A K TO NASLEDSTVU KONVENCIJE ZDRUENIH NARODOV O POMORSKEM MEDNARODNEM PRAVU
Na podlagi 3. lena Ustavnega zakona za izvedbo Temeljne ustavne listine o samostojnosti in neodvisnostiRepublike Slovenije v zvezi z dolobami 1. lena Ustavnega zakona za izvedbo Ustave Republike Slovenije, Dravnizbor Republike Slovenije odloa, da se notificira nasledstvo Konvencije zdruenih narodov o pomorskem mednarodnempravu, podpisane v Montegu Bayu na Jamajki dne 10. decembra 1982 (objavljene v Uradnem listu SFRJ - Mednarodnepogodbe, t. 1/86), katere pogodbenica je bila nekdanja SFR Jugoslavija.
Republika Slovenija daje naslednjo interpretativno izjavo:Skladno s pravico, ki jo imajo drave pogodbenice na temelju 310. lena Konvencije Zdruenih narodov o
pomorskem mednarodnem pravu, Republika Slovenija meni, da dolobe V. dela Konvencije, vkljuno s 70. lenomo pravici drav z geografsko neugodnim poloajem, predstavljajo del obiajnega prava.
Ta akt in informacija o pridobitvi statusa drave pogodbenice s strani depozitarja se objavita v Uradnem listuRepublike Slovenije - Mednarodne pogodbe.

IZROITVI
1. lenRatificira se Evropska konvencija o izroitvi z dne 13. decembra 1957, Dodatni protokol k Evropski konvenciji
o izroitvi z dne 15. oktobra 1975 in Drugi dodatni protokol k Evropski konvenciji o izroitvi z dne 17. marca 1978,
2. lenKonvencija in dodatna protokola se v izvirniku v anglekem jeziku in prevodu v slovenskem jeziku glasijo:

EUROPEAN CONVENTIONON EXTRADITION
The governments signatory hereto, being Membersof the Council of Europe,
Considering that the aim of the Council of Europeis to achieve a greater unity between its Members;
Considering that this purpose can be attained by theconclusion of agreements and by common action in legalmatters;
Considering that the acceptance of uniform ruleswith regard to extradition is likely to assist this work ofunification,
Have agreed as follows:
Article 1Obligation to extradite
The Contracting Parties undertake to surrender toeach other, subject to the provisions and conditions laiddown in this Convention, all persons against whom thecompetent authorities of the requesting Party are procee-ding for an offence or who are wanted by the saidauthorities for the carrying out of a sentence or detentionorder.
Article 2Extraditable offences
1. Extradition shall be granted in respect to offencespunishable under the laws of the requesting Party and ofthe requested Party by deprivation of liberty or under adetention order for a maximum period of at least oneyear or by a more severe penalty. Where a convictionand prison sentence have occurred or a detention orderhas been made in the territory of the requesting Party,the punishment awarded must have been for a period ofat least four months.
2. If the request for extradition includes severalseparate offences each of which is punishable under thelaws of the requesting Party and the requested Party bydeprivation of liberty or under a detention order, but ofwhich some do not fulfil the condition with regard to theamount of punishment which may be awarded, the reque-sted Party shall also have the right to grant extraditionfor the latter offences.
3. Any Contracting Party whose law does not allowextradition for certain of the offences referred to inparagraph 1 of this article may, in so far as it is concerned,exclude such offences from the application of this Conven-tion.
4. Any Contracting Party which wishes to avail itselfof the right provided for in paragraph 3 of this articleshall, at the time of the deposit of its instrument ofratification or accession, transmit to the Secretary Generalof the Council of Europe either a list of the offences forwhich extradition is allowed or a list of those for whichit is excluded and shall at the same time indicate the legalprovisions which allow or exclude extradition. The Secre-tary General of the Council shall forward these lists tothe other Signatories.
5. If extradition is subsequently excluded in respectof other offences by the law of a Contracting Party, thatParty shall notify the Secretary General. The SecretaryGeneral shall inform the other Signatories. Such notifica-tion shall not take effect until three months from the dateof its receipt by the Secretary General.
6. Any Party which avails itself of the right providedfor in paragraphs 4 or 5 of this article may at any timeapply this Convention to offences which have been exclu-

Vlade podpisnice te Konvencije, lanice Sveta Evro-pe, so
glede na to, da je cilj Sveta Evrope dosei vejoenotnost med njenimi lanicami,
glede na to, da je ta cilj dosegljiv v sklenitvijosporazumov in s skupnim delovanjem v pravnih zadevah,
glede na to, da bo sprejem enotnih pravil za izroitevpo vsej verjetnosti v pomo takemu enotnejemu delu,
sklenile:
1. lenObveznost izroitve
Pogodbenice se obvezujejo, da si bodo v skladu zdolobami in pogoji te Konvencije predale vse osebe,proti katerim pristojni organi pogodbenice prosilke vodijopostopek za kaznivo dejanje ali za katerimi so omenjeniorgani razpisali tiralico, da bi jih lahko obsodili ali priprli.
2. lenKazniva dejanja, za katera je predpisana izroitev1. Izroitev se odobri za dejanja, ki se v skladu z
zakoni pogodbenice prosilke in zaproene pogodbenicekaznujejo z odvzemom prostosti ali v skladu s pripornimnalogom za najdalje obdobje vsaj enega leta ali s strojokaznijo. e je prilo do obsodbe in zaporne kazni aliizdaje naloga za pripor na ozemlju pogodbenice prosilke,je morala biti kazen izreena za vsaj tiri mesece.
2. e pronja za izroitev vkljuuje ve loenih kazni-vih dejanj, katerih vsako se kaznuje po zakonih pogodbe-nice prosilke in zaproene pogodbenice z odvzemomprostosti ali s pripornim nalogom, od katerih nekateri neizpolnjujejo pogoja glede viine kazni, ki se lahko izree,ima zaproena pogodbenica tudi pravico, da odobri izro-itev za taka kazniva dejanja.
3. Vsaka pogodbenica, po zakonih katere izroitevza nekatera kazniva dejanja, navedena v 1. odstavku tegalena, ni dovoljena, lahko, e jo to zadeva, izkljui takakazniva dejanja iz te Konvencije.
4. Vsaka pogodbenica, ki eli izkoristiti pravico,doloeno v 3. odstavku tega lena, mora ob deponiranjusvoje listine o ratifikaciji ali pristopu poslati generalnemusekretarju Sveta Evrope bodisi seznam kaznivih dejanj,za katera se izroitev dovoljuje, ali seznam tistih, zakatera se prepoveduje, in mora soasno navesti pravnedolobe, ki izroitev dovoljujejo ali jo prepovedujejo.Generalni sekretar mora te sezname poslati preostalimpodpisnicam.
5. e se izroitev za druga kazniva dejanja po pravupogodbenice pozneje prepove, mora ta pogodbenica obve-stiti generalnega sekretarja. Generalni sekretar mora otem obvestiti druge podpisnice. Tako obvestilo pa prineveljati ele tri mesece po datumu, ko ga je prejel generalnisekretar.
6. Vsaka pogodbenica, ki izkoristi pravico, predvi-deno v 4. ali 5. odstavku tega lena, lahko kadar koliuporabi to Konvencijo za kazniva dejanja, ki so bila iz

ded from it. It shall inform the Secretary General of theCouncil of such change, and the Secretary General shallinform the other Signatories.
7. Any Party may apply reciprocity in respect of anyoffences excluded from the application of the Conventionunder this article.
Article 3Political offences
1. Extradition shall not be granted if the offence inrespect of which it is requested is regarded by therequested Party as a political offence or as an offenceconnected with a political offence.
2. The same rule shall apply if the requested Partyhas substantial grounds for believing that a request forextradition for an ordinary criminal offence has beenmade for the purpose of prosecuting or punishing aperson on account of his race, religion, nationality orpolitical opinion, or that that person's position may beprejudiced for any of these reasons.
3. The taking or attempted taking of the life of aHead of State or a member of his family shall not bedeemed to be a political offence for the purposes of thisConvention.
4. This article shall not affect any obligations whichthe Contracting Parties may have undertaken or mayundertake under any other international convention of amultilateral character.
Article 4Military offences
Extradition for offences under military law which arenot offences under ordinary criminal law is excluded fromthe application of this Convention.
