3. INDIA VISAS: US Passports must be valid for at least six months AFTER the date of return. Visa requirements vary; it is the passenger’s responsibility to obtain current informa-tion from local consulates. Visas are required for entry into India for U.S. citizens. Non-U.S. citizens should check visas with appropriate consulates or their travel agent. PDT does not accept responsibility for passengers in possession of incorrect or invalid visas.

4. CANCELLATION FEES (All tours): A written notice of cancellation must be received by PDT either by mail, fax, or e-mail. GENERAL BOOKING CONDITIONS1. FINAL PAYMENT: Land Only Payment: Due 75 days prior to departure and may be made by check or credit card with a signed authorization form. PDT reserves the right to modify your tour arrangements to accommodate unforeseen circumstances due to high demand for air, cruise and hotel space. You will be notified, should this situation arise.

2. SPECIAL DISCOUNTS: Discounts are applicable to new bookings only, if the special promotion is being rendered by a third party such as hotels, airlines, ground operators, etc. All discounts are not combinable. Unfortunately, we are not able to apply promotional discounts, when payments are not received by the specified deposit and final payment due dates.

3. RE-BOOKING: A change in departure date, or from one tour to another after your original reservation has been processed, is considered a cancelled trip, and cancellation fees will apply.

AIR & LAND INFORMATIONLAND ONLY TOURS: Land only tour prices include domestic intra-India flights in conjunction with the land tour, and, once ticketed, are non-refundable and subject to all other applicable airline fare rules. PDT endeavors to follow itineraries precisely; however, if flights are not available at the scheduled time, we reserve the right to modify the air and land arrangements for smooth operation of the tour. International and domestic air schedules are subject to change at any time. Land only tour prices do not include international flights, however, PDT offers special rates on international flights for travel originating in the U.S. (subject to availability). Land only tour prices are subject to increase prior to the time you make full payment; land only tour prices are not subject to increase after full payment has been made, except where minimum participation levels have not been met. A signed form will be required at the time of initial payment to expressly acknowledge your acceptance of this price increase policy. International and domestic air schedules are subject to change at any time.

REFUND ON UNUSED OR CHANGED TOUR ARRANGEMENTS: Portions of land arrangements, hotel accommodations or any other service or feature of the tour, which are not used, are neither refundable nor exchangeable. Travel Protection Insurance fee is non-refundable. Refund claims must be made in writing through the agent from whom the tour has been purchased within 14 days of the termination of the tour. A written statement from the Tour Director or Local Guide certifying the exact services not rendered must be attached to this claim.

LAND ONLY TOUR PRICE DOES NOT INCLUDE: 1. International air from USA/first point of entry abroad, or last point of exit on tour/USA . 2. Initial arrival and departure transfers, unless transpacific air is purchased through Pacific Delight Tours®. Please call us for transfer cost for land only arrivals and departures. 3. Airline-imposed baggage fees: please consult your airline. 4. Fees for delivery of tour documentation to international destinations, and overnight delivery of tour documentation due to late payments. 5. Cost of passport and visas, and all items of personal nature. 6. Any fees incurred due to delays, changes, or cancellations beyond PDT’s control. 7. Customary gratuities to local guides, drivers, boatmen, river guides, hotel waiters, chambermaids and porters. The end-of-tour gratuity to the Tour Director is also not included.

RESPONSIBILITY: Pacific Delight Tours® (hereinafter PDT) acts as a tour operator and agent. The suppliers that provide transportation, conveyance or accommodations are independent contractors and are not agents or employees of PDT. All tickets, coupons and receipts issued by PDT, and all arrangements for transport, conveyance or accommoda-tions are made by PDT as agent of the suppliers. By utilizing the services of suppliers, you agree that neither PDT nor any of its officers, directors, employees, subsidiaries or affiliates shall be liable for any injury, damage, loss, accident or delay incurred by you or those traveling with you in connection with any accommodations, transportation, conveyance or other services of whatsoever nature resulting directly or indirectly from any acts or default of the suppliers or from any occurrence or condition, including but not limited to defects in vehicles or vessels, breakdown in equipment or the negligence of their operators. PDT, its employees, officers, directors, subsidiaries or affiliates also shall not be liable for any injury, damage, loss, claim or accident resulting directly or indirectly (i) from delays, cancellations or changes in flights, itineraries, schedules, or other services of any nature whatsoever, (ii) from strikes, theft, sickness, weather, quarantine or any other causes of any nature whatsoever or (iii) from acts or omissions of any Government, its local subdivisions, bureaus or authorities. All tour itineraries and fares may be affected by alterations or delays in air or surface transportation services of the various countries. PDT reserves the right to withdraw any tour and to make such alterations in the itineraries which, in its sole discretion, it may find desirable for the convenience of the parties or the proper operation of the tour. PDT reserves the right to decline to accept, or to retain any person as a member of the tour party at any time, if they in any way violate the laws of the country they are visiting, pose a risk to the safety of fellow tour members, or their behavior interferes with a smooth operation of the tour.

NOTE: All tour fares shown in this brochure are based on the value of foreign currencies in relation to the U.S. dollar in effect at the date of the printing of the brochure and on the tariffs, airfares, taxes and fuel surcharges as of that same date and are subject to change at any time to reflect those or other changes since the date of the brochure’s printing. PDT reserves the right to correct promotional, pricing or typographical errors at any time. PDT reserves the right to cancel the tour prior to departure for any reason. The Terms and Conditions contained herein and set forth in the brochures issued by PDT and on its website, under which you agree to utilize the services of PDT in arranging the tours, may not be amended in any way except in writing signed by an authorized officer of PDT. By utilizing the services of PDT, you agree that the exclusive jurisdiction for all claims, suits, actions or proceedings of whatsoever nature against PDT, its employees, officers, directors, subsidiaries or affiliates shall be the State of New York, and that such claim, action or proceedings shall be determined according to the laws of the State of New York. You also agree that, if you have a claim against PDT, its employees, officers, directors, subsidiaries or affiliates, (i) you will notify PDT, in writing, of your claim as soon as possible and (ii) that, if you choose to commence a law suit against PDT, its employees, officers, directors, subsidiaries or affiliates, you will do so within one year from the date of the last day of the tour on which your claim arose, failing which, your claim against PDT, its employees, officers, directors, subsidiaries or affiliates, will be forever barred.
