1. The Department fs an. agency of the State of Fk>r.ida and the enforcing. authority

2. The Departtnent initiated an investigation. into allegations ·that Defendants

engaged in acts or practices that were misleadin$. unfair,. de~ve or unconseionable in the

sales~ marketing, advertising, and: perfQnnance ot _,wimtning pool construction and. ~odeling.

3. Defendant Keith Stuart, at aU times material hereto, owned, managed and

controlled the· daily operations of Nationwide. Paa.ts.

4. Defendants, at all times material hereto, solicited consumers withili the definidons.

favor of Plaintiff and agalnst Defendants Keith Stuatt Lynn Stuart, Felicia Mallia ~- Terry
