    In accordance with DOE Order 460.2A “Departmental Materials Transportation and Packaging Management”, the Department of Energy (DOE) Office of Packaging and Transportation (EM‐4.24) and Contractors/Laboratories acting on their behalf (hereafter referred to collectively as either “DOE” or “DOE contractor/laboratory”) are requesting quotations under 49 U.S.C. Section 13712 for the movement of household goods (HHG) in interstate and (de‐regulated) intrastate transportation for the period beginning January 1, 2017 through December 31, 2017. A description of HHG service is based on the conditions, limitations, specifications, and evaluation criteria described in this bid specification.

    SECTION I

    QUOTATION REQUIREMENTS A DOE makes no guarantee as to a minimum or maximum quantity of weight movements as a result of issuance of, response to, or tender acceptance based upon this request.

    B Movement of HHG may be granted, for the period involved, to the responsive carrier(s) whose tender conforms to this request. DOE reserves the right to reject any or all tenders and to waive minor tender irregularities.

    C DOE reserves the right to cancel any selection(s) made under this bid specification if lower published rates or charges are found to have been in effect at least thirty (30) days prior to the opening of tenders submitted under this request.

    D Responding carriers shall be prepared to demonstrate the ability to perform effectively under their stated rates and charges. Determination of the suitability of the carrier’s equipment will remain with the respective DOE organization.

    E

    Responding carriers will provide DOE immediate notification of any change in the carrier’s DOT Safety Rating or Safety Fitness Determination. The carrier is required to maintain a “SATISFACTORY”, “CONTINUE TO OPERATE”, or a rating of similar meaning. Carriers shall be prepared to provide DOE with evidence that deficiencies noted by DOT compliance reviews have been corrected or such shall be considered as cause for non‐selection or disqualification.

    F

    Six bid rate discount percentages shall be considered. The percentages shall reflect discounts to be taken from (% discount off) rates for each of the following services: • Contiguous United States (CONUS) Transportation related charges, including packaging, extra

    labor, and shuttle –formerly “other charges” • CONUS Storage in Transit (SIT) related charges • Alaska Inbound Transportation related charges, including packaging, extra labor, and shuttle

    –formerly “other charges” • Alaska Inbound Storage in Transit (SIT) related charges, including packaging, extra labor, and

    shuttle –formerly “other charges” • Alaska Outbound Transportation related charges, including packaging, extra labor, and

    shuttle –formerly “other charges” • Alaska Outbound Storage in Transit (SIT) related charges, including packaging, extra labor,

    and shuttle –formerly “other charges” Note: Use Attachment B, CY 2017 Standardized DOE Household Goods Discount List, to record these discounts.

    G

    Applicable rules concerning accessorial charges and other issues that are not specifically addressed in the Carrier Tender Agreement are included in the 400DOE Tariff with the exception of items specified in Section V of this document. Note: When a conflict arises between the bill of lading and other sources, the Carrier’s tender provisions shall take precedence.

    H

    DOE requires their contractors/laboratories to consign shipments in the name of the DOE or NNSA, referencing accepted government tenders. This disjoins HHG tenders from the account of the individual contractor or laboratory. Failure to consign as required shall not be cause for carriers to knowingly disallow coverage, under the tender, where shipments are proven to be paid from government funds.

    I Variations in the volume listed in Section IV of this document shall not be the basis for a cost adjustment prior to or after award. J Rates and charges shall be frozen for the tender period stated in Section IV of this document. Any increase in the rates or charges during this period shall subject the carrier to disqualification. K The Rand McNally Mileage Guide 36

    th Edition shall be used to determine mileage for the tender period.

    L Prior to acceptance of carrier tender(s), any modifications to the specifications shall be mutually agreed to in writing by the carrier(s), DOE and their contractors/laboratories.

    M

    Intrastate shipments of HHG made in the deregulated states of AZ, AR, CO, DC, DE, FL, ID, ME, MD, OK, SD, TN, UT, VT, WI and WY shall utilize the 400DOE tariff. Separate discounts for intrastate shipments shall be provided in the tender. Note: If regulatory status of a state changes during the tender period, the carrier shall notify the contractor/laboratory prior to shipment and rate accordingly.

    N Carriers may also include as a part of their tender, pricing for 3rd proviso items, as a separate

    tender.

    O Carriers may also include as part of their tender, pricing for Containerized household goods interstate shipments between points within the United States based on availability of containers and markets as a separate tender.

    SECTION II PERFORMANCE REQUIREMENTS

    A DOE shall evaluate the carrier/agent using the criteria listed in Section VII of this document. Failure to meet the outlined criteria may result in non‐use. Gross negligence of responsibility may be cause for immediate disqualification by the contracting officer.

    B Carrier(s) shall agree to comply with any specific security inspections or training required by the DOE contractors/laboratories.

    C The volume of HHG moves requested may increase during certain periods. DOE contractors/laboratories reserve the right to use alternate carriers in the event that carrier(s) selected under this request cannot meet temporary surge requirements.

    D Cancellation of the tender by either party requires sixty (60) days written notification. Any cancellation shall be at no cost to either party and/or the U.S. Government and without prejudice.

    E Requests for changes to tenders shall be submitted to the DOE contact listed in Section III of this document no later than 7 working days prior to the effective date of the change. The cancellation/change of any currently active tenders should be listed in Items 2B, 2C, and 2D.

    F Carriers shall submit tenders and provide service in compliance with all applicable local, state, and federal laws and regulations. G Carriers agree not to use system terminal points for extraordinary consolidation of freight moved under accepted tender(s) to reduce costs and therefore, add to normally accepted transit times. H Carriers shall notify the contractor/laboratory of acceptance/declination of move request within 24 hours. I Carrier’s transit time shall be consistent with current industry standards.

    J Carriers shall provide service between points in the continental United States. A current listing of DOE contractor/laboratory facilities and their Zip Codes are provided in Section VIII of this document.

    K

    The carrier will provide DOE immediate notification of any change in the carrier’s DOT Safety Rating or Safety Fitness Determination. The carrier shall maintain a “SATISFACTORY”, “CONTINUE TO OPERATE”, or a rating of similar meaning throughout the period of the rate tender. Failure to maintain an acceptable rating shall result in immediate disqualification.

    SECTION III SUBMISSION REQUIREMENTS

    A

    All submissions must be filed by e‐mail to [email protected] no later than 5 pm on November 30, 2016.     C The carrier must complete and provide a motor carrier profile as provided electronically with the solicitation for bid package

    D

    In submitting tenders, carriers shall ensure that all provisions are carefully read and items are properly completed. Failure to do so shall render the submission non‐responsive and eliminate it from further consideration. Do not change or alter any of the tender format provisions. Alternative provisions shall not be accepted under this solicitation, but may be submitted under separate cover.

    E The tender shall not be submitted to the Surface Deployment and Distribution Command or other parts of the Department of Defense or the General Services Administration.

    F

    Service requested and not specified as a requirement of this request will be furnished at rates or charges in carrier tenders/tariffs, or in bureau tenders/tariffs in which the carrier is shown as a participant, and at rates or charges effective on the issue date of the enclosed tender. Carriers must list such tenders/tariffs in the tender under Item 14 “Governing Publications and Exceptions”.

    G When a conflict arises between a DOE contractor/laboratory operating procedures and a provision of the Bid Specifications, the operating procedure shall apply.

    H Responding carriers are required to complete Items 1A, 1B, 2A, 12A, 13, 15A, 15B, 16, 17, and 20 of the enclosed tender format. The cancellation of any currently active tenders that would result from acceptance of this submission should be listed in Items 2B, 2C, and 2D.

    SECTION IV

    TENDER REQUEST SPECIFICATIONS A Commodity: Household Goods, Personal Effects and Vehicles B Potential Total Volume: 500 moves per year

    C Rate Structure 400DOE Tariff (Revised 24 Oct 2016), except that Fuel Cost Price Adjustment (Fuel Surcharge), is based upon the matrix listed in Section IX of this document. D The Rand McNally Mileage Guide 36 shall be used to determine mileage for the tender period. E Period of Award: January 01, 2017 through December 31, 2017. The DOE reserves the right to

    extend the expiration date of all or part of the Rate Offers accepted in accordance with this bid for up to one (1) year beyond its original expiration date

    SECTION V PRICING

    A Full Value Replacement Insurance at $125,000 will apply at no charge. This Full Value Replacement Insurance shall be in effect during the SIT portion of the move at no charge. B Peak season rates shall not apply. C A maximum fee of $125.00 will be allowed for debris removal.

    D Bulky Article charges do not apply.

    E Property and Casualty Adjustment charges do not apply.

    F Fuel Cost Price Adjustment (Surcharge), will be based upon the matrix listed in Section IX of this document.

    SECTION VI

    SPECIFIC TERMS AND CONDITIONS

    A The carrier will be notified of authorization to move by the authorized DOE contractor/laboratory relocation officer. Contractor/Laboratory employees (employee) may not authorize their own moves.

    B Auxiliary Service (shuttle services) shall be allowed only when preauthorized by the contractor/laboratory relocation officer. C Crating policies are DOE contractor/laboratory specific.

    D Overtime shall only be performed with the preauthorization of the relocation officer. Weekend, After‐Normal Hour, or Holiday services performed for the convenience, and at the discretion of the carrier, shall be performed at no additional charge.

    E

    Packing and unpacking policies are DOE contractor/laboratory specific. If allowed by policy, both full service packing and unpacking options shall be made available to the employee. The employee’s decision concerning these services shall be provided in carrier’s support documentation.

    F SIT policies are contractor/laboratory specific. Before movement, the relocation officer shall communicate the number of reimbursable days in storage to the carrier. Carrier to provide SIT (including insurance and discounted rates) up to 180 days if approved by shipper.

    G

    Cost reimbursement policies and restrictions for the movement and/or storage of vehicles are DOE contractor/laboratory specific. Before movement, the relocation officer shall communicate these specific policies to the carrier. Vehicle weight shall be documented by separate weight ticket, National Automobile Dealers Association (NADA) weight specification, or Branham Automobile Reference Book (BAR), or similar publication.

    H Vehicles may be transported via van or car hauler, at the discretion of the carrier. However, the invoiced cost shall be based upon the tariff rates for the weight of the vehicle as part of the total weight of the movement.

    I

    If the employee is determined to be responsible for charges over DOE contractor/laboratory allowances, the carrier shall allocate costs and invoice the employee based upon the DOE rate and the percentage of total weight and/or total days in SIT. A copy of the COD charges should be sent to the DOE contractor/laboratory as part of the invoicing.

    J Shipments shall be weighed gross and tare at the origin or within a reasonable distance. Separate legible copies of certified weight tickets for goods and vehicles (or NADA/BAR, etc. pages) shall be included with the carrier invoice.

    K

    The carrier agrees to provide, at no additional charge, Full Value Protection (FVP) coverage with a limit of $125,000 for goods shipped. The FVP coverage is defined as replacement at current market value and not actual value (depreciated value). The $125,000 coverage will not be allowed on a per pound basis, but on a flat rate of $125,000 for the shipment. Under no circumstances will an item be reimbursed on a per pound basis. If an employee requests coverage greater than $125,000, the carrier and the employee must negotiate both price and payment. This FVP shall be in effect during the SIT portion of the movement, at no additional charge.

    L The carrier shall advise the employee to file loss and/or damage claims within nine (9) months of delivery. Concealed damage claims will carry the same nine month statute of limitations.

    M

    The carrier shall reimburse the employee up to $100 per day for delay or inconvenience when the carrier does not meet the committed delivery date. No other payment for expenses or lodging will be made by the carrier and the total amount paid will not exceed the billed linehaul. This will only apply to shipments which weigh, or are rated at, 3,500 pounds or more. This item will not apply to overflow shipments when the weight is less than 20% of the total shipment weight and contains non‐essential items.

    N In the claims settlement process, individual items that compose a pair or set shall be considered in whole.

    O

    The carrier waives the right to reimbursement for charges that are not received by the DOE contractor/laboratory or the employee via invoice within 60 days of completion of the following actions: For transportation‐related charges, or third party charges, from the final actual delivery date to residence or storage facility For SIT charges, from the date the final shipment was removed from SIT or converted to long term storage Support documentation for proof of services rendered must be legible, signed, dated and must include the following: Bills of Lading Inventories Additional services and third party receipts Weight Tickets (gross and tare) Note: If a vehicle is transported on the household goods equipment, then a separate weight ticket for that vehicle shall be provided, to include year, make and model of the vehicle. All invoices and supporting documents to be paid by the DOE contractor/laboratory shall be sent, or made available electronically, to the appropriate relocation officer. Payment for services is dependent upon receipt of supporting documentation. Unless specifically addressed by a site specific requirement, terms of payment shall be Net 30 days.

    P Notification required by 400DOE Item 210 “Pickup and Delivery Transportation Charges on SIT Shipments” shall also be made to the DOE contractor/laboratory relocation officer.

    Q

    Debris removal policies are DOE contractor/laboratory specific. If allowed by policy, the service shall be made available to the employee. Contractor/Laboratory policy may require debris removal only to be performed with the preauthorization of the relocation officer.

    SECTION VII

    DOE CARRIER SELECTION AND EVALUATION CRITERIA

    A DOE may evaluate carrier/agents during the tender period using the criteria listed in this section. Failure to meet the outlined criteria may result in non‐use. Gross negligence of responsibility may be cause for immediate disqualification by the contracting officer.

    B

    Criteria by which the carriers may be evaluated shall include: On time pickup On time delivery Equipment availability Accurate and timely invoicing Providing required supporting documentation for proof of services Timely claim settlement Claims ratio

    C

    Carriers will be selected based upon a variety of factors carrying equal weight: Level of Service Customer service Claims ratio Local facility evaluations Local representation Service area Pricing Accurate and timely invoicing Equipment condition and availability

    17. COMBINATION RATE (CHECK APPROPRIATE BOX)

    The rates and charges in this tender may be used as factors in the construction of any combination through rates, charges or other provisions.

    The rates and charges in this tender may be used as factors to make combination rates and charges to and/or from other points of origin and destination, provided that such other points are not more than thirty (30) highway miles distant from the pertinent point of origin or destination named in this tender. The distance shall be measured from: (1) the nearest boundary, in the case of designated commercial zones; (2) the nearest corporate limit, in the case of incorporated communities not in commercial zones; or (3) the nearest post office within other points of origin or destination.

    The rates and charges in this tender may not be used in construction of combination rates or charges.

    18. GENERAL TERMS AND CONDITIONS a. Lawful Performance: Operating authorities The transportation service provider(s) (TSP) represent(s) to the Untied States government that the services provided in this tender will be performed in accordance with applicable Federal, state, and municipal laws and regulations including Federal Management Regulations, 41 CFR 102-117 and 41 CFR 102-118, and the TSP(s) hold(s) the required operating authority to transport the commodity from, to, or between the places specified in the authorized certificates, permits, or temporary operating authorities. b. Charges and allowances Except as otherwise provided in this tender, shipments made under the provisions of this tender are entitled to those additional services and privileges as are provided in separately published tariffs or tenders to which the TSP(s) participates, including additional tariff or tender charges, rules and regulations applicable to such services and privileges.

    c. Payment The TSP shall bill the DOE contractor through an invoice, appropriately supported. The TSP(s) shall send bills to the "Bill Charges To" address shown on the face of the billing document.

    d. References Where reference is made in this tender to an item, tender, tariff, or classification, the reference shall be construed to include the supplements, amendments or reissues of that item, tender, tariff, or classification, unless otherwise specified in this tender.

    e. Cancellation or amendment of tender This tender may be canceled or amended by the TSP(s) on written notice of not less than thirty (30) calendar days, except for shipments made from the original point of origin (or port of importation, where appropriate) before the affective date of the notice and except for any accrued rights and liabilities of either party to the tender. Cancellations or amendments may be made upon shorter notice by mutual agreement between the Government and the TSP(s) concerned.

    f. Filing with regulatory agencies The TSP(s) certifies (certify) that, where required, the necessary copies of this tender shall be filed with regulatory bodies, as appropriate.

    g. Alterations and volume of traffic This tender shall not apply where charges for service provided under this tender exceed charges otherwise applicable for the same service. Receipt and acceptance of this tender by the Government shall not be considered as a guarantee to the TSP of a particular volume of traffic described in this tender.

    19. TRANSPORTATION SERVICE PROVIDER (TSP) OFFER AND INSTRUCTIONS I am (we are) authorized to and offer on a continuing basis to the United States Government (subsequently called the Government), based on 49 U.S.C. 10721 and 49 U.S.C. 13712 or other appropriate authority, the transportation services described in this tender, subject to the terms and conditions stated in this tender.
