DELTA TWP. - On April 18 Waverly school board members agreed to con- sider at a future meeting a full-day kindergarten pro- posal presented by superin- tendent Debra Jones. A motion by Britt Slocum to act immediately on the proposal failed to achieve a second. Other members said that uncertainty about the K-12 budget and Waverly’s looming deficit make it dif- ficult to sign on for any new expenditure. “I’m not ready to have this discussion tonight,” said board member Fonda Brewer-Williams, “but thanks for the heads up.” Jones said her proposal, which would require four more certified teachers and would replace the KAP pro- gram, would cost between $150,000 and $170,000 next year. There would be eight kindergarten classrooms, each with 25 students. “This is something we need,” Jones said, citing the growing literacy and math goals students are expected to achieve. By the 2013-2014 school year, all students are expected to reach 100-percent on their MEAP scores. Jones said that increased instructional time is what will help all students to be reading at grade level by the end of third grade. Another benefit she cited is more time to inte- grate science and social studies into the school day. She also believes a full- day kindergarten is likely to attract new school-of- choice students, particu- larly since some nearby districts are considering cutting their full-day pro- grams for financial reasons. BENTON TWP. - Thevictim of a fatal house firein Benton Township onMonday night has beenidentified asretired EatonCounty sher-iff’s DeputyM a r i o n“ W h i t e y ”Kayne II, 62of Charlotte.

U n d e r -sheriff FredMcPhail on Tuesdayremembered Kayne as asupportive mentor who waswell-liked by everyone inthe department.

“We’re all shocked andsaddened by the loss,” saidMcPhail, who worked underKayne in the late 1980s andearly 1990s in the DeltaTownship patrol division.“Our thoughts and prayersgo out to his family.”

Kayne lived alone in thehouse in 4000 block of OttoRoad. The fire startedaround 6:20 p.m. Monday.

The cause is still underinvestigation by the statefire marshal’s office, sher-iff’s spokeswoman JessicaLarkin said.

A call to the firemarshal’s office was notreturned Tuesday.

Police said Monday thatthe fire apparently startedin the living room of thehome, but did not appearsuspicious.

Kayne retired from theEaton County Sheriff’sOffice in April 2000, Larkinsaid.He spent the last sev-eral years of his career asa sergeant assigned to theDelta Township Patrol.

DELTA TWP. - Aneighth-grader at St. GerardCatholic School was thelocal winner in the Barnes& Noble “My FavoriteTeacher” essay contest.

The contest is a nation-wide (chain wide) essaycontest open to public andprivate K-12 students. Par-ticipants were asked towrite an essay, poem orthank-you letter (500 wordsor less) sharing how ateacher has influenced theirlife and submit the piece totheir local Barnes & Noblestore.

At each store a team ofjudges, made up of manag-ers and booksellers, chosethe winning entry. Thewinning teacher was rec-ognized at a special event attheir local Barnes & Nobleand received a specialaward acknowledging theirachievement, together witha set of classics books.

The student who wrotethe winning essay or poemalso received a certificateof recognition and was hon-ored at the store.

The Lansing Mall storechose an essay written byOlivia St. Germain, an eigthgrader at St. Gerard School.Olivia lives, in Lansing, with

her parents, Jenee and Mat-thew St. Germain.

Olivia wrote about her7th grade history teacher,Kathleen Partlow, of GrandLedge.

She wrote about howPartlow used personal timeto help her deal with peerdifficulties and constantlyassured her that she is asmart, beautiful, and valuedmember of the studentbody.

Olivia describes Part-low’s classroom as a “sanc-tuary” and Partlow as her“true hero.”

the store on Friday,April 15.

Gov. Rick Snyder hasunveiled his “shared sacri-fice” budget for 2011-2012and the time is drawingnear for the legislation toapprove or modify his plan.

The House and Senateare proposing a completedbudget by June 1.

Although it would bevery beneficial for schooldistricts to have a definitiverevenue number beforefinalizing their 2011-12budget in June, there issome shared concernamong public entities - suchas school systems - aboutthe revenue crisis the Gov-ernor’s plan would create ifapproved.

I applaud the governor’scommitment to deal withthe structural deficit in thestate’s budget.

Unfortunately some ofhis proposals give largetax breaks to big businessand balances the budget

at the expense of our stu-dents. The governor’s pro-posed $470 cut in state’s perpupil foundation allowancewill cost Waverly PublicSchools an additional 1.4million dollars.

The planned increase inthe retirement rate thatschool districts arerequired to pay into thepublic school employees’retirement system will costWaverly Public Schools anadditional 714,000 dollars.

As a reminder, Waverlywill experience the lossof 20j money again whichamounts to a revenue lossof approximately 1 milliondollars.

Waverly Public Schoolsis projecting another sig-nificant decline in studentenrollment for next year.We are graduating a largesenior class and our Kin-dergarten Round Up num-bers reflect a smaller classfor this fall.

The net effect is a pro-jected loss between K -12 of62 students, which will costthe District another 504,000dollars in lost State Aid.

So to put it all together,if the governor’s budgetgoes through and Waverlyexperiences the projectedenrollment decline,Waverly Public Schools willstart next year with a reve-nue shortfall of more than 3million dollars ($3,000,000).

Next week I will bedetailing what a $3,000,000loss to Waverly Schoolswill mean to our program-ming, staffing, extra-curric-ular, etc.

DELTA TWP. - The data fromlast fall’s MEAP tests presentedto the school board April 18 havesome good news and some badnews for Waverly.

One piece of good news is theupswing in middle school results.

The number of eighth-gradersproficient in writing was24-percent higher than last yearand slightly above the stateaverage.

More students were proficientin math and reading, too, thoughthe number was still below thestate average.

Seventh-grade proficiency ratesin math and reading matched thestate average.

In addition, chief academicofficer Dorothy Blackwell notedthat these MEAP results includestudents who hadn’t been in thedistrict for a full year.

Final MEAP scores will likelybe stronger because these studentswon’t be included.

Blackwell cautioned the board,however, that there were definiteareas of concern, citing fourth-grade reading, fifth-grade mathand science, sixth-grade math andeighth-grade science.

In addition, with 30 or morein many grades, special educationstudents have become a MEAPsub group and will affect thedistrict’s adequate yearly progressthis year.

• Larceny from an auto: Severalwindows in the victim’s 1997 Saturnwere smashed with rocks in the10700 block of Knockaderry and his$150 Verizon cell phone taken.

Friday, April 8

Larceny from an auto: A pair ofsunglasses, a bag of change and a

credit card were taken from the vic-tim’s 2011 black Kia in the 5300 blockof W. Saginaw. There was no damageto the car.

Saturday, April 9

• Telephone harassment: Thevictim has been receiving unwantedtext messages from her former boy-friend, some in her Delta Townshipworkplace in the 8000 block of Mil-lett. The deputy explained the per-sonal protection order process to herand she will document all the mes-sages she receives and seek a PPO inthe county where she lives.

• Assault: Two men parked in ano parking zone, then came in to buybottles of water in the 1700 block ofS. Waverly. When the victim refusedto serve them until they moved theircar, one man threw a bottle of waterover the counter. The victim wasn’tinjured.

Sunday, April 10

• Verbal argument: A mother anddaughter were arguing in a cararound I-96 and W. Saginaw. Themother got out of the car and started

to walk, then the daughter convincedher to get back in the car. There wasno assault or threat of assault.

• Larceny from an auto: Six dol-lars in change was taken from thevictim’s vehicle in the 5900 block ofSunchase.

• Larceny: One hundred andthirty dollars , one debit card andone credit card were taken from thevictim’s 2004 red Pontiac in the 1800block of Stoney Point. She had for-gotten to put down her garage door.

• Malicious destruction of prop-erty: All four tires on the victim’svehicle were slashed in the 300 blockof Gatewood. The same thing hap-pened less than one week ago.

Fire runs

During the week of April 11,the Delta Township Fire Departmentresponded to 67 EMS and 22 firecalls: two false alarms, seven EMSassists, one gas leak, one good intentcall, three building fires, one mal-functioning alarm, one call canceleden route, one person in distress, oneassist to the police, two smoke scare/odor of smoke, one vicinity alarmand one smoke detector activation.

CHARLOTTE — An Eaton County Dis-trict Court employee has been chargedwith embezzling at least $47,000 in courtfunds, officials said.

Kelly Jo Beck, 48, of Lansing, facesone count of embezzlement by a publicofficial, which carries a maximum pen-alty of 10 years in prison.

Beck, a deputy clerk, was arraignedTuesday in Eaton County District Court.

Judge Julie Reincke set bond at $5,000.Reincke is expected to disqualify her-

self from handling the case further, offi-cials said.

The alleged embezzlement happenedbetween December 2005 and December2010, officials said.

An audit of court records is continu-ing to determine if more was stolen.

The criminal investigation was han-dled by the Michigan State Police MajorCase Team.

DELTA TWP. - Delta TownshipFire Chief John Clark presentedawards to 14 GM employees April18, recognizing that their quickaction saved the life of a man whosuffered cardiac arrest at the DeltaPlant Feb. 3.

Finding a fellow employee notbreathing near the time of a shiftchange, the plant emergency

response team gave him CPR andshocked him twice with a defibrilla-tor. He was breathing again and GMnurses had started an IV by the timetownship EMTs arrived to transporthim to the hospital.

“It was a pretty incredible feat,”Clark said. “He was lucky to beat work (when he suffered thearrest).”

Clark added that the team’squick thinking and prompt actionwere crucial to the man’s survival

because brain cells start to die afterabout six minutes without oxygen.

The unidentified man survived asecond cardiac arrest at the hospital.

DELTA TWP. - All eighththrough 11th grade studentswere given a bus transportationsignup sheet on Tuesday for reg-istration for Waverly bus trans-portation next year. In an effortto appropriately route secondarystudents, Waverly is asking for2011-12 Waverly High Schoolstudents to register that they willbe using bus transportation nextyear.

After receiving the signupsheets, Waverly TransportationDirector, Rhonda Sosnowski, willroute only those high school stu-dents who have indicated theyneed a bus stop for next schoolyear. All registration sheets aredue back to students’ first periodclassroom teachers by Friday,April 29.

Chapter 2, Definitions

Section 2.2.0 General Definitions.

For the purpose of this ordinance, certain words and terms are de-fined as follows:

Clinic:

An establishment where human patients are admitted for examina-tion and treatment by a group of physicians, dentists or similar pro-fessionals on an out-patient basis, but not to include the dispens -ing of medical marihuana. A clinic may incorporate customary lab-oratories and pharmacies incidental or necessary to its operation.

Nursery, Plant Material

Any land, space, building or structure, or combination thereof, usedfor the storage of live trees, shrubs or plants, but not including medi-cal marihuana and not including any land, space, building or struc-ture, or any part thereof, used for the sale of fruits, vegetables or har-vested and cut Christmas trees.

CHAPTER 1, GENERAL PROVISIONSSECTION 1-2, DEFINITIONS AND RULES OF CONSTRUCTION

The Delta Township Board introduced the following ordinance repeal and ordinance text at its regular meeting held on Monday, April 18, 2011.The Delta Township Board will consider adoption of the following ordinance repeal and ordinance text at its regular meeting scheduled for 6:00 p.m. on Monday, May 2, 2011.THE CHARTER TOWNSHIP OF DELTA ORDAINS TO AMEND THE CODE OF ORDINANCE OF DELTA TOWNSHIP AS FOLLOWS:AN ORDINANCE OF THE CHARTER TOWNSHIP OF DELTA, EATON COUNTY, MICHIGAN, PROVIDING THAT THE CODE OF ORDINANCES, CHARTER TOWNSHIP OF DELTA, MICHIGAN, BE AMENDED BY AMENDING SEC-TION 1-2 ("DEFINITIONS AND RULES OF CONSTRUCTION") OF CHAPTER 1 ("GENERAL PROVISIONS") TO: INCLUDE THE DUTIES OF THE COMMUNITY SERVICES DIRECTOR; TO REPEAL ORDINANCES AND PORTIONSOF ORDINANCES INCONSISTENT WITH THIS ORDINANCE; AND PROVIDE AN EFFECTIVE DATE HEREOF.THE TOWNSHIP BOARD OF TRUSTEES FOR THE CHARTER TOWNSHIP OF DELTA HEREBY ORDAINS:1. Section 1-2 ("Definitions and rules of construction") of Chapter 1 ("General Provisions") is hereby amended as follows:

SECTION 1-2. DEFINITIONS AND RULES OF CONSTRUCTION.It is the legislative intent of the township board, in adopting this Code, that all provisions and sections of this Code be liberally construed to protect and preserve the peace, health, safety and welfare of the inhab -itants of the township. In the construction of this Code and any amendment thereto, the following rules shall be observed, unless the context clearly indicates otherwise:Code. The term "this Code" or "Code" shall mean the Code of Ordinances, Charter Township of Delta, Michigan, as designated in section 1-1.

Computation of time. The time within which an act is to be done, as provided in this Code or in any order issued pursuant to this Code, when expressed in days, shall be computed by excluding the first day andincluding the last, except that if the last day is Sunday or a legal holiday it shall be excluded; and when the time is expressed in hours, the whole of a Sunday or a legal holiday, from midnight to midnight, shall beexcluded.

County. The term "the county" or "this county" shall mean the County of Eaton in the State of Michigan.Gender. A word importing the masculine gender only shall extend and be applied to females and to firms, partnerships and corporations as well as to males.

Month. The word "month" shall be construed to mean a calendar month.

Municipal civil infraction. The words "municipal civil infraction" shall mean an act or omission that is prohibited by this Code of Ordinances of the township, but which is not a crime under this Code of Ordinan-ces, and for which civil sanctions, including, without limitation, fines, damages, expenses and costs may be ordered, as authorized by Chapter 87 of Act No. 236 of the Public Acts of 1961, as amended. A municipalcivil infraction is not a lesser included offense of a violation of this Code that is a criminal offense.Number. A word importing the singular number only may extend and be applied to several persons and things as well as to one person and thing.

Oath, affirmation, sworn, affirmed. The word "oath" shall be construed to include the word "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases the word"sworn" shall be construed to include the word "affirmed."Officer, department, etc. Whenever any officer, department or other agency is referred to by title only, such reference shall be construed as if followed by the words "of the Charter Township of Delta, Michi-gan." Whenever, by the provisions of this Code, any officer of the township is assigned any duty or empowered to perform any act or duty, reference to such officer shall mean and include such officer or his depu-ty or authorized subordinate. Whenever in accordance with the provisions of this Code or any ordinance of the township, any specific act is required to be done by any designated officer or official of the town-ship, such act may be performed by any township employee duly authorized to perform that act by such officer or official.

Person. The word "person" includes firms, joint ventures, partnerships, corporations, clubs and all associations or organizations of natural persons, either incorporated or unincorporated, howsoever operatingor named, and whether acting by themselves or by a servant, agent or fiduciary, and includes all legal representatives, heirs, successors and assignees thereof.Shall/may. The word "shall" is mandatory and the word "may" is permissive.

State. The term "the state" or "this state" shall be construed to mean the State of Michigan.

Superintendent. The word "superintendent" shall be construed to mean "township manager" of Delta Charter Township."Tense. Words used in the present or past tense include the future as well as the present and past.

Township. The word "township" shall mean Charter Township of Delta in Eaton County, Michigan.

Township board or board. The term "township board," "board of trustees" or "board" shall mean the township board of Delta Township, Michigan.

Township Engineer. The term "township engineer" shall mean the community development director of the Township.

Chief Building Inspector. The term "chief building inspector" shall mean the community development director of the Township.

Planning Director. The term "planning director" shall mean the community development director of the Township.

Building Department. The term "building department" shall mean the community development department of the Township.

Planning Department. The term "planning department" shall mean the community development department of the Township.

Engineering Department. The term "engineering department" shall mean the community development department of the Township.

Week. The word "week" shall be construed to mean seven days.

Written, in writing. The words "written" or "in writing" may include any form of reproduction or expression of language.

Year. The word "year" shall be construed to mean a calendar year.

2. Severability. If a court of competent jurisdiction declares any provision of this Ordinance, or a statutory provision referred to or adopted by reference herein, to be unenforceable, in whole or in part, such dec-laration shall only affect the provision held to be unenforceable and shall not affect any other part or provision. Provided, however, that if a court of competent jurisdiction declares a penalty provision to exceedthe authority of the Township, the penalty shall be construed as the maximum penalty that is determined by the court to be within the authority of the Township to impose.3. Repeal. All ordinances or parts of ordinances in conflict or inconsistent with the provisions of this Ordinance are hereby repealed; provided that any violation charged before the effective date of this Ordinanceunder an ordinance provision repealed by this Ordinance shall continue under the ordinance provision then in effect.4. Effective Date. This ordinance shall take effect immediately after final publication.
