It was moved by Hr. Outcault, seconded by Hr. Rummonds, and carried, that Bid No. B-76-6 for the autoclave sterilizer be awarded to the American Sterilizer Company (Amsco Industrial Company) in the total amount of $8,215.00.
It was moved by Hr. HcFadden, seconded by Hr. Outcault, and carried, that the administration be authorized to advertise for bids for fencing north perimeter of. the Palm Desert campus.
It was moved by Hr. Outcault, seconded by Hr. HcFadden, and carried, that the base bid and alternate no. 1 be awarded to Hassey Sand and Rock Company in the total amount of $34,790.00 and $10,610.00, respectively.
It was moved by Hr. HcFadden, seconded by Hrs. Harx, and carried, that the proposed Conflict of Interest Policy be adopted as presented. (See pages 5a, b, c, and d, attached)

Outcault, and carried, that in accordance with Education Code Section 17206, the Riverside County Superintendent of Schools be notified that the Board of Trustees of the Coachella Valley Community College District intends to provide for the audit for the 1975-76 fiscal year.

In compliance with the Political Reform Act of 1974, California Government Code Section 81000, et. seq, the Coachella Valley Community College district hereby adopts this Conflict-of-Interest Code, which shall apply to all governing board members and designated employees of this school district, as specifically required by California Government Code Section 87300.

This Conflict-of-Interest Code is applicable to all designated employees of the school district, including governing board members, who hold positions which involve making, or participation in the making, of decisions which may foreseeably have a material effect on any financial interest. All persons who hold the positions specifically enumerated in the following paragraph shall comply with the provisions of this code and are designated employees.
III. Designated Employees
This code is applicable to governing board members, the superintendent, president, deans, direc tors, coordinators, department ch·airpersons, purchasing agents. and any other employees who exercise discretion in purchasing of, or awarding contracts for, goods and services.
IV. Disclosure Statement-Filing
Each designated employee, including governing board members, shall file an ilnnllal statement disclosing reportable investments, interests in real property and income. An investment, interest in real property or income shall be reportable if the business entity in which the investment is held, the interest in real property or the income or source of income may foreseeably be a·ffectedmaterially by any decision made or participated in by the designated employee by virtue of his position.

Statements shall be filed by each designated employe,e within 30 days after the effective date of this Conflict-of-Interest Code and annually tllereafter. New designated employees shall file statements not less than ten days before assuming office, unless an earlier assumption is required by emergency circumstances. [California Government Code Section 87302(b)J
The statement shall be filed with the College District Administrative Office, which shall make and retain a copy and forward the original to the Fair Political Practices Commission. (Government Code Section 82011)
Statement forms and instruction manuals shall be available in the Central Administrative Office for individual use.
V. Disclosure Statement-Contents
Three categories of financial interest must be reported: Investments, interests in real property, and income (See Definitions)
A. Investment or Interest in Real Property
When an investment or interest in real property is required to be disclosed, the statement shall contain the following:
1. A statement of the nature of the investment or interest.
2. The name of the business entity in which each investment is held and a general description of the business activity in which the business entity is engaged.
3. The address or other precise location of the real property.
4. A statement whether the fair market value of the real property invested in exceeds ten thousand dollars ($10,000) and whether it exceeds one hundred thousand dollars ($100,000). This information need not be provided with respect to an interest in real property which is used principally as the residence of the filer. (Residence excluded)
5. In the case of an investment which constitutes 50% or more of the ownership interest in a business entity, disclosure of the investments and interests in real property of the business entity.
6. If the property or investment was partially or wholly acquired or disposed of during the period covered by the statement, the date of acquisition or disposal.
B. Income
1. When income is required to be reported under this Code, the statement shall co~tain the following:
a. The name and address of each source of income aggregating $250 or more in value, or $25 or more in value if the income was a gift, and a general description of the business activity, if any, of
each source.

2. When income of a business entity, including income of a sole proprietorship is required to he reported, the statement shall contain:
a., The name, address, and a general description of the business activity of the business entity.
b. In the case of a business entity which provides legal or brokerage services, the name of every person who paid fees to the'business entity, if the filer's pro rata share of fees from such person was greater than $1,000.
c. In the case of a business entity not covered by paragraph (b), the name of every person from which the business enti,ty received payments if the filer's pro rata share of gross receipts from such person was greater than $10,000 during a calendar year.
VI. Disqualification
Designated employees, including governing board members, must disqualify themselves from making or participating in the making of any decision when the employee or member has a financial interest'which it is reasonably foreseeable ma'y"be"affected materially by the decision, 'unless such decision falls within Section VII of this Conflict-of-Interest Code. No designated employee shall be required to disqualify himself with respect to any matter which could not legally be acted upon or decided without his participation California Government Code Section 87302(c) .
A designated employee, including a governing board member, has a, financial interest in a decision if it is reasonably foreseeable that the decision will have a material financial effect, distinguishable from its effect on the public generally, on any investment, interest in real property or income. (See Definitions)
VII. Governing Board-Contracts
Governing board members must comply with California Education Code Section 1174, et seq., in addition to the provisions of the Political Reform Act of 1974. loihere there is conflict between the Ac,t and the Education Code sections, the Education Code sections shall prevail (California Education Code Section 1175.5).

A. No member of the governing board of this school district shall b" illt('restcd in an" contract made by· the board (Section 1174).
B. Where a member of the governing board has an interest in a contract or other transaction made by the board of which he is a member, he shall not be disqualified nor will the contract be void or voidable if:
1. The fact of such interest is disclosed or known to the governing board and noted in the minutes, and the governing board thereafter authorizes, approves, or ratifies the contract or transaction in good faith by a vote sufficient for the purpose without counting the vote or votes of·such interested member or members, and
2. rhe contract or transa·ction is just and reasonable as to the school district at the time it is authorized .or approved (Section 1174.5)
C. The following contracts or transactions are prohibited:
1. A contract between the school district and a member of the governing board.
2. A contract between the school district and a partnership or unincorporated association of which a member of the governing board is a partner, owner, or holder of a proprietorship interest.
3. A contract between the school district and a corporation in which any member of the governing board holds five percent or more of outstanding common stock.
4. A contract in which a board member Is interested and, without first disclosing such interest to the governing board at a public meeting of the board, influences or attempts to influence another member or members of the board to enter into the contract (Section 1175).

1. NON-TEACHING PERSONNEL SALARIES
The salary item for 1976-77 is a prominent concern to all faculty and staff. By and large, progress is being made under our usual procedures of "meet and confer." There are no new dimensions of negotiations for classified and teaching personnel, however, since the non-teaching certificated (administrative) personnel have been removed from the faculty salary schedule as a base, there are apprehensions in this category.
Because we do not have sufficient time to fully study and recommend a completely different system of salary determination, I suggest that:
1) Administrative levels I-IV be determined on an indi vidual position basis. 1'his group would include:
President/Superintendent First-level deans Coordinators of Continuing Edu
cation, Community Service, Occupational Education, and

This would necessitate shifting the posttion of Coordinator of Occupational Education and Coordinator of Community Services from Level V up to Level IV, which can be welldefended (they are management in every sense of the word.)
2) Determine salaries for Administrative Levels V-VII on the basis of the faculty salary schedule for two reasons: a) Requirements of their job qualifcations and performance are analogous with classroom teachers' and b) their R-faetors are modest.

Proposed Changes in Sabbatical Leave PrC>Cedures and Contract
As a result of our problems connected with sabbatical leaves

this spring semester, I called several rreetings of the Faculty Salary Reclassification Advisory Committee to examine the existing Sabbatical Leave Procedures and Contract. After working with this cormdttee and with Dr. Wilson, who chaired the faculty cormdttee on sabbatical leaves last year, we came up with the attached proposed revisions to the existing sabbatical leave procedures and contract. These changes were approved unaniJrously at the April 6, 1976 Faculty Association rreeting by those merrbers in attendanoe. I recomrend, therefore, that you recomrend to the Board of Trustees that they adopt these changes.
I shall be happy to discuss these changes with you if you have any questions or comments.

8. Applicant, Before, During and After Leave:

a. At least t\ro weeks prior to the date the sabbatical leave recipient plans to start his/her sabbatical leave, the recipient will file a written plan with the Dean of Instruction. This plan should include (but not be limited to) the date the recipient plans to leave his/her position at College of the Desert, the date of COlltOOncerrent of the sabbatical leave project, an appropriate review of the steps in the project, the date projected for ccmpletion of the sabbatical leave project, the date projected for the recipient to return to tIOrk at College of the Desert, the projected date of the recipieht's report to the Dean of Instruction. This plan will be oonsistent with the goals and objectives of the plan approved by the Board of Trustees.
b. The recipient should receive written approval of the sabbatical leave plan prior to absence fran his/her position of responsibility at College of the Desert.
c. If a recipient has any serious accident or illness which will affect the leave plan, the recipient will notify the Dean of Instruction by registered or certified mail within ten days of said accident or illness.
d. If any changes are proposed in the leave plan as approved by the Board of Trustees and as listed in the approved plan, the recipient will request approval of this change, in writing, through the Dean of Instruction's office. No substantive changes are to be made in the sabbatical leave plan without prior written authorization fran the Dean of Instruction or" the President of the College.
e. Not later than six weeks after return to duty, the recipient shall suJ:rnit evidence as required, through the Dean of Instruc"'tion, to verify that he/she has lOOt objectives stated in the approved application. Evidence shall oonsist of:
(1) Formal Study I.eave--An official transcript showing all oourses ccmpleted and degrees granted; additional credentials obtained should be registered.
(2) Independent Research Leave--A report in a form consistent with the sabbatical leave project and agreed upon by the Dean of Instruction and the recipient.
(3) Travel Leave--A ccmprehensive typewritten report which may include a brief description of places visited and the significance of the experiences to the employee's professional growth.

Instituting a Learning Resources Center Concept at College of the Desert
In the fall of 1974, we had an outside team of experts on our campus to evaluate our Library and A-V Services. As a part of their report they recommended we institute a Learning Resources Center concept at College of the Desert as soon as feasible.
To study this idea further, with your permission, I appointed a faculty committee chaired by Dr. Kroonen. The committee was charged with the responsibility of becoming knowledgeable about Learning Resource Centers and then determining if they felt this would be a good plan to be implemented at C.O.D.
They submitted their report in June of 1975. They included in their report a recommendation to bring in outside consultants to make recommendations to us. This was completed in January of 1976.
The committee has now submitted its final report recommending we seek and select a Learning Resources Center Director to implement the concept of a Learning Resources Center at C.O.D. Unanimous approval of this recommendation was given by the Faculty Association at their meeting on April 6, 1976. As you will recall, we chose 'to wait for this committee's final report before deciding how to fill the vacancy created by the resignation of the Head Librarian in the spring of 1975. It is my recommendation that we ask the Board of Trustees for permission to

RE: FINAL REPORT
This final report is presented to you to spell out the conclusions reached by the Learning Resources Center Committee after a prolonged study of the feasibility of establbhing such a unit on this campus. The report is based on the finding" of the committee itself, and also incorporates recommendations of the Report of Media Program Evaluation Team, January 1975, and of three experts inilie field I.ho have visited o;;r campus this winter; ~lr. Richard Yates (Arizona Nestern college) , Mrs. Joleen Bock (College of the Canyons), and Dr. Gary Peterson (DeAnza College) .
It should be stated, at this point, that the committee's report of June 27, 1975 remains intact and that segments of that report which have not been pursued as of this time should be considered as a part of this report.
All factors considered, it is the strong feeling of this committee that the success of efforts in this endeavor depends greatly on the selection of a highly qualified person to lead it and that highest priority should be given to selection of a Director of Learning Resources, responsible to the Dean of Instruction and of administrative rank so as to be a member of the "Dean's Meeting" group at College of the Desert. It is felt that the Job Announcement prepared by Dr. Peterson can, with modification, be used in announcing the post. The committee feels that selection of the Director should be made according to guidelines currently in eftect and that this committee, itself, should be employed in the screening process. Involvement of· a representative of the Friends of the Library is also suggested - preferably an individual who is not affiliated with College of the Desert in any capacity other than as a member of that group.

Final Report
Following selection of a Director, and allowing him/her ample latitude for development of the Learning Resources Center, the committee urqes the formation of an on-campus Advisory Committee consisting of persons lOOS.t directly affected by and involved in the r~arning Resources Center.
The committee would again stress, as it did in iten, (4) of the report of June 24·, that the administration of College of the Desert make a strong financial commitment to the implementation and continued functioning of a Learning Resources Center.
As a group we look forward to our continued involvement in the selection of a Director and are anxious to see the Learning Resources Center concept carried to fruition •
