� SPECIAL INSTRUCTIONS TO BIDDERS

The tender should be submitted in one sealed main envelop with clearly marked on the main

envelop for the work of “Work of Cloth Cleaning & Jumper Checking / Tightening work on EHV

lines String disc insulators under Jetpur Tr. Jurisdiction.”. The main envelope will contain two

separate sealed covers as under:-

(A) Cover No.1:

This cover shall be clearly marked “Qualification documents” and contain all qualifications

documents as under:

(i) Demand Draft for Tender Fee.

(ii) Demand Draft for EMD in separate envelope.

(iii) Attested copy of Registration Certificate.

(iv) Attested copy of work experience certificate for the similar works executed.

(v) List of works in progress duly certified by concerned department.

(vi) Attested copy of document showing P.F. Number obtained by the bidder.

(vii) Attested copy of Company registration or Partnership deed.

(viii) Attested copy of Power of Attorney, if any for signing the bid documents.

(ix) Attested copy of balance sheet or profit and loss account of last 3 financial years duly

audited by Chartered Accountant.

(x) Attested copy of latest solvency certificate issued by Schedule Bank.

(xi) Attested copy of service tax registration certificate.

(xii) Web Tender documents other than schedule B dully signed and stamped.

(xiii) Income Tax Certificate along with Pan Card.

(B) Cover No.2:

1) This cover shall be clearly marked “Percentage Rate Offer” and shall contain Schedule –

B & condition of contract with dully-filled in percentage rate offer.

2) The bidder must clearly quote percentage above or below the tender rates in figure as

well as in words. The bidder must work out the total price of their tender offer

accordingly and the total amount should be clearly written in words & figure. In case of

any discrepancy whatever written in words shall prevail. GETCO shall at liberty to

decide the matter as it deems fit.

3) No deviation in terms, conditions Schedule-B and technical specifications will be

entertained. All the documents related to this tender shall be final and binding to all the

bidders. Any ignorance for this shall not relieve the contractor from their contractual

liability arising as per tender documents

4) An earnest money deposit shall have to be remitted by the bidder by way of Demand

Draft payable to “Gujarat Energy Transmission Corporation Ltd.” Drawn on a schedule

bank in JETPUR with the tender only. Cheques or in any other from towards payment of

earnest money deposit will not be accepted and the bid will be disqualified.

5) The bidders are required to quote only firm percentage prices. No variation on price

statutory or otherwise on raw materials or finished products on any cause will be

accepted.

6) The bidders should note that the completion of above mentioned work in all respect in

accordance with the time limit is very important and should be strictly adhered to.

“Completion within time limit from the date of issue of letter for commencement of the

work” by the field office.

7) The bidders should furnish a list of orders for similar works executed by them and

clearly mention the name of the party for whom the works have been completed. The

reference of order number and date performance report of such works be furnished in

attached bidding at Schedule-B.

8) The bids should be valid for a minimum period of 6 months from the date of opening.

On which there are due for submission and during this period no tenderer shall be

allowed to withdraw his tender. Any such withdrawal during the said period will entail

for forfeiture of the Earnest Money Deposit submitted with the tender.

9) The works covered under these specification shall be carried out and governed by

“Tender and contract for works” booklet appended herewith except where conditions

specified in this specifications.

10) The contractor shall have a separate provident fund code of RPFC and the contractors

who do not possess separate P.F. code shall not be considered for acceptance of tender.

Contractor has to submit such certificate showing separate P.F. code along with tender.

11) COORDINATION WITH OTHERS :

The contractor shall have to execute the above mentioned work with the concerned

agencies who are Engineers for the GETCO, wherever required. The contractor shall

cooperate in all aspects and exchange the necessary technical data/drawings with the

Engineers under intimation to E.I.C. to ensure proper co-ordination and satisfactory

completion of the work in time.

12) Any more information of the proposed above mentioned work may be referred from the

office of the EXECUTIVE ENGINEER (TRANS), JETPUR during office hours.

13) The successful contractor shall have to sign an agreement as per GETCO’s rules on a

stamp paper and necessary stamp duty charge shall be borne by the contractor. Before

signing agreement, contractor has to pay security deposit as per GETCO’s rule within

fifteen days on receipt of L.O.I. from GETCO.

14) The work shall commence after the due intimation by EIC for commencement is issued.

15) The complete specification comprises of the following. Bill of quantities (Schedule : B)

& condition of contract. Tender and contract for works booklet, general conditions and

instructions to bidder. Technical specification. All these sections are complimentary to

each other and the particulars and requirements contained here in shall cover the

execution of the works covered under these specification.

16) GETCO will not issue any materials; all materials required for completion of work shall

be arranged by the contractor at his own cost.

17) No collection of material shall be made before it is got approved from the E.I.C.

18) Approval to any of the executed item for the work does not in any way relieve the

contractor as per the drawing and specification.

19) Any information, dossier or revised offer during or after the date of submission of tender

shall not be accepted.

20) The tender must reach to the office of EXECUITVE ENGINEER (TRANS),400KV

S/s, Transmission Division, Dhareshwar- Jetpur on or before due date & time of

submission mentioned in tender notice. No tender shall be accepted/opened in any case

� INSTRUCTIONS TO BIDDERS

A. Scope of Work of Tender / Contract: - Work is to be carried out as per instruction of EIC,

The jurisdiction of Jetpur Tr. Dn. is as under,

400 KV Lines

1. 400 KV Jetpur – Hadala Line (25 Tension)

2. 400 KV Jetpur Amreli Line (17 Tension)

220 KV Lines

1. 220 KV Jetpur – Jamnagar – 1 Line (20 Tension)

2. 220 KV Jetpur – Jamnagar – 2 Line (20 Tension)

3. 220 KV Jetpur – Sardargadh Line (20 Tension)

4. 220 Kv Jetpur – Keshod Line (20 Tension)

5. 220 Kv Jetpur- Visavadar Line (23 Tension)

- each 400 / 220 Kv Line must be completed in maximum 2 Nos. of outages of 10

Hours each.

Remarks:

Qty Estimated for one round of Cloth cleaning of 220 Kv lines suspension Insulator disc string,

400 KV Jetpur - Hadala line suspension insulator disc string and 400 KV Jetpur - Amreli line

Suspension / Tension disc string under Jetpur Tr. Dn. Jurisdiction.

Qty. Estimated for one round of jumper checking / tightening in all 220 Kv and 400 Kv Lines

Tension Loc. jumpers.

Contractor have to provided sufficient men power to complete the work as per above time slot.

No Transportation Charges will be provided by GETCO.

Also when required the contractor has to provide his service at the same rate for the work to be

carried out in the other jurisdiction other than mentioned above.

B. Procedure of Cloth Cleaning of Insulator String.

- Cleaning of Each Disc insulators with clean cotton cloth in Suspension and Tension

Loc. string insulator.

Procedure of Jumper checking in Tension Loc.

- Each Jumper of Tension String to be checked for its tightness with proper spanners,

and to be tight with proper spanners, to be brought by the Contractor.

Both the above work is to be simultaneous completed in outages provided.

C. Payment of Earnest money Deposit and Security Deposits:

i. Earnest money Deposit:

1. Bidders are requested to pay an earnest money deposit (1 % of estimated cost) by demand

draft only on any Nationalized Bank at Jetpur for the amount as specified in the tender

notice. Payment of EMD in form of Cheque or any other form shall not be accepted.

2. The EMD shall be submitted along with submission of Technical bid only. In no case it shall

be submitted with sealed cover of Price Bid.

3. Tenders not accompanied by EMD shall be rejected as non- responsive.

4. If during the tender validity period, i.e. 180 days, the tenderer withdraws his tender, the

EMD shall be forfeited and the tenderer may be disqualified from tendering for further

works.

5. The EMD will be returned promptly to the unsuccessful tenderer. The EMD will be returned

to the successful tenderer after he furnishes the Security Deposit for performance and duly

enters in to the contract. If he fails to furnish the SD or to execute the contract for the work

offered to him, his EMD shall be forfeited and the tenderer may be disqualified from

tendering for further work.

ii. SECURITY DEPOSIT:

As per prevailing rules of the Corporation, 5% of the contract value shall be paid as ‘Security

Deposit’. Out of this, 50 % of S. D. shall be paid at Transmission Division- Jetpur within 10

days from receipt of letter of intent either

a) In form of FDR in favor of "Gujarat Energy Transmission Corporation Ltd. " of any

Nationalized Bank OR

b) In form of Bank Guarantee of any Nationalized Bank as per the approved format of the

Corporation.

The balance 50 % Security Deposit shall be recovered from first two R.A. Bills in equal

installments.

Alternatively 100 % S. D. in form of FDR or B. G. may be submitted on receipt of LOI.

The security deposit will be refunded only after the completion of guarantee period of 1 year of

work completed or finalization of final bill whichever is later.

If Security Deposit is not paid within 10 days of issue of LOI, EMD paid will be forfeited and

Corporation will not deal with party for the period of two years.

D. Commercial Conditions :

1 Sealed Percentage rate tender invited for work of “Work of Cloth Cleaning & Jumper

Checking / Tightening work on EHV lines String disc insulators under Jetpur Tr. Jurisdiction” for Gujarat Energy Transmission Corporation Limited- Vadodara (herein referred to as

Corporation).

2 The scope of work is explained in this tender in Para – A & B. The work shall be carried

out according to the enclosed General Conditions, Technical Specifications.

3 Tenders must be submitted in the enclosed schedule of work & quantities. Those

received in any other form will not be accepted. They should be accompanied by a

covering letter in which the bidder should give all information as called for in the

specifications & any other point which he would like to be considered along with the

tender.

4 The Schedule-B shall be filled up with the quoted % above or below & shall be

submitted in sealed envelope superscripted– PRICE BID for “Work of Cloth Cleaning &

Jumper Checking / Tightening work on EHV lines String disc insulators under Jetpur Tr.

Jurisdiction”. The Quoted % above or below shall be written both in words, & figures &

the units in words. If any discrepancy occurs between words & figures, then words shall

prevail. The tender documents shall be written legibly & free from erasure, overwriting

or conversions of figures, crossing out, initializing, dating & rewriting, shall be avoided.

In case of any deviation in figure and words the rates quoted in words will prevail.

5 The bidders shall note that no deviations from the technical specifications or commercial

conditions with this bid are acceptable & it will be presumed that the bidder agrees

entirely with the specifications & general terms &conditions of the contract.

6 The Corporation reserves the right to accept any tender irrespective of whether it is

lowest or not or to reject all the tenders without assigning any reasons there of. Tenders

departing from the technical Specification or the method of bidding in a radical manner

may also be rejected.

7 On acceptance of the tender the name(s) of the accredited representative(s) of the

tenderer who would be responsible for taking instructions from the Engineers of the

Corporation shall be communicated to the Executive Engineer (Trans), Gujarat Energy

Transmission Corporation, Transmission Division, Jetpur.

8 All royalties, sales tax, toll tax, local tax, development charges, service tax, Works

Contract taxes & any other taxes etc. in respect of this contract shall be payable by the

contractor & Gujarat Energy Transmission Corporation will not entertain any claims

whatsoever in this aspect. Any statutory variation in future towards the above mentioned

taxes and imposing any new tax that shall also be payable by the contractor & Gujarat

Energy Transmission Corporation shall not entertain any claim of whatsoever nature,

during or after the completion of this tendered work. Proof of such payments made by

the Contractor to the appropriate departments shall be produced to Gujarat Energy

Transmission Corporation failing which appropriate amount shall be withheld on getting

information / instruction from the concerned departments.

9. The successful contractor will have to sign an agreement as per the Gujarat Energy

Transmission Corporation rules on stamped paper & the necessary stamp duty charges

shall be borne by the contractor.

10. Bidders must submit the schedule of quantities & rates by quoting the % above or below

the total estimated cost & other schedules duly signed & seal of the company. Any

tender not bearing signature of the bidder & seal of the company on all the documents

accompanying the tender is liable to rejection. Further it is specifically instructed that

conditional tenders shall summarily be rejected.

11. The bidder shall carefully study the work to be carried. The Corporation will not pay any

extra or rate for any reason in case the contractor claims, after acceptance of contract, to

have misjudged the site condition.

12. The percentage quoted shall include cost towards of all materials, & machinery including

equipments, fixtures, labour, constructional equipments, fuel, scaffolding, staging,

ramps, walkways, approach and haul road, temporary works, etc. bearing permanent or

temporary nature necessary for the completion of the work in all respects, except for

those items specifically mentioned to be furnished by the Corporation. The contractor

must also arrange for the transport of materials & include all such costs in the rates

quoted by him for finished work.

13. During the execution of the work if it is found that the work is not progressing as per the

Scheduled Progress Program, approved by the Corporation & planned by the Contractor,

due to the reasons attributable to the Contractor; suitable action shall be taken as per

Clause No.3 & 4 appearing in the Corporation’s prescribed Booklet for ``Tender &

Contractor for Works’’ and Corporation may take such action as it may deem fit to

ensure that the work is completed in time at risk & cost of the contractor.

14. The contract or any part thereof shall not be subject to change without the written permission

of the Executive Engineer (Trans), Gujarat Energy Transmission Corporation,

Transmission Division, Jetpur or his authorized representatives.

15. Tender shall remain open for acceptance for a period of 180 days from the date of Technical

bid opening & during this period no bidder shall be allowed to withdraw his tender. Any

such withdrawals, during the said period will entail forfeiture of the earnest money

deposited with the tender.

16. Further information required, if any, can be had from the office of the Executive Engineer (Trans), Gujarat Energy Transmission Corporation, Transmission Division, Jetpur. But

it must be clearly understood that the tenders must be received complete in every

respects by the due date & time.

17. The notice inviting tender, general instructions to the contractors & all documents of this

tender shall form part of the contract.

18. Work under this contract shall be completed in all respects within stipulated period from the

date of commencement order issued by field office. However, interim mile stones to be

jointly fixed after issue of LOI.

19. Bidders must quote firm price only, till completion of work under contract, & this is to be

confirmed by bidder while submitting his offer. No escalation towards labor and material

/ fuel shall be paid in this execution of contract.

20. Contractor shall pay minimum wages to his laborers as per the Minimum Wages Act, 1948

& rules there under as applicable from time to time in pursuant to the State Government

notification. The concerned contractor shall submit the details of the payment with due

certificate of LWO/IRO of the Corporation

21. Once the offer submitted will not be returned back for any reason thereof in any case.

22. The Bidders shall note:

I. Percentage rates quoted shall cater for the cost of all materials & labor including all

leads & lifts, tools, plants, consumables such as but not limited to fuels, lubricants,

etc.

II. Percentage rates quoted shall include for which are obviously & fairly intended &

which may not have been specifically referred to in these documents but are essential

for the satisfactory completion of the work.

III. Percentage rates shall be firm for variations up to any extent for individual items.

IV. No price escalation on any account, will be payable.

23. Each tender shall contain the name, residence & place of business of person or persons

making the tender & shall be signed by the tenderer with his usual signature with seal of

the company.

24. Tender by partnerships shall furnish the full names of all partners. It shall be signed with the

partnership name by one of the members of the partnership or by an authorized

representative followed by the name &designation of the person signing.

25. An attested copy of the constitution of the firm with the name of partners shall be furnished.

Whenever, whether in submission of the tender or later in other matters, the signatures

are made by one person on behalf of Directors or a firm or a corporation, an attested

copy of the resolution of the partners or of law shall be supplied by the tenderer

authorizing Witnesses & sureties shall be persons of status & probity, &their names,

occupation & address shall be stated below their signatures. All signatures shall be dated.

26. Tenders by corporation shall be signed with the legal name of the corporation followed by

the name of the state of incorporation & by the signature & designation of the president,

secretary or other person authorized to bind it in the matter with rubber seal of the

company.

27. Corporation reserves the right to delete any item of Schedule-B for which contractor shall

not have any right to claim on this account.

28. The Bidders shall study the Conditions of site & shall resort to dewatering, where necessary,

by appropriate methods & maintain reasonably dry areas to work at and no extra claim

will be entertain on this account.

29. The Contractor shall prepare all required way to execute various items of this Contract &

arrange all transport of materials & all such costs shall be taken care of while quoting

the rates. No extra payments shall be admissible towards such costs. On completion, this

shall be cleared if asked by GETCO at no extra cost.

30. Gujarat Energy Transmission Corporation shall entertain no idle charges for any site

conditions or any circumstances.

31. The Contractor shall take all requisite & necessary care to observe that no damage is

occurred to the Existing structures, if any. For any damage to the Existing Structures of

Gujarat Energy Transmission Corporation the Contractor shall be held responsible.

32. Tenders that do not fulfill all the above conditions & those specified in the documents

attached with this contract document or incomplete in any respect are liable to rejection.

33. The submission of any bid connected with these document and specification shall constitute

on agreement that bidder shall have no cause of action or claim against the GETCO for

rejection of his bid. The owner shall always be at liberty to reject or accept split any bid

or bids at his sole discretion and any action will not be called into question and the

bidder shall have no claim in that regards against the owner.

34. Site visit: The bidder is advised to visit the site and examine the site condition. Where in the

work is proposed to be carried out and to get himself fully acquainted at his own

responsibility for all information that may be necessary for quoting the tender bid and

entering in to contract. All cost and liabilities arising out of the site visit shall be at

bidder account.

35. Recoveries:

(I) In case of any damage to equipment/machinery/ structure/building/ hardware/

conductor/ insulators etc. of GETCO or any public property due to negligence’s of

contractor or any other reasons attributed to contractor the decision of E.I.C.

regarding the amount of recovery shall be final and binding.

(II) If the contractor fails to execute the proportionate work as per direction of E.I.C.

within the time frame given for completion of part / whole of the work GETCO

shall get the work done through any other contractor and the cost of execution of

such work along with 15% overhead charges shall be recovered from contractor.

(III) For violation of any rule / regulation described here, the penalty of Rs. 500/- for

each violation per day will be deducted from the payment of Bill.

36. Notwithstanding anything contained to the contrary in the specification or tenders in

subsequent exchange of correspondence, the conditions of contract shall be binding on

the contractor and any change or variations expressed or implied, however made in the

said conditions shall not be valid or operative unless expressly sanctioned by the

Corporation. The contractor shall be deemed to have fully informed himself and to have

special knowledge of the provisions of the conditions of contract herein contained.

37 Tenderer shall be deemed to have full knowledge of relevant documents, site conditions

etc. whether inspected or not by him.

38 Submissions of tender by a contractor implies that he has read the instructions and

condition of contract herein contained and has made himself aware of the scopes and

specifications of the work to be done.

39 These rules and directions shall form part of the contract.

40 In case of any deviation in any terms and conditions between Instruction to the bidders

and Tender and contract for works, the terms and conditions mentioned in Instruction to

the bidders will prevail.

41 Validity Of Tender: Tender shall remain open for acceptance for a period of 180 days

from the date of Technical bid opening & during this period no bidder shall be allowed

to withdraw his tender. Any such withdrawals, during the said period will entail

forfeiture of the earnest money deposited with the tender, and Corporation will take

further action for “not dealing” with party etc.

42 Water Supply Connection: The contractor has to make his own arrangement of water

for Maintenance and other activity at his own cost.

43 Separate Provident Fund Code: The contractor shall have a separate Provident Fund

Code of RPFC in the name of company. The contractors, who do not posses such

separate P.F. code, shall not be considered for acceptance of tender. The contractor has to

submit such certificate showing P.F. code along with tender.

44 Tenders received after time: The tenders received after time and date specified in the

tender notice, will not be accepted. Once the offer submitted by the contractor before due

date of submission, the contractor will not be allowed to submit revised / additional /

modified / other even before due date. However, if the issue and receipt of tender is

extended by the Corporation due to any reason, the contractor may submit the revised

offer before due date of submission, if he wish to submit.

45 The work shall be completed within the period stipulated in the contract. The contractor

has to organize & coordinate the works to suit these. In the event of any delay to any

other reason not attributable to the contractor, reasonable extension in the completing the

work may be given at the discretion & as decided by the Corporation but no

compensation or idle charges will be paid to the contractor under any circumstances.

46 The price proposals will be opened in the presence of the bidder’s representatives who

choose to attend at the date and time and venue to be notified by the GETCO, after

conclusion of the Technical Evaluation and Post Qualification process.

47 The Schedule-B shall be filled up with the quoted % above or below & shall be returned

& submitted in sealed envelope superscripted Price Bid – “Work of Work of Cloth

Cleaning & Jumper Checking / Tightening work on EHV lines String disc insulators under Jetpur

Tr. Jurisdiction” so as to reach the office of EXECUTIVE ENGINEER (TRANS),

Gujarat Energy Transmission Corporation, Transmission Division, Jetpur.

Schedules for tools & tackles, equipments, personnel details etc., and all other necessary

details shall also be submitted, in Envelop – I, i.e Technical Bid. Tenders will be opened

on the day & time indicated in the tender notice in the presence of such bidders who wish

to remain present.

Any tender not bearing signature of the bidder & seal of the company on all the

documents accompanying the tender is liable to rejection. Further it is specifically

instructed that conditional tenders shall summarily be rejected.

E. ADDITIONAL TERMS AND CONDITIONS: -

1. Contractor have to remain in constant touch with EE [TR] Jetpur for taking up the work.

2. On finalization of outage Contractor will be informed 1 day in advance for taking up the

work.

3. On taking up of the work according to outage schedule, if it will be changed according to

prevailing situation of power supply, Contractor have to carryout the work as per revised

schedule and nothing will be paid extra for the same.

4. For availing outage on the line, Contractor have to depute their authorized representative

approved by EE [TR] Jetpur and line clear will be issued to this authorized representative

only.

5. The line clear will be issued for particular period and if contractor have fail to return in

time then it will be viewed very seriously and any financial loss will be there, it will be

recovered from contractor.

6. Any safety pre-cautions required before taking up the work on the line has to be arranged

by Contractor i.e. earthing on either side of locations, safety belt etc.

7. All the safety regarding human life and as per I. E. rules is to be observed by Contractor

and regarding any violation of these GETCO will not take any responsibility.

8. For silicone application works all tools and tackles excluding Diesel, Diesel – Silicone

mixture and Cotton cloth is to be arranged by the contractor.

9. After completion of silicone application work Engineer or GETCO’s responsible person

will be inspect the work and if any defect will be found then same is to be attended up to

satisfaction of Engineer in charge / GETCO’s responsible person at contractor’s cost and

risk.

10. During work if any damage is done to the GETCO’s property such as insulator,

conductor hardware, the cost of the same will be recovered from contractor.

11. The GETCO will not be liable for the infringement of the rules described under

workman compensation due to injuries and accident to the workman etc. Contractor have

to observe and comply with various provisions under above Act etc.

12. Contractor has to work as per location and line allotted by EIC in LCP, If any work will

be carried out outside the scope of instruction, the contractor is responsible for the risk

and cost of un-instructed work, and GETCO will not pay any additional charges or take

any responsibility for that work.

13. Contractor shall have to engage qualified and experienced supervisor having necessary

electrical license for supervision and capable in managing the work.

14. The work is to be completed as per the time limit and no extension in time limit will be

granted unless other wise justified and recommended by the competent authorities, the

penalty will be levied as per GETCO’s rules, if the work is not completed in time and

according to our requirement.

15. The time limit for the above work is 24 months from the date of issue of the order.

GETCO reserves right to extend the contract for year or part thereof.

16. The bill will be passed on actual work done bases. IT Will be deducted from each bill as

per prevailing rules. The GETCO will not be held liable for any payment if no work or

partial work executed due to non availability of outages or work is postponed due to

unavailable circumstances.

17. Contractor have to submit bill in triplicate to Division Office.

18. Contractor have to make their own arrangement for transporting of necessary materials

and laborers for this job from GETCO’s yards centers / sub-station entrusted the line at

his cost only.

19. If excess work is required to be carried out it will be paid as per rate accepted by the

GETCO and it will be payable after completion of necessary formalities as per GETCO’s

rules.

20. Contractor will have to take insurance of all persons engaged for this work till

completion of work. GETCO will not be liable for any compensation due to accident

either electrical or mechanical to contractor and persons engaged by contractor for this

work. Contractor have to produce the proof of such insurance to the EE [TR] Jetpur.

21. Contractor has to produced a copy of registration as contractor.

22. Contractor has produced Solvency at least Rs. 50,000.00

23. Contractor has to produced a copy of P. F. code registration from P. F. Office.

24. Successful contractor has to submit the monthly copy of P. F. challans of P. F. paid in to

P. F. office of employees who engage for this job. Other wise no any R. A. bill or final

bill will be passed and paid.

25. Successful contractor has to intimate his P. A. N. No. to the undersigned.

26. Contractor has to offer their rates inclusive of all taxes applicable.

27. No any material will be provided by the GETCO to contractor for this job.

28. Contractor has to pay revenue loss as asked by EE [TR] Jetpur if wholly work is carried

out by the contractor beyond permissible time limit of line shut down on a particular

date.

29. No tenders will be accepted other than received by R.P.A.D. at Tr. Dn. Jetpur.

30. If successful contractor who awarded the contract fail to execute the entire work or part

thereof, it will be got done at the risk and cost of successful contractor.

31. Contractor has to produce a copy of Service Tax registration certificate.

F. TECHNICAL CONDITION:

General Conditions of Contract The contractors shall at their own expense make all necessary provisions for housing,

water supply, and sanitary arrangements for their employees as well as for works and shall pay

direct to the authorities concerned, all rates and taxes.

The contractor shall make their own arrangements for the necessary approach, road, for

transport of their materials and be responsible for the compensation on account of damage to

crop etc. & shall till completion of work.

All the royalty charges, Octroi and other duties & all taxes will be paid by the contractor

and no extra be claimed on this account.

It must be distinctly understood that conditions of contract and of claims in respect of

extra work, will not be allowed unless the works to which they relate is clearly without the spirit

and meaning of the specifications or unless such works are ordered in writing by the Engineer-

in-charge and claimed for in specified manner.

On completion of the work, the site shall be cleared by the contractor within the

stipulated period, and ground brought to original state and they shall not be entitled for any extra

claim on this account.

General Specifications of the relevant Indian standard specification shall also apply.

Damage to work clause:

1. Any components or part of the work shall not be given to any sub-contractor without

approval of the competent authority of the Corporation. The whole responsibility of the

execution of the work, as per the terms and conditions of the contract, will entirely rest

of the main contractor. The main contractor shall always keep his responsible

representative, preferably a technical hand, on work site with powers to sign M.R.s. and

take necessary decision and implement the instructions issued in the interest of efficient

execution of the works.

2. The Engineer-in-charge will fix the hours of work, and no work shall be executed

beyond that period.

3. In any work is not executed according to the specifications, and the directions of the

Engineer-in-charge, the same will be rejected, and the contractor has re execute the same

without any financial implication to the Corporation.

4. Contractor will have to communicate the name of his authorized agent, who shall be

present on the works, and shall be authorized to sign the material requisitions, receive

instruction given verbally or on the order book, on behalf of the contractor.

5. The contractor will have to sign the conditions of contract, and execute the agreements,

send the list of previous works executed, solvency certificate and pay up the security

deposits, falling to that, the tender will be rejected and earnest money deposited will be

forfeited. The value of the stamp paper and stamp duty charges shall be borne by the

contractor.

6. Tenderer must return the form of tender, with the specifications and the schedule of

quantities, and rates and other schedules only signed on each page. Any tender not

bearing signature of the tenderer on all the documents accompanying the tender is liable

to be rejected.

7. Before submitting his tender, unit rates, which shall be for the finished work complete,

the tenderer shall closely examine the specifications and carefully study site conditions

which form a part of the contract, to be entered into by the accepted tenderer.

8. The Tenderer must visit the site of works and see for himself the site conditions

regarding water, labour conditions rates approach road during all seasons and all other

matters affecting the works before submitting the tender.

9. The submission of tender by a contractor implies that, he has read these instructions, the

conditions of contract etc. and has made himself aware of the scope and specifications of

the work to be done, and of conditions and rates at which stores will be issued to him,

and local conditions and other factors bearing on the executions of the work. The

Corporation will not therefore, after acceptance contractor’s rate, pay any extra charge

for lead or for any other reason. In case the contractor is found later on, to have

misjudged the site conditions.

10. The tender document shall be written legibly and free from erasure, over writing or

conversions of figures. Correction where unavoidable, shall be made by crossing out,

initialing, dating and rewriting.

11. The Corporation or its officers, who accept tender, shall have the right of rejecting all or

any of the tenders, and will not be found to accept the lowest offer not to assign any

reasons whatever, for the rejection of any tender or all tenders

12. The tender notice to tenderers shall form a part of the contract.

13. The entire work is to be completed, within the stipulated time limit from the date of issue

of letter for commencement of the work by field office. The contractor will not be

eligible for any extra for the idle period of works, or waiting period that may be required

to suit other consideration, and no claims for compensations on account of such, will be

considered. However in case of delay due to circumstances beyond the control of

contractors, either in date of commencement or due to, waiting during construction,

extension in time may be considered for completion of works, without any penalty to the

Corporation.

14. The contractor shall keep full time qualified person at the site, who shall be fully

authorized to receive and comply with such instructions, as given by the Executive

engineer or Engineer in Charge. The name of such Engineer with his qualifications and

experience shall be intimated by the contractor. The Executive Engineer shall have the

right to demand the removal of any technical personnel, skilled or unskilled workmen,

who in his opinion are considered to cause bad workmanship in the execution of works

or to cause indiscipline.

15. Bills shall be submitted by the contractor monthly on or before the date fixed by the

Executive Engineer, for all works executed in the previous months.

16. Should this tender be accepted I /We hereby agree to abide by and fulfill all the terms

and provisions of the “Tender & contract for works” as applicable, and in default thereof

to forfeit and pay to the Corporation the sums of money due.

17. The contractor shall keep instruction book on site, for taking site instruction from time to

time. This book shall be made available on site whenever asked for.

18. The contractor shall pay wage to the workers, as per minimum wages act as declared by

the Government time to time.

19. The contractor shall follow all labour laws of Govt.

20. The full value of the “Earnest Money Deposit” paid herewith, shall be forfeited to the

Corporation, if the contractor fails to deposit the full amount of specified security

deposit, within stipulated time.

� NOTES FOR QUALIFICATION

The tender documents are for two separate bids i.e. technical bid (i.e. qualifying

bid) and price bids (i.e. commercial bid). Following credentials shall be submitted

with the technical bid for qualification.

1. Experience: Contractor should produce evidence of having experience in

executing similar nature & magnitude of jobs preferably photo copy of

orders secured from GETCO / Central / State Government / Railway / Semi-

Government and satisfactory completion certificate from respective

department.

2. Latest bank solvency certificate from any nationalized bank of a sum of

minimum 20 % of the estimated cost shown in the tender.

3. Separate provident fund code number towards your firm registered with

Regional P. F. Commissioner.

4. The Earnest Money Deposit and tender fee will be accepted by Demand

Draft on any Nationalized Bank only situated at “JETPUR”, drawn in favor

of “Gujarat Energy Transmission Corporation Ltd.”. Tender without

EMD and tender fee shall be rejected. Two separate demand draft for

Tender fee and EMD should be submitted with technical bid. Any tender

submitted without tender fee and E. M. D. will be disqualified.

5. The details of tools and tackles, owned and available for using in this work.

6. Contractor should produce audited copy of the Balance sheet with profit and

loss account of last three Years.

7. Attested copy of Power of Attorney, if any, for signing the bid documents.

The commercial bid (i.e. Price bid) shown in tender documents comprising

schedule B shall be submitted in separate self-addressed envelope provided with

tender documents.

The technical bid shall be opened at 3.00 pm, if possible on due date. After

scrutinizing of the technical bid, if party fails to fulfill the above requirement for

qualification, the price bids of such parties will not be opened. The price bid of

qualifying parties thereafter shall be opened on the date and time communicated to

qualified parties afterwards in the presence of parties.

The bid should be clearly subscribe with our reference number due date and

title of work. The offer should be valid for acceptance for a minimum period of 6

months from the date of opening of technical bid.

General Conditions

1.0 General Definitions: -

1.1 The “GETCO” means Gujarat Energy Transmission Corporation Limited [GETCO]. The

GETCO is engaged in the business of transmission of electricity for consumer use in the

State of Gujarat through various Electrical sub station and having its registered office at

Sardar Patel Vidyut Bhavan, Race Course, Circle, Vadodara – 390 007.

1.2 The “Contract” means the documents forming the offer letter, the acceptance thereof, the

letter of intent and the acceptance thereof, together with the all documents taken together

shall deemed to form contract and shall be complementary to one another.

1.3 The “Contractor” means the individuals or institutions or the firm or company or partnership

concern undertaking this contract or work and shall include its legal representatives,

successors and assigns.

2.0 Labour Laws: -

2.1 The Contractor shall observe, comply with and abide by the conditions of labour laws

mentioned in the annexure-V attached herewith.

2.2 The Contractor shall have to submit a document showing allotment of PF code No. received

from Regional Provident Fund Commissioner.

3.0 Provision for Penalty: -

3.1 In case of any pilferage, loss, damage, to the GETCO’s properties, due to any negligence or

inaction on the part of the personnel of the contractor, the contractor shall be liable to

compensate the GETCO.

3.2 In case of violation or non-observation of any of the special and detailed terms and

conditions of the contract stipulated in this tender document the GETCO reserves the right to

impose a penalty upto Rs. 500.00 per day per violation / omission and for any continued

violation / omission the decision of the Executive Engineer [TR] of GETCO shall be the final

and binding on the contractor on this issue.

4.0 Security Deposit: -

4.1 You shall submit the Security Deposit of Rs. 35,250.00 [Rupees Thirty Five Thousand Two

Hundred Fifty Only] valid for the contract period either in cash / DD or in form of Bank

Guarantee. This security deposit shall not bear any interest thereon. This security deposit /

Bank Guarantee will be returned to be returned to the Contractor on completion of the

contract period and on his fulfilling all his obligations to the GETCO’s entire satisfaction and

in terms of contract awarded to Contractor in the execution / performance of the awarded

work or non-fulfilling of any obligation towards statutory / legal payment etc. the security

deposit shall be forfeited by the GETCO.

5.0 Cash Retention Money:

5.1 The GETCO shall deduct from your monthly bill 5.0% [Five Percent] of the monthly service

/ charges as cash retention money and the same shall be returned to you at the end of the

Contract period on your fulfilling all the Contract obligations.

6.0 Period and Termination of the Contract:

6.1 The contract shall be awarded initially for a period of two year. The GETCO reserves its

right to extend the said contract for a further period of one year subject to mutually agreed

terms and conditions.

6.2 The GETCO reserves the right to terminate the contract at any time without assigning any

reason thereof and without giving any prior notice and without payment of any compensation

etc.

7.0 Quotation of Rates

7.1 Your offer rates shall be inclusive of all legal & statutory liabilities and other terms and

conditions mentioned in this tender document.

8.0 Payment:

8.1 The payment shall be made once in a month on certification of successful execution of the

scope of work carried out during the previous month including submission of required

documents / certification as may be necessary, by the GETCO.

9.0 Submission of Tender: -

9.1 The cover containing the tenders should be super-scribed “400 KV / 220 Kv Line Tension

Location, Jumper checking / Tightening work.”

9.2 The sealed tenders shall be sent to Ex. Engineer [Transmission] Gujarat Energy Transmission

Corporation Limited, 400 KV Sub-Station Jetpur. The tenders will be submitted separately

for technical bid & price bid in two sealed covers separately clearly marking the same on top

of the sealed envelope.

9.3 The offer shall be accompanied by Earnest Money Deposit [EMD] for an amount of Rs.

3500.00 by a Demand Draft drawn in favour of Gujarat Energy Transmission Corporation

Limited payable at Jetpur. This EMD will be forfeited in the event of a tenderer not accepting

the workorder if placed. The EMD will be refunded to un-successful tenderer. The EMD

amount will be refunded to successful tenderer on his furnishing security deposit as per

clause No. 11.0 above. This EMD will not bear any interest.

9.4 Tender will be submitted by the Contractor on his own letterhead along with the Earnest

Money Deposit, as well as the copy of the terms and conditions of the tenders enclosed duty

signed by the Contractor.

9.5 Tenders received after the due dates are liable to be rejected.

9.6 The selected tenderer may be invited for confirmations / clarification, if any. He / They shall

at his / their own cost keep himself / themselves available during that period.

9.7 The GETCO reserves the right to reject any / all the tenders without assigning any reason

thereof.

10.0 Jurisdiction: -

10.1 All disputes differences arising out of, or in relation to the contract will be subject to the

exclusive jurisdiction of the Courts of Jetpur only.

11.0 General: -

11.1 In case of any terms and conditions not defined herein, the decision of the GETCO shall be

final and binding upon the tenderer.All other terms and conditions as per works contact

booklet will be applicable.
