• The State must have in effect policies and procedures to ensure that all children with disabilities in the state, including children who are homeless children or are wards of the State, and children with disabilities attending private schools regardless of the severity of their disability, and who are in need of special education and related services are identified, located and evaluated.

(1) School districts must identify, locate and evaluate all residents with disabilities, regardless of the severity of disability, who are in need of early intervention, early childhood special education, or special education services. The requirements of this rule apply to all preschool and school age children unless these children are no longer entitled to a free appropriate public education under OAR 581-015-2040 to OAR 015-2050.

INDIVIDUALS WITH DISABILITIES EDUCATION ACT (IDEA) AS AMENDED IN 2004

FOR FEDERAL FISCAL YEAR 2007: July 1, 2007-June 30, 2008

The EI/ECSE Contractor, in collaboration with school districts, identifies, locates, and evaluates all children with disabilities (birth to the age of eligibility for kindergarten), regardless of the severity of their disabilities, who are in need of special education and related services. This includes children with disabilities attending private schools located within the contractor’s service area.
