BINGAMPLIFYINGINUITYPHOTOCONTESTOFFICIALRULES

1. SPONSOR

TheseOfficialRules(“Rules”)governtheoperationoftheBingAmplifyIngenuityPhotoContest(“Contest”).MicrosoftCorporation,OneMicrosoftWay,Redmond,WA,98052,USA,istheContestsponsor(“Sponsor”).

2. DEFINITIONSIntheseRules,"Microsoft","we","our",and"us"refertoSponsorand“you”and"yourself"referstoaContestparticipant,ortheparent/legalguardianofanyminorContestentrant.Byenteringyou(yourparent/legalguardianifyouareaminor)agreetobeboundbytheserules.

3. ENTRYPERIODTheConteststartsat9a.m.PacificTime(PT)onApril30,2018,andendsat11:59p.m.PTonMay28,2018(“EntryPeriod”).EntriesmustbereceivedduringtheEntryPeriodtobeeligible.

4. ELIGIBILITY

Toenter,youmustbealegalresidentofthe50UnitedStates(includingtheDistrictofColumbia),13yearsofageorolder.Minorsmusthaveconsentofaparentorlegalguardian.EmployeesanddirectorsofMicrosoftCorporationanditssubsidiaries,affiliates,advertisingagencies,andContestPartiesarenoteligible,norarepersonsinvolvedintheexecutionoradministrationofthispromotion,orthefamilymembersofeachabove(parents,children,siblings,spouse/domesticpartners,orindividualsresidinginthesamehousehold).Voidwhereprohibited.

5. HOWTOENTERNOPURCHASENECESSARY.Tocreateanentry,shareyourbestphotographthatamplifieshumaningenuity.Forpurposesofthiscontest,“amplifyinghumaningenuity”isdefinedasanoriginalphototakenofart,architecture,transportation,andtechnologythatdoesnotcontainawatermark,signature,photographername,orlogo.Therearethree(3)differentwaystosubmityourphoto:Facebook:Tosubmityourphoto,logintoyourlegallyregisteredsocialmediaaccountonFacebookandnavigateto(https://www.facebook.com/Bing/app/489347001448444/)Onthelandingpage,clickthe“submitphoto”buttontouploadyourimage.Next,followtheinstructionstoenterbysubmittingyourcompleteandaccurateinformation,then,uploadaneligiblephototoreceiveone(1)entryintotheContest.InstagramandTwitter:

Tosubmityourphoto,logintoyourlegallyregisteredsocialmediaaccountonInstagramorTwitter,andpostapubliclyviewablemessagethatincludesyourphotoandtheContesthashtag#AmplifyIngenuity.Allelementsmustbeincludedtobeeligible.Theaccountsettingsforthismessagemustbesetto“unprotected”or“public”tobeeligible.IfyouenterviaInstagramorTwitterandareselectedasawinner,youwillbeaskedtoprovideafinalrevisedphotothatisatleast3000pxwideand300dpiforittobefeaturedontheBinghomepage.Thispromotionisinnowaysponsored,endorsed,oradministeredby,orassociatedwith,Facebook,Instagram,orTwitter.YouunderstandthatyouareprovidingyourinformationtotheSponsorandnottoFacebook.TheinformationyouprovidewillonlybeusedforadministeringthePromotionandtocontactyouifyouareawinner.Thereisalimitoffifty(50)uniqueentriesperpersonacrossallsocialmediaaccounts.Ifyousubmitthesamephototomultiplesocialmediaaccounts,wewilldisqualifythatphotoentirely.Wearenotresponsibleforexcess,lost,late,orincompleteentries.Ifdisputed,entrieswillbedeemedsubmittedbytheauthorizedaccountholderoftheemailaddress,socialmediaaccount,orothermethodusedtoenter.

6. ELIGIBLEENTRY

Tobeeligible,anentrymustmeetthefollowingcontent/technicalrequirements:

• Yourentrymustbeanoriginalphototakenofart,architecture,transportation,ortechnologyinanurbansettingthatdoesnotcontainawatermark,signature,photographername,orlogo.

• IfyousubmityourphotoonFacebook,Instagram,orTwitterbutyourphotoendsupbeingselectedasawinner,youwillbeaskedtoprovideafinalrevisedphotothatisatleast3000pxwideand300dpiforittobefeaturedontheBinghomepage.Intheeventyourwinningphotoisnotavailableinthissize,youwillstillreceiveyourprize,minusanopportunitytobefeaturedonthehomepage;and

• Yourentrymustbeyourownoriginalwork;and• Yourentrycannothavebeenselectedasawinnerinanyothercontest;and• Youmusthaveobtainedallconsents,approvals,orlicensesrequiredforyoutosubmityour

entry;and• Totheextentthatentryrequiresthesubmissionofuser-generatedcontestsuchassoftware,

photos,videos,music,artwork,essays,etc.,entrantswarrantthattheirentryistheiroriginalwork,hasnotbeencopiedfromotherswithoutpermissionorapparentrights,anddoesnotviolatetheprivacy,intellectualpropertyrights,orotherrightsofanyotherpersonorentity.YoumayincludeMicrosofttrademarks,logos,anddesigns,forwhichMicrosoftgrantsyoualimitedlicensetouseforthesolepurposesofsubmittinganentryintothisContest;and

• YourentrymayNOTcontain,asdeterminedbyusinoursoleandabsolutediscretion,anycontentthatisobsceneoroffensive,violent,defamatory,disparagingorillegal,orthatpromotesalcohol,illegaldrugs,tobaccooraparticularpoliticalagenda,orthatcommunicatesmessagesthatmayreflectnegativelyonthegoodwillofMicrosoft.

WearenotclaimingownershiprightstoyourSubmission.However,bysubmittinganentry,yougrantusanirrevocable,royalty-free,worldwiderightandlicensetouse,review,assess,testandotherwiseanalyzeyourentryandallitscontentinconnectionwiththisContestanduseyourentryinanymediawhatsoevernowknownorlaterinventedforanynon-commercialorcommercialpurpose,including,butnotlimitedto,themarketing,saleorpromotionofMicrosoftproductsorservices,withoutfurtherpermissionfromyou.Youwillnotreceiveanycompensationorcreditforuseofyourentry,otherthanwhatisdescribedintheseOfficialRules.

WINNERSELECTIONANDNOTIFICATIONTherewillbeone(1)roundofjudgingandone(1)roundofpublicvoting.JudgingPeriod:OnMay29nd,2018,aqualifiedjudgingpanelfromMicrosoftortheiragentwillselectFifty(50)toOneHundred(100)semi-finalistentriesbasedonthefollowingjudgingcriteria:50%-Technicalqualityandcompositionofthephoto(includingleavingappropriatespaceintheupperlefthandsizefortheBinglogoandsearchbox)30%-ArtisticAppeal20%-RelevancetothethemeoftheContestTheseentrieswillbecomeeligibleforthePublicVotingPeriod.

PublicVotingPeriod:Followingthejudgingperiod,alleligibleentrieswillbepresentedonlineatURLforvotingbythepublicfrom12:01a.m.PTonMay30th,2018to11:59p.m.PTonJune13,2018.DuringthePublicVotingPeriod,thepublicwillbeabletovotefortheirfavoriteentrybyvisitingthewebsitegalleryfortheContestandclickingonthe“heart”iconfortheirfavoriteentry.YoumustbeamemberofFacebookandbeloggedintovote.Limitone(1)voteperentryperpersonandFacebookaccount.Pictureswiththemostvoteswillbethewinner.Intheeventofatiebetweenanyeligibleentries,anadditionaljudgewillbreakthetiebasedonthejudgingcriteriadescribedabove.Thedecisionsofthejudgesarefinalandbinding.Ifwedonotreceiveenoughentriesmeetingtheentryrequirements,wemay,atourdiscretion,selectfewerwinnersthanthenumberofContestPrizesdescribedbelow.Ifpublicvotedetermineswinners,itisprohibitedforanypersontoobtainvotesbyanyfraudulentorinappropriatemeans,includingofferingprizesorotherinducementsinexchangeforvotes,automatedprogramsorfraudulenti.d’s.Microsoftwillvoidanyquestionablevotes.

IfyouenteredviaFacebook,youwillbenotifiedviaemailifyouareawinner.IfyouenteredviaTwitterorInstagram,youwillbenotifiedviaDirectMessagenomorethan7daysfollowingjudgingandvotingwithprizeclaiminstructions,includingsubmissiondeadlines.Ifaselectedwinnercannotbecontacted,isineligible,failstoclaimaprizeorfailstoreturnanyFormswithin48hours,theselectedwinnerwillforfeittheirprizeandanalternatewinnerwillbeselectedtimeallowing.Ifyouareapotentialwinnerandyouare13yearsofageorolder,butareconsideredaminorinyourplaceoflegalresidence,wemayrequireyourparentorlegalguardiantosignallrequiredformsonyourbehalf.Onlythreealternatewinnerswillbeselected,afterwhichunclaimedprizeswillremainunawarded.

*Intheeventyourwinningphotoisnotavailableinthesize/resolutionrequired,youwillstillreceiveyourprize,minusanopportunitytobefeaturedonthehomepageandwewillinsteadoffertheopportunitytothenextrunnerup.TheTotalApproximateRetailValue(ARV)ofthispackageis:$4,198One(1)SecondPlacePrize.A$1,000Airlinesgiftcard.FilsonCameraBackpack$400One(1)ThirdPlacePrize.An$500airlinesgiftcard.

TheARVofelectronicprizesissubjecttopricefluctuationsintheconsumermarketplacebasedon,amongotherthings,anygapintimebetweenthedatetheARVisestimatedforpurposesoftheseOfficialRulesandthedatetheprizeisawardedorredeemed.Wewilldeterminethevalueoftheprizetobethefairmarketvalueatthetimeofprizeaward.ThetotalApproximateRetailValue(ARV)ofallprizes:$6,098Wewillonlyawardone(1)prize/prizepackageperperson/companyduringtheEntryPeriod.Nomorethanthestatednumberofprizeswillbeawarded.Nosubstitution,transfer,orassignmentofprizepermitted,exceptthatMicrosoftreservestherighttosubstituteaprizeofequalorgreatervalueintheeventtheofferedprizeisunavailable.Prizeswillbesentnolaterthan28daysafterwinnerselection.Prizewinnersmayberequiredtocompleteandreturnprizeclaimand/ortaxforms(“Forms”)withinthedeadlinestatedinthewinnernotification.Taxesontheprize,ifany,arethesoleresponsibilityofthewinner,whoisadvisedtoseekindependentcounselregardingthetaximplicationsofacceptingaprize.Byacceptingaprize,youagreethatMicrosoftmayuseyourentry,name,imageandhometownonline

10. ODDS

Theoddsofwinningarebasedonthenumberofeligibleentriesreceived.

11. GENERALCONDITIONSANDRELEASEOFLIABILITY

Totheextentallowedbylaw,byenteringyouagreetoreleaseandholdharmlessMicrosoftanditsrespectiveparents,partners,subsidiaries,affiliates,employeesandagentsfromanyandallliabilityoranyinjury,lossordamageofanykindarisinginconnectionwiththisContestoranyprizewon.Alllocallawsapply.ThedecisionsofMicrosoftarefinalandbindingWereservetherighttocancel,changeorsuspendthisContestforanyreason,includingcheating,technologyfailure,catastrophe,waroranyotherunforeseenorunexpectedeventthataffectstheintegrityofthisContest,whetherhumanormechanical.IftheintegrityoftheContestcannotberestored,wemayselectwinnersfromamongalleligibleentriesreceivedbeforewehadtocancel,changeorsuspendtheContest.RulesviolatorswillbeprosecutedtothefullextentofthelawandmaybebannedfromparticipationinMicrosoftContest.

12. GOVERNINGLAWThisContestwillbegovernedbythelawsoftheStateofWashington,andyouconsenttotheexclusivejurisdictionandvenueofthecourtsoftheStateofWashingtonforanydisputesarisingoutofthisContest.
