AGREEMENT Overview: This agreement contains the entire understanding between Blue Giraffe

Photography and the above named client. It supersedes all prior and simultaneous agreements

between the parties. The only way to add or change this agreement is to do so in writing, signed by all

the parties. If the parties want to waive one provision of this agreement, that does not mean that any

other provision is also waived. The party against whom a waiver is sought to be effective must have

signed a waiver in writing.

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible

result within the definition of this assignment. Blue Giraffe Photography is not responsible if key

individuals fail to appear or cooperate during photography sessions or for missed images due to details

not revealed to Blue Giraffe Photography.

IMAGES and COPYRIGHTS: the photographs produced by Blue Giraffe Photography are protected by

Federal Copyright Law and may not be reproduced in any manner without Blue Giraffe Photography's

explicitly written permission. Upon final payment by the client, the client has limited copyright

ownership of the resulting images Which may be used only for personal use and may not be copied, or

reprinted without express permission of Blue Giraffe Photography owners, Jackilyn or Wesley Brown.

The Client must obtain written permission from, and compensate Blue Giraffe Photography prior to the

client, or their friends/ relatives publishing the images. The reproduction of the images received is

expressly prohibited unless a cd with a signed copyright release has been purchased by the client.

MODEL RELEASE. The Client(s) & Subject(s) hereby grant to Blue Giraffe Photography and its legal

representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of

the client or in which the client may be included, for editorial, trade, advertising and any other

purpose and in any manner and medium; to alter the same; and to copyright the same. The CLIENT

hereby releases Blue Giraffe Photography and its legal representatives and assigns from all claims and

liability relating to said photographs. A separate model release form is included in the clients packet

and will need to be signed by the parent or legal guardian of all children under the age of 18 and by all

featured parties over the age of 18.

LIMIT OF LIABILITY: In the unlikely event that the photographer is injured or becomes too ill, or

has an extreme emergency that prevents him from photographing the event, Blue Giraffe Photography

will make every effort to reschedule the event. If for whatever reason this is not possible,

responsibility and liability is limited to the return of all payments received for the package purchased.

Blue Giraffe Photography takes the utmost care with respect to exposure, transportation, and

processing the photographs. However, in the unlikely event that photographs have been lost, stolen,

or destroyed for reasons within or beyond Blue Giraffe Photography s control, Blue Giraffe

Photographys liability is limited to the return of all payments received for the portrait package.

Proofs & Editing: Blue Giraffe Photography will post edited session proofs to their own album at

www.bluegiraffephotography.comwithin 4 weeks from the day of the clients session. If the client is

interested in a cd of the watermarked proofs one can be provided with a $5 charge. These proofs are

for ordering purposes only and cannot be replicated.

RETAINER & PAYMENT SCHEDULE: 50% of the total cost of the session fee is due at time of

signing this agreement. This is a NON-REFUNDABLE RETAINER. In the event of cancellation, the

retainer paid is non-refundable. It shall be liquidated for damages to Blue Giraffe Photography in the

event of a cancelation, or breach of contract by the client. The client shall also be responsible for

payment of any Blue Giraffe Photography materials/charges incurred up to time of cancellation. The

retainer shall applied towards the total cost of the service to be rendered. The remaining charges are

payable in full on the date of the session. If for some reason the client is unable to make it to the

scheduled session, Blue Giraffe Photography will be willing to reschedule if the session is cancelled at

least 24 hours before the session was meant to take place using the retainer that was already paid.

The session must be rescheduled within 24 hours of the cancellation and will only be rescheduledonce.

Other Valuable Information: The welcome packet each client receives contains a price list, model

waiver, copyright agreement, and suggestions for the photo shoot. Some of these forms contain a

signature line and will need to be signed and returned with this contract.

Obviously we cannot meet every request but if you have an idea or special concept youd like to

incorporate feel free to ask and we will do our best to work with you to make your session a

memory that will last a lifetime for your family.
