AN ACT TO RESTRICT THE IMPORTATION AND EXPORTATION OF CERTAIN

ANIMALS, PLANTS AND ARTICLES; TO RESTRICT THE MOVEMENT AFTER

IMPORTATION OF CERTAIN LIVE ANIMALS; AND FOR CONNECTED PURPOSES.

Commencement

[7 April 1982]

Short title

1. (1) This Act may be cited as the Endangered Animals and Plants Act.

(2) Except in so far as the context otherwise requires a reference in this Act to any other enactment is a reference to that enactment as amended by or under any other enactment.

Restriction of importation and exportation of certain animals and

plants

2. (1) Subject to subsection (2), the importation and the exportation of the following things are hereby prohibited, namely—

(a) a live or dead animal of any of the kinds for the time being specified in the second column of Schedule 1 ;

(b) a live or dead plant of any of the kinds for the time being specified in the second column of Schedule 2;

(c) an article for the time being specified in Schedule 3 .

(2) Subsection (1) does not apply to the importation or exportation of anything therein referred to under and in accordance with the terms of a licence issued by the Governor acting on the advice of Cabinet.

(3) A licence issued under subsection (2), may be to any degree, general or specific, may be expressed to be valid for such period as may be stated in the licence and may be modified or revoked at any time by the Governor acting on the advice of Cabinet.


(4) A person who, for the purpose of obtaining, whether for himself or another, the issue of a licence under section 2 (2)—

(a) makes a statement which he knows to be false in a material particular;

(b) furnishes a document or information which he knows to be false in a material particular; or

(c) recklessly makes a statement which is false in a material particular,

shall be guilty of an offence and shall be liable on summary conviction to a fine of $500 or to imprisonment for a term of six months.

(5) Where a live or dead animal or plant of any of the families for the time being specified in the first column of Schedule 1 or 2 or an article for the time being specified in Schedule 3 is being imported or exported or has been imported, or brought to any place for the purpose of being exported, a person appointed by the Governor acting on the advice of Cabinet as an Inspector under the Animals (Disease and Importation) Act, or any rules made thereunder or a person authorised in that behalf, may require any person possessing or having control of the animal, plant or article to furnish proof that its importation or exportation is or was not unlawful by virtue of this section; and if such proof is not furnished to the satisfaction of the said Inspector the animal, plant or article shall be liable to forfeiture under the Animal (Disease and Importation) Act.

Power to modify Schedules 1 to 3

3. (1) The Governor acting on the advice of Cabinet may by order make such modifications in any of Schedules 1 to 3 as he considers necessary for any of the following purposes, namely—

(a) to reflect any amendment made under Article XV of the Convention on International Trade in endangered Species of Wild Fauna and Flora 1973 (which relates to amendments about the kinds of animals and plants in respect of which trade is restricted under the Convention);

(b) to reflect the inclusion of an item or the withdrawal of an item from Appendix III to the Convention (which relates to kinds of animals and plants the trade in which a party identifies as needing international control) at the instance of a party other than the United Kingdom;

(c) to reflect the inclusion of an item in or the withdrawal of an item from the said Appendix at the instance of the United Kingdom;

(d) where the Governor acting on the advice of Cabinet decides, after consultation with any body or bodies established under section 4, that the importation and exportation of any animal or plant of a particular kind or of any article derived from any animal or plant should be (or should no longer be) restricted, to give effect to that decision.

(2) The power to make an order under subsection (1) shall be exercisable statutory instrument and includes power to vary or revoke a previous order made thereunder; and a statutory instrument containing an order by virtue of paragraph (c) or (d) shall be subject to annulment in pursuance of a resolution of the Legislative Assembly.


Restriction of movement of certain live animals after importation

4. (1) Where a licence is issued under section 2 in respect of the importation of a live animal of any of the kinds for the time being specified in column 3 of Schedule 1 and the Governor acting on the advice of Cabinet considers that it is desirable to prevent the commercial exploitation of that kind, he may issue with the licence a document stating that the animal shall as soon as is reasonably practicable after its importation be taken to and subsequently kept at a place specified in the document until such time as he may, on an application made by or on behalf of the person to whom the animal for the time being belongs, give permission for it to move from that place. (2) Where a document has been issued under subsection (1) any person who being the person to whom the animal concerned for the time being belongs—

(a) takes it, or knowingly permits it to be taken, after it has been imported, to a place other than that specified in the document and other than one connected with the importation; or

(b) moves it or knowingly permits it to be moved from the place so specified in the absence of such permission as is mentioned in subsection (1);

shall be guilty of an offence and liable on summary conviction to a fine of $500.

(3) Proceedings for an offence under subsection (2) may be commenced at any time within a period of six months from the date on which there comes to the knowledge of the Inspector evidence sufficient in his opinion to justify a prosecution for that offence; and for the purposes of this subsection—

(a) a certificate of the Inspector stating that such evidence came to his knowledge on a specified date shall be conclusive evidence of that fact; and

(b) a document purporting to be such a certificate and to be signed by the Inspector or on his behalf shall be presumed to be such a certificate unless the contrary is proved.

Advisory bodies

5. The Governor acting on the advice of Cabinet may establish such body or bodies, consisting in each case of such members as he may from time to time appoint, and it shall be the duty of any body established under this section to advise the Governor acting on the advice of Cabinet on any question which he may refer to it, and on any question on which it considers it should offer its advice, in connection with the administration of this Act or otherwise in connection with the importation and exportation of animals and plants of kinds which appear to him or, as the case may be, the body to be endangered and articles derived wholly or partly from them.


Offences by corporations

6. (1) Where an offence under this Act has been committed by a body corporate is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of a director, manager, secretary or other similar officer of the body corporate, or any person who was purporting to act in any such capacity, he, as well as the body corporate, shall be guilty of that offence and shall be liable to be proceeded against and punished accordingly.

(2) In this section “director”, in relation to a body corporate established by or under any enactment for the purpose of carrying on under public ownership any industry or undertaking, being a body corporate whose affairs are managed by its members, means a member of that body corporate.

ARTICLES THE IMPORTATION AND EXPORTATION OF WHICH ARE RESTRICTED

1. Any dead whale.

2. Meat and edible meat offals of cetaceans, fresh, chilled or frozen meat and

edible meat offals of cetaceans, salted, in brine, dried or smoked.

3. Whalebone and the like, unworked or simply prepared but not out of shape,

and hair and waste of these products.

4. Meat and meat offals of cetaceans, unfit for human consumption.

5. Fats and oils of cetaceans, whether or not refined.

6. Oils of cetaceans, boiled, oxidized, dehydrated, sulphurized, blown, or

polymerized by heat in vacuum or in an inert gas, or otherwise modified.

7. Oils and fats of cetaceans, wholly or partly hydrogenated or solidified or

hardened by any other process, whether or not refined, but not further

prepared.

8. Spermaceti, crude, pressed or refined, whether or not coloured.

9. Extracts and juices of the meat of cetaceans.

10. Flours and meals of the meat and offals of cetaceans, unfit for human

consumption.

11. Leather treated with oil, whether or not modified, of whales or of other

cetaceans.

12. All the products listed below which have been treated with oil, whether or not

modified, of whales or of other cetaceans or which have been made from

leather treated with such oil:

Articles of leather; saddlery and harness; travel goods, handbags and

similar containers;

Fur skin and manufactures thereof;

Footwear, gaiters and the like; parts of such articles.

14. Ivory derived from the tusks of any animal of any of the (families)

15. The horn of any animal of the family Rhinocerotidae, whether unworked or

simply prepared but not if cut to shape, and powder and waste thereof.

16. The teeth of any animal, whether unworked or simply prepared but not if cut

to shape, and powder and waste thereof.

17. The stuffed head and the skull together with the skin covering it, of any

animal of any of the families Elephantidae and Rhinocerotidae.

18. Raw furskins and hides or skins, tanned or dressed with the hair on, of any of

the following animals and any rug, coverlet, coat, jacket, cape or stole derived

from any such furskin, hide or skin, namely—

(a) any animal of any of the following genera, namely—

(b) any animal of any of the following species, namely—

whether or not split, and the leather of any (crodile, lizard or snake).

22. The dried body of any animal of any of the families Alligatoridae and

Crocodylidae.

23. The shell and scales, whether unworked or simply prepared but not if cut to

shape, the waste of the shell and scales, and the claws, of any animal of the

family Chelonidae.

24. The preserved body of any animal of the sub-species Atelopus varius zeteki.

25. The whale shell of any animal of the species Papustyla Papuina) pulcherima,

whether unworked or simply prepared but not if cut to shape.

26. The feathers, or the skin or any other part with the feathers on it, of any of the

following animals, namely—

(a) any animal of the family Paradisaecidae; and

(b) any animal of the species Gallus sonneratii.

27. Any fishing fly containing the (plumage) of any animal of the species Gallus

sonneratii.

28. The stem of any plant of the family Cyatheaceae and any article made wholly

or partly of any such stem or stems.

29. Any collection of botanical or zoological items, or of both, which contains

any item referred to in any of the preceding paragraphs of this Schedule.
