Samsung Galaxy S10 Pre-Order Promotion Terms and Conditions for Gift with Purchase (T&Cs)

Promotion Eligible Entrants who purchase a Participating Product from a Participating Retail Store during the Promotional Period will be eligible to receive a Gift from the Participating Retail Store after completing their purchase, subject to these T&Cs.

Eligible Entrants

a) Australian residents (but not Excluded Entrants); and b) Australian businesses or companies with an ABN and a registered office in Australia.

Excluded Entrants

Australian residents aged less than 18 years without their parent’s or guardian’s permission to participate in this Promotion.

Participating Retail Store

Any of the Australian carriers and retailers set out in the below table, authorised by Samsung to participate in this Promotion, but excludes the websites known as either: the “Samsung Staff Portal”; the “Samsung Education Store” or the “Samsung Small to Medium Business Store”, any online bidding or auction websites (including ebay.com.au) and any unauthorised retailers. Samsung recommends entrants verify with the retailer that they are a Participating Retail Store for the purposes of this Promotion before purchasing a Participating Product.

Other matters (a) Participation in this Promotion is deemed acceptance of these T&Cs. (b) Limit of one (1) Gift per Participating Product purchased by each Australian resident. (c) Limit of one (1) Gift per Participating Product purchased by each Australian business or

company up to a maximum of five (5) Participating Products purchased. (d) This Promotion is not valid in conjunction with any other offer or promotion. (e) All prices quoted in these T&Cs are inclusive of GST. (f) Samsung may reclaim the Gift if the Participating Product is returned. This does not limit

or affect Eligible Entrants’ rights in relation to Samsung’s express warranties or consumer guarantees under the Australian Consumer Law.

(g) The Gift is not transferable, exchangeable or redeemable for cash. (h) If an Eligible Entrant purchases a Participating Product through the Samsung Online Store,

and does not redeem the Gift at the time of checkout, the Eligible Entrant has ninety (90) days (from the end of the Promotional Period) in which to claim the Gift from Samsung.

(i) If this Promotion is interfered with or cannot be conducted as planned, Samsung may disqualify any entrant and/or modify, suspend or terminate the Promotion as applicable.

(j) If a Gift is unavailable, Samsung may substitute a reasonably equivalent item at its discretion. However, the Promotion ends if Gift stocks run out.

(k) The Promotional Period may be extended in Samsung’s absolute discretion. (l) Except for liability which cannot be excluded as a matter of law, including the Australian

Consumer Law, Samsung excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect or consequential, arising in any way out of the Promotion, including any tax liability.

Privacy Samsung (or third parties on its behalf) may collect personal information to conduct the Promotion and disclose such information to third parties for this purpose, including agents, contractors, service providers and offer suppliers. Validity of an eligible entry is conditional on providing this information. Some of these entities may be outside Australia, including in Singapore, Korea and the Philippines. Entrants acknowledge that by consenting to this disclosure, Samsung is not obliged to take reasonable steps to ensure overseas recipients do not breach Australian privacy law. All entrants consent to their personal information being collected and stored for this purpose in accordance with Samsung’s privacy policy available at http://www.samsung.com/au/info/privacy/, which forms part of these T&Cs.
