From the Editor . . . Ashburn Farm Association will be holding its Annual Meeting of the Board of Trustees on April 7th this year. At this meeting, members

of the community have the chance to vote for Board of Trustees members for the 2020-2022 term .

The Board of Trustees is a great committee that is essential to the functioning of Ashburn Farm. If you are interested in running for one of the available positions, please see pages 6 - 8 for more information. If you have any questions, please feel free to call the Association Office at 703-729-6680 .

The Association staff is also working on lots of exciting eventsfor this spring and summer. The first event of the year, the annual Wine & Beer Tasting, is scheduled for Friday, March 13th. The registration form is available on page 9. Our next event, the Easter Bunny Brunch, will be held on Saturday, April 4th. See page 12 for all the details. Volunteers are still needed to help with both of these events. If you are interested in joining us for either of them, please contact Kristen ([email protected]).

As always, there will be a Spring Community Yard Sale for those of you looking to do some spring cleaning (scheduled for Saturday, June 6th this year). We are also in the process of planning this year’s and our Annual Summer Kick Off (scheduled for Saturday, May 23rd).

If you would like to help with any of these great events, our Events staff is always in need of more volunteers, and they would love your help! Information about the committee is available on page 19. Contact Kristen ([email protected]) for more information on any of the events or to sign up to volunteer.

REMINDER: EXTERIOR ALTERATION APPLICATIONS

Spring is just around the corner, and many residents are already planning spring renovations for their homes. Please remember that all changes to the exterior of your home require a completed Exterior Alteration Application be submitted to, reviewed by, and approved by the ARB, prior to the work being started .

All completed EAA’s to be reviewed by the ARB must be received in the Association Office on or before the Thursday prior to the scheduled ARB meetings. The ARB meets the 2nd and last Thursdays of the month .

The Board of Trustees is an all-volunteer resident group that is responsible for interpreting the covenants and rules governing Ashburn Farm. Board of Trustees meetings are held on the first Tuesday of each month at 7:00 pm at the Windmill Community Center located on Windmill Drive. All Ashburn Farm homeown-ers are encouraged to attend.

Ashburn FarmAssessments & General Information

Collection PolicyAssessments are due the first day of each month. Any install-ment of the annual assessment not paid to the Association within thirty (30) days after the due date shall be considered delinquent and a late charge of $25.00 shall be assessed to the Owner and posted to the Owner’s account for every thirty (30) days delinquent .

Home SalesEffective July 1, 1989, the Virginia General Assembly enacted a new law entitled the “Virginia Property Owner’s Association Act”. This act requires the seller of a home to make certain disclosures to the intended purchaser of their lot . All home sales in Ashburn Farm are subject to the Virginia Property Owner’s Association Act. A written request of the Association Disclosure Package and a check in the amount of: $225.00 for an electronic disclosure (on CD-R) for townhome/single family; $250 for a paper disclosure for townhome/single family; $100 for electronic or paper disclosure for condo; are required to begin process-ing. A rush fee of $50.00 may be paid to receive your disclosure within 3 days. Checks should be made payable to the Ashburn Farm Association. A form is available on the website or at the Association Office. The completed package will be issued within 14 calendar days to the requesting party or agent. For further information, please contact the Association Office.

Board BriefsA complete draft of the BOT meeting minutes will be reviewed and voted on at the next BOT meeting. The complete set of minutes may be viewed at the Association Office.

At the regular BOT meeting held on January 14, 2020, the following items were discussed:

• President, Steve Lovejoy, called the meeting to order at 7:00 PM.

• A motion passed (4/0/1/1) to approve the December 3, 2019 minutes, as submitted.

APPEALS• 21243 Smokehouse Court, Appeal of Wire Mesh on

Fence – The homeowner was not able to attend due to the rescheduling of the meeting. A motion was made to approve the appeal of wire mesh fence for the property located at 21243 Smokehouse Court . The mesh is located on the outside of the fence . The fence is old, and it will likely need to be replaced in the near future. A friendly amendment to the motion was made to give the homeowner 12 months to move the wire mesh to the inside of the fence. The motion was withdrawn. A motion passed (6/0/0/0) to grant the homeowner at 21243 Smokehouse Court 12 months to either remove or relocate the wire mesh on his fence to the inside of the fence .

• 21052 Cornerpost Square, Compliance Date Extension Request – The homeowner did not attend the meeting. A motion passed (6/0/0/0) to extend the compliance date to June 30, 2020 for the property located at 21052 Cornerpost Square .

• 20958 Timber Ridge Terrace #101, Appeal of Late Charge – A motion passed (6/0/0/0) to waive the $25 late charge and $5 administrative fee for the property located at 20958 Timber Ridge Terrace #101 . The homeowner has brought his account current, and his payment history shows that he has made prompt monthly payments .

REPORTS• Architectural Review Board – No report.

• Budget & Finance – Steve Lovejoy stated that revenue is on target with the budget, and expenses are slightly under-budget. The next B&F meeting is scheduled for late January. It is hoped that Summit Management will have the December financials available for that

meeting. Steve Lubore stated that he would like to discuss some investment options at the upcoming B&F meeting.

• Manager’s Report Windmill and Chokeberry Pond – Work has been done on these ponds over the last two years to try to reduce the sediment build up. A bathometric study was recently done on both ponds. It showed that the work has helped slow the sediment build up, but they will likely need to be dredged at some point in the future. This will be a General Reserve consideration. It was recommended that the ponds be treated again this year to postpone the dredging as long as possible.

OLD BUSINESS• Association Covenants & Standards Evaluation – ARB

member, Corrado Dugo, provided feedback on the proposed changes. Mr. Brewer recommended holding another meeting with ARB members, staff, and BOT members to review the Architectural Design & Main-tenance Standards and comments from the Board . It was noted that many of the current standards were in support of good home maintenance practices and should be maintained, but that some of the more sub-jective aesthetic standards, as well as the enforcement thresholds and notification letter language and sup-porting policies and practices were likely to be amend-ed. A resident stated his concerns about “softening” the language of the inspection letters. He noted that he is aware of many of his neighbors who did not feel a sense of urgency to complete the needed repairs with the current inspection letter; he is concerned that they will make no attempt to complete those repairs if there is no penalty for waiting.

• Association Covenants Enforcement Policy & Prac-tice Review – Violations are currently given a numeric rating, based on their severity (Priority 1 violations being the most severe). Priority 1 violations are given 150 days for the repairs to be completed. Options to extend the deadline were discussed. A cover letter has been drafted that will be mailed along with the annual inspection letters in 2020 to better explain the inspec-tion process, how to file an appeal, etc. It was recom-mended that the Priority 3 violations not be enforced unless a complaint is received from another home-owner. Patrol violations were discussed as well, such as high grass, trash container storage, etc. These viola-tions are things that can be seen from the curb, and they tend to have a correction deadline of 10 days. Call for Candidates Board of Trustees Election 2020

The 2020 Annual Meeting of the Association members is scheduled for April 7th, 2020 at 7:00 pm at the Windmill Community Center located at 21400 Windmill Drive in Ashburn Farm. Please mark your calendars and plan to attend.

One of the items at the Annual Meeting is to elect new members to the Ashburn Farm Board of Trustees. These volunteers are a huge part of our Association's success. You can be an important part of that by bringing your expertise to the Board. Please consider running for a seat on the Board of Trustees.

The Ashburn Farm Board of Trustees generally schedules their meetings for the first Tuesday of each month to meet with homeowners and discuss Association business; however, there are some exceptions due to holidays. Some time may occasionally be required between meetings to deal with critical business that cannot wait until the next regularly scheduled meeting. Email is also an important tool used by the Board members when there are decisions and discussions that need to take place prior to a meeting.

Our ByLaws state "Candidates for election shall file a petition of candidacy, signed by not less than ten Members, with the Election Committee at least three weeks before the Annual Meeting. The Election Committee shall provide all members with a ballot containing the names of all bona fide candidates with the notice of the Annual Meeting."

Because quorum was not met during the 2019 election, the ByLaws state that the appointed members (those who received the most votes) can only serve a one-year appointment term. This means there will be seven open Board of Trustee seats, in the 2020 election. The term will run from 2020 through 2022. To qualify for candidacy, you must complete the two forms enclosed in this newsletter (Petition for Candidacy and the Member Nominating Form). You can also download any of the forms from the Association website. The Member Nominating Form must be submitted to the Association Office no later than February 10th, 2020 if you would like your profile to be included in the March newsletter. Any profile submitted after that date will only be published to the website, but will still be included in the informational letter that will be sent out to all homeowners with the proxies for voting.

The closing date for the completed forms (which are included in this newsletter and available on our website) is March 13th, 2020, by 5:00 pm to fulfill the requirement of the ByLaws.

Election Volunteers Needed!

The Annual Election is a busy time in the Association Office. Each year, thousands of ballots come into the office prior to the election. The ballots must each be counted, and homeowner residency verified. We are always looking for help during this time to ensure that each and every vote is counted accurately.

The Election Committee consists of homeowners who commit to working a two-hour shift on the evening of the Annual Election to help count ballots. WE NEED YOUR HELP!!

Janice Brewer - Three Decades in Ashburn FarmJanuary 1st marked the end of one decade and the beginning of another, and with it, a career of more than 30 years with the Association comes to a close. Mrs. Janice Brewer, who has been with the Association since the beginning is retiring at the end of February of this year. The Association came into being in 1988 and the Association Office was located on Golden Meadow Circle, where the daycare is located now. Back then Ashburn Farm was just a few hundred homes and a pool, with the hopes of creating a 3,800-home community just outside of Washington DC and the nearby Washington Dulles International Airport. Janice was returning to the workforce while raising a daughter with her husband, Doug, and was happy to have found the opportunity to work in the community where she lived.

Janice began her career with the Association welcoming new homeowners and aiding them through the process of owning a new home in a planned community. Janice was there to help Members transform new houses into individual homes, each with its own unique character, while ensuring the community aesthetic was safe-guarded. As the community matured and was fully built out, Janice’s assorted roles became more singly focused on helping the Architectural Review Board administrate their various functions. Janice handled approximately 400 Exterior Alteration Applications per year for the past 31 years, personally touching more than 12,100 Exterior Alteration Applications in her career; helping thousands of Association Members enhance their homes and properties, since 1988. She has worked closely with all six of the Association’s General Managers and the many volunteers who have made up the Architectural Review Board.

Janice was always a familiar face in the community center and has acted as the Association’s unofficial historian. Janice’s meticulous notes and her having been witness to 31 years of all things Ashburn Farm have helped to resolve hundreds of questions. Janice’s experience and thoughtfulness will assuredly be missed.

The Association’s Board of Trustees, Architectural Review Board, & Staff wish her many happy days in retirement.

Trash & Recycling Collection Days• Regular Trash Collection - Monday and Thursday• Yard Waste Recycling - Monday Only (March 1 - December

Patriot Disposal’s service includes twice-per-week trash removal and once-per-week recycling. Please do not put trash on the curb before 6:00 PM the night before pickup, and remove your container(s) from the curb as soon as possible after pick-up (the same day as trash/recycling pickup). Trash and recycling services will take place between 7:00 AM and 6:00 PM on Mondays and Thursdays. Uncollected trash and recycling should be reported to Patriot’s Customer Service Department, 1-703-257-7100 or [email protected].

There will be NO pick-up, if the regular service day falls on New Year’s Day, Thanksgiving Day, Christmas Day, or any other collection day when the refuse and recycling facilities are closed. Collection services will resume on the next regularly- scheduled service day. Please note: Collection tends to be somewhat delayed the day following a holiday.

TRASH and RECYCLING• Trash & Recycling must be kept in hard side containers

• Secure all trash in tightly tied trash bags, inside hard-sided trash containers .

• Loose trash bags, or grocery bags from stores such as Giant, Harris Teeter, etc. are prohibited and are not to be used for trash or recycling disposal.

• All homeowners are responsible for picking up litter on their property and preventing wind-blown debris from originating from their property .

• Loudoun County requires rigid containers with lids for storage and collection of household trash and recycling. It is recommended and encouraged to place ones address on the containers and lids .

STORAGE

Single Family Homes• Storage of trash and recycling containers must be on one’s

own property, in the garage or behind the rear plane of the home against the structure, or in a location on file with, and approved by the Association’s Architectural Review Board or Board of Trustees .

• Storage of these containers in front or beside the house or garage is not acceptable and is a violation. If property fencing extends on the side of the home, the containers may be stored behind the fence against the side of the house or garage, providing the side yard is not directly facing the front of a neighboring housing unit, road frontage, or otherwise negatively impacting a neighboring home from ground level.

• Trash, recycling, and storage containers cannot be kept on an elevated deck.

Townhomes• Storage of trash and recycling containers must be on one’s

Covenants Enforcement ProgressAssociation Members expressed concerns resulting from the 2019 Association Property Inspections, specifically citing anxiety felt as a result of the Annual Inspections. Creating anxiety or feelings of disrespect has never been the intent of the annual inspection process. Since 2013, as a result of the annual inspections that started in 2010; the number of issues noted during resale disclosure inspections has decreased sharply. A fortuitous byproduct of the effort has been a substantial reduction of concerns about neighboring properties being reported to the Association; allowing neighbors to simply be neighbors and not have to police others.

Ashburn Farm Association is committed equally to representing those with concerns about the enforcement of the Covenants and Architectural Design & Maintenance Standards, as well as those that purchased a home in the community because of the protections provided by the Covenants and Architectural Standards. The inspections are meant to notify Association Members about conditions on their property that they may be unaware of, and that would be noted on a resale disclosure, so they may be addressed during favorable weather, and/or long before any plan to sell the property. The Association understands that repairs must be budgeted, extensive repairs even more so, which also may be impacted by scheduling and other issues beyond one’s control and simply ask that Association Members communicate any issues regarding home maintenance or modification issues so we can work together to resolve them.

The Association volunteers and staff have been reviewing the Association’s Architectural Standards, as well as the policies and practices governing the Covenants Enforcement process to ensure properties are maintained in accordance with good maintenance practices and that any anxiety or hardship is minimized. Those changes have been discussed at the Board of Trustees, and Architectural Review Board at public meetings held in October, November, December and January, as well as at ad hoc committee meetings to address that matter specifically. The fruits of that labor will be discussed, amended and approved at the February 4th, and March 3rd, Board Meetings ahead of the beginning of the 2020 Annual Inspections.

One of the enforcement practices to be approved will address prioritizing any violations noted on the property, so that severe issues can be addressed quickly, allowing less severe issues to be resolved at a pace that does not create anxiousness. The most severe, Priority One issues

will have an initial 90-day period to remedy the issue or contact the Association to discuss or risk the issue being escalated if uncorrected for more than 150 days . The Association will provide 150 days, up to a full year to remedy less severe issues that do not impact neighboring properties and have not been reported to the Association by another Association Member.

The Association would like to complete inspections on all 3,200 Lots during the warm months so that Association Members are afforded the time and weather conditions to tidy up or make repairs; however the Association will continue to provide guaranteed compliance period extensions to Members whose properties were inspected in the early Spring or late Fall upon request and is happy to cooperate with anyone with a measured plan to, or that is actively working on bringing their home into compliance. (Thirty-day extensions will be approved upon request; extensions materially longer than 30 days are reviewed by the Board of Trustees at a monthly meeting.) Members that receive a violation for large or costly issues like driveway replacements, etc., or have other pressing matters to tackle; the Association is happy to provide additional time to make repairs and asks that you reach out to the Covenants staff.

Additionally, the Architectural Standards have changes pending approval and relate to: decorative objects, lawns (weeds and bare areas) storage of trash containers, dirt/staining on rain gutters and soffit vents, Single Family Driveway Extensions, the use of loose stone, utility screens, chairs or a bench in the front of a home, mismatched colors, missing window screens, portable basketball goals, townhome driveway borders, as well as how the Association records color changes to decks / railings and fences. The Association will continue to review seasonal / holiday decorations or displays, the language governing the placement of decks and patios on a property, electric insect traps, the use of vines/ivy in landscape designs, artificial turf, and sheds.

ASHBURN CLASSICS

The Ashburn Classics is a senior’s social club in Ashburn founded in September 2003 and is open to those who are 50 years or older. We welcome all seniors in the Ashburn area to join us at our monthly membership meetings. The mission of the club is to promote a social wellness for all members; provide general, social, educational and other information through the use of varied programs for its members; provide a variety of special events to the benefit and enjoyment of its members; and support and make monetary donations to selected charities.

The club meets the second Saturday of each month at the Mills Recreation Center in Ashburn Village. A few of our past events include barbeques/potlucks, line dancing, speakers on timely topics, trips, and musical groups. We had a spaghetti dinner in January. Activities for February through May are as follows: February – President’s Theme – a president’s trivia game and desserts; March – March madness with basketball; April – Easter with tea sandwiches and egg decorating; May – Wine tasting party. Watch for information regarding open house in the Spring.

The club also sponsors several satellite clubs; i.e., mystery book club, regular book club, bridge, Pay Me, Mexican train, Bunco, ladies’ night out, lunch bunch, and the Ashburn Guys. Most of the satellite clubs meet at the Ashburn Farm Windmill location on a monthly basis. However, at times a club may meet in a member’s home. The Ashburn Guys usually meet for breakfast prior to the monthly membership meeting.

Ashburn Farm Association Non-Resident Pool Membership Authorization Resolution

POLICY RESOLUTION NO. 01072020

WHEREAS, Ashburn Farm Association (the “Association”) is a Virginia nonstock corporation and subject to the provisions of the Virginia Nonstock Corporation Act; and,

WHEREAS, Article III, Section 3, Subparagraph (b) of the Covenants of the Association invests the Board of Trustees with all powers for the conduct of the affairs of the Association which are enabled by law, the Declaration and the articles of Incorporation which are not specifically reserved to the Members; and,

WHEREAS, Article III, Section 3, Subparagraph (c) (2) of the Covenants invests the Board of Trustees with the power to establish rules and regulations for the use of the property as provided in Article IV and VI and to review, modify, and approve architectural standards adopted by the Architectural Review Board.

NOW THEREFORE, BE IT RESOLVED, That the Ashburn Farm Association Board of Trustees has authorized two hundred (200) non-resident pool memberships for sale for the 2020 pool season, at a cost of $375 per family Membership, $175 for a single person, per year/season. The price to be prorated after the second week in July each year/season, reduced by $27.00 each week thereafter until the end of the pool season.

The Board of Trustees adopted this Resolution at a duly convened meeting on January 7, 2020 and directed that the same be incorporated in the Book of Resolutions.

• Cross Breeze Place Parking & Wayside Circle Traf-fic Calming – Neighbors from Cross Breeze Place and Misty Meadow Place addressed the Board a second time regarding this topic, stating that the parking situation has gotten worse. Parking in this area has limited the view of the walking trail, and it is creating a safety issue for residents using the trail. A homeowner noted that many of the vehicles parked on this VDOT have antique plates, but they are not operational. The streets involved are not owned by the Association, but Mr. Cushman has met with officials from VDOT, Loudoun County, and the County Supervisor to find a solution to the issue. The County, the Sheriff’s Depart-ment, and VDOT are very limited in their abilities to make any changes, due to the fact that no laws are be-ing broken. Mr. Cushman and the Board will continue to work with these agencies to find ways to make the pedestrian trail crossing at Cross Breeze Place safer, and help alleviate the parking issues at the entrance to Cross Breeze Place.

NEW BUSINESS• 2018 Financial Audit Approval – A motion passed

(6/0/0/0) to approve the 2018 Financial Audit from Daly & Hammond. The B&F Committee reviewed the audit provided, and the members made a recommen-dation to the Board to approve it.

• AFIMS Licensing Renewal – A motion passed (6/0/0/0) to approve the AFIMS Licensing Renewal, amount NTE $8,200.

• Non-Member Pool Membership Resolution 01142020 – A motion passed (6/0/0/0) to approve Resolution 01142020, Non-Member Pool Membership, to allow 200 non-residents of Ashburn Farm to purchase mem-berships to the Ashburn Farm pools in 2020, at a cost of $375 per family or $175 per person, with amounts to be pro-rated as the summer progresses. Purchased guest passes will no longer expire at the end of the pool season .

• Surveillance Camera Data Security Policy Resolution 01142020A – A motion was made to approve Resolu-tion 01142020A, Surveillance Camera Data Security Policy. The motion was amended to change the word-ing of “community property” to “Association common property”. The amended motion passed (6/0/0/0).

• Pool Furniture Maintenance & Replacement – A mo-tion passed (6/0/0/0) to approve the proposal from Criterion to repair and replace pool furniture, at a cost NTE $11,000.

• Employment Contract Renewal, Jeremy Cushman Resolution 01142020B – This will be reviewed at an upcoming Board meeting.

• Article 4, Section 3 – Mr. Cushman recommended get-ting an opinion from the Association attorney regard-ing this section of the Covenants in order to determine if it allows the repair/storage of vehicles on private property in single family homes.

• J&M Landscaping Payment – A motion passed (6/0/0/0) to honor the request from J&M Landscapes to make two accelerated payments for January and February 2020, then reduce payments for the remain-der of the year, with this agreement to be written and signed in a formal contract.

• Annual Election – A discussion was held regarding the Annual Election and ways to increase the number of residents who return votes.
