CHRISTIE BUILDING FLOOR TILE NORTHERN MAINE COMMUNITY COLLEGE

PRESQUE ISLE, MAINE

1.0 PROJECT OBJECTIVE AND SCOPE OF WORK The project objective is:

The removal and proper disposal of Asbestos-Containing Material (ACM) present within the Christie Building Student Services area including: floor tile and associated floor tile mastic.

The scope and sequence of work to be completed under this contract is presented in this Work Plan (refer to Section 2.0; Sequence of Work). Portions of the building will be occupied at the time of the abatement work. The Abatement Contractor will be required to coordinate work with Northern Maine Community College (NMCC) to reduce any potential impact to the building occupants. The Work Plan includes Figures and the following appendices:

Appendix A: Floor Plan Appendix B: Bid Proposal Form Appendix C: Proposed Owner-Contractor Agreement

Work shall be performed in accordance with applicable Maine Department of Environmental Protection (MEDEP), U.S. Environmental Protection Agency (USEPA), U.S. Department of Transportation (DOT) and the Occupational Safety and Health Administration (OSHA) regulations. 1.1 Asbestos Containing Materials The following ACM, present within the Christie Building Student Services area are scheduled for removal:

The Abatement Contractor is responsible to verify actual quantities of identified ACM for bidding and abatement purposes. 2.0 SEQUENCE OF WORK 2.1 GENERAL

A. The Abatement Contractor shall prepare a sequence of work and abatement project design for the specified work area. Area specific sequence of work will be subject to review and approval by Owner. An Asbestos Abatement Project Design Consultant licensed by the MEDEP, and representing the Abatement Contractor, shall prepare all asbestos abatement project designs. Designs will be subject to review from the MEDEP. The Abatement Contractor will be responsible to properly notify MEDEP and the USEPA of renovation or demolition activities and associated asbestos abatement. The Contractor shall pay for all notifications fees.

B. Water, electricity and sanitary facilities will be available for use by the Abatement Contractor for the duration of this project.

C. Equipment and supplies present within the designated work area(s) will be moved prior to the commencement of abatement activities.

D. The Abatement Contractor will be responsible for work area security for the duration of the abatement work.

2.2 TYPICAL SEQUENCE OF WORK A typical sequence of work will include, but may not be limited to, the following steps:

A. Prepare asbestos abatement work areas in accordance with the Abatement

Contractor's asbestos abatement design (prepared by a MEDEP licensed Asbestos Abatement Design Consultant) and with State of Maine Asbestos Management Regulations, Chapter 425.

B. Perform asbestos abatement work in compliance with all applicable State and

Federal laws and regulations. ACM shall be adequately wet during the removal process utilizing amended water. The Abatement Contractor shall select abatement methods appropriate for the existing conditions.

D. Package ACM waste for disposal by double bagging in 6 mil poly bags or

double wrapping in 6-mil poly sheeting. Prior to bagging or wrapping, waste that may puncture disposal bags or wrap shall be enclosed with burlap or other suitable material that will prevent bag failure.

E. Transport and properly dispose/recycle removed wastes, residuals, debris, materials and equipment.

F. Demobilize from the site including removal of barriers, disposable items and

equipment.

3.0 HEALTH AND SAFETY 3.1 GENERAL

A. All asbestos abatement work shall be performed in full compliance with applicable State and Federal laws and regulations. Personnel present within the boundaries of the regulated area shall wear respiratory protection and shall be dressed in full body disposable clothing.

B. Abatement personnel shall be appropriately trained for the assigned work

task in accordance with applicable MEDEP and Federal regulations. 3.2 WORK AREA MONITORING

A. Work area and perimeter monitoring for asbestos fibers are required for this

project. The Abatement Contractor is responsible for providing work area and perimeter air monitoring.

4.0 SCHEDULE

A. A final project schedule shall be determined by the Owner. It is the responsibility of the Abatement Contractor to maintain an adequate work crew on site to complete the work within the Owner’s specified time constraints.

B. The Student Affairs Area start date is March 13, 2017 with a completion date of March 24, 2017. All work for this area will need to be completed on nights and weekends.

C. The Business Office area start date is July 1, 2017 with a completion date of July 17, 2017.

D. Unless otherwise approved by the Owner, all work associated with this contract shall be completed by July 17, 2017.

5.0 PROJECT MEETINGS

A. A pre-construction meeting will be scheduled following Abatement Contractor selection. Attendees will include the Abatement Contractor (Project Manager and Superintendent) and representatives of the Owner.

B. Project progress meetings will be conducted as deemed necessary by the

Owner and/or the Abatement Contractor. 6.0 CLEARANCE/ACCEPTANCE CRITERIA

A. Work will be evaluated for completion following the removal of visible residue from surfaces of equipment, floors and walls, and the removal of containers and equipment. This evaluation will be completed by the Abatement Contractor's supervisor, subsequent to completion of successful asbestos abatement clearance inspection, sampling and analysis for the work area.

Visual evaluation protocol will include:

1. Entering the work area where the abatement/clean-up/remediation activity was performed.

2. Inspection of the surfaces from which ACM and associated residue was removed.

3. Examination of the permanent features within the work area such as walls, floors, ceilings, conduits, pipes, tanks, etc., and attempting to determine whether residual materials or visible debris is present.

4. Examination of the decontamination and waste-load out facilities and observe whether residual material or visible debris is present. The waste will be evaluated to determine proper containerization and labeling.

B. The Abatement Contractor is responsible for providing final asbestos abatement clearance inspection, sampling and analysis for the work area. Clearances will be performed in accordance with MEDEP regulations by an independent, MEDEP licensed air monitor.

7.0 PROJECT DOCUMENTATION

A. The Abatement Contractor will provide the following documentation to the Owner representative:

8.0 CONTRACT ADMINISTRATION 8.1 Measurement and Payment

A. The Abatement Contractor will be subject to the terms and conditions described in the supplemental contract documentation provided in Appendix C.

B. This project will be bid by the Abatement Contractor on a lump sum basis. The lump sum cost will include furnishing necessary labor, materials, equipment, disposal costs and permitting, etc. to complete the work.

C. This project will be bid by the Abatement Contractor with consideration for the Alternate #1 as optional ONLY. The Owner shall notify the Abatement Contractor regarding the acceptance of the Alternate #1 Bid at the time of vendor selection, after bids have been reviewed.

D. The Abatement Contractor shall submit one lump sum application for

payment for the work associated with this project and one lump sum application for withheld retainage. Payment shall include full compensation for all required labor, products, tools, equipment, plant, transportation, services and incidentals; erection, application or installation of an item of the Work; overhead and profit.

E. The Owner will withhold retainage of 10 percent (%) from the pay

requisition, until final completion (receipt of final waste manifests).

F. The Abatement Contractor shall promptly pay each subcontractor, upon receipt of payment from the Owner, out of the amount paid to the Abatement Contractor on account of such subcontractor's work, the amount to which said subcontractor is entitled. The Abatement Contractor shall, by appropriate agreement with each subcontractor, require each subcontractor to make payments to its subcontractors in a similar manner

G. Prior to release of retainage, the Abatement Contractor shall file, with the Owner, an executed Waiver and Release of Claims stating that bills for all items of labor, material and parts have been paid and no claims exist against the Owner.

H. A final inspection of the work area will be made by the Owner and the Abatement Contractor to determine whether the specified work has been completed.

8.2 Provisions for Extra Work

A. All extra work under this Contract shall be performed under change orders to the original contract and issued by the Owner.

B. The Abatement Contractor shall not start any extra work until the prices for the extra work involved and the amount of extension of contract time, if any, resulting from the extra work have been agreed upon, or compensation has been established, in writing, by the Owner and the Abatement Contractor.

C. The Owner shall have the right, by verbal instructions, to make minor

changes in the Scope of Work not involving additional cost and not inconsistent with the purpose of the original Scope of Work.

D. All extra work involving cost or changes in the scope of the Work shall be

previously agreed to and as ordered in writing by the Owner. No claim for a change to the Contract Price shall be valid unless so ordered.

9.0 BIDDING REQUIREMENTS 9.1 Site Investigation

A. By submitting a bid, the Abatement Contractor acknowledges that he has investigated and satisfied himself as to:

a) the conditions affecting the work, including but not limited to physical conditions of the site which may bear upon site access, handling and storage of tools and materials, access to water, electric or other utilities or otherwise affect performance or required activities.

b) the character and quantity of all surface and subsurface materials or obstacles to be encountered in so far as this information is reasonably ascertainable from an inspection of the site, including exploratory work done by the Owner or a designated consultant, as well as information presented in drawings and specifications included with his contract. Any failure by the Abatement Contractor to acquaint himself with available information will not relieve him from responsibility for estimating properly the difficultly or cost of successfully performing the work. The Owner is not responsible for any conclusions or interpretations made by the Abatement Contractor on the basis of the information made available by the Owner.

9.2 Discrepancies and Explanations

A. Should a bidder find discrepancies in the plans and/or specifications or should

he be in doubt as to the meaning or intent of any part thereof, he must, no later than four days prior to the bid opening, request clarification from the Owner. Discrepancies with regard to conflicts between the Contract Documents and applicable Federal, State, or Local regulations or requirements shall be included herein. Failure to require such clarification is a waiver to any claim by the Bidder for expense made necessary by reason of later interpretation of the Contract Documents by the Owner.

B. Explanations desired by a prospective Bidder regarding this Work Plan,

drawings or other bid documents shall be requested in writing no later than four days prior to the bid opening. Requests shall include the project name and shall be directed to:

C. Oral explanations or instructions will not be binding. Only written addenda are binding. Any addenda resulting from these requests will be mailed to all listed holders of the Bid Documents no later than one day prior to the bid opening. The Bidder shall acknowledge the receipt of all addenda on the bid proposal form.

9.3 Modification and Withdrawal of Bids

A. Withdrawal or modifications to bids are effective if written notice thereof is filed prior to time of bid opening and at the place specified in the Notice of Bidders. A notice of withdrawal or modifications to a bid must be signed by the Abatement Contractor or his designated representative.

B. No withdrawal or modifications shall be accepted after the time for opening

of proposals. 9.4 Bid Security

A. A bid security (Bid Bond) and Performance and Payment Bonds, are not required for this project.

9.5 Insurance requirements

A. The Abatement Contractor shall purchase and maintain insurance that will protect him from claims that may arise out of the result from his activities under this contract, whether those activities are performed by the Abatement Contractor or by any subcontractor or by anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable.

B. The Insurance required shall be written for not less than the following, or

greater if required by law.

1. Workmen’s Compensation: State Statutory Coverage

2. Comprehensive General Liability (including Premises Operations; Independent Contractor’s protective; Products and Completed operations; Broad Form Property damage):

C. Certificate of Insurance acceptable to the Owner shall be filed with the Owner

prior to commencement of the work.

E. If the Owner permits the Abatement Contractor to use any of the Owner’s equipment, tools, or facilities, such use will be gratuitous and the Abatement Contractor shall release the Owner from any responsibility arising from claims for personal injuries, including death, arising out of the use of such equipment, tools, or facilities irrespective of the condition thereof or any negligence on the part of the Owner in permitting their use.

F. Should the Bidder to whom the contract is awarded fail or be unable to

execute the contract for any reason within notification of award, then an amount equal to the difference between the acceptable bid price, and that of the next highest Bidder shall be paid to the Owner as liquidated damages.

G. As a prerequisite to signing the contract and prior to the expiration of seven

days following notification of award, the Bidder shall have furnished Certificates of Insurance.

9.6 Licenses and Qualifications

A. Bidders must be licensed as required by the State of Maine, Department of Environmental Protection, Solid Waste Bureau, for purpose of removal, encapsulation, enclosure, demolition and maintenance of structures or components as stated in 06-096 Department of Environmental Protection Chapter 425, Asbestos Management regulations.

9.7 Rejection of Bids

A. The Owner reserves the right to reject bids for any reason that serves the best interests of the Owner or this Project. The Owner also reserves the right to waive any technicality or irregularity in a bid. Failure to submit requested information/documentation may result in automatic disqualification of bid package.

9.8 Bidding

A. All perspective bidders shall visit the project site prior to preparing bids. Vendor walk-throughs will be scheduled upon request, 48 hours notice is required. Quantities provided in this Work Plan and on the Drawings are for informational purposes only. Actual determination of baseline project quantities for removal and recycling/disposal shall be the responsibility of the Abatement Contractor. All prospective bidders shall visit the project site prior to preparing and submittal of bids.

B. Bids will be submitted on the Bid Form included as Appendix B.

C. One copy of the bid submittal package addressed to the attention of:

Current MEDEP Asbestos Abatement Contractor License, Asbestos Abatement Designer License and Asbestos Abatement Supervisor license for the proposed project superintendent.

10.0 PRECONSTRUCTION PERIOD 10.1 CONTRACT

A. A tentative date for Notice of Award is March 10, 2017.

B. The successful bidder will contract directly with the Owner.

10.2 PRECONSTRUCTION MEETING

A. A pre-construction meeting will be conducted by the Owner prior to commencement of work by the Abatement Contractor.

10.3 PRECONSTRUCTION SUBMITTALS

A. Submittals including Abatement Contractor training and medical certifications, Certificate of Insurance, disposal facility, testing laboratory, etc., will be submitted for review by the Owner a minimum of one week prior to the Pre-construction Meeting.

B. Copies of the asbestos abatement designs, notifications and associated

documentation will be submitted to the Owner at the time of the pre-construction meeting.

STANDARD TERMS AND CONDITIONS

NOTICE TO VENDORS AND BIDDERS:

STANDARD TERMS AND CONDITIONS APPLICABLE TO ALL MCCS CONTRACTS

The following standard contracting terms and conditions are incorporated and shall become a part of any final

contract that will be awarded by any college or other operating unit of the Maine Community College System

(collectively “MCCS”). These terms and conditions derive from the public nature and limited resources of the

MCCS. MCCS DOES NOT AGREE TO:

1. Provide any defense, hold harmless or indemnity;

2. Waive any statutory or constitutional immunity;

3. Apply the law of a state other than Maine;

4. Procure types or amounts of insurance beyond those MCCS already maintains or waive any rights

of subrogation;

5. Add any entity as an additional insured to MCCS policies of insurance;

6. Pay attorneys’ fees, costs, expenses or liquidated damages;

7. Promise confidentiality in a manner contrary to Maine’s Freedom of Access Act;

8. Permit an entity to change unilaterally any term or condition once the contract is signed; and

9. Automatic renewals for term(s) greater than month-to-month.

By submitting a response to a Request for Proposal, bid or other offer to do business with MCCS, YOUR ENTITY

UNDERSTANDS AND AGREES THAT:

1. The above standard terms and conditions are thereby incorporated into any agreement entered into

between MCCS and your entity; that such terms and condition shall control in the event of any

conflict with such agreement; and that your entity will not propose or demand any contrary terms;

2. The above standard terms and conditions will govern the interpretation of such agreement

notwithstanding the expression of any other term and/or condition to the contrary;

3. Your entity will not propose to any college or other operating unit of the MCCS any contractual

documents of any kind that are not in at least 11-point font and completely contained in one Word

or PDF document, and that any references to terms and conditions, privacy policies or any other

conditions referenced outside of the contract will not apply; and

4. Your entity will identify at the time of submission which, if any, portion or your submitted

materials are entitled to “trade secret” exemption from disclosure under Maine’s Freedom of

Access Act; that failure to so identify will authorize MCCS to conclude that no portions are so

exempt; and that your entity will defend, indemnify and hold harmless MCCS in any and all legal

actions that seek to compel MCCS to disclose under Maine’s Freedom of Access Act some or all

of your submitted materials and/or contract, if any, executed between MCCS and your entity.

This RFP shall be referenced in, and considered part of, any final contract.
