    CHILD WELFARE IN GEORGIA 2011

    The Division of Family and Children Services (DFCS) has overall responsibility for the administration and management of the States public child welfare programs Child Protective Services, Foster Care, Independent Living Services, Family Support and Family Preservation Services and Adoptions. DFCS staff carries out a wide range of responsibilities that support the delivery of financial services and social services. Organizational Structure The Division of Family and Children Services is a state-administered, county operated system comprising 159 local county agencies. As of the end of the state fiscal year, DFCS had seventeen regional service areas each having field operations responsible for the direct supervision of the local county agencies and all service programs in that region. The regional managers report to the Deputy Director of Field Operations, who reports to the DFCS Division Director. The Division of Family and Children Services has continued to plan aggressively for child welfare improvements. This planning has been carried out in partnership with an array of allied agencies, formal and informal collaborators, care providers, and consumers including families, children, youth served, and concerned citizens. As a result of public and media attention to child welfare services, Georgia has opportunities to examine current practice and design programs that will offer expedient, high quality services to children and families.

    Child Protective Services Children usually come to the attention of the Department of Family and Children Services when a concerned citizen, often a mandated reporter, makes a referral to the local county office. A decision is made as to whether or not the report meets the criteria for an investigation: there is a child under the age of eighteen, a known or suspected incident of maltreatment, and a maltreater. Some callers only need referrals to local resources (e.g., mental health, court system or preventive programs). All reports, whether or not they result

    in a CPS investigation, are referred, as required by O.C.G.A 19-7-5, to the local law enforcement agency. All screened-out reports are reviewed and approved by the supervisor to ensure that any case with specific allegations of maltreatment is investigated.

    Georgia began a new practice of responding to reports through Diversion during SFY 2006. Since that time, the number of CPS cases accepted for service has decreased substantially. Diversion is a differential response that emphasizes the utilization of strengths-based, prevention-driven community response to vulnerable children and families. It is presented as an option to assist families when the safety of children is not in question. Diversion response provides targeted support and linkage to community resources to meet identified needs.

    During SFY 2011, DFCS received 63,547 reports statewide. Of those reports, 11,590

    were screened out as not meeting the criteria for investigation; 30,809 were handled through diversion; and 21,148 were investigated. Compared to the preceding year, these numbers reflect a decrease in the number of reports. Once an investigation is completed, the investigator and immediate supervisor make a determination about the status of the case.

    Two findings are made on each report that is investigated: (1) a maltreatment finding and

    (2) a risk finding. If a case is substantiated, a preponderance of the evidence supports the allegation. If a case is unsubstantiated, there is either no evidence or not a preponderance of the evidence to support the allegations. The risk findings are: (1) risk indicated case opened for services, (2) risk indicated case opened for placements, (3) risk factors controlled, (4) no significant risk factors, and (5) risk assessment not applicable.

    Investigation Cases by Determination

    During SFY 2011, 31,840 children were involved in DFCS investigations of maltreatment. This was a 15% decrease from SFY 2010 (37,440). Sometimes families are investigated for more than one abuse/neglect incident in a single year. DFCS received 2,006 reports of alleged repeat incidents of maltreatment statewide during the year. The average time between reports was 113 days or approximately 4 months. The following charts depict the age (Figure 3), gender and race status ((Figure 4) of children in DFCS investigations of maltreatment during SFY 2011.

    Figure 4 Gender and Race of Children in DFCS Investigations If children cannot be adequately protected in their own home and continue to be at risk of abuse and neglect by their parent or caretaker, the court may order temporary removal from the home. The first preference for an out of home placement is with relatives. If there are no available relatives in the area, or if relatives cannot ensure the childs continued protection, the child is placed in a foster home or emergency shelter.

    Foster Parents and Foster Homes In Georgia, there are approximately 4,453 foster homes. Recruitment goes on continually throughout the state. County DFCS staff is responsible for recruiting foster parents. They look for prospective foster parents who are in good physical and mental health with homes that meet the minimum standards as set forth and approved by DHR. Foster parents provide temporary care for children, but if a foster child becomes available for adoption, the foster parents often adopt that child. In fact, foster parent adoptions account for approximately 77 percent of adoptions of children in DFCS custody. Prior to being approved as foster parents, applicants must complete pre-service training. Physical exams, drug screens, and criminal record checks. Each year, foster parents complete additional hours of parent development training, and a re-evaluation of the home is conducted.

    The number of children placed in a foster home will range from one to six (including the parents own children) and is predetermined by the foster parent and the DFCS agency. The foster parents are reimbursed for a childs care. The rate varies with the age and needs of child. During the first six months of care, initial clothing costs are reimbursed by the agency. The costs are $150 for a child whose age is birth through age 12 or $300 for a child whose age is 13 and older. An annual clothing allowance of $100 per year, and medical treatment costs are covered by the agency. A toll-free foster parent support and intake line (1-888-310-

Foster Care Services There were 13,127 children who were in the custody of DFCS during SFY 2011 who had not reached the age of majority (18). As of the end of the year only 7,435 children remained in the custody of DFCS. Approximately 400 children re-sign themselves back into foster care after emancipation. Figures 5, and 6 depict the age, gender, and race of children in the custody of DFCS during SFY 2011. Figure 5

    During the year, about 58% of the children in DFCS custody live in a family foster home or emergency shelter. Approximately, 19% of the children live with relatives. Many children have special needs and are placed in intensive, intermediate or therapeutic settings, institutions, hospitals or group homes. Figure 7

    It is critical that a child spends as little time as possible in foster care. While in care, it is

    important that the child remains in the same out-of-home placement, if at all possible, as long as it meets the childs needs. Federal regulation specifies that the number of times a child moves while in foster care be reduced in tandem with an overall reduction in the length of time in foster care. Figure 8

    Some children remain in foster care throughout their teen years. Over 3,864 youth were

    reported as eligible to receive services through the Independent Living Program, a transition program that prepares teens, ages 14-21, for independence and adulthood. Services include financial assistance for tutoring, college, technical school, supervised housing and life skills, training such as budgeting, job seeking and job retention. During SFY 2011, 309 youth were enrolled in some type of post-secondary training or college program.

    Adoptions Prior to the implementation of the Adoption and Safe Families Act (ASFA) in Georgia, there were less than 500 finalized adoptions per year. In SFY 2011, 1,090 children were placed in adoptive homes and 1,119 adoptions were finalized**. Figure 11

    were in custody and discharged from foster care to adoption.

    Challenges for FY 2011 and Beyond Child Protective Services (CPS) has continued to draw on the community resources to protect and serve the most vulnerable among us. The challenge is to find community partners willing to address the expanding needs of our families and develop community- based solutions. Maximization of current resources must continue while recruiting others to help in our rewarding but difficult endeavors. Additional support from the Legislature is required to provide the services and meet the needs that our growing population deserves and requires. Responding to the mandate placed on child welfare agencies to ensure reform in the child welfare field continues to be our priority and our challenge even while resources are lacking and there is a statewide staff shortage. However, we are confident that our best efforts will continue to result in providing the best services possible for families and children.

    THE DEPARTMENT OF HUMAN RESOURCES IS SUPPLYING REPORTS AND STATISTICS ON CHILD WELFARE TO FULFILL THE REQUIREMENTS OF HOUSE BILL 1406. FROM HOUSE BILL 1406:

    (a) The county director of the department of family and children services of each county shall provide an annual report no later than December 31 of each year, beginning in the year 2000, to the county board, the director of the Division of Family and Children Services, each member of the General Assembly whose legislative district includes any part of that county. The report shall include the following information for the 12 month period ending June 30 of that year:

    - The number of children for whom the county department has received a complaint of child abuse;

    - General demographic data such as gender, race, and age regarding children;

    - The number of children taken into county department custody;

    - The number of placements of children in county department custody by the type of placement;

    - The length of time in county department custody by the number of children; and

    - Any other information required by the director of the Division of Family and Children Services.
