Stank gaan nog ’n ruk lankvoortduur in Apiesdraai

MONIQUE VERMEULEN

Volgens ’n ontstelde inwoner, Lynette Lom-baard, is daar skaars enige voëllewe by die damin Apiesdraai oor.

VERA SCHOEMAN

FOUR high school girls from Humansdorpwill join 25 other learners from the EasternCape, Lesotho and North West in a six weekRotary cultural exchange program to Germa-ny. They have been selected by the RotaryClub of Jeffreys Bay and will depart on No-vember 29 for Frankfurt.

Chanté du Plessis, Micheala Japhta, Habre-Ann Krige and Lene Prinsloo, all in Grade 10at Humansdorp Secondary School learntabout the Rotary short term exchange pro-gramme and were encouraged to apply bytheir class teacher.

They are all excited about what lies ahead, including flying for the first time. They willbe hosted in various parts of Germany by thefamilies of German students who recentlycompleted their stay in South Africa as partof the Rotary exchange programme.

Chante said this is an amazing opportunityto broaden their horizons. “I love challengesand can’t wait to learn more about Germanyand the German people. I can already speaksome German and am determined to learn the

language properly while I am there.”“After spending time with our respective

host families, we will go on a 12 day tour to-gether. We will be skiing in Austria, visit theChristmas Market in Berlin as well sight-see-ing Munich. We cannot wait to see snow!”

Chante’s father passed away in May, andshe almost backed out of the trip. “I then rea-lised how much he would have wanted me togo and I want to make the most of this tourfor his sake,” she said. “Our families havebeen completely supportive and are veryproud of us. They are happy to make sacrificesso that we can pay for our airfares and tourexpenses. Once there, our host families willtake care of our living expenses.”

Rotary base their selection on the candi-dates’ individual personalities and suitabilityas ambassadors for their country and the Ro-tary organisation.

For more information on the Rotary shortterm exchange programmes contact Ted Popeon e-mail [email protected] or 0 083 6501594.

YOUR PROPERTY QUESTIONS ANSWERED

Paving the way for common problemsOUR panel is often asked to deal witha variety of issues relating to section-al title complexes, from problems be-tween neighbours to maintenance ofthe common property.

This week’s reader question is aclassic example of the latter.

The reader explains that he hasowned and lived in his unit for sometime. Approximately two years ago,he approached the trustees of the com-plex about paving a dusty and unusa-ble area adjacent to his unit.

He was well aware that the areaformed part of the common propertyand offered to use the contractor re-sponsible for other building work inthe complex to ensure its uniform ap-pearance.

The reader accepted the fact thatthe paving would be to the benefit ofthe body corporate and other resi-dents, even though he paid for it.

The trustees approved of this actionand the managing agent confirmed inwriting that he could proceed, whichhe duly did.

During the past year, some pavingoutside two other units collapsed(having been laid many years ago byowners long gone) and the body corpo-rate paid for the repair work.

However, the body corporate hassubsequently advised that future re-pairs to collapsed paving in commonareas will have to be paid for by theowners of the units lying adjacent tothe relevant area.

Understandably, the reader is con-cerned about the trustees’ approachsince the paving he had done is con-sidered common property and doesnot form part of his unit.

He questions whether such a deter-mination is valid and, if so, how onewould impose this responsibility on anewowner if theunitwere tobe re-sold.

The common property is the por-tion of a sectional title scheme thatdoes not form part of any section, saysWanda Hayes from Huizemark Jef-freys Bay.

“Someexamples of commonproper-ty would include driveways, parkingbays, garages, swimming pools andwalkways.”

Hayes says the common property isjointly owned by all the section own-ers and it is controlledby thebodycor-porate.

“In terms of the Sectional TitlesAct, the responsibility for the mainte-nance of any common property lieswith the body corporate.”

This entity must arrange for themaintenance to be effected and shouldalso pay for the work that needs to bedone, says Hayes.

Herman Pieterse from Jan VisserAttorneys in Jeffreys Bay says the Actplaces an obligation on the body cor-porate to maintain the common pro-perty.

“This obligation makes it clear thatthe trustees cannot decide that theunit owners are now responsible forthe maintenance of certain portions ofthe common property.”

Pieterse says this includes thepaved areas outside their units.

“The fact that the reader offered tohave the paving done and paid for itdoes not change this situation.”

Similarly, says Pieterse, it wouldnot be possible to bind a third-partypurchaser of a section to maintaininga common area outside his or her unit.

“The reader should certainly raisethis issue with the body corporate andclarify the situationbefore repairs areactually required. Action now willhelp to avoid a potentially unpleasantsituation in the future.”

Celebrities hit Sixes for charitySOME Some of the biggest names in sport andentertainment will come out to bat for charityat the Celebrity Cricket Sixes tournament inPort Elizabeth on Saturday, September 24.

Spectators at Kemsley Park will see a hostof former national sportsmen and celebritiesface off in 10 six-a-side matches in aid of theCancer Association of South Africa and JAGFoundation.

Organiser Laurence Finn said the positiveresponse to last year’s inaugural event in PEhad made it the natural choice as kick-off ven-ue for the nationwide tour, which consists ofsix tournaments.

“Every one of the players has given his timefor free. They realise this is for a great causeas well as a lot of fun.”

Finn said each of the six teams would be cap-tained by a national cricket legend while theremainder of the team would be made up ofa provincial cricketer, rugby legend, two non-cricketers and a local businessman.

He said Dave Callaghan, Eldine Baptiste,Kenny McEwan, Pieter Strydom and RudiBryson are among the legends “selected” tolead a team. They will be assisted by ChevroletWarriors players such as Corbyn Dolley,Reece Williams and Basheer Walters.

According to Finn, the cricketers would ei-ther be helped or hindered in their quest forvictory by former Springbok rugby playersChadAlcock,RobbieKempsonandDeWetBar-ry as well as EP Kings team-mates Jaco Engels,Jaco van Schalkwyk and Mzwandile Stick.

“The funny part is that it’s the rough, toughrugby players who are most afraid of the littlered ball.”

Adding to the fun will be sundry sportsmenlike Olympic pole-vaulter Okkert Brits, jave-lin-thrower Philip Spies, former national su-perbike champion Arushen Moodley, racingdriver Shaun Watson-Smith, golfer TitchMoore, wrestler Mark Beale and national jet-ski champion Brett Armstrong.

Former Mr South Africa Denver Burns, Nel-son Mandela Bay Municipality’s communica-tions director Roland Williams and Cricket SAmatch referee Dev Govindjee are some of thebusinessmen who round out the teams.

Finn said the Hong Kong Sixes-style tourna-ment would provide entertainment for thewhole family.

“Six overs a side is the fastest form of crick-et, so it’s fun and full of action. There is a lotof sledging and interacting with spectators.”

Besides the cricket action, Finn said there

would be a beer garden, food and retail stallsand children’s entertainment.

“We will interrupt play (at 10.30am) for theRugby World Cup game between New Zealandand France. It will be shown live on the bigscreen, so spectators won’t miss a moment ofthe action.”
