Mission

Dear AGC San Diego Members,

Serving as the 2014 AGC San Diego President has been an honor. It has been a year of accomplishments at AGC, thanks to the leadership of the Board of Directors, and the participation of the members. Here is a look at some of the highlights:

• Update of AGC’s Strategic Plan The 28-page document “charts the course” for the next 3-5 years, sets the vision and mission of AGC, and details goals and objectives. We are in a strong position to provide the best possible service for AGC’s membership.

• Building a San Diego Business Coalition AGC joined several other business organizations to help elect San Diego Mayor Kevin Faulconer, and San Diego Council Members Lorie Zapf and Chris Cate. AGC members stepped up and contributed time and financial resources to put these candidates over the top. The City Council, once dominated by “progressives,” is now more evenly divided with pro-economic development council members.

• Grassroots Success at the Federal Level AGC worked with our local Congressional delegation to pass legislation that will encourage federal prime contractors to make sure small businesses have opportunities to compete for subcontracts at every tier, thereby allowing more opportunities for small business growth. AGC members were “called into action” to write letters to their Congressional Representatives.

• Recognition of Safety Programs AGC San Diego members once again dominated in the annual AGC of America Construction Safety Excellence Awards (CSEA), which recognizes construction firms that have developed and implemented premier safety and loss prevention programs. Eight firms placed either 1st or 2nd in their respective categories…a great accomplishment in this extremely competitive national contest!

• A Winning CEM Program AGC members once again stepped up to the plate to help fund the J.R. Filanc Construction & Engineering Management Program (CEM) at San Diego State University. The annual GALA raised over $120,000. In addition, five CEM teams participated in the Associated Schools of Construction “Reno” Competition, where two of the teams placed third.

• Fall Protection AGC’s Board of Directors approved the construction of a fall protection facility on the AGC property. Hands-on instruction will be provided for craft workers on multi-level steel structures, bridges, confined spaces, and roofs, and column simulators will be used to teach fall protection techniques. The facility will be completed in 2015.

• Strength in Numbers Over 800 members “volunteered” in AGC’s 20 committees and four councils. Member involvement is important to the success of AGC, and you make a difference when you participate!

It has been a productive and successful year, and it’s been my privilege to serve as the 2014 President of AGC San Diego.

The Committee worked with the Engineering General Contractors’ Council to address stormwater run-off and the liability of project owners and contractors. Legislation will be pursued in 2015 to clarify who is responsible for Stormwater Pollution Prevention Plan (SWPPP) design.

AGC continued to monitor the progress of the California Air Resources Board (CARB) diesel emissions rules, and held a workshop to discuss compliance deadlines, regulatory changes, and potential fines.

The Government Relations Committee ensures that AGC San Diego keeps a high-profile position in the “political arena” at the local, regional, state and national levels. This involves a continual analysis of all political efforts affecting the industry. The committee annually develops legislative positions for distribution to the membership. It works closely with our legislative advocate in Sacramento and with the AGC of California and AGC of America on all statewide and federal legislative matters. The committee is responsible for advocacy of adequate infrastructure investment.

AGC San Diego joined AGC California for a trip to Sacramento on June 17-18 to meet with and lobby our local legislators. The visit included a private evening reception with legislators, dinner with Senator Marty Block, election briefings from Republican and Democratic political consultants, and remarks from legislative leaders and Administration officials. David Lanier, Secretary of the Labor and Workforce Agency, discussed the new $300 contractor registration fee, as well as proposed legislation which would have allowed employees to file pre-judgment wage liens against an employer (AB 2416 subsequently failed passage).

Our talking points during the legislative visits focused on the importance of investing in infrastructure, support of design build legislation, and opposition to AB 2416.

LEGISLATIVE TRIP TO SACRAMENTO

AGC members continued to use AGC’s “Legislative Action Center,” which allows them to contact elected officials on important issues, register to vote, or search for local and state election information.

Specific issues addressed via the Legislative Action Center included:

• Opposition to the City of San Diego Linkage Fee• Opposition to AB 2416• Support of federal highway funding and “Hardhats for Highways” Program

Success in San Diego City races best describes 2014. Winning candidates included AGC-endorsed San Diego Mayor Kevin Faulconer, and City Council Members Lorie Zapf and Chris Cate. A coalition of business organizations raised significant funds to support Independent Expenditure (IE) campaigns in support of those candidates. AGC and AGC’s PAC contributed to the IE campaigns, and AGC members raised over $100,000 in personal contributions to help the candidates get their messages out to voters.

The focus of the PAC (Political Action Committee) is on fundraising and candidate endorsement. Specific activities included developing an annual fundraising plan for Board of Directors’ approval. This is particularly important in key election years. The fundraising should include a plan to solicit PAC donations, a plan for reception-type fundraisers sponsored by members in their offices, and coordination of key individual donations with the AGC. The PAC interviews candidates at the local, state, and national level, and makes endorsement recommendations to the Board of Directors.

AGC-endorsed Congressional Members Duncan Hunter and Darrell Issa, and San Diego County Supervisors Bill Horn and Ron Roberts were re-elected.

The passage of needed construction bond measures was good news. Statewide: Proposition 1 _ $7.5 million for water projects; and Proposition 41 _ $600 million for housing and infrastructure for at-risk veterans and their families. Local: Measure E _ $182 million for Escondido Union School District; and Measure N _ $26 million for National School District. Lakeside Union School District’s $31 million bond measure passed, but nearly half will be used to fund “hand-held devices, technology systems, and software.”

Don’t expect a slowdown in political fundraising, as the 2016 elections are right around the corner. With the balance of power in the City of San Diego potentially shifting to the pro-economic development side, and the possibility of infrastructure funding proposals on the November 2016 ballot, the construction industry will have to step up to the plate.

The Labor Relations Committee is responsible for members’ labor relations (both open shop and union). This includes agreements for union members and general labor relations for open shop members. The committee is responsible for AGC participation on the various Taft Hartley Fringe Funds, and the various Joint Apprenticeship and Training Committees.

All AGC Master Labor Agreements (MLA) and wage/fringe information are available on the AGC San Diego website. All contracts are indexed to assist in finding key provisions. MLAs can be downloaded per page or as a complete document.

A number of unions continue to target both AGC union and non-union members with picketing and demonstrations. AGC staff assists members with dual gates and other methods that eliminate or limit the picketing. AGC staff visited projects, contacted unions, and gave direct “front line” help with these situations.

AGC provided assistance with Prevailing Wage/Davis Bacon compliance and interpretation throughout the year. Several AGC staff members have strong backgrounds and understanding of these very complex and often confusing laws. AGC also maintains a strong relationship with the Department of Industrial Relations, which oversees the prevailing wage laws.

AGC ASSISTS MEMBERS WITH PICKETING / DUAL GATE

In labor negotiations, AGC represented members that are signatory to the Collective Bargaining Agreement between the AGC and Operating Engineers Local #12. All other agreements between the AGC and various crafts did not expire in 2014. The agreements that AGC negotiates for its signatory members are recognized as the Master Labor Agreements in San Diego County. The agreements are used to establish the State of California Prevailing Wage and the Federal Davis-Bacon rates for each craft.

AGC represented members on a number of Taft Hartley joint labor management health, pension, apprenticeship, and other trusts that are part of the union collective bargaining agreements. Most of these trusts are facing challenging economic conditions, and AGC works with the trustees to ensure proper funding. AGC was successful in working with AGC of America and the Building Trades to pass federal legislation improving the stability of multi-employer pension trusts. These changes prevent pension trusts from insolvency and taxpayer bailout, while reducing liabilities to contractors.

In 2014, AGC’s Apprenticeship and Training Trust graduated 113 apprentices. Since 1988, the Trust has graduated over 1,500 apprentices into journeyman status. These graduates are working for contractors throughout Southern California, and they are an important part of the total craft worker population in this area. Over 75% of the graduates are minority or females, and they come from a wide variety of ethnic and cultural backgrounds.

AGC introduced a new Journeyman Upgrade Program on July 1, 2014. The program allows journeymen from AGC Apprenticeship member contractors to enroll in a number of training and upgrade courses to increase their industry knowledge, increase their value to the contractor, and further their careers in the construction industry. There is no cost to the journeyman or contractor to take these courses.

The San Diego AGC Apprenticeship & Training Trust is designed to meet the needs of AGC members who are interested in providing training and education for their jobsite apprentice employees. The program trains open shop employees in carpentry, cement masonry, drywall finishing, drywall lathing, laborers, painting, and heavy equipment operating. The program is approved by the State of California Department of Industrial Relations, the Division of Apprenticeship Standards, and by the Federal Department of Labor. Apprentices graduate in 3-4 years and are certified by the AGC, the State of California, and the US Department of Labor. The completion certificates are recognized throughout the nation as valid indicators that an apprentice has completed training that meets the industry’s standards of occupational proficiency.

The Alliance adopted Monarch School, a public school located downtown serving students who are impacted by homelessness. Volunteers from AGC member firm Hensel Phelps helped 8th grade students build five park benches to enhance the school. In addition, AGC member firms generously donated over $9,000 toward the “Back to School Backpack Project,” which provided 300 backpacks filled with the necessary school supplies.

The Alliance joined forces with the AGC Meetings & Events Committee to collect hundreds of toys at AGC’s Annual Holiday Dinner Dance. Children at Rady’s Children’s Hospital, Polinsky Children’s Center, and Ronald McDonald House benefit from this 35-year tradition.

The Alliance hosted Operation Keep San Diego Warm by collecting barrels of blankets, throws, comforters, and coats from many generous AGC members, which was donated to St. Vincent de Paul Village, Southern California’s largest residential homeless service provider. In addition, a toiletry drive was included to help benefit the children residing at Polinsky Children’s Center, a temporary emergency shelter for children who must be separated from their families for their own safety.

The Boy Scout Lunch-O-Ree is an annual fundraiser to benefit the Boy Scouts of America. Each year, a local honoree in the community is selected, and this year the “Good Scout of the Year Honoree” was Don Adair of Swinerton Builders. The committee assisted in this effort to raise $157,500 for the Boy Scouts. Since 2006, the construction industry has helped raise $1,147,830.

The Build & Serve Charitable Alliance provides a venue for AGC members to “give back” to the community. This committee selects charitable projects and programs throughout San Diego County that provide AGC and its members an opportunity to help “build” and “serve” the community.

THE STANLEY E. FOSTER SCHOOL OF ENGINEERING, INNOVATION & DESIGN Thirteen years ago, AGC worked with San Diego Unified School District to create a “school within a school,” now called the Stanley E. Foster School of Engineering, Innovation and Design (EID) - formally Construction Tech Academy. Over 1,000 graduates are either going into an apprenticeship program to pursue craftworker careers, or on to SDSU to study Construction Engineering and Management. AGC also sponsors an extensive Summer Jobs Program for EID students.

AGC OR UNION APPRENTICESHIP PROGRAMS & AGC JOURNEYMEN UPGRADE PROGRAMAGC’s Apprenticeship and Training Trust is the largest open-shop Training Trust in the United States. Nearly 1,000 students take advantage of the free training the Trust provides each year. In addition, AGC supports and participates in a number of union craft apprenticeship programs. Nearly all AGC Education and Safety Training courses are now offered free of charge to eligible journeymen as part of the AGC Journeyman Upgrade Program (detailed on page 10).

SAN DIEGO STATE UNIVERSITY CONSTRUCTION ENGINEERING AND MANAGEMENT PROGRAMStudents who would like to pursue a university degree have the opportunity to attend the J.R. Filanc Construction Engineering and Management Program at San Diego State University. This program was formed with over $5 million in donations from the AGC San Diego membership.

AGC SCHOLARSHIP PROGRAMAGC provides a full four-year tuition scholarship for deserving students graduating from the Stanley E. Foster School of Engineering, Innovation and Design (EID) who are accepted into the J.R. Filanc Construction Engineering & Management Program (CEM) at San Diego State University (SDSU). The program also provides a full scholarship for EID students who attend a local community college, and plan on transferring to SDSU’s CEM program.

AGC SAN DIEGO’S CONTINUING EDUCATION PROGRAMAGC San Diego, in its state-of-the-art educational facility, offers continuing education opportunities to the industry on a year-round basis. Each year, the AGC Education and Training Committee issues two catalogs of courses that include 8-10 classes per month. Learning is a life-long process, and AGC San Diego understands its obligation to ensure that its members have every opportunity to continue their education and pursue professional development.

In 2007, the Committee and the AGC Board of Directors unveiled a multi-million dollar renovation of the C.W. BURKE San Diego AGC Building. The result is a state-of-the-art construction education facility that includes outstanding classrooms, and the most up-to-date teaching equipment available. Most days, the classrooms are used beginning at 6:30 a.m. and throughout the day, for continuing construction education classes that range from construction-oriented computer classes, to NAVFAC CQM and EM 385 classes, to high-end complex safety classes. Beginning at about 4:00 p.m. each day, the facility is turned over to the AGC Apprenticeship and Training Trust, which conducts both classroom and hands-on classes until 9:00 p.m.

In addition, AGC’s Apprenticeship Program provides training in the 10,000 sq. ft. annex across the street from the AGC building; in the 25,000 sq. ft. facility the Program owns in Riverside; in the 12,000 sq. ft. training facility in Orange County; and on two multi- acre sites in Riverside and San Diego that provide hands-on training for horizontal construction and training in the AGC heavy equipment program.

SAN DIEGOCONSTRUCTION LEADERSHIP COUNCIL

The AGC San Diego Construction Leadership Council (CLC) encourages a higher level of involvement in the AGC, creates and promotes industry innovations, fosters face-to-face collaboration among early- to mid-career professionals, addresses important industry issues and concerns, and provides crucial feedback to the AGC San Diego leadership, which will help to structure the AGC of the 21st century. The CLC is part of the nationwide AGC organization that provides an open forum for early- to mid-career construction professionals to receive training, network, socialize with peers, and exchange ideas on special issues facing the construction industry.

The CLC offers young members exposure to other professionals within the industry, provides opportunities to augment their education through relevant programs, and assists in developing strong leaders for the association and the industry as a whole. AGC Fringe Benefits Programs are provided through three professionally administered trust funds. Trustees are AGC members who have the responsibility to oversee the administration and management of the funds. The funds provide health & welfare, dental, vision, insurance, and pension benefits that are customized to the San Diego construction industry. During 2014, the AGC San Diego Chapter offered four programs under its Employee Medical Plan. These programs ranged from basic to comprehensive coverage. AGC San Diego Chapter’s Benefits Plus Plan offers a comprehensive menu of benefits tailored to meet the needs of AGC Contractor and Affiliate members. The Benefits Plus provides exceptional coverage that includes low-cost HMO to a benefit point-of-service option. The plan also makes available five different plans: dental, vision, chiropractic, life, and dependent care coverage.

AGC San Diego Chapter’s Employee Pension Plan offers a fully IRS-approved, bona fide master pension plan that provides significant benefits for AGC Contractors and Affiliate firms. The plan can be customized for hourly contributions that meet California Prevailing Wage and Federal Davis Bacon requirements.

In 2003, the AGC Employee Pension Plan added a group 401(k) Retirement Plan designed specifically to include prevailing-wage employer contributions. The plan provides AGC firms and their employees outstanding flexibility, while keeping the administrative overhead to the absolute minimum.

The AGC Human Resource Practices Committee is a resource and forum for human resource professionals and others with Human Resource (HR) responsibility in their AGC member firms. The committee meets on a regular basis, and shares HR legal and other

developments, and invites guest speakers to address the critical HR issues. Highlights during the year 2014 included a seminar by the Division of Labor Standards Enforcement, and discussion of “hot” topics, such as heat illness prevention legislation, hiring and recruiting, Medicare D, minimum wage increase, and paid sick leave.

State legislation was passed and signed into law requiring employers to provide a minimum of three paid sick days per year to all employees. AGC will monitor the impact of AB 1522 and will hold a workshop in 2015 to look at the implications for AGC members.

AGC Industry Relations Liaison Committees meet regularly with officials from the County & City of San Diego; Naval Facilities Engineering Command, Southwest Division; Caltrans District 11; the Airport Authority; the Port District; County Water Authority; the San Diego Unified School District (Public Building Committee); and other public entities as needed. The meetings focus on solving the day-to-day challenges faced on construction sites. Topics include, but are not limited to: bidding practices, specification content, project delivery systems, payment schedules, inspector methods, change order procedures, contracts, etc. Public entities are typically represented by those officials involved in “doing the work.” AGC’s Industry Relations efforts ensure an open line of communication between these officials and the industry.

The California Department of General Services has designated the AGC’s Good Faith Report as a state-approved “Trade” & “Focus” publication. Advertising in this digital publication will fulfill requirements for “Good Faith Efforts” for the various Business Enterprises. The AGC’s Good Faith Report is one of the few publications in the state to be designated in this manner.

AGC MEMBERS RECEIVE ONLINE PLAN ROOM - INCLUDING PUBLIC & PRIVATE SECTOR PROJECTSThe AGC Online Plan Room service is a unique service offered to all AGC members as part of their membership. AGC’s professional reporting staff provides the best information in Southern California. Members have complete access to projects, including plans and specifications, that are out for bid or negotiation in San Diego, Orange, Riverside, San Bernardino, and Imperial counties, and areas within other Southern California counties. In addition, members are able to view and purchase plans and specifications for projects from nearly 30 other plan rooms in California and nearby states. This is an outstanding benefit to AGC members that usually sells for up to $2,500 per subscriber with other providers.

The AGC Online Plan Room continues to be an extremely valuable benefit for the AGC membership, with over 2,000 individuals accessing it annually.

During 2014, hundreds of safety training professionals attended AGC Safety classes. The classes included NAVFAC required EM385-1-1 40-hour course.

The Safety Committee is one of the few AGC Chapter Safety Committees that writes its own newsletter. This biannual publication contains a wealth of relevant material.

On the first Wednesday of most months, an AGC Safety Committee meeting is “the place” to be for construction safety professionals. Over 100 area safety professionals serve on this committee.

AGC’s Construction Safety Excellence Awards (CSEA) program is the industry’s elite safety competition. CSEA is a rigorous competition that recognizes construction firms that have developed and implemented premier safety and loss prevention programs. AGC San Diego Chapter has been known as the CSEA superstar, with multiple high-ranking finishes each year. The committee holds bimonthly meetings that allow the information technology management staff from AGC member firms to network. During each meeting, the committee has a highly active and informative roundtable discussion where numerous topics are discussed, new technologies are highlighted, and technological resolutions are found, making this a great resource for IT professionals.

During 2014, the committee organized the largest construction technology event in Southern California. Over 1,000 attended the event, which included 60 exhibits, all displaying the latest technology available to the construction industry. In this capacity, the committee will be charged with researching new and better means and methods that will help the industry now and in the future.

The committee is charged with utilizing the information generated to develop training and educational programs that will allow members to view new technologies and to be trained in their usage.

Jim is the Staff Chief Executive, and is responsible for implementing and administering the association’s policies and programs. His experience includes four years as Labor Relations Director for the Iowa Chapter AGC and ten years as the Chapter’s EVP. His experience also includes seven years experience as Vice President of an ENR Top 150 construction firm. He provides direct staff support for the AGC Executive Committee, the Board of Directors, the Labor Relations Committee, the General Building Contractors’ Council, and AGC Fringe Benefit Funds. Jim has a B.A. degree and an M.B.A. degree.

Brad is responsible for staffing AGC’s local government relations efforts, acting as staff liaison with AGC’s lobbying effort in the State Legislature and with the AGC of America in Congress. He also has staff responsibility for AGC’s Government Relations Committee and Political Action Committee, and various Industry Relations Liaison Committees. Brad has a B.A. degree.

Dave is responsible for representing AGC in the State Legislature and at the Governor’s Office. He presents AGC of San Diego and AGC California’s positions throughout the year to ensure that the industry’s voice is heard on all key issues. He is responsible for working as a liaison with other statewide business associations. He works closely with Brad Barnum, and AGC’s Government Relations Committee.

RaeMarie provides administrative support to the Vice President Government Relations, Director of Engineering Construction & Industry Relations and the Safety Director. She assists with the eight liaison committees and fundraising efforts of the Infrastructure Political Action Committee. In addition, she also provides administrative support for the Meetings and Events department. She is also responsible for the collection and entry of all bid results for the AGC Online Plan Room.

Glenn functions as the chief executive officer of the apprenticeship program, and under the guidance of the board of trustees. Glenn is responsible for running all aspects of the program including education, strategic planning, government relations, administrative and field operations, and fiscal responsibility.

Jack is responsible for curriculum development and all aspects of education for apprentices, including course curriculum, textbook development, training materials and projects, and certifications. Jack also works with instructors to supplement their teaching skills, assists in development of journey level upgrade courses, as well as numerous outreach efforts with local schools.

Phil is responsible for maintaining and managing the Accounting Records for the AGC and Plan Room. He conducts financial analysis and performance reviews for all departments with the association. He also prepares all monthly and annual financial statements for presentation to the AGC Board of Directors. Phil has a B.S. degree and an M.B.A. degree from SDSU.

Vince is owner and CEO of SMART Safety Group an environmental, health and safety service provider. He represents AGC at a local and national level in regards to industry safety. His responsibilities include staffing AGC’s safety efforts, creating and presenting safety training programs, acting as liaison to the Safety Committee, and answers safety questions for the industry partners that come to AGC for assistance. Vince has over fifteen years of comprehensive safety experience, a B.S. in Occupational Safety, a M.S. in Industrial Hygiene, and is a Certified Safety Professional (CSP).

Shari is responsible for all communication with the State Division of Apprenticeship Standards and the Federal Office of Apprenticeship regarding enrollment, cancellations, nd graduation of apprentices. She also is responsible for assisting in AGC’s marketing efforts and heads up AGC’s Human Resource functions. Rae has over 30 years of construction industry experience.

Marcy is instrumental in the day-to-day operations of AGC. Marcy has a B.S. degree from SDSU.

Jessica is responsible for the branding, design and production of all communications and publications produced by the Chapter, including the AGCSD website and representation within social media. Jessica serves as the staff liaison for the Technology Trends in Construction Committee and co-staffs the Construction Leadership Council (CLC).

Eddie is responsible for representing the engineering construction industry to owners and agencies that build the region’s horizontal/underground infrastructure. Additionally, Eddie assists the Chief Executive Officer with a variety of Labor Relations issues. Eddie has a B.A. in Economics, and a Minor in Political Science from U.C. Davis.

During 2014, AGC developed a strategic plan that charts the Association’s course for the next 3-5 years. The chair of the process was 2014 AGC President, Brian Jordan, Helix Electric, Inc. This plan continues the detailed planning the AGC conducted with strategic plans developed in 2002 by Chair Ted Rossin, Rossin Steel, Inc.; in 2006 by Chair Thomas L. Brown, Sierra Pacific West, Inc.; and in 2009 by Chair Kevin Elliott, J.R. Filanc Construction Company, Inc.
