance of Records:

The contractor shall submit the returns under the Contract Labour Act, Payment of Bonus Act, Payment of Gratuity Act etc. and shall have to maintain all up-to-date records/registers in respect his employees as prescribed under various Labour Laws and produce the same as and when demanded by GSECL’s appropriate authorities.

29. Execution of Agreement:

The successful bidder (contractor) will have to enter into an agreement with the GSECL and the cost of the stamp paper will be borne by the contractor. The contractor will also have to execute indemnity bond on required value of stamp paper as per GSECL’s rules. The cost of stamp paper for indemnity bond will be borne by the contractor.

30. Contractor to Indemnify the GSECL:

The contractor shall indemnify and keep indemnified the GSECL and every member, officer and employees of the GSECL including Engineer-in-Charge and his staff, against all actions, proceedings, claims, demands, costs and expenses whatsoever arising out of or in connection with the matters referred in above clauses and elsewhere and against all actions, claims, demands, costs and expenses which may be made against the GSECL, by any workman/employee of the contractor or sub-contractor or any other person under any laws, rules or regulations having the force of law, including, but not limited to, claims against the owner under Workmen’s Compensation Act, 1970. The GSECL shall not be liable for or in respect of or in consequence of any accident or injury to any workman or other person in the employment of the contractor. The contractor shall indemnify and keep indemnified. The GSECL against all such damages and compensation and against all claims, demands, proceeding costs, charges and expenses whatsoever in respect thereof or in relation thereof.

The contractor shall also indemnify GSECL in all respect against any liability due to breach of legal provisions contained in any of the Labour Laws The Contractor shall also indemnify GSECL for injury or damage to third party other than employees of the GSECL, contractor or sub-contractor.

31. As a contractor, the contractor shall be responsible and liable to pay difference in wages, if any, and/or observe the revised service conditions that may be awarded by the Honourable Industrial Tribunal effective from the date directed in the award.

32. The contractor must be maintaining regular labour record and should be paying all acquired benefits to labour force and contractor should obtain certificates to this effect from Labour Commissioner.

33. Any other rules and regulations, conditions etc. that are in force at present and that may be framed by the GSECL from time to time in connection with the contract will be binding and acceptable to the contractor.

34. The contractor will make arrangements at his own cost to insure all men, materials and equipment employed for this work. The GSECL will not be responsible for any loss or damage either to the contractor’s personnel or his equipment.

35. Dispute, if any, taking place between the contractor and labourers must be intimated to Labour Welfare Officer, KLTPS, immediately.

36. The contractor must insure all the labourers before starting the works.

37. Any casualty will also have to be borne by the contractor for the period the contract continues.

38. The contractor shall not engage any sub-contractor without written prior permission of the Chief Engineer or the authorized officer of the GSECL. In no case the GSECL will be liable in any manner regarding any liability in respect of any contract labourer engaged by the sub-contractor and the liability of such contract labourer will solely rest with the principal contractor.

39. The contractor shall deploy with the adequate number of experienced staff at site for daily supervision and for maintenance of various registers and records required under the law and contract. No payment by the GSECL for supervision shall be admissible.

GSECL will provide supervision on chargeable basis if demanded by the contractor or if directed by the competent authority

40 Staff Discipline:

It is the responsibility of the contractor to ensure that his employees maintain strict discipline as regards security, methods of safe working etc., and not to cause any hindrance to smooth running of power station or in execution of duties by GSECL staff. Any lapse in this regard will be viewed seriously and contract is liable to be terminated. If any of his staff is found unsuitable or not behaving properly, Ignoring the instruction of EIC, misguiding the EIC, the contractor shall have to remove him from the work-site on demand by GSECL. The contractor shall have to strictly observe the rules and conditions specified in the enclosed works contract booklet of the GSECL, which are not modified hereunder. To keep harmonious Industrial Relations amongst contract labourers is the sole responsibility of the contractor. Any breach of the same will be viewed seriously.

41. Arbitration:

If at any time any question, dispute, differences, shall arise between the GSECL or the Engineer-in-Charge and the contractor or any person claiming through him upon or in relation to or in connection with the matter herein before stipulated and specified to be referred to arbitration, either party may forthwith give to the other a month’s notice in writing of the existence of such question, dispute or differences whatsoever, which may at any time arise between the parties to this agreement, touching the agreement or subject matter thereof, arising out or in relation thereto and whether as to construction or otherwise, shall be referred to the decision of the sole Arbitrator appointed by the Chairman of GSECL for the purpose, who shall be a retired High Court Judge or a retired District and Sessions Judge, and upon the parties’ reference to the Arbitration act, 1940, as amended from time to time and the rules therein. The Arbitration proceedings shall be conducted at GSECL’s head office, Baroda, or at such places as the sole arbitrator may determine. The award of the sole arbitrator (or umpire) shall be final and binding upon the parties upon every or any such reference the costs of and incidental to the reference and award respectively, shall be at the discretion of the arbitrator or umpire who may determine the amount thereof or direct the same to be taxed as between party, and the party shall direct by whom and in what manner the same shall be borne and paid, provided, however, that either party to the dispute shall in respect of any monetary claim, be entitled to receive from the other party by way of cost any time exceeding the percentage set out below, irrespective of the actual fees and expenses incurred by him. Work under contract shall continue during the arbitration proceedings and no payment, other than for matters in dispute due or payable by the purchaser, shall be withheld on account of such proceedings.

The percentage above referred to in this clause is five percent on any such monetary award, which does not exceed Rs.10,000/-; three percent on the next or any part thereof; two percent on the next Rs.50,000/-, or any part thereof, and one percent on Rs.40,000/- or in case it exceeds Rs.1,00,000.

42. Labour Escalation:

The contractor shall pay minimum wages to his labourers as per the Minimum Wages Act, 1948 and rules therein, as applicable from time to time, in pursuance to the state government notification. The concerned contractor, after making such payment to his labourers, shall submit the details of the payment with the certification of Labour Welfare Officer/Industrial Relations Officer. However, no labour escalation will be payable by GSECL to the contractor as this is a firm price contract throughout the period of contract.

43. The GSECL reserves the right to terminate this contract at any time during its currency without giving notice of termination or any reason thereof.

44. Time Limit:

The time limit for completion of this contract works, if awarded, is 18 month from date of commencement of work.

45. The contract will remain in effect for the period of 18 months from the date of Commencement of work. GSECL at any time during the tenure of the contract may terminate the same at its sole discretion without assigning any reason, if it is observed that obligations under this contract are not performed up to the satisfaction of GSECL. The contractor will, however, not be entitled for any compensation for such premature termination of contract. If required the party will have to execute the work up to further 06 (six) months or the said work is required to be carried out in same / other Units at the same rates and terms & conditions.

46. In case of default, the work will be got done through other agency/agencies at the risk and cost of the original contractor, and the GSECL shall be entitled to recover such expenses from defaulting contractor by such methods as deemed fit. The contractor shall not, however, be entitled to terminate the contract or stop works undertaken by him before expiry of the contract period/extended period due to any reason whatsoever.

47. Under the contract, the contractor should either himself be present at the site or should nominate persons in writing, who must be available at site and who should be authorized to take decisions about the works and receive the instructions from Engineer-in-Charge of the work at any time In absence of any responsible man of contractor at the time of any emergency, ad hoc decision of Engineer-in-Charge will be binding on the contractor.

49. The contractor is bound to execute the work for any item as per the instruction of the Engineer-in-Charge. On refusal to do so, the work will be carried out at the risk and cost of contractor by using the contractor’s tools and tackles, for which no compensation whatsoever shall be payable to the contractor and recovery will be made for that work as actual.

50. If any immovable articles/tools/equipment will be found stolen from the working place, the contractor would be held responsible and cost will be recovered from his bill.

51. For any conflict and ambiguity, the decision of the Chief Engineer (KLTPS) shall be final and binding on the contractor.

52. Sealed tender should be super scribed as “Work of repairing of beater wheel, replacement of beater plates, web liners, outer ring & static balancing of the beater wheel unit#1 & 2 at KLTPS on as and when required basis.”Technical Bid & Price Bid should be sent by R.P.A.D. only so as to reach this office before last date & time of acceptance of the tender.GSECL will not be responsible for any postal delay. Tender received after last date and time of acceptance will not be considered.

53. The contractor shall quote only certain percentage of rates above or below the estimated rates, i.e., contractor should quote either, say A% above the estimate or B% below the estimate for all the items. The contractor should not quote different percentage for different items. Tenders received with different percentage rates for different items shall be liable to be rejected. The contractor should quote only percentage higher/lower in figures as well as in words in Schedule-B. In case of not mentioning clearly above/below the estimate, the Board shall consider the quoted percentage below the estimate and the contractor must have to honour this, failing which suitable actions may be taken, considering this as dishonour and/or summary rejection of offer without assigning any reason thereof as deemed fit by Chief Engineer. 54. The rates quoted shall be firm and valid for 180 days for acceptance from the date of opening.

55. The contractor, if desired, can see the plant and site on any working day and during working hours with permission of the Chief Engineer.

56. Conditional tender is liable to be rejected. Withdrawal or insertion of conditions unilaterally after opening of tenders will not be permitted unless it is so desired by the GSECL.

57. Chief Engineer, KLTPS, reserves the right to reject any or all tenders without assigning any reasons thereof.

58. Before starting the work, the contractor should contact Industrial Relation Officer/ Labour Welfare Officer for all formalities and obtaining the gate passes of his labourers and for other formalities.

59. Office correspondence will be carried out in English language, and if at any time to facilitate the contractor, Gujarati translation may be furnished, if deemed fit. The English version will be the correct one and the same only will held good for legal matters.

60. The contractor should intimate to the office the name and address of authorized and responsible representatives, so that our field officers can contact them when required in connection with the execution of the said works.

61. As the nature of the work is urgent and “as and when required basis during 18 months period.” contractor shall has to mobilize the manpower for commence the work within six hours of prior information given to start the work
