7. Issue of tender document to bidder will not automatically mean that the bidder is qualified

for the Award of contract. No condition/ deviation which is either additional or in modifications of the tender conditions shall be included in the bid submitted by the bidder. If the bid contains any such conditions or deviations from the tender conditions, the bid shall be rejected.

8. Bidders are required to put their sealed tender in the Tender Box personally or through their

authorized representative. Bids in sealed condition can also be received by post/ courier provided that the bid is received at least one hour before the stipulated date and time for opening, in the receipt section of RITES Office Ground Floor, RITES Bhawan, Plot No.1, Sector-29, Gurgaon – 122001, Haryana, India. RITES Ltd shall not be held responsible for the delay/non-receipt of the bid.

9. The Tender No., Due date of opening and Title shall be super scribed on the sealed

envelopes. 10. RITES Limited does not bind themselves to accept the lowest or any offer or to give

reasons for their decision. RITES Limited also reserves the right to reject or accept or divide the offer between more than one tenderer without assigning any reason.

ANNEXURE – I TERMS & CONDITIONS OF TENDER

1. Definitions: “Purchaser” means RITES Limited, Gurgaon

2. Scope Of Work: A. The Profile Stretch Bending Machine to be supplied shall be new and as per

specifications given at Annexure II. B. Past Supplies: The Bidder must attach with the offer a list of purchasers of the said machine both

in Indian and abroad.

C. Installation, Testing & Commissioning: The Bidder shall also install, test & commission the Profile Stretch Bending

Machine at place of final delivery in Myanmar. The manufacturer / supplier shall depute his authorized experience

commissioning team immediately on receipt of material at site in Myanmar. 3. Validity Of Offer: The validity of offer shall be 90 days from the date of opening of offer.

4. Delivery: The Profile Stretch Bending Machine shall be delivered at RITES Warehouse,

New Delhi at the earliest. Bidder should quote the shortest delivery schedule. 5. PRICES:

5.1 Prices quoted shall be delivery at RITES Warehouse, New Delhi. 5.2 EXCISE DUTY AND TAXES: Since the item is for export, CT-1 Form will be

provided for clearance of spares from the place of manufacturer, without payment of excise duty, if payable.

In lieu of sales tax, Form “H” (for Central Sales Tax for outside firms for Inter-state transaction) will be provided by RITES after export of material within stipulated time period. The firm shall submit /fax the invoice within 7 days from the date of dispatch of material so as to enable us submitting timely information to the Sales Tax Department for arranging form ‘H’ as date of invoice is reckoned as date of sales and monthly information for ‘H’ form to sales tax department. Non submission to the department will result in non issuance of ‘H’ form. For Sales Tax purpose RITES jurisdiction is Delhi being Regd. Office is in Delhi.

6. Payment Terms: 6.1 70% of the payment shall be made against delivery of the material at RITES

Warehouse, New Delhi. The balance 30% of payment will be released after successful commissioning and prove out of machine/equipment at site.

7. Bid Security: The Bidder shall provide for Rs. 29,000/- in the form of Demand Draft drawn in

favour of RITES LTD payable at Gurgaon. Bid Security of successful bidders shall be returned on receipt of performance security. Bid Security of unsuccessful bidders shall be returned within 30 days of finalization of bid. No interest shall be paid on Bid Security. If the bidder withdraw/modifies his bid for any reason during its validity, the bid security shall be forfeited. Failure to submit bid security would lead to rejection of offer.

8. Performance Bank Guarantee (PG): The successful bidder is expected to submit Performance Bank Guarantee for an

amount equivalent to 10% of the contract value valid up to one month beyond the warranty period.

9. Documents: Following documents will be submitted along with each Profile Stretch Bending

Machine.

i) Catalogues and complete spare parts/ Wear part list. ii) Operations and maintenance manual including write-up on safety

measurements/ provisions iii) Electrical, electronic, hydraulic and lubrication circuit diagrams. iv) Commissioning and troubleshooting instruction.

10. Inspection: Inspection will be done by QA Division of RITES Ltd.

11. Warranty: Notwithstanding the pre-dispatch inspection by RITES’s representative bidder

shall provide complete warranty against any manufacturing defect, design and such other defects for a period of 12 months from the date of commissioning and Provisional Acceptance by Myanma Railways. All such defects shall be removed by the Bidder at his own cost with in a responsible period of time as agreed with RITES representative.

12. Tool Kit: The bidder shall supply necessary tool kits along with each Profile Stretch

Bending Machine. 13. Basis of Evaluation:

The offer will be evaluated on delivery at RITES Warehouse, New Delhi +commissioning & training.

14. Liquidated damages: If the Bidder fails to supply the material/equipment or complete the work given

under this Order within the agreed delivery schedules mentioned herein or any extension thereof authorized by the Purchaser and /or fails to fulfill their obligations under this order, The Bidder shall be liable to pay liquidated damages and not by way of penalty, a sum of ½ (half) percent per week of delayed supplies subjected to maximum of 10 (ten) percent of the order value. The compensation shall be payable by the Bidder without prejudice to other rights and remedies available to the Purchaser in respect of any failure/defaults committed by the Bidder. However, for delay beyond 10 weeks for supply of the material/equipment or complete the work given under this Order within the agreed delivery schedules mentioned herein or any extension thereof authorized by the Purchaser and /or fails to fulfill their obligations under this order, the purchaser may take action for termination of the Contract as per The Termination clause mentioned below and make arrangements at the risk & cost of the bidder.

15 Arbitration/Settlement of Disputes: Mutual settlement of Disputes: Except where otherwise provided for in the

contract, all questions and dispute relating to any matter directly or indirectly connected with this agreement shall in the first place be resolved through mutual discussions, negotiation, deliberations and consultations between both the parties. General:- Subject to aforestated conditions the provision of the Arbitration and conciliation Act 1996 or any statutory modifications or re-enactment thereof and the rule made there under and for the time being in force shall apply to the conciliation and arbitration proceedings under this clause.

16 Force Majeure: Force majeure shall mean unforeseeable cause beyond the central and without

the fault or negligence including but not restricted to acts of God or caused by war, civil commotion, riots, mobilization, flood, epidemics, quarantine restrictions, freight embargoes and obstructions of navigation at part of exit or entry or acts of Governments.

17 Termination: Termination for default: RITES may, without prejudice for breach of contract, 10

days after written notice of default sent to the supplier, terminate in whole or in parts.

a) If he faults to deliver full or part consignment with in the time period(s) specified in the contract or any extension thereof granted by RITES

b) If he fails to perform any other obligation under the Contract or. c) If he, in either of the above circumstances, does not cure his failure with in

a period of 30 days or longer as specified by RITES after receipt of the default notice from RITES.

In the event RITES terminates the contract in whole or in part, pursuant to above, RITES may procure, upon such terms and in such manner as it deemed appropriate, equipment/plant similar to those undelivered, and supplier shall be liable to RITES for any excess costs for such similar equipment/plant.

18 Packing: The item shall be packed in sea worthy export quality packing in order to ensure

their being free from any loss or damage during handling or transshipment on arrival at destination. Suitable thickness steel banded plywood/wooden boxes lined with tar coated Hessian cloth, dust proof paper, air bubble polyethylene film and thermocol shall be used. Silica gel bags must be placed at strategic locations to prevent moisture. Surfaces prone to rusting must be given oil / grease coating. Castings and forgings must be painted with red primer paint. Non-compliance to seaworthy packing shall entail the packing to be got done by RITES at Supplier’s Cost.

19 Marking: Plywood/wooden boxes to be suitably marked with paint/indelible waterproof ink

with the following particulars on outside: - RITES Purchase Order No., Gross weight, Net weight & measurements. -Box. No. to be indicated on at least three sides of the Box.

20 Correspondence: Offer to be sent in sealed envelope clearly superscribing Tender no. and date of

21 Other conditions: 21.1 Invoice should be in the name of RITES Ltd, SCOPE Minar, Laxmi Nagar, Delhi-

110092 and should be dispatched to RITES Corporate office at Gurgaon. 21.2 The quantity against the tender can be increased/decreased upto 50% without any

increase in the rates. 21.3 The order can be placed for part/whole of the items under tender. 21.4 Deliveries of the stores can be staggered into 2-3 installments, if required. 21.5 RITES Ltd. is registered with Delhi VAT and the registered office is at Delhi.

whatsoever thereof.

Annexure-II

TECHNICAL SPECIFICATION OF PROFILE STRETCH BENDING MACHINE

1. DESCRIPTION AND SCOPE OF SUPPLY

The scope of supply for the above machine will be as following.

1. Profile Forming and Bending Assembly. Holed strip then will be fed to rolling assembly manually. At the end of forming rolls there will be set of three bending rolls to give desired curvature. These bending rolls will have the exact profile which will be identical to finishing rollers of profile forming assembly. Layout of the machine is attached at annexure.

The unit is complete in itself, by connecting it to an appropriate power supply it is ready to operate.

2. LEADING DIMENSIONS: 2.1 PROFILE FORMING AND BENDING ASSEMBLY

OBJECTIVE: To make sections in precut and pre punched Mild Steel sheets as per drawing attached at Appendix-I, II,III & IV.

MATERIAL : CR Mild Steel

STRIP WIDTH : 150 mm

SPEED : 6 mtrs. Per minute

THICKNESS : UPTO 3.5 mm.

3. LIST OF EQUIPMENTS:

Roll Forming Line should consisting of the following parts: 1 Side guide 1 no. 2 Horizontal forming stands 10 nos. 3 Section bending assembly 1 no. 4 Control Panel 1 no. 5 Roll Set material EN-31 1 Set

4. TECHNICAL DETAIL OF EQUIPMENTS: 4.1 STRIP ENTRY GUIDE ROLL.

The side guide roll assembly is fabricated of steel construction which consists of 2 ground rollers on each side. The rollers are mounted on individual housing which is adjustable in the slides by two screw jacks for setting the gap equal to the strip width. This is required to maintain the center line of the strip with the shearing machine. It has proper adjustment and sufficient space available for 150 mm width sheet. The rollers are made out of En – 31 material duly hardened and ground.

4.2 HORIZONTAL FORMING STANDS The forming section of this mill consists of the roll stand base frame and the drive base frame. Both the bases are fabricated out of steel construction. The forming section has ten driven roll passes with 10 nos., of rear and front bearing housings and two sets of vertical guide rolls. Both the rear and front spindles housings are bolted with the base frame. The height of the housing is 450 mm x 110 mm width between two steel plates. One cap is located at the top of each housing. The driven spindles are 50 mm in diameter and are duly hardened, ground and made out of EN-9 alloy steel material. The spindles are mounted on roller bearings of 40 mm bore in bearing blocks. The upper driven roll spindle is adjustable up and down by a screw and lower spindle is fixed. The rolls stands are precisely machined.

4.3 SECTION BENDING ASSEMBLY

This assembly will bend section coming out of the roll forming line to required angles. This assembly has 3 nos. of rollers (placed in zig–zag arrangement of 1 + 2 rollers). These rolls are mounted on precisely machined bushes of Phosphorous Bronze which are mounted in steel fabricated stands. The stretch bending arrangement should such that it is able to remove the wrinkles on inside the curvature.

4.4 ROLLERS One no. Roll set made out of EN-31 alloy steel hardened, ground and chrome plated along with suitable spacers will be required to successfully make the profile.

4.5 ELECTRICALS Main Drive: 15 HP. A.C Variable frequencies Drive Control Panel: 1 No. All AC. Motors will be ABB or Crompton Greaves make.

5. TECHNICAL LITERATURE 5.1 One copy of the printed illustrative catalogue showing features of the machine and its

elements must be enclosed with each copy of the bid. 5.2 The successful bidder shall furnish for each machine 4 copies of spare parts catalogue

giving the part list number of each component with exploded views and assembly drawings, maintenance manual, trouble shooting guide, operational manual and electrical circuit diagrams to consignee directly within 3 months of issue of Acceptance of Tender. The bidder shall furnish a list of literature to be supplied along with the machine.

6. DEVIATIONS The bidder shall certify that the offered machine fully meets the specification

requirements. Design features incorporated in the machine to fulfill different technical and performance requirements shall be fully explained in the offer. A deviation statement must be provided detailing clause wise deviation if any on all clauses of all specifications and annexures clearly highlighting the advantages/limitations of the deviations.

7. TRAINING 7.1 Technical experts of the manufacturer shall fully and adequately train operators and

maintenance staff nominated by the consignee during commissioning of the machine. The training shall be for at least (3) three days.

8. FOUNDATION & RELATED DRAWINGS 8.1 For the machine, the supplier shall furnish directly to each consignee,6 copies of

foundation drawings and related diagrams (mechanical and electrical), giving machine weight, overall dimensions, foundation details, electrical load and circuitry, within 4 weeks of receipt of Advance Acceptance to enable all preparations to be made for commissioning of the machine on receipt.

9. INSTALLATION, COMMISSIONING AND PROVING TESTS 9.1 PRE-DISPATCH PROVING TEST: Pre-dispatch proving test is required to be done at

factory premises in order to check the capability of Profile Stretch Bending Machine for the objective mentioned at clause 2.1 above.

9.2 The contractor or his agent shall be required to carry out a joint check at the consignee's

end along with the consignee before unpacking is done to avoid subsequent complaints regarding short shipment or transit damages. It is necessary that this joint inspection be done immediately on receipt of the machine by consignee to avoid commissioning delays due to shortages/transit damages.

9.3 Installation shall be done at Myanmar by firm’s engineers. Firm’s Engineer will be

required to be present as soon as the foundation is ready. RITES will provide only to and fro air-ticket in economy class for one service engineer during installation, commissioning and training. The other expenses like boarding, lodging ,local transport etc. in Myanmar will be borne by the Firm.

9.4 The contractor or his agent shall commission the machine within 30 days of intimation by

the consignee in respect of readiness of foundation etc. 9.5 Performance of the machine shall be demonstrated by the contractor or his agent after

successful commissioning at the consignee’s works for a period of two 8 hr. Thereafter the machine performance shall be watched by the consignee for a period of one month (each working day having one shift of 8 hrs.), before final proving test certificate is issued.

9.6 If an assembly/sub assembly is required to be taken back to the manufacturer's

premises for repair/replacement either before commissioning or during warranty, the manufacturer or his agent would be required to submit an Indemnity Bond. In case the entire machine has to be taken back, a Bank Guarantee would have to be submitted. The Indemnity Bond/Bank Guarantee should be of adequate value so as to cover the cost of the assembly/subassembly/paid-up cost of the machine.

10. COLOUR 10.1 The machine and its accessories shall be painted in apple Green colour No.281

conforming to IS-5-1978.

11. QUALIFYING CRITERIA

11.1 TECHNICAL CAPACITY:

(i) The tenderer must have experience in design, manufacturer ,supply, testing and commissioning of Profile Stretch Bending Machine for various steel sections for at least 5 years.

(ii) The tenderer should have successfully designed, manufactured , supplied, tested and commissioned at least two (2) no. of Profile Stretch Bending Machine in last five years which is currently in running condition and must have been operating satisfactorily.

(iii)The tenderer shall submit the details of its past experience along with copies of purchase order and /or Performance certificates of machine from the respective customers/clients in support of their meeting the above-stipulated technical requirements.

Documents establishing the satisfactory performance of some of the above should be submitted along with offer.

11.2 FINANCIAL CAPABILITY:

(i) The bidder shall have achieved the operating turnover of Rs. 30 lakhs in any one of the last three (3) financial years.

(ii) The applicant firm shall be a profit (net) making firm and shall have made profit in two preceding financial years out of the three earlier financial years.

(iii) The bidder shall have satisfactorily completed similar work in his own name.

(iv) A solvency certificate of minimum solvency of Rs. 12 lakhs from a scheduled bank issued not earlier than 6 months from the last date of submission of tender shall be required to be submitted.

11.4 EARNEST MONEY DEPOSIT: The bidder shall required to submit the Security deposit/EMD, which shall be Rs 29,000/- (Rupees Twenty nine thousand only).

Note: Necessary documents establishing the above will be required to be submitted by the Bidder. IMPORTANT NOTE: Bidders are required to give clause-wise comments on the following technical

specifications, Annexures etc. conforming compliance/non-compliance to details of deviations to avoid back reference. Offers are likely to be ignored in case of non-compliance with these instructions.
