    On March 18, 2011, the Office ofManagement and Budget (0MB) received a request fromyou under the Freedom of Information Act, 5 U.S.C. 552, seeking all documents from january 21 ,2009 to the present related to the U.S. Department of Educations proposed regulations governingthe for-profit education industry, which include what is sometimes referred to as the gainfulemployment regulations.

    Pursuant to your phone conversation with Deputy General Counsel Steve Aitken onSeptember 26h, and because the Department of Educations Gainful Employment Final Rule waspublished in the Federal Register on June 13, 2011 (publically available atht: / /www. fcderalregistcr.gov/ardcles/2011 /06 / 13/2011-13905/program-intcgri-gainfulemployment-debt-measures), you have tentatively agreed to accept, in satisfaction of your requestcopies of the Proposed and Final Rules as they were submitted to the Office of Information andRegulatory Affairs (OIRA) and returned by OIRA to the Department of Education upon conclusionof review documents which may be released under section 6(b)(4)(D) of Executive Order 12,866.Please find these four (4) documents saved on the enclosed CD. In addition, the dates and names ofindividuals involved in substantive oral communications with OIRA personnel about thisrulemaking arc publically available at http://www.whitehouse.gov/omb/oira 1840 meetings.
