Reference:- GOI, Min of P, PG & Pensions, Deptt. of P&PW OM No.38/37/2016-P&PW (A)(i) dated, the 4 th August, 2016. ***************************** The Govt. of India, Ministry of Personnel, Public Grievances & Pensions, Deptt. of Pension & Pensioners’ Welfare in their O.M. No 38/37/2016-P&PW (A) (i) dated, the 4 th August, 2016 have issued orders for implementing Govt’s decision on the recommendations of Seventh CPC revising provisions of pension/commutation of pension with effect from 1-1-2016 (copy enclosed). With a view to implement the Govt. decision, the following procedural changes are made in regard to submission of fresh pension/family pension and commutation of pension claims. 2.1 Consequent on application of the C.C.S. (RP) Rules, 2016 and Deptt. of P&PW OM dated 4 th August, 2016 referred to above, it has been decided that all pension claims shall be submitted to this office in the revised LPC Cum Data Sheets enclosed as Appendix-‘E’ and ‘F’ to this circular. 2.2 Pension claims in r/o individuals who have drawn pay and allowances in the revised scale of pay will be floated by the Head of Office in the revised LPC Cum Data Sheet as per Appendix-‘E’. Another Data Sheet (Rev) has been designed as Appendix ‘F’ for proposing amendments/revision of pensionary awards (for issue of corrigendum PPO) notified in the original PPO based on LPC Cum Data Sheet (Appendix-‘E’) as stated above. 3. The new designed Data-sheets, viz, Appendix ‘E’ & ‘F’, will be given effect for implementation as soon as Pay under Seventh CPC is fixed and H.O.O. is in a position to initiate the pension cases on the revised formats. However, no case on the old Data-sheets will be accepted after 30-09-2016. It may please be noted

No 38/37/2016-P&PW (A) (i)dated, the 4th August, 2016 have issued orders for implementing Govt s decisionon the recommendations of Seventh CPC revising provisions ofpension/commutation of pension with effect from 1-1-2016 (copy enclosed). Witha view to implement the Govt. decision, the following procedural changes aremade in regard to submission of fresh pension/family pension and commutationof pension claims.

Another Data Sheet (Rev) has been designedas Appendix F for proposing amendments/revision of pensionary awards (forissue of corrigendum PPO) notified in the original PPO based on LPC Cum DataSheet (Appendix- E ) as stated above.

3. The new designed Data-sheets, viz, Appendix E & F , will be given effect forimplementation as soon as Pay under Seventh CPC is fixed and H.O.O. is in aposition to initiate the pension cases on the revised formats. However, no caseon the old Data-sheets will be accepted after 30-09-2016. It may please be noted

that this is an essential requirement for expeditious notification ofpension/revision of pension.

4. In this connection, sets of each data sheet alongwith instructions are forwardedherewith for transmission of the same to the lower formation/unit/HOO underyour control. The unit/formation declared as H.O.O. may be instructed to use thedata sheets alongwith supporting documents as per the revised procedure.Additional copies of data sheets and instruction, if required, may please beprepared/printed at your end for circulation. A copy of the instruction issued byyou to your unit/formation/HOO may please be endorsed to this office.

5. These orders do not apply to those cases (retired after 1.1.16 but gotpensions as per 6th CPC) where the pension at the old rates has alreadybeen finalized. For revision of pension of such cases, a separate Circularwill be issued. Separate proforma for preparation of Data-Sheets in suchcases, as provided in the Circular, would be used.

Column 28(Pay in Pay Matrix)Pay in Pay Matrix drawn in the Pay Level by the individual at the time of retirementshould be filled in this Column. In no case it should be left blank or filled with zeroes.

Column 29(NPA/MS Pay)

NPA/MS PAY - In case of Doctors employed as Defence Civilians, Non practicingallowance drawn at the time of retirement should be filled in this Column. In case ofMNS LOCAL Officers, MS PAY drawn at the time of retirement should be filled in thisColumn.

Column 30(Date of Last Pay Drawn)(DDMMYYYY)This Column should be filled with date of Last Pay drawn by the individual.

Column 31(10 Months Average)10 MONTHS AVERAGE:The average pay which includes sum of Pay in Pay Band, Grade Pay and non-practicingallowance(NPA)/MS Pay actually drawn by the individual during the last 10 monthsperiod preceding the date of his retirement will be shown in this Column.This field contains 5 boxes for rupee and 2 boxes for paisa. This field should not be leftblank.

Column 32( Gal Award)These columns may be filled with reference to the codes provided for differentGallantry Awards in Annexure-5 to the Data Sheet. In first box gallantry awards codeand in second box bar code will be filled.

Column 33( Last Pay reduced due to penalty)This Column should be filled with ‘Y’, if pay of individual reduced due to any penalty. Inother case it should be filled with ‘N’.

Column 34, 35 &36 (On A/c of RDR Head, On A/c of other than RDR Head, Interest on RDRDemand)These columns may be filled with demands if any to be recovered from the pensionarybenefits.

Column 40(Percent to be commuted in %)This column may be filled with reference to the percentage of commutation opted bythe officer in his commutation application. However, it may be seen that percentagecommuted may not exceed 40%.

Column 41 (Loading in Age) (YY)Loading in age may be filled in completed years only. This may be verified with referenceto Release Medical Examination Report/Medical board Report.

Column 42(Whether Married)If the individual got married before retirement, this column may be filled with “Y”otherwise “N” may be indicated.

Column 43(Spouse Alive)Wife alive or not should be filled as under:

If wife alive- “Y”If wife is not alive “N” Ifmarriage is under dispute or plural marriage-

“T” If a caseof Divorce- “D”

Column 44(Name of Spouse)The name of spouse may be filled with reference to family details as per Service Book.On space may invariably be left blank between first, middle and last portions of thename.

Column 50 (DPDO Code)This column may be completed only if the PDO code in the column 29 is 1i.e. the officer desires to draw his pension from DPDO. A list of codes for all the DPDOsis given in the Annexure-6 to the Data Sheet. The appropriate code for the DPDOconcerned may be ascertained and filled in this column.

Example- If the individual desires to draw his pension from DPDO, GurgaonColumn 30 will be filled as under

Column 51(PDA Station)PDA Station Field will be used for bank station also. The station where the paying bankbranch is located may be entered in this column. If pensioner desires to draw his pensionfrom a Sub Treasury, then it should be filled Sub Treasury name after then PDA stationname. One box may be left blank between Sub Treasury name and PDA station.For example: Sub Treasury is Meja and PDA station is Allahabad.

Column 52(PDO State Code)The station from where the officer desires to draw his pension may be entered in thiscolumn. Alphabetic codes assigned to various states as per Annexure-7 to the DataSheet may be used to fill up this column.

Column 53(Bank /sub-treasury code)Three digital alphabetic codes assigned to various public sector banks as shown inAnnexure-8 to the Data Sheet may be used to fill up this column. Abbreviation of subtreasury as SUB may filled up in this column, if the individual desires to draw hispension from a sub treasury.

Column 54(BSR Code Link Bank/CPPC)The code allotted by RBI to each bank branch. (Annexure-9)

Column 55(IFSC Code Paying Branch)The code allotted by RBI to each bank branch. Please also attach a cancelled cheque for

verifying Bank A/c no. and IFSC code.

Column 56(Bank account Number)The bank account number of the paying branch may be entered in this column.

Example: If the account number of the officer is SB/4502 It should befilled as underS B / 4 5 0 2

Column 57(Dual Family Pension)

In the dual family pension case, the code ‘D’ should befilled in this field otherwise the code ‘S’ should be filled in this field. ‘D’ denotesfor Double and ‘S’ for single.Where government employee died after retirement but before 24/09/2012, the Dual familypension will not be notified/processed through Civil pension Data Sheets. Such cases will beprocessed through Civil F. P. Data sheets. Where employee retired before 24/09/2012, beforeprocessing of Dual F. P. case through civil pension Data sheets it may be ensured that theindividual was alive on 23/09/2012.

Column 58(Gratuity withheld)If any ‘Government dues’ on a/c of Government accommodation are outstanding then in thiscolumn Ý’ should be filled otherwise it should be filled with ‘N’.If ‘N’ is required to be filled in the revised data sheet i.e. in case Retirement/death gratuity isnot to be withheld for the purpose of recovery of outstanding Government dues.

Column 59 (i) to 59 (v)Name Column The name of the dependant members of officer may be filled in thesecolumns. One box may be left blank between first middle and surname etc.

Whether HandicappedThis column may be filled with “Y” if the officer is having a handicapped childotherwise it should always be filled with “N” and in no case it should be left blank.

Column-A:- It should be filled with original PPO No. of individual.

Column-B:- It should be filled with Pensioner ID, allotted at the time of original PPO notification.

Column-C:- If original PPO has to be cancelled, it should be filled with ‘CAN’, otherwise it left blank.

If required other Column of DATA SHEET may be filled as per instruction given to fill Appendix-‘E’ (Post-2016).

OFFICE MEMORANDUM

Sub: Implementation of Government's decision on the recommendation of the SeventhCentral Pay Commission - Revision of provisions regulating pension/gratuity/commutation of pension/family pension/disability pension/ex-gratia lump-sumcompensation, etc.

The undersigned is directed to state that in pursuance of Government'sdecision on the recommendation of the Seventh Central Pay Commission, the Presidentis pleased to introduce the following modifications in the rules regulating pension,Retirement/Death/Service Gratuity, Family Pension, disability pension, ex-gratia lump-sum compensation, etc. under the CCS (Pension) Rules, 1972 and Commutation ofPension under CCS (Commutation of Pension) Rules, 1981, CCS (ExtraordinaryPension) Rules, 1939, etc.

2. These orders apply to Central Government Employees governed by theCCS (Pension) Rules, 1972. Separate orders will be issued by the Ministry of Defence,Ministry of Railways and the AIS Division of the DOPT in respect of Armed Forcespersonnel, Railway employees and the officers of All India Services respectively on thebasis of these orders.

DATE OF EFFECT

3.1 The revised provisions as per these orders shall apply to Government servantswho retire/die in harness on or after 1.1.2016. Separate order have been issued inrespect of employees who retired/died before 1.1.2016.

3.2 Where pension/family pension/Gratuity/Commutation of pension, etc hasalready been sanctioned in cases occurring on or after 1.1.2016, the same shall berevised in terms of these orders. In cases where pension has been finally sanctioned onthe pre-revised orders and if it happens to be more beneficial than the pension

becoming due under these orders, the pension already sanctioned shall not be revisedto the disadvantage of the pensioner in view of Rule 70 of the CCS (Pension) Rules,1972.

EMOLUMENTS

4.1 The term 'Emoluments' for purposes of calculating various pensionarybenefits other than various kinds of Gratuity shall have the same meaning as in Rule 33of the Central Civil Services (Pension) Rules, 1972.

4.2 Basic pay in the revised pay structure means the pay drawn in theprescribed level in the Pay Matrix with effect from 01.01.2016 but does not include anyother type of pay like special pay, etc.

4.3 In the case of all kinds of gratuity, dearness allowance admissible on thedate of retirement/death shall continue to be treated as emoluments along with theemoluments as defined in Paragraph 4.1 above.

PENSION

5.1 Subject to para 5.2, there shall be no change in the provisions regulatingthe amount of pension as contained in Rule 49 of the CCS(Pension) Rules.

5.2 The amount of pension shall be subject to a minimum of RS.9000/- and themaximum pension would be 50% of highest pay in the Government (The highest pay inthe Govt. is Rs 2,50,000 with effect from 1.1.2016). The provisions of sub-rule (2) of Rule49 of the CCS (Pension) Rules, 1972 shall stand modified to this extent.

5.3 The quantum of additional pension/family pension available to the old pensioners/family pensioners shall continue to be as follows:-

From 85 years to less than 90 years 30% of revised basic pension / family pension

From 90 years to less than 95 years 40% of revised basic pension / family pension

From 95 years to less than 100 years 50% of revised basic pension / family pension

100 years or more 100% of revised basic pension / family pension..

The Pension Sanctioning Authorities should ensure that the date of birth and the age of apensioner is invariably indicated in the pension payment order to facilitate payment ofadditional pension by the Pension Disbursing Authority as soon as it becomes due. The

amount of additional pension will be shown distinctly in the pension payment order. Forexample, in case where a pensioner is more than 80 years of age and his pension isRs.10,000 pm, the pension will be shown as (i) Basic pension=Rs.10,000 and (ii)Additional pension = Rs.2,000 pm. The pension on his attaining the age of 85 years willbe shown as (i).Basic Pension = Rs.10,000 and (ii) additional pension = Rs.3,000 pm.

Retirement! Death Gratuity

6.1 The rates for payment of death gratuity shall be revised as under:

Accordingly, Rule 50(1 )(b) of CCS (Pension) Rules, 1972 shall stand modified to thisextent.

6.2 The maximum limit of Retirement gratuity and death gratuity shall be Rs. 20 lakh.The ceiling on gratuity will increase by 25% whenever the dearness allowance rises by50% of the basic pay. Accordingly, first proviso under Rule 50(1 )(b) of CCS (Pension)Rules, 1972 shall stand modified to this extent.

FAMILY PENSION 1964

7.1 Family pension shall be calculated at a uniform rate of 30% of basic pay in therevised pay structure and shall be subject to a minimum of Rs.90001-p.m. and maximumof 30% of the highest pay in the Government. Rule 54(2) relating to Family Pension, 1964under CCS (Pension) Rules, 1972 shall stand modified to this extent.

7.2 The amount of enhanced family pension shall be 50% of basic pay in the revisedpay structure and shall be subject to a minimum of Rs.90001-p.m. and maximum of 50%of the highest pay in the Government. (The highest pay in the Govt. is Rs. 2,50,000 witheffect from 1.1.2016).

7.3 There will be no other change in the provisions regulating family pension,enhanced family pension and additional family pension to old family pensioners.

COMMUTATION OF PENSION

8.1 There will be no change in the provisions relating to commutation values, the limitupto which the pension can be commuted or the period after which the commutedpension is to be restored.

9.1 The pension/family pension under para 5 and 7 above shall qualify for dearnessrelief sanctioned from time to time, in accordance with the relevant rules/instructions.

FIXED MEDICAL ALLOWANCE

10.1 Fixed Medical Allowance to the pensioners who are residing in non-CGHS areasand are not availing OPD facility of CGHS shall continue to be paid at the existing rate tilla final decision is taken on the basis of recommendations of the Committee constitutedfor the purpose.

CONSTANT ATTENDANT ALLOWANCE

11.1 The amount of Constant Attendant Allowance to pensioners who retired ondisability pension with100% disability under the CCS (Extraordinary) Pension Rules,1939, (where the individual is completely dependent on somebody else for day to dayfunctions) shall continue to be paid at the existing rate till a final decision is taken on thebasis of recommendations of the Committee constituted for the purpose.

EX GRATIA LUMPSUM COMPENSATION

12.1 The amount of ex gratia lump sum compensation available to the families ofCentral Government Civilian employees, who die in the performance of their bona fideofficial duties under various circumstances shall be revised as under:

Death occurring due to accidents in course of performance of duties 25 lakh

Death in the course of performance of duties attributed to acts of 25 lakhviolence by terrorists, anti social elements etc.Death occurring in border skirmishes and action against militants, 35 lakhterrorists, extremists, sea piratesDeath occurring while on duty in the specified high altitude, 35 lakhunaccessible border posts, etc. on account of natural disasters,extreme weather conditionsDeath occurring during enemy action in war or such war like 45 lakhengagements, which are specifically notified by Ministry of Defenceand death occurring during evacuation of Indian Nationals from awar-torn zone in foreign country

13.1. Formal amendments to CCS (Pension) Rules, 1972 and CCS (Extraordinary)Pension Rules, 1939 in terms of the decisions contained in this order will be issued indue course. Provisions of the CCS (Pension) Rules 1972, CCS (Extraordinary) PensionRules, 1939, and CCS(Commutation of Pension) Rules, 1981 which are not specificallymodified by these orders, will remain unchanged.

14.1. These orders issue with concurrence of the Ministry of Finance Department ofExpenditure vide their U.O. No. 30-1/33(c)/ 2016-IC dated 03.08.2016

15.1. In their application to the employees of the Indian Audit and AccountsDepartment, these orders issue in consultation with Comptroller and Auditor General ofIndia.

16. Ministry of Agriculture etc. are requested to bring the contents of theseorders to the notice of Controller of Accounts/Pay and Accounts Officers and Attachedand Subordinate Offices under them on a top priority basis.
