I concur with the council query in that the layout and number of the tables/chairs used within the enclosed veranda (and outside it) is different from the plans Marshall Day Acoustics were provided with in order to assess noise. In this regard I have revised/updated my noise prediction model to take account of the seating layout as shown in Figure 1 below (the RC plan layout), and re-run the model to obtain noise predictions for the seating layout in Figure 1.   • The noise predictions in my original report for the front outdoor dining area were based on 1 in every 4persons dining speaking with a loud male voice as a worst case scenario i.e. a total of 12 loud male voicesfor the 12 tables each seating 4 persons (48 seats in total for the front outdoor dining area). The RC layout (as per Figure 1 above) has 7 tables in the Dining Terrace area (each 2 seats) and 16 tablesin the Enclosed Veranda area (11 tables with 2 seats each and 5 tables with 4 seats each – note “benchtype” seats along one side of these tables). This equates to 42 seats within the Enclosed Veranda areaand 14 seats within the Dining Terrace area, a total of 56 seats. Applying the same noise assessmentmethod (i.e. 1 loud male voice per 4 persons) I have updated the noise model assessment to include for14 (i.e. 56/4) loud male voices distributed across the tables in both the Dining Terrace area and theEnclosed Veranda area. Results:The outcome of assessing the layout as per Figure 1 above is that the predicted noise levels in Table 5 (re-produced below) of the original MDA report remain the same , except for the noise prediction at 38Ponsonby Rd (Business -Town Centre Zone) which increases by 2 decibels from 45 to 47 dB LAeq. Thisrevised level of 47 dB LAeq still readily complies with the relevant noise limits of 65/55 dB LAeq for theBusiness – Town Centre Zone (see Table 3 of original MDA report). Therefore, any conclusions reached in the original MDA report in relation to noise remain unchanged.

    1.0 INTRODUCTION

    RCP has engaged Marshall Day Acoustics (MDA) on behalf of Samson Corporation Limited to assess the potential noise impacts of a proposal to redevelop the sites located at 42 - 48 Ponsonby Road in Ponsonby, Auckland.

    The purpose of this report is to assess compliance with noise performance standards in the Auckland Unitary Plan Operative in Part (AUP), to assess effects in accordance with Section 16 of the Resource Management Act (RMA), and to form a part of an application for Resource Consent.

    A Glossary of Terminology is included in Appendix A.

    2.0 APPLICATION SITE

    Figure 1 shows the existing application site and neighbouring sites.

    3.0 PROPOSAL

    3.1 Re-development

    This proposal relates to the re-development of the site and is described in full in the application documents and the plans prepared by Patterson Associates Limited.

    Existing on the site is a single level building (Sawadee Restaurant) and a two-storey corner building (Existing Character Defining Building). The existing single level building and rear annex of the Existing Character Defining Building would be removed.

    The original Existing Character Defining Building would be fully renovated to provide for hospitality tenancies, including associated outdoor seating areas at ground level on both sides of the building.

    A new L-shaped building would be constructed around the Existing Character Defining Building, including:

    • One level of basement parking

    • Ground floor tenancies, primarily for retail and hospitality

    • Three levels of commercial space above the ground floor, including an outdoor roof terrace on Level 3 envisaged for hospitality use

    The proposed site layout and various floor level layout plans are shown in Appendix B.

    Details of any mechanical plant have not yet been finalised.

    3.2 Expected Activity

    Table 1 lists the use envisaged/activity with timeframes for each of the tenancy spaces indicated on the plans (refer Appendix B).

    4.0 EXISTING ENVIRONMENT

    4.1 Noise Measurements

    A site inspection was carried out on Thursday 19 April 2018 between 11:45 am and 1:30 pm, during which ambient noise levels were measured, in accordance with the relevant standards. The measurement positions are marked MP1 to MP5 on the figure in Appendix C and are shown in photos in Appendix D.

    The weather during the measurements was fine with a light south-westerly breeze (1.6 – 3.3 m/s) and varying cloud cover from 3 to 6 okta. These conditions were within the allowable parameters for measuring outdoor noise.

    The predominant noise source at all measurement positions was generally traffic noise from local roads, in particular from Ponsonby Road.

    In summary, ambient noise levels ranged from 57 to 68 dB LAeq and background noise levels ranged of 50 dB LA90 to 61 dB LA90.

    The ambient noise levels measured at the residential zone interface (MP1 and MP2) were 65 dB LAeq and 68 dB LAeq.

    This is typical of a busy road/intersection on the city fringe.

    5.0 NOISE PERFORMANCE STANDARDS

    5.1.1 Zoning

    The application site is situated on land zoned Business – Town Centre Zone in the AUP, as are adjoining properties to the south-west and south-east and directly opposite across Crummer Road. To the west, also on the opposite side of Crummer Road, is land zoned Business – Mixed Use Zone (1 Vinegar Lane).

    Across from the application site, on the corner of Ponsonby Road and Hopetoun Street, is land zoned Residential – Single House Zone.

    To the north, across the intersection of Ponsonby Road and Hopetoun Street, is land zoned Open Space – Sport and Active Recreation Zone / Informal Recreation Zone (Park). Some further Residential – Single House Zone sites are situated along the northern side of Hopetoun Street surrounded by the Park. Figure 2 shows zoning at the application site and neighbouring sites.

    5.1.2 Noise Standards

    Noise standards and policies for the zones are set out in the AUP Section E25. The relevant standards are addressed below and reproduced in Appendix E.

    5.1.3 Operational Noise Limits

    Table 3 summarises the limits that apply for noise received from the proposed re-development at neighbouring sites.

    Standard E25.6.8 (1) addresses noise in the Business – Town Centre Zone. It requires that the noise (rating) level is measured or assessed as the incident level on the façade of any building on any other site in the same zone or in the Business – Mixed Use Zone.

    Standard E25.6.19 (1) addresses noise at the Business zones interface. It requires that the noise (rating) and maximum noise level is measured within the boundary of a site in a residential zone.

    5.1.4 Construction Noise Limits

    Standard E25.6.27 (1) provides construction noise limits for construction activities in all zones except the Business - City Centre Zone and the Business – Metropolitan Centre Zone.

    The total duration of construction works is expected to be more than 20 weeks with normal hours between 7:30 am and 6:00 pm Monday to Saturday. Accordingly, the relevant noise limits that would apply for this duration and times are presented in Table 4.

    5.1.5 Measurement and Assessment Standards

    Operational Noise

    Standard E25.6.1 (1) states that noise levels arising from activities must be measured and assessed in accordance with the New Zealand Standard NZS 6801:2008 Measurement of Environmental Sound and the New Zealand Standard NZS 6802:2008 Acoustics – Environmental Noise, except where more specific requirements apply.

    Construction Noise

    Standard E25.6.1 (3) states that noise from construction must be measured and assessed in accordance with the requirements of New Zealand Standard NZS 6803:1999 Acoustics – Construction Noise.

    6.0 PREDICTED NOISE LEVELS AND ASSESSMENT OF EFFECTS

    6.1 Predicted Noise Levels

    From Table 1, expected activity within the re-development includes:

    • Office

    • Retail / showroom

    • Café

    • Basement car parking

    • Restaurants / outdoor areas

    Commercial activity (office, retail, showroom, cafe) and use of the car park is not expected to generate any significant noise as these activities are generally confined to indoors. The most significant noise generation from the proposal would be related to the use of the outdoor areas associated with the restaurants.

    Noise generation from the various activities including mechanical plant are addressed separately below.

    6.1.1 Office / Retail /Showroom

    As noted in Table 2, these commercial tenancy spaces would be utilised between 9:00 am and 6:00 pm Monday to Friday.

    All activity would generally be indoors and would not generate any significant external noise. Therefore, it is considered that this activity would readily comply with both the applicable 65 dB LAeq daytime noise limit (applicable 7:00 am to 10:00 pm all days) at surrounding Business zoned sites and the 55 dB LAeq daytime noise limit (applicable Monday to Saturday 7:00 am to 10:00 pm) at Residential zoned sites across Ponsonby Road.

    6.1.2 Café

    The café shop front would be located off Crummer Rd and would operate between 9:00 am and 5:00 pm on all days of the week.

    The café would be screened from the nearest residential zoned sites (3 Ponsonby Road) by the Existing Character Defining Building as well as being distance separated by the Ponsonby Road carriageway. Based on our experience, any noise generated from the café would readily comply with the relevant daytime noise limits at both Business and Residential zoned sites.

    6.1.3 Basement Car Park

    The basement car park would provide 17 spaces with access off Crummer Road.

    It is understood that the parking spaces provided would be associated primarily with commercial tenancies and would not be available for use by restaurant patrons. Consequently, the most frequent use of the car park is expected to occur during weekdays between 9:00 am and 6:00 pm.

    As the parking activity is confined to an enclosed basement, there would be no noise effects from vehicles using the basement car park.

    6.1.4 Restaurants / Outdoor Areas

    Tenancies G01 and G02 plus both levels of the Existing Character Defining Building (refer Appendix B - Ground Floor Plan) are proposed for use as restaurants, operating 7 days a week between the hours of 9:00 am to 11:30 pm.

    It is understood that the front outdoor dining area (covered by a veranda - refer Appendix B - Ground Floor Plan) and rear outdoor dining area (situated in the courtyard area - refer Appendix B - Ground Floor Plan) and rooftop terrace dining area (refer Appendix B – Third Floor Plan) would be used by restaurant tenancies located within the Existing Character Defining Building.

    Access to the rooftop terrace would be via a pedestrian bridge extending from the rear upper level façade of the Existing Character Defining Building to the first floor of the new L-shaped building behind.

    An assessment of the noise emission from patrons dining outdoors has been completed based on:

    • Front outdoor dining: 12 dining tables under the front outdoor veranda covered seating area in front of the Existing Character Defining Building, facing Ponsonby Road2

    • Rear outdoor dining: 9 dining tables in the rear courtyard2 area behind the Existing Character Defining Building

    • Rooftop terrace outdoor dining: 13 dining tables situated on the rooftop terrace3

    People’s voices are considered to be the most significant potential noise source when dining and generally not all patrons at a specific table would speak at the same time.

    With a worst-case scenario whereby, there is one male speaking with a ‘loud’ voice at each table noted above at the same time, the noise levels predicted to be received at the nearest Business zoned building facades and Residential zoned boundaries (without averaging) have been calculated for the following two scenarios:

    • All 3 outdoor areas in use (12 + 9 + 13 tables)

    • Rear and rooftop terrace outdoor areas only (9 + 13 tables)

    The results are presented in Table 5.

    Based on the results in Table 5, the relevant noise limits of 65 dB LAeq (daytime) and 55 dB LAeq (night-time) would be complied with at all nearest Business zoned sites4.

    Predicted noise levels at residential zoned sites are 1-2 decibels above the 55 dB LAeq daytime noise limit. However, the noise levels generated by patrons dining would fluctuate across the day depending on levels of patronage and use of the outdoor areas. Taking this into account, it is considered that the resulting average noise levels at residential sites would be less than 55 dB LAeq with all 3 outdoor areas in use, and therefore, would comply.

    It is also noted that achieving compliance with the 55 dB LAeq daytime noise limit at residential zoned sites is reliant on there being no material contribution from ‘loud’ music.

    As noted in Table 1, proposed operation of the restaurants is from 9:00 am to 11:30 pm on all days.

    Based on the above assessment, use of the front outdoor dining area would need to be limited to the residential zone daytime hours (i.e. Monday to Saturday between 7:00 am – 10:00 pm and Sunday 9:00 am – 6:00 pm) in order to achieve compliance with the 55dB LAeq daytime noise limit. It is noted that noise from the front outdoor dining area is the controlling outdoor area in terms of noise generation at the residential zoned sites on the other side of Ponsonby Road.

    Based on Table 5, use of the rear and/or rooftop terrace outdoor dining areas during the proposed restaurant opening times of 9:00 am to 11:30 pm on all days would comply with both the Business and Residential noise limits, provided no ‘loud’ music was played outside.

    6.1.5 Mechanical Plant

    As previously stated the details of proposed mechanical plant have not been finalised. Any mechanical plant/services installed, should be designed to meet the relevant noise limits.

    It is considered that with appropriate selection of equipment in terms of noise emission characteristics, typical methods of noise control (if required) and appropriate location on the site, noise levels from mechanical plant/services would be able to comply with the relevant noise limits.

    6.2 Operational Noise Effects

    Based on the measured noise levels in Table 2 and observations during the site visit, the existing noise environment in the vicinity of the application site is significantly affected by existing road traffic noise.

    Noise levels from the proposal are expected to comply with the relevant noise limits in the AUP provided that the restaurant front outdoor dining area is not used between 10:00 pm and 11:30 pm Mondays to Saturdays or between 6:00 pm and 11:30 pm on Sundays (when the 45 dB LAeq night-time residential noise limit applies) and that loud music is not played outdoors.

    Noise levels generated at the nearest façades of buildings in the Business zone from the proposal are expected to comply with the relevant noise limits in the AUP.

    The highest noise levels received at Business zoned sites are expected from the use of restaurant outdoor dining areas.

    It is considered that with achieving compliance with the relevant noise limits, and taking into account the elevated noise environment from traffic, the noise effects would be acceptable and reasonable in terms of Section 16 of the RMA.

    The activity proposed on the application site would also be similar in character to that which is currently established in the vicinity of the nearest business zoned sites i.e. cafes / restaurants / commercial / retail (refer Section 4.2).

    7.0 CONSTRUCTION NOISE

    It is understood that details of the proposed construction methodology and equipment have not yet been determined by the applicant.

    Therefore, to provide an indication of potential noise levels, the following construction activity has been considered:

    • Demolition of existing buildings/foundations using excavators with pulveriser attachment

    • Removal of materials from site using excavators loading trucks

    • Bored reinforced concrete soldier piles (basement), using rotary auger piling rigs

    • Lifting of materials on site using mobile cranes

    • Delivery of materials to site using trucks

    Indicative equipment noise levels for typical equipment are given in Table 6. The levels are based on MDA measurements of similar equipment or reference levels from British Standard BS 5228-1:2009 “Code of practice for noise and vibration control on construction and open sites – Part1: Noise”.

    Due to the multi-level nature of the surrounding buildings, the predicted levels in Table 6 do not include mitigation from the use of acoustic screens as these are typically ineffective at the upper levels of adjacent buildings.

    Based on the worst case indicative setback distances in Table 6, it is concluded that there would be receivers where the construction noise limit would be exceeded for intermittent periods.

    As the actual construction methodology and equipment is unknown at this stage, it is recommended that any potential construction noise effects be managed through a Construction Noise Management Plan (CNMP), to be submitted to council prior to any works commencing.

    The CNMP should be implemented throughout the demolition and construction periods of the project. As a minimum, the CNMP should include the mitigation and management procedures outlined in Annex E of NZS 6803:1999.

    8.0 RECOMMENDED NOISE CONDITIONS

    It is recommended that the following noise conditions are imposed on any consent granted:

    1. A Construction Noise Management Plan (CNMP) must be prepared by a suitably qualified person and submitted to Auckland Council for certification 5 days prior to the commencement of the works. The purpose of the detailed CNMP is to, as far as reasonably practicable, avoid, remedy or mitigate adverse effects of construction noise. The CNMP must be implemented throughout the Project and a copy must be maintained on site. The CNMP shall include:

    a. A description of the works;

    b. Hours of operation;

    c. Contact details for staff responsible for implementation of the CNMP;

    d. The construction noise performance standards for the project;

    e. Identification of affected sensitive receivers where noise performance standards apply;

    f. Management and mitigation options, including the relevant measures from Annex E of NZS 6803:1999 "Acoustics - Construction Noise”;

    g. Methods and frequency of monitoring and reporting; and

    h. Communication, consultation and complaints response protocol.

    2. Construction noise shall comply with AUP OIP Standard E25.6.27 unless otherwise provided for in the CNMP

    9.0 CONCLUSION

    Marshall Day Acoustics has assessed the potential acoustic impacts of a proposal to redevelop the sites located at 42 - 48 Ponsonby Road in Ponsonby, Auckland.

    The proposed activities are predicted to comply with the relevant noise limits of the AUP, provided:

    • The restaurant front outdoor dining area is not used between 10:00 pm and 11:30 pm Mondays to Saturdays or between 6:00 pm and 11:30 pm on Sundays

    • No loud music is played/emitted within any of the outdoor dining areas

    It is considered that with achieving compliance with the relevant noise limits, and taking into account the elevated noise environment from traffic, any noise effects would be acceptable and reasonable in terms of Section 16 of the RMA.
