Willow in Jackson. The meeting was called to order at 9:13 a.m. Commission present: Barbara Allen Chair, Mark Newcomb Vice-Chair, Paul Vogelheim, and Smokey Rhea. Natalia Macker arrived at 9:29 a.m. ADOPT AGENDA Smokey Rhea moved to adopt the agenda as presented. Paul Vogelheim seconded and the motion passed unanimously. PUBLIC COMMENT none ACTION ITEMS 1. Consideration of Payment of County Vouchers Paul Vogelheim moved to approve the March 11, 2016 vouch- ers in the amount of $453,015.36 and a second voucher run in the amount of $49,673.94. Smokey Rhea seconded and the motion passed 4-0 with Natalia Macker absent. 2. Consent for Proposed Outgoing Commissioner Correspondence Chief Deputy County Attorney Keith Gingery spoke to the Ambulance Service District and contract privity. He presented a letter addressed to the Teton County Ambulance Service District and gave historical information on the agreement. Chief Willy Watsabaugh spoke to a back-up plan that would be to certify the Idaho employees in Wyoming. Paul Vogelheim moved to approve the Teton County Ambulance Service Letter dated March 14, 2016 as presented. Mark Newcomb seconded and the motion passed unanimously. DISCUSSION ITEMS Review of the March 15 Agenda. The Board reviewed the agenda for the March 15, 2016 regular meeting for any chang- es and proposed items for the consent agenda. Phillip Delaney spoke to the construction contract for the Coroner’s office. Landfill Closure Cost Estimate & Funding. Heather Overholser of Integrated Solid Waste & Recycling reviewed the cost estimate, budget, and project funding for the Horsethief Canyon landfill closure project and landfill capping. Pending Board approval of the SLIB grant application on March 15, 2016 for landfill closure funding, staff will sub- mit this application for $5,120,188. If approved, all landfill closure/waste excavation/capping work from June 3, 2016 onward, excluding two budget line items that pertain spe- cifically to the construciton of the five acre operational pad, will be eligible for reimbursement at 50%, including up to 10% of engineering fees. As of February 29, 2016, there was $13,179,314 in Fund 34, the 2012 SPET for Landfill Closure and TTS. Staff recommended using $5,229,639 from this Fund to cover the remaining costs of this project. As of the end of February, approximtely $1.71 million has been spent out of Fund 34 on the Scale Plaza project and overall Taming the Wild Waste project engineering. South Park Boat Ramp. Parks & Recreation Director Steve Ashworth spoke to the bidding process for the ramp material and requested to add an agenda item to the March 21 voucher meeting. Matters from Commission. The Board reviewed their weekly calendar. County Commissioner Administrator Updates. Alyssa Watkins stated Teton County Housing Authority had request- ed to meet with the Board regarding Phase 3. This will be further discussed in tomorrow’s meeting under Matters from Commissioners. Commission Updates. Natalia Macker spoke to an open house on grooming and level of service on pathways to be held by Parks & Recreation. Mark Newcomb spoke to signage efforts by the Historic Preservation Board. Paul Vogelheim spoke to the WIR planning. Barbara Allen stated she and Smokey Rhea attended the Teton Village Association meeting last week. EXECUTIVE SESSION – not convened. FY2015 Annual Library Report. Library Director Valerie Maginnis presented the Library’s 2015 annual report. The report included visits, active card holders, total circulation, research questions answered by library staff, public space meeting room usage, attendance in the children and teen pro- grams, attendance in the adult programs, number of wireless users, and genealogy classes. The Board held discussion with Ms. Maginnis on various aspects of library operation and programs that are offered. Employee Service Award Presentations. The County Commissioners recognized the following county employees who had reached milestones in their employment: Five Years Shawn Means, Senior Planner with Planning and Development Ten Years Eva Dahlgren, Library Sally McCullough, Library Accounting Specialist Rick Smith, Facilities Maintenance Coordinator with Parks and Recreation Chris Crook, Recycling Operator with Integrated Solid Waste & Recycling Fifteen Years Jon Dahl, Deputy Sheriff on Patrol Dave Gustafson, Road and Levee Superintendent The meeting recessed for lunch at 11:16 a.m. and reconvened at 1:06 p.m. Review of 2015 Benefit Plan and Performance. Randy Johnson, Stephanie Mace, and Darrell Rollins of Hays Benefits presented a 2015 Retrospective Review and Utilization Analysis of county benefit performance. Consideration of Amendment #4 to the Golder Associates Contract #2 for Integrated Solid Waste & RecyclingCounty Engineer Sean O’Malley presented this fourth amend-ment to the second Golder Associates contract. The amend-ment would allow for completion of the waste relocation bid package, engineering support during construction, and con-struction quality assurance and construction management for the 2016 waste relocation.Paul Vogelheim moved to approve Amendment #4 to the County’s Contract with Golder Associates for the completion of the waste relocation bid package, engineering support during construction, and construction quality assurance and manage-ment for the 2016 waste relocation and earthworks project at Horsethief Canyon, in the amount of $282,595.00, a not-to-exceed amount. Consideration of a Bid Award and Contract for Fire Protection at the Transfer StationHeather Overholser of Integrated Solid Waste & Recycling presented this proposed award of bid to provide fire suppres-sion at the Transfer Station.The Board held discussion with Ms. Overholser on the force account, location of the bidders, and award for finishing early. Chief Deputy County Attorney Keith Gingery spoke to the in-state preference, bonus, and penalties.Paul Vogelheim moved to approve the Award of Bid to Dale Weaver Wyoming for the Transfer Station Fire Suppression project in the amount of $177,720 not to exceed, unit price work at $212,140 with a force account of $10,607 and delete subsection B of 4.03 (the bonus section). Natalia Macker sec-onded and the motion passed unanimously.

7. Consideration of a Construction Contract for a Coroner’s Office AdditionFacilities Manager Phillip Delaney presented this request to approve a construction contract for remodel addition of a restroom and fire suppression at the Coroner’s office at 3240 S. Adams Canyon Drive.The Board held discussion with Mr. Delaney regarding the number of bidders and cost overrun.Chief Deputy County Attorney Keith Gingery spoke to Wyoming labor laws.County Coroner Dr. Brent Blue spoke to the project’s original budget which did not include architect fees.County Clerk Sherry Daigle spoke to the current amount in the budget line item.Paul Vogelheim and Smokey Rhea voiced discomfort on the item based on having only one bid and questions on the con-tingency amount.Mr. Delaney spoke a prior project performed by Eagle Ridge Construction.Natalia Macker moved to continue this item to the March 21, 2016 voucher meeting. Smokey Rhea seconded and the motion passed unanimously.

8. Consideration of Matching Funds for the Teton Pass Centennial Trail – Federal Lands Access GrantCounty Engineer Sean O’Malley presented for approval for a Match Agreement with the Federal Highway Administration for the Federal Lands Access program (FLAP) Teton Pass

Centennial trail Project and approve a match not to exceed $36,019.00. He requested the motion be changed to include the Chair’s signature.Public comment was given by Tim Young and Jack Kohler.Mark Newcomb moved to approve the Match Agreement WY DOT 22(1) and approve a project match not to exceed $36,019.00 and request and require the Chair to sign. Smokey Rhea seconded and the motion passed unanimously.

9. Consideration of Agreement for Film Production with Warm Springs Productions, LLC regarding Teton County Search and RescueDeputy County Attorney Erin Weisman presented this request for an Agreement for Film Production highlighting Search and Rescue (SAR) operations. The County would receive $3,000 for each episode and the Sheriff’s office would have opportu-nity to review the episodes before they air.Lt. Slade Ross of the Sheriff’s Office spoke to the film crew being with SAR operations.The Board voiced concerns with this proposal and the con-tract. Lt. Ross spoke to the reputation of the filming company, the quality of their work, and their intent to capture success stories versus tragedy.Mark Newcomb restated his concern that Search and Rescue’s focus should remain on the mission and not be distracted by entertainment aspects.Paul Vogelheim moved to approve the Agreement for Film Production with Warm Springs Production, LLC, regard-ing Teton County Search and Rescue, amending the term in Article 3 from two years to one year. Natalia Macker sec-onded.The Board held further discussion and suggested meeting with the Sheriff’s office and Search and Rescue about the film production.Paul Vogelheim withdrew his motion and the Natalia Macker, as the second, agreed.Paul Vogelheim moved to continue this item to the April 12 regular meeting. Ms. Means first presented Final Development Plan DEV2015-0003, which was an amendment to a previously approved Final Development Plan DEV2004-0024. Ms. Means pro-vided historical information on this parcel. The amendment would exclude six acres from the PRD, allow subdivision of the remaining 53.2 acres within PRD, and no changes were proposed to the open space or existing easement. The result would be a six acre parcel which would be subject to no development approvals. Lot 1 would be 45.7 acres, with all open space, a main residence, guest house, and an office. Lot 2 would be 7.4 acres with a caretaker’s quarters and an attached garage. Key issues and Findings for Approval were presented. The Planning Commission and staff recommend approval with four conditions of approval.The Board held discussion with staff on non-subdivision PRDs, how this ties with the road exemption and the condition of approval, and relation to DEV2015-0006.Christen Hutton Holt representing the applicant presented a history on the property and applicant’s plans for the parcel.Property owner Jesse Combs made a presentation to the Board.Attorney representative for the applicant, Nicole Krieger made a presentation to the Board. The Board held discussion with Ms. Krieger.Public comment was open at 2:49 p.m. and given by neighbor Zaidee Fuller, Scott Garland an attorney representing Kevin and Lynn Graham and John and Linda Abrams who own the Moose Hollow Holdings LLC and Blue Skies West LLC par-cels, and Leah Corrigan. Public comment was closed at 3:07 p.m.The Board held discussion with staff on the number of units, open space standards and easements, and conditions of approval.Housing Authority Executive Director Stacy Stoker spoke to the affordable housing obligation.

Natalia Macker moved to approve Development Plan DEV2015-0003 based upon finding that the application meets the findings for approval of a Development Plan established in Section 8.3.2.C of the Teton County Land Development Regulations with the four conditions as recommended by staff and the Planning Commission:1. Approval of this proposal is conditioned upon approval of Administrative Adjustment ADJ2015-0008, being reviewed concurrently. Should ADJ2015-0008 be denied, the applicant shall either apply for and be granted approval of a Variance prior to application for Subdivision Plat to establish the lots proposed in this Development Plan, or the applicant shall improve Smoky Hollow Road such that it meets all applicable standards of Section 7.6.4. Necessary improvements shall be detailed in the Subdivision Improvements Agreement and adequate financial assurances shall be provided at the time of application for Subdivision Plat. The applicant shall be respon-sible for obtaining all necessary permits or approvals prior to initiating work and shall be required to complete the improve-ments to the road prior to issuance of a Building Permit for any physical development. 2. Concurrent with approval of the Development Plan, the applicant shall be required to pay an affordable housing fee-in-lieu in the amount of $108,776.25 to the County Treasurer, unless other arrangements with acceptable financial assur-ances are approved by the Board of County Commissioners. 3. Prior to approval and recordation of the Subdivision Plat, the applicant shall be required to pay a development exaction

fee-in-lieu, currently estimated as $14,778.00; to be updated based on the market values of the parcels identified above at or immediately prior to recording of the Subdivision Plat. 4. The proposed Shared Well Agreement shall be recorded concurrently with Subdivision Plat.Smokey Rhea seconded.

Natalia Macker suggested a timeframe on the housing fee-in-lieu; Ms. Means suggested condition #2 could be changed.Mark Newcomb, Paul Vogelheim, and Barbara Allen stated they could not make all the findings for this application before the road was addressed.This motion was left on the table in order to hear the roadway exemption ADJ2015-0008.

Amy Ramage from County Engineering presented ADJ 2015-0008, an Administrative Adjustment for Road Exceptions Request for Smoky Hollow Road. Smoky Hollow Road was a private road with access from a Forest Service Road called Mosquito Creek Road. The exception requests were to allow for a 14’ road width, a 75’ turning radius, and a maximum grade of 11-12.6%. Ms. Ramage provided the criterion reviewed for road exceptions and Findings for Approval.The applicant Jesse Combs spoke to Smoky Hollow Road repair and maintenance.Attorney Nicole Krieger addressed the Board on behalf of the applicant.Dan Smith of Nelson Engineering addressed the Board on behalf of the applicant.The applicant Jessie Combs spoke to additional improvements planned for the road.Public comment was given by Robbie Fuller, Reed Armijo, and Lynette Abrams.The Board held discussion and Mr. Smith spoke to the guard rail issue.Paul Vogelheim asked for clarity on the guard rail design and suggested continuing this item.

Paul Vogelheim moved to continue DEV2015-0003, ADJ2015-0008, DEV2015-0006, and ADJ2015-0009 to the April 12 regu-lar meeting. Natalia Macker seconded and the motion passed unanimously.

DISCUSSION ITEMSThe Grove Phase 2 Monthly Update. Executive Director of the Housing Authority Stacy Stoker introduced Chet Lockard of Project Guide Services (PGS). Mr. Lockhard provided an update on the construction progress of Phase 2 and the devel-opment budget. The Board held discussion with Mr. Lockard and Ms. Stoker.

Matters from Commission. The Board reviewed their weekly calendar. Chief Deputy County Attorney Keith Gingery sug-gested a method to advertising, interviewing, and appointing members to the new regional housing authority.

Attorney’s office update regarding IAFF Local 5067. Keith Gingery spoke to a November 2015 Attorney General’s opin-ion issued to Campbell County regarding union formation. Volunteer firefighters were considered a paid firefighter due to receiving pay for the event and contributions to both worker’s compensation and to a volunteer retirement plan. The AG concluded that this means they are paid and should have been included in the union formation vote.Discussion took place on how to proceed, drafting a letter to Local 5067 for the Board to review this afternoon, protecting the volunteers, coordinating with the Town, and discussing this matter further this afternoon.

County Commissioner Administrator Updates. Alyssa Watkins provided an update on a staff meeting this Wednesday with Teton County Idaho, Victor, the Town and County.

Commission Updates. Natalia Macker gave an update on the Airport Board meeting. Paul Vogelheim spoke to the WIR planning process.

Stilson Agreement Update. Barbara Allen complimented Jerry Blann, Melissa Turley and Chris Hawks (who were pres-ent in the audience) regarding the large concert held in Teton Village over the weekend and how well the crowd and traffic was orchestrated.Parks & Recreation Director Steve Ashworth spoke to his department’s maintenance and management responsibilities at the Stilson Ranch Parking and Transit Facility as outlined in the 1997 Teton County and Jackson Hole Ski Corporation agreement. He described the level of service proposed for the upcoming season.County Planning Manager Susan Johnson spoke to the park-ing use at Stilson.Jerry Blann of Jackson Hole Mountain Resort and Teton Village Association board member first spoke to the concert and the collaborative effort that contributed to the event’s success. He then spoke to the Stilson Agreement accepted in 1997 and an updated draft agreement.The Board held discussion.

Focal Habitat Project Update. County Planner Susan Johnson provided an update on the Focal Habitat Feature project. The report prepared by Biota went through an expert peer review with mixed response. Wyoming Game & Fish attempted to help by validating the report but concluded that the report should be conducted again. Staff recommended rebidding the

project with new specifications in the request for proposals process. Ms. Johnson provided copies of an October 2015 let-ter from Wyoming Game & Fish and Mule Deer Focal Habitat Feature maps to the Board.The Board held discussion on the maps provided by Game & Fish, the request for proposal process, and updating the Natural Resource Overlay (NRO).Hank Phibbs, Chair of Natural Resources Technical Advisory Board (NRTAB) suggested speeding up the process by allow-ing NRTAB to work directly with Game & Fish on the project.

Annual Indicator Report and Work Plan Discussion. Joint Planning Director Tyler Sinclair and Long Range Planner Alex Norton quickly provided an overview of the 2016 Indicator Report and 2016-17 Implementation Work Plan in preparation of the April 15 joint meeting. Annual Indicators included nineteen points in the areas of Amount of Growth, Location of Growth, and Type of Growth. Due to time con-straints, the Board asked staff to provide the full presentation tomorrow at 9:00 a.m.

Teton County Housing Authority – The Grove Phase 3. Present from the Teton County Housing Authority (TCHA) were Jeff Collins, Brian Siegfried and Executive Director Stacy Stoker. Discussion took place on the TCHA’s recommendation for The Grove Phase 3. TCHA presented an option of selling property in order to fund Phase 3 as it is currently designed and permitted. TCHA properties available for sale included Cheney Lane, Rains Property, Phase 1 Grove Building, and the 260 W. Broadway Building. Several category mix and funding scenarios were presented. Fannie Mae funding on condomini-ums was discussed. The buyer pool for employment-based units was larger than categories 1, 2, or 3. Concerns voiced by TCHA regarding Habitat’s proposal related to the design pro-cess and permitting, financing of Phase 3, parking, livability during construction, longevity of the timeframe to complete Phase 3, the need for a homogeneous and consistent neighbor-hood, and being able to serve a wider range of people.Discussion took place with Chet Lockard of Project Guide Services and Christina Feuz of Habitat for Humanity.Keith Gingery spoke to the expired bid from GE Johnson for Phase 3 and a new complete hard bid process for Phase 3 would need to begin. He explained the stepped approval process that has been taken for The Grove, which the Board approved at the onset of the project. The bid process would take about six weeks and The Grove Phase 3 design docu-ments are ready to go for bidding.Further discussion was held, then Ms. Feuz fielded questions from the Board on Habitat’s vision, timeframe, going from three-stories to two-stories and parking two cars, and that their design would provide 24 units in four years.Mark Newcomb asked for clarification on what Habitat’s design process would entail – going through the Town’s pro-cess and costs, and design costs. Natalia Macker asked about TCHA’s Fannie Mae financing on Phase 2, and if Phase 3 went to Habitat would TCHA’s recommendation on the Phase 2 category mix change. Paul Vogelheim asked to get the Town’s commitment of $1 million in writing just to firm that up and which category had the highest need in the community. Ms. Stoker stated she would research TCHA applications to pro-vide that information. Barbara Allen suggested having another session in the next few weeks, working the schedule around spring break.

MATTERS FROM COMMISSIONIAFF Local 5067. Barbara Allen spoke to the draft letter addressed to John Tobey of IAFF Local 5067 provided by Mr. Gingery. Keith Gingery spoke to a March 20, 2016 Gillette Record newspaper article regarding the Campbell County fire union. He called the Campbell County attorney’s office and requested a copy of the AG’s letter. The Attorney General’s (AG) opinion dated November 16, 2015 addressed volunteer firefighters as being part of the paid members of the fire department. Based on the AG’s opinion, Campbell County stopped recognizing the fire union and stopped their collective bargaining negotiations based on Statute 27-10-103 not being followed.Mr. Gingery explained his draft letter and attachments. An argument could be by the volunteers that they had been dis-enfranchised and a new vote should take place on who should be the sole bargaining agent for the firefighters and include all of the firefighters, He had been in contact with IAFF Local 5067’s attorney David Evans and relayed Mr. Evans’ message to the Board.Town Manager Bob McLaurin stated the Town would hear the same issue that afternoon.Paul Vogelheim moved to approve and request and require the Chair to sign the letter addressed to John Tobey, International Association of Firefighters Local 5067 dated March 21, 2016 as presented by staff and request that this letter be presented to Mr. Tobey today. Natalia Macker seconded and the motion passed unanimously.

The Teton County Board of Commissioners met in special session on March 22, 2016 in the Commissioners Chambers located at 200 S. Willow in Jackson. The meeting was called to order at 9:09 a.m.Commission present: Barbara Allen Chair, Mark Newcomb Vice-Chair, Natalia Macker, Paul Vogelheim, and Smokey Rhea.

DISCUSSION WITH PLANNING DEPARTMENT: Comprehensive Plan 2016 Annual Indicator Report and 2016-17 Work PlanLong Range Planner Alex Norton stated today’s discussion was to prepare the Board for the joint presentation on April 15 and to potentially be able to take action on the proposed Work Plan. The Town had a similar presentation in preparation as well. The Jackson/Teton County Comprehensive Plan includes 19 indicators of the community’s success in managing the amount, location, and type of growth so that it represents the vision described in the Plan. While these indicators are com-piled and reported annually, to inform budgeting and strategic work planning, it is the longer term trends that most interest the community. Corrective actions to affect trends are evalu-ated through a Growth Management Program described in the Comprehensive Plan once the community has grown five percent.Mr. Norton and Regan Kohlhardt, Associate Long Range Planner, stepped through each of the annual indicators and included discussion with the Board as needed. Trends as stated in the 2016 Annual Indicator Report:Amount of Growth. Since adoption of the Comprehensive Plan, the number of residential units in the community has grown 3.9% (384 units).Location of Growth. In 2015, 61% of residential units were built in Complete Neighborhoods. This raised the percentage of residential growth in Complete Neighborhoods since adop-tion of the Comp Plan to 56%. While short of the community’s goal that 60% of growth occurs in Complete Neighborhoods, the recent trend is positive as the percentage of units built in Complete Neighborhoods has grown in each of the past 5 years.Type of Growth. The local workforce is growing slower than local jobs meaning the percentage of the workforce that lives locally is declining. Less than 60% of the workforce lives local-ly at this point, while the community’s goal is to house at least

Trends also indicate positive progress in con-servation of wildlife and scenic resources and reducing wildlife vehicle collisions.Key Takeaway points in the Indicator Report:1. Adoption of the Rural LDRs was a major accomplishment in meeting the community’s goal that less than 40% of growth be located in rural areas. But it must be complemented by allowances and incentives for workforce housing in complete neighborhoods if the community is also going to meet its goal of housing 65% of the workforce locally.2. Jobs are being created at a faster rate than housing units or nonresidential floor area is being constructed. This indi-cates that growth is being driven by more than just develop-ment, and therefore development regulations alone cannot be expected to address all of the issues associated with growth. More work is needed to understand the other drivers of growth and how to mitigate their impacts.3. For a major planning or LDR project to be efficient and effective the community, Electeds, and staff need to stick to an efficient, predetermined schedule. A set schedule allows for one step of the process to build on another and avoids changes in direction due to changes in circumstances and elected officials. Because continuity is so important, the community, Electeds, and staff cannot be expected to engage in more than 3 efforts at once.The 2016-2017 Work Plan was presented with the major areas being LDR Updates, Coordination in Comprehensive Plan Implementation, Comprehensive Plan Administration, and Data Maintenance and Provision. Staff impacts and fis-cal resources were discussed. A five-year work plan was also presented.No action was taken by the Board.

Notice is hereby given that Teton County, Wyoming (Owner) will receive sealed bids prior to 10:00 AM MDT on Wednesday, April 27, 2016 at the Teton County Road & Levee Office, 3190 South Adams Canyon Road in Jackson, Wyoming, at which time the Bids received will be publicly opened and read aloud. The Project consists of application of dust control agent to various County roads in Teton County, Wyoming. Total project length is approximately 11.5 miles. Any bids received later than the time specified above will be rejected and returned unopened to the bidder.

• Public Notices •SECTION 2 OF TOWN OF JACKSON ORDINANCE NOS. 1074 (PART) AND 1094 AND DIVISION 6.1.10(D) OF THE TOWN OF JACKSON LAND DEVELOPMENT REGULATIONS REGARDING WIRELESS COMMUNICATIONS FACILITIES; AND PROVIDING FOR AN EFFECTIVE DATE.NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF JACKSON, WYOMING, IN REGULAR SESSION DULY ASSEMBLED THAT:SECTION I.Section 2 of Town of Jackson Ordinance Nos. 1074 (part) and 1094, and Division 6.1.10(D) of the Town of Jackson Land Development Regulations are hereby amended and reenacted to read as follows:DIVISION 6.1.10 – Transportation and Infrastructure Uses D. Wireless Communications Facilities1. Definitions. a) A Wireless Facility is a facility consisting of a Base Station and any structure or modifications to a structure constructed or designed to support a Base Station or any portion of a Base Station. The term specifically includes, but is not limited to a Tower. b) Wireless Communications Facility - Major is any new Wireless Facility and any modification to an Existing Wireless Facility other than a modification for which an applicant seeks a Basic Use Permit pursuant to Section IV.c) Wireless Communications Facility – Minor is an Eligible Facilities Request under Section 6409 of the Middle Class Tax Relief and Job Creation Act of 2012, 47 U.S.C. 1455(a), or as amended, for so long as the Town is obligated by federal law to consider requests submitted under that section. 2. Exempt Facilities. The following are exempt from all approval processes:a) A Carrier on Wheels or Cell on Wheels (COW) temporary wireless communications facility, upon the declaration of a state of emergency by federal, state, or local government, and a written determination of public necessity by the Town of Jackson designee; except that such facility must comply with all federal and state requirements. No communications facility shall be exempt from the provisions of these LDRs beyond the duration of the state of emergency.b) A COW temporary wireless communications facility for the purposes of providing coverage of a special event, and sub-ject to federal and state requirements. Said communications facility may be exempt from the provisions of this section up to one week before and after the duration of the special event.3. Standards for Wireless Facility Permits. a) Not in Lieu of Other Required Permits or Authorizations. Any permit to place a Wireless Facility issued under this ordinance and any exemption under subsection C autho-rizes placement of a facility at a location as proposed and as approved in the permit or as provided within the exemp-tion, with the permission of the entity that controls access to that property. It is not in lieu of building permits, electrical permits, or any other permits or authorizations that may be required as a condition of construction or operation of a Wireless Facility, and it does not excuse compliance with any other law, regulation, practice or other requirement under federal, state or local law; nor does it authorize any action that creates a hazard. b) A Wireless Facility Conditional Use Permit is valid for 5 years. c) A Wireless Basic Use Permit shall be valid for the shorter of (a) 5 years; or (b) for such period as the FCC rules in effect on June 20, 2015 remain in effect and are applicable to the facility. The Wireless Basic Use Permit is issued solely to comply with a requirement established by federal law, and is not intended to grant any rights under state or local law or to survive any alteration to the federal law or associated regula-tions. d) Standards for Wireless Facility Conditional Use Permit.1. All Telecommunications Conditional Use Permit applica-tions must contain the following:i. Application form signed by applicant; ii. Copy of a lease or letter of authorization from property owner evidencing applicant’s authority to pursue the applica-tion. Such submissions need not disclose financial lease terms; iii. Site plans detailing proposed improvements which must include the details consistent with the Administrative Manual;iv. Documentation from a licensed professional engineer of calculation of the Fall Zone and certification that the new wireless support structure has sufficient structural integrity to accommodate the required number of additional users as provided in this ordinance;v. Documentation proving compliance with American National Standards Institute (ANSI) standards for electro-magnetic radiation: In order to protect the public from exces-sive exposure to electromagnetic radiation, the facility appli-cant shall certify through a written statement that the facility meets or exceeds current ANSI standards as adopted by the FCC;vi. Affirmation by the applicant in a written statement that the proposed facility complies with all FCC regulations, including, but not limited to “The Enhanced Best Practices Guide,” as set forth in Appendix D of FCC 04-168 (released August 6, 2004, or as amended). The applicant shall submit a statement that the application is in compliance with all FCC rules regarding interference to other radio services and the applicant shall submit a statement of compliance with all FCC rules regarding human exposure to radio frequency energy; vii. Affirmation by the applicant in a written statement that the new Tower and, if applicable, the modified Tower or Base Station, comply with all non-discretionary structural, electri-cal, energy, building, and safety codes; and 2. Design Review Committee: All Wireless Communications Facility – Major uses shall be subject to review by the Design Review Committee (DRC) prior to submission of the Planning Commission. The DRC shall review such facilities for consis-tency with the stealth requirements in Sec. 6.1.10.D.3(f).3. Procedure, Timing, Final Decision.i. Refer to Sec. 8.2.5(D) and Sec. 8.2.8(B).4. Bonding.i. Refer to Sec. 8.2.115. Permit Revocation and Suspensioni. Refer to Div. 8.9.6. Zones where allowed use.i. Business Park-Town (BP-ToJ).

ii. Public/Semi-Public – Town (P/SP-ToJ). iii. Planned Resort District (PR-ToJ). e) Standards for Wireless Facility Basic Use Permit 1. All notice only applications must contain the following: i. Statement certifying that the request is being made pursu-ant to Section 6409 of the federal Middle Class Tax Relief and Job Creation Act of 2012, 47 U.S.C. 1455(a) and complies with all regulations set forth therein. ii. The location of where the modification work will take place. iii. The date(s) and time(s) during which the work will take place. iv. Statement certifying compliance with all non-discretionary structural, electrical, energy, building, and safety codes2. Procedure Timing, Final Decision.i. Refer to Sec. 8.2.5(E) and Sec. 8.2.8(B).f) General Standards and Design Requirements1. All Wireless Facilities permitted under this ordinance are required to be Stealth Facilities unless it can be clearly dem-onstrated to the satisfaction of the Planning Director or his or her designee that a non-Stealth Facility will have concealment elements that more effectively minimize visual impacts than a Stealth Facility (which showing may be made for the Wireless Facility as a whole, or particular elements of the facility), there is a demonstrated need for a non-Stealth Facility, or the facil-ity is an exempt facility as set forth above in Sec. 6.1.10(D)(2); or is not subject to Stealth obligations under federal law. Every Wireless Facility shall employ concealment elements to minimize visual impacts. 2. All Wireless Facilities shall be subject to the following standards, except to the extent federal law prevents the appli-cation of the standards to a Basic Use Permit.: i. Determination of Need. No Tower shall be permitted unless the applicant demonstrates that no existing public facility or Tower can accommodate the applicant’s proposed use without causing a substantial change to an existing Tower, or otherwise creating a greater visual impact, or that use of an existing Tower would prohibit or have the effect of prohibiting provision of personal wireless services in the area to be served by the new Tower. No modification of a Wireless Facility, other than a modification permitted under Sec. 6.1.10(D)(3)(e), shall be permitted unless applicant shows, denying the modification as proposed that would prohibit or have the effect of prohibit-ing provision of personal wireless services in the area to be served by the new Tower. ii. Concealment Element. A Concealment Element is defeated for purposes of this ordinance if the modification:1. Fails to meet a condition of approval;2. Frustrates the purpose of a condition of approval;3. Changes a Stealth-Designed Facility or alters a Concealment Element such that the modified facility will no longer be as effectively concealed or disguised; 4. Changes a Stealth-Designed Facility or alters a Concealment Element such that the modified facility no longer blends in with its surrounding nature or architecture; or 5. Changes a Stealth-Designed Facility or alters a Concealment Element such that the presence, purpose or nature of the facility become more readily apparent to a rea-sonable observer.iii. Height. 1. The highest point of any free-standing Wireless Facility shall be 30 feet above ground level.2. The highest point of any roof-mounted Wireless Facility shall be 5 feet above the roof on which it is affixed. iv. Setbacks. Wireless Facilities shall be subject to the set-backs described below:1. If the supporting structure has been constructed using breakpoint design technology, the minimum setback distance must be equal to, at minimum, 110% of the distance from the top of the supporting structure to the breakpoint level of the structure, or the minimum yard setback requirement, which-ever is greater. EXAMPLE: On a 50-foot tall Monopole with a breakpoint at 20 feet, the minimum setback distance would be 33 feet (110% of 30 feet, the distance from the top of the Monopole to the breakpoint) or the minimum yard setback requirements.2. If the supporting structure is not constructed using break-point design technology, the minimum setback distance shall be equal to the height of the supporting structure.v. Other Conditions. Wireless facility sites designed and maintained to be visually compatible with adjoining terrain and structures, shall not be used for the storage of any excess equipment or hazardous materials, and shall not have in or around them any outdoor storage. vi. Landscaping. Wireless facility sites shall be landscaped with the intent of screening and buffering. At minimum 75% of the ground mounted elements of the Wireless Facility (not including a Tower or supporting structure) must be obscured within 3 years of construction completion. vii. Signage. Commercial messages shall not be displayed on any Tower, Base Station, or transmission equipment. Required noncommercial signage shall be restricted to ASR (Antenna Structure Registration Number as required by the FAA and FCC) and shall list the party responsible for operation and maintenance of the facility and a 24-hour telephone number at which an operator can be reached in case of emergency, and security and/or safety signage required by law or expressly permitted by the Town. viii. Lighting. Lighting shall be prohibited on all Wireless Facilities unless required by the Federal Aviation Administration (FAA) or by the FCC. Lighting required by the FAA shall satisfy, but not exceed, the minimum standards and shall be of minimum intensity and number of flashes per min-ute allowed by the FAA, or shall be a dual lighting system.ix. Quantity Limit. Only one Tower shall be permitted per legally created parcel of property.x. Emergency Generators. Emergency generators are permit-ted and are exempt from noise requirements during emergen-cies. xi. Noise Level. All sounds or noise emanating from a Wireless Facility, whether temporary or permanent, must com-ply with Sec. 6.4.3.xii. Visibility. In addition to the foregoing:1. Lattice and guyed Towers are prohibited. 2. Antennas shall be flush-mounted, unless it is demon-strated through RF propagation analysis that flushmounted antennas will not meet the network objectives of the desired

coverage area, will not allow for concealment elements and/or will not allow for a Stealth Facility, are inconsistent with the proposed design, or prohibit collocation.3. New Towers shall be constructed to accommodate colloca-tion of as many antenna arrays as feasible without causing interference, subject to height limits, Stealth Facility require-ments, and concealment elements.xiii. Notice Requirements. Refer to Sec. 8.2.14(C)(2)(iii). xiv. Access: No facility shall be built so as to cause the Right-of-Way in which the facility is located to fail to comply with the Americans with Disabilities Act or otherwise obstruct access.xv. Security: All facilities shall be designed to be resistant to and minimize opportunities for unauthorized access, climbing, vandalism, graffiti, and other conditions, which would result in hazardous conditions, visual blight, or attractive nuisances. However, all security designs and measures must be consis-tent with the concealment elements of the wireless facility. xvi. Building Design: Roof-mounted or structure-mounted Towers shall be in scale and architecturally integrated with the building design to appear visually unobtrusive. The high-est point of any structure-mounted Tower shall be 5 feet above the structure.g) Miscellaneous Provisions 1. Abandoned or Discontinued Use of Wireless Facilityi. Each permittee who intends to abandon or terminate the use of any Wireless Facility shall notify the Town of such intentions no less than 60 days prior to the final day of use. Said notification shall be in writing, shall specify the date of termination, the date the Tower or Base Station or Transmission Equipment will be removed, and the method of removal.ii. Non-operation, disuse (including, but not limited to, cessa-tion of wireless services) or disrepair for 90 days or more shall constitute abandonment by the permittee under this section. The Planning Director shall send a written notice of abandon-ment to the permittee. iii. If a Wireless Facility is abandoned but not removed within the specified time frame, the Town may remove the facility and place a lien on the property. Towers being utilized for other purposes, including but not limited to light standards and power poles, may be exempt from this provision.iv. An owner wishing to extend the time for removal or reac-tivation shall submit an application stating the reason for such extension. The Planning Director may extend the time for removal or reactivation up to 60 additional days upon a showing of good cause. If the Tower or antenna is not removed within this time, the Town may give notice that it will con-tract for removal within 30 days following written notice to the owner. Thereafter, the Town may cause removal of the Wireless Facility. v. Upon removal of the Wireless Facility and/or any other accompanying structures, the Wireless Facility owner shall return the site to its natural state and topography and vegeta-tion consistent with the natural surroundings or consistent with the current uses of the surrounding or adjacent land at the time of removal, excluding the foundation, which shall be reduced to below finished grade. If the Tower owner failed to remove the Wireless Facility and/or any other accompanying structures in accordance with this provision and failed to pay for the removal of the abovementioned facility and appurte-nances, the owner must pay the Town for the cost it incurred in removing the Tower and appurtenances and remediat-ing the site. The Town may, in lieu of storing the removed Wireless Facility and/or any other accompanying structures, convert it to the Town’s use, sell it, or dispose of it in any man-ner deemed appropriate by the Town.h) Facilities that Exist on the Date of Adoption of this Ordinance1. Activities at Non-Conforming Wireless Support Structures. Notwithstanding any provision of this Ordinance: i. Collocation that does not cause a substantial change to an Existing non-conforming Tower shall not be construed as an expansion, enlargement or increase in intensity of a non-conforming Tower.ii. Any change to an Existing Tower or Base Station that would be substantial if made must be permitted under the Telecommunication Conditional Use Permit process in Sec. 6.1.10(D)(3) and deprives the Tower or Base Station of its non-conforming status. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.SECTION III. If any section, subsection, sentence, clause, phrase or por-tion of this ordinance is for any reason held invalid or uncon-stitutional by any court of competent jurisdiction, such por-tion shall be deemed as a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of the ordinance.SECTION IV. Upon having parked up to forty-eight (48) consecutive hours, a vehicle must be vacated from the parking garage for a period of no less than three (3) hours before the vehicle may be permitted to park within the parking garage again. No person shall park outside the marked lines of a des-ignated parking space so as to obstruct the ability of another vehicle to park in the adjacent parking space. (Ord. § 1, 2016.) C. Any Special Event which generates noise from any source exceeding eighty (80) decibels as measured under Section 9.44.040 of this Municipal Code requires permission from the Town Council as part of the Special Event applica-tion. District #2 comprises all areas north of Strawberry Creek Road to County Road 119 then west of Highway 89 to the Teton County boundary, including Wayan, Freedom areas and north Alpine.

District #5 comprises the town of Jackson, east of Cache Street and all areas north of Zenith Drive, excluding Jackson Hole Golf & Tennis Club.

Any ten (10) or more members of any district may make a nomination by petition. The names nominated will be placed on the printed ballot and voted upon by proxy or at the annual meeting of the members on June 23, 2016 in Afton, WY.

Prospective candidates should be aware of the following established policy:

A board member:

1. Must be a member and a bona fide resident of a director district as provided for in the bylaws.

2. Must be willing to promote and safeguard the interests of the cooperative and represent the membership on an impartial basis for the good of the entire cooperative.

3. Must not, in any way, be employed by or financially interested in any enterprise primarily engaged in selling energy as described in the bylaws of the cooperative.

4. Must not be employed by the cooperative or have a near-relative employed by the cooperative. Must not have been an employee of Lower Valley Energy within the last five (5) years.

5. Must be willing to attend regularly scheduled and special meetings of the board of directors, plus meetings of national, state, and local organizations with associated interests. Directors must also be willing to attend training institutes or seminars that will aid in keeping him/her well informed on matters affecting the cooperative.

6. Is aware that members of the board of directors serve on a fee basis for time given to regularly scheduled and approved affairs of the cooperative. In addition, they will be reimbursed for all reasonable expenses in connection with such scheduled activities.

7. Must agree to serve the term of office for which elected until a successor has been appointed or elected.

8. Shall not use, or cause to be used, the position as direc-tor to further political ambitions.

RST Sand and Gravel of Jackson, Wyoming has applied for a small mining permit from the Land Quality Division of the Department of Environmental Quality for the State of Wyoming. The mining permit area for the mining of sand and gravel will be located in: Sections 17, 18, & 19, T40N, R116W, Teton County, Wyoming. The proposed gravel opera-tion is located north of South Park Loop Road approximate-ly one mile west of US Highway 89. The proposed operation is scheduled to begin June, 2016 and is estimated to con-tinue until at least the year 2045.

Information regarding the proposed mining operation and reclamation procedures may be reviewed in the Office of the Land Quality Division of the Department of Environmental Quality in Cheyenne and Lander, Wyoming, or the Teton County Clerk’s Office in Jackson, Wyoming. Written objec-tions to the proposed mining operation must be received by the Administrator of the Land Quality Division of the Department of Environmental Quality, Herschler Building, 122 West 25th Street, Cheyenne, WY 82002, before the close of business May 20, 2016. If an objection specifi-cally requests a public hearing before the Environmental Quality Council, a public hearing shall be held within twenty (20) days after the final date for filing objections unless a different period is stipulated to by the parties. The Environmental Quality Council or Director shall publish notice of the time, date and location of the hearing or con-ference in a newspaper of general circulation in the locality of the proposed operation once a week for two (2) consecu-tive weeks immediately prior to the hearing or conference.
