With a view to give a fillip to the industrial development in the State of J&K and in conformity with the national policy of ensuring ‘Ease of doing Business’ for the success of ‘Make in India Programme’, it has been felt necessary to simplify the procedures being followed in the Industries and Commerce Department and to make these more industry-friendly. Accordingly, sanction is, hereby, accorded to the following instructions, orders and guidelines for strict compliance by all concerned with immediate effect. These will be in supersession of the instructions, orders and guidelines issued on the subject, earlier. Annexure- ‘A’ to this Government Order contains the revised documentation requirements/checklist for different types of registration, permission, certification and clearances etc. 1) EM-I for provisional registration shall be made online as soon as possible. However, it is necessary to reduce the number of documents required for submission, at present. Accordingly, the requirement of 16-Point affidavit and DPR copies are dispensed away with in case of Micro units. Instead of DPR copies, a Project profile duly attested by the Project Manager of the concerned DIC or a recognized consultant/Expert shall be submitted. EM-I shall be issued within two days after receipt of the requisite documents. 2) EM-II for formal registration shall also be made online in due course of time. Submission of 16-point affidavit for formal registration as prescribed at present shall be dispensed away with Formal registration shall be issued within 05 days from the date of receipt of requisite documents. 3) Single Window Clearance System (SWCC): Henceforth, there shall also be a Single Window Clearance Committee at the District Level (DLSWCC) to be headed by the District Development Commissioner (DDC) for Micro and Small industrial units (with an investment upto Rs 1 Crore in Plant & Machinery). The composition of the Committee shall be as under: i) District Dev. Commissioner Chairperson ii) Superintendent Engineer,PDD Member iii) General Manager, DIC Member Secretary iv) Rep. of SPCB to be nominated by Chairman, SPCB Member v) Lead Bank Manager of the concerned District Member vi) Representative of SICOP/SIDCO (to be nominated by MD, SICOP/MD, SIDCO) Member The District Level Single Window Clearance Committee shall discharge all such functions for the Micro and Small scale industrial units in terms of delegation made above as are discharged at present by the Divisional Level Single Window Clearance Committee headed by the Director, Industries and Commerce Kashmir/Jammu in terms of Government Order No: 175-IND of 2010 dated 11.10.2010. 4) The existing Divisional Level Single Window Clearance Committee (SWCC) headed by the respective Directors of Industries & Commerce shall, henceforth, also have a representative of the Chairman, SLBC i.e., Chairman, J&K Bank to facilitate and track the financing of the unit by the financial institution/bank to which the applicant has approached with the DPR for loan. The need for submission of the 7-Point affidavit shall be dispensed away with. As against the existing system of allotment of land and subjecting the SWCC clearance to various conditionalities like power availability, consent to operate from SPCB, etc, the SWCC shall consider and accord all clearances in the meeting itself. In order to ensure this, the representatives deputed by various departments to the SWCC must be authorized to accord their departmental clearance in the meeting itself. The Director, Industries and Commerce shall ensure that the SWCC is held atleast once in every month to avoid accumulation/ pendency of cases. The Divisional Level Committee shall clear the cases of Small scale units with an investment of above Rs 1 Crore and upto the maximum of Rs 5 Crore in Plant & Machinery. 5) Allotment of land: In case an allottee does not take effective steps to set up his/her unit on the allotted land within one year from the date of allotment/ handing over of possession (whichever is later), the allotment shall be liable to be cancelled. Similarly, if the allottee does not start commercial production within two years from the date of allotment, the Director, Industries and commerce may cancel the allotment. 6) Toll tax exemption /assessment: It shall be obligatory on the part of DICs to carry out the basic assessment of raw material and finished goods within fifteen (15) days from the date of issuance of EM-II without waiting for further documents or application in this regard. 7) Toll tax proforma in respect of raw materials imported and finished goods exported shall, henceforth, be prepared at the end of each financial year by the unit-holder/promoter on self certification basis which shall, then, be submitted to the General Manager, DIC for attestation. Concerned General Manager shall forward the same to the Director, l&C for counter signatures within a maximum period of ten (10) days and the Director, l&C shall forward the toll tax proforma to the Excise Department within five (05) days. 8) Self certification: The following shall also be submitted on self certification basis by the promoters of Micro and Small Scale units for attestation/ countersignatures to the General Manager, DIC/ the Director, Industries and Commerce as per the existing delegation of powers: a. Export permit for repair of machinery and selling of scrap. b. Permission for import of spares and consumables within assessed capacity. c. Permission to import additional machinery and equipment without any incentives and change in capacity. The attestation/ countersignature of the General Manager/the Director, Industries and Commerce shall be done either on the same day or after a single inspection within a period of 2 days. 9) Clearance from the SPCB- The State Pollution Control Board shall ensure to give or refuse clearances within one month of the date of application made to it in the prescribed manner in respect of all types of industry - Green, Orange and Red. In case of Green category units, State Pollution Control Board (SPCB) clearance shall not be insisted upon if the applicant furnishes proof of having applied to the SPCB in the prescribed manner at least one month before the date of filing of application under EM-II. 10) Capital Investment Subsidy and annual Interest Subsidy on Working Capital upto Rs.10 lac under each type of subsidy and subsidy on brand promotion, testing equipment and pollution control devices etc under the State Package of Incentives upto Rs. 5 lacs (under each type of subsidy) shall now be sanctioned by the Divisional Level Committee headed by the Director, Industries and Commerce instead of the existing State Level Committee-I. The Divisional Level Committee shall comprise of the following officers: i. Director, Industries and Commerce, Kashmir/ Jammu. Chairman ii. Joint Director(Dev), Directorate of l&C, Kashmir/Jammu. Member iii. FA/CAO of Directorate of l&C, Jammu/Kashmir Member Secy. IV. Deputy Director(Planning), Directorate of l&C, Jammu/Kashmir Member V. General Manager, DIC (concerned) Member VI. A representative of the Administrative Deptt. (not below the rank of Deputy Secretary) Member In respect of incentives/subsidy above Rs. 5 lacs, the cases shall be referred to the State Level Committee-I as per the existing procedures. 11) In the matter of permission for purchase of DG set(s) under the State Package of Incentives, the General Manager shall accord the permission and disburse the incentive amount as per the norms after obtaining prior approval of the Director, Industries and Commerce who shall give the approval subject to the following conditions: Undertaking by the applicant (self certification) that the DG, set shall be installed. Attestation of the AEE (PDD) concerned to the capacity of the DG set (s) to be purchased. Quotations for the said DG set(s) from atleast three authorized suppliers. Certificate from the concerned General Manger, DIC that Plant and Machinery has been installed. 12. Director, Industries and Commerce, Kashmir/Jammu shall restore all the administrative and financial powers to the General Manager, DICs as already delegated to them through various Government Orders issued by the competent authority. Similarly, the General Managers shall delegate powers to dispose of the work to the Project Managers, Manager (Extension), Manager (Development), Manager (Credit), Manager (Raw material), etc in the interest of smooth functioning of the DICs and facilitation of the unit holders. Both the Directors shall issue requisite orders in this regard and give wide publicity to the delegation, so ordered. The General Managers, DIC shall erect billboards outside their office buildings showing the authority vested in them and the work distribution among different Managers of the DIC. 13. The Director, l&C, Kashmir/Jammu shall also host and maintain a proper website along with links to other sister websites of the l&C Department and other Departments to facilitate the industrial unit holders, stakeholders and potential entrepreneurs. Financial projection of the proposed rehabilitation, relief and concession sought by the promoter 7. Whether Financial Institution/ bank has approved the proposal, if yes, give details. 8. Whether the unit is matching the criteria of sick unit? If yes, details with copy of last two years audited balance sheet. 9. Present status of Project, details of Production, Sales & Power consumption. 10. Details/evidence of proposed financial tie-up marketing tie-up or technology tie-up as proposed in the rehabilitation scheme. XI. Testing Equipment (Incentive) 1. Quotation of Testing Equipment. 2. List of Testing Equipment to be purchased. 3. Form to be filled by the unit holder. 4. Self declaration from the entrepreneur regarding not having installed the equipment and not having availed subsidies earlier. 5. Self declaration by the entrepreneur that the equipment will be handled by person having requisite qualification to handle them. 6. Sanction and disbursement a. Copy of permission by Director, l&C. b. Bills/Vouchers of equipment purchased. c. Mode of payment certificate from bank. d. Satisfactory commissioning certificate from SICOP/any other authorized agency. XII. Check list for DG set permission. 1. Quotations of DG set to be purchased, minimum from two suppliers. 2. List of plant and machinery installed with power load. 3. Self declaration from the entrepreneur regarding not having installed the DG set and not having availed subsides earlier. 4-. NOC from PDD regarding installation of DG. Set of the desired load. XIII. Sanction/Disbursement of subsidy for DG set. 5. Permission from Director, Industries and Commerce. 6. Bills/Vouchers of DG set purchased. 7. CA certificate regarding investments made on purchase of DG set. 8. Satisfactory commissioning certificate/ fitness certificate from PDD. 9. With a view to give a fillip to the industrial development in the State of J&K and in conformity with the national policy of ensuring ‘Ease of doing Business’ for the success of ‘Make in India Programme’, it has been felt necessary to simplify the procedures being followed in the Industries and Commerce Department and to make these more industry-friendly. Accordingly, sanction is, hereby, accorded to the following instructions, orders and guidelines for strict compliance by all concerned with immediate effect. These will be in supersession of the instructions, orders and guidelines issued on the subject, earlier.Annexure- ‘A’ to this Government Order contains the revised documentation requirements/checklist for different types of registration, permission, certification and clearances etc.1) EM-I for provisional registration shall be made online as soon as possible.

However, it is necessary to reduce the number of documents required for submission, at present. Accordingly, the requirement of 16-Point affidavit and DPR copies are dispensed away with in case of Micro units. Instead of DPR copies, a Project profile duly attested by the Project Manager of the concerned DIC or a recognized consultant/Expert shall be submitted. EM-I shall be issued within two days after receipt of the requisite documents.

2) EM-II for formal registration shall also be made online in due course of time. Submission of 16-point affidavit for formal registration as prescribed at present shall be dispensed away with Formal registration shall be issued within 05 days from the date of receipt of requisite documents.

3) Single Window Clearance System (SWCC): Henceforth, there shall also be a Single Window Clearance Committee at the District Level (DLSWCC) to be headed by the District Development Commissioner (DDC) for Micro and Small industrial units (with an investment upto Rs 1 Crore in Plant & Machinery). The composition of the Committee shall be as under:

i) District Dev. Commissioner Chairperson ii) Superintendent Engineer,PDD Member iii) General Manager, DIC Member Secretary iv) Rep. of SPCB to be nominated by Chairman, SPCB Member v) Lead Bank Manager of the concerned District Member vi) Representative of SICOP/SIDCO (to be nominated by MD, SICOP/MD,

SIDCO) MemberThe District Level Single Window Clearance Committee shall discharge all such functions for the Micro and Small scale industrial units in terms of delegation made above as are discharged at present by the Divisional Level Single Window Clearance Committee headed by the Director, Industries and Commerce Kashmir/Jammu in terms of Government Order No: 175-IND of 2010 dated 11.10.2010.4) The existing Divisional Level Single Window Clearance Committee

(SWCC) headed by the respective Directors of Industries & Commerce shall, henceforth, also have a representative of the Chairman, SLBC i.e., Chairman, J&K Bank to facilitate and track the financing of the unit by the financial institution/bank to which the applicant has approached with the DPR for loan. The need for submission of the 7-Point affidavit shall be dispensed away with. As against the existing system of allotment of land and subjecting the SWCC clearance to various conditionalities like power availability, consent to operate from SPCB, etc, the SWCC shall consider and accord all clearances in the meeting itself. In order to ensure this, the representatives deputed by various departments to the SWCC must be authorized to accord their departmental clearance in the meeting itself. The Director, Industries and Commerce shall ensure that the SWCC is held atleast once in every month to avoid accumulation/ pendency of cases. The Divisional Level Committee shall clear the cases of Small scale units with an investment of above Rs 1 Crore and upto the maximum of Rs 5 Crore in Plant & Machinery.

5) Allotment of land: In case an allottee does not take effective steps to set up his/her unit on the allotted land within one year from the date of allotment/handing over of possession (whichever is later), the allotment shall be liable to be cancelled. Similarly, if the allottee does not start commercial production within two years from the date of allotment, the Director, Industries and commerce may cancel the allotment.

6) Toll tax exemption /assessment: It shall be obligatory on the part of DICs to carry out the basic assessment of raw material and finished goods within fifteen (15) days from the date of issuance of EM-II without waiting for further documents or application in this regard.

7) Toll tax proforma in respect of raw materials imported and finished goods exported shall, henceforth, be prepared at the end of each financial year by the unit-holder/promoter on self certification basis which shall, then, be submitted to the General Manager, DIC for attestation. Concerned General Manager shall forward the same to the Director, l&C for counter signatures within a maximum period of ten (10) days and the Director, l&C shall forward the toll tax proforma to the Excise Department within five (05) days.

8) Self certification: The following shall also be submitted on self certification basis by the promoters of Micro and Small Scale units for attestation/ countersignatures to the General Manager, DIC/ the Director, Industries and Commerce as per the existing delegation of powers:

a. Export permit for repair of machinery and selling of scrap. b. Permission for import of spares and consumables within assessed capacity. c. Permission to import additional machinery and equipment without any incentives

and change in capacity.The attestation/ countersignature of the General Manager/the Director, Industries and Commerce shall be done either on the same day or after a single inspection within a period of 2 days.9) Clearance from the SPCB- The State Pollution Control Board shall ensure

to give or refuse clearances within one month of the date of application made to it in the prescribed manner in respect of all types of industry - Green, Orange and Red. In case of Green category units, State Pollution Control Board (SPCB) clearance shall not be insisted upon if the applicant furnishes proof of having applied to the SPCB in the prescribed manner at least one month before the date of filing of application under EM-II.

10) Capital Investment Subsidy and annual Interest Subsidy on Working Capital upto Rs.10 lac under each type of subsidy and subsidy on brand promotion, testing equipment and pollution control devices etc under the State Package of Incentives upto Rs. 5 lacs (under each type of subsidy) shall now be sanctioned by the Divisional Level Committee headed by the Director, Industries and Commerce instead of the existing State Level Committee-I. The Divisional Level Committee shall comprise of the following officers:

i. Director, Industries and Commerce, Kashmir/ Jammu. Chairman ii. Joint Director(Dev), Directorate of l&C, Kashmir/Jammu. Member iii. FA/CAO of Directorate of l&C, Jammu/Kashmir Member Secy. IV. Deputy Director(Planning), Directorate of l&C, Jammu/Kashmir Member V. General Manager, DIC (concerned) Member VI. A representative of the Administrative Deptt. (not below the rank of Deputy Secretary) MemberIn respect of incentives/subsidy above Rs. 5 lacs, the cases shall be referred to the State Level Committee-I as per the existing procedures.11) In the matter of permission for purchase of DG set(s) under the State

Package of Incentives, the General Manager shall accord the permission and disburse the incentive amount as per the norms after obtaining prior approval of the Director, Industries and Commerce who shall give the approval subject to the following conditions:

■ Undertaking by the applicant (self certification) that the DG, set shall be installed.■ Attestation of the AEE (PDD) concerned to the capacity of the DG set (s) to

be purchased.■ Quotations for the said DG set(s) from atleast three authorized suppliers.■ Certificate from the concerned General Manger, DIC that Plant and

Machinery has been installed.12. Director, Industries and Commerce, Kashmir/Jammu shall restore all the

administrative and financial powers to the General Manager, DICs as already delegated to them through various Government Orders issued by the competent authority. Similarly, the General Managers shall delegate powers to dispose of the work to the Project Managers, Manager (Extension), Manager (Development), Manager (Credit), Manager (Raw material), etc in the interest of smooth functioning of the DICs and facilitation of the unit holders. Both the Directors shall issue requisite orders in this regard and give wide publicity to the delegation, so ordered. The General Managers, DIC shall erect billboards outside their office buildings showing the authority vested in them and the work distribution among different Managers of the DIC.

13. The Director, l&C, Kashmir/Jammu shall also host and maintain a proper website along with links to other sister websites of the l&C Department and other Departments to facilitate the industrial unit holders, stakeholders and potential entrepreneurs.
