The Nitty Grittys Agreement:ThisWeddingPhotographyAgreement(referredtointheremainderofthisdocumentastheAgreement) containstheentireunderstandingbetweenAmandaMaePhotographyDesignandtheClient.Itsupersedes allpriorandsimultaneousagreementsbetweentheparties.

Reservation:AsignedAgreementanda50%ReservationFeearerequiredtoreservethespecifiedcoverage.

Consultation:Thepartiesagreetoapre-eventconsultation,whichcanbeinperson,viaemailoroverthetelephone, twotothreeweeksbeforetheeventdateinordertofinalizetheactualshootingtimes,locations,andClient’s requestlist(inwriting)forspecificPhotographs,andapost-eventreviewsessiontwotothreeweeksafterthe eventdate.Thebrideand/orgroomagreestosetasideaminimumofonehouroftimethatendsatleasthalfan hourbeforetheceremonycommencementoftheweddinganda30-minutetimeframeafterwardforphotographs thatcannotbeobtainedduringthewedding.Ifthebride’sorgroom’slatearrivalpreventsafullhourfromoccurring, thephotographershallnotbeheldliableforfailuretotakedesiredphotographs.

Cooperation:Thepartiesagreetocheerfulcooperationandcommunicationforthebestpossibleresultwithinthe definitionofthisassignment.AmandaMaePhotographyDesignrecommendsthatClientdesignatean“event guide”topointoutimportantindividualsforinformalorcandidphotographstothephotographerduringthe weddingthattheywishtohavephotographed.Thephotographerwillnotbeheldaccountablefornotphotographing desiredpeopleifthereisnoonetoassistinidentifyingpeopleorgatheringpeopleforphotographs.AmandaMae PhotographyDesignisnotresponsibleifkeyindividualsfailtoappearorcooperateduringphotographysessionsor formissedPhotographsduetodetailsnotrevealedtoAmandaMaePhotographyDesign.

House Rules:Thephotographerislimitedbytheguidelinesoftheceremonyofficialorreceptionsitemanagement. Clientagreestoacceptthetechnicalresultsoftheirimpositiononthephotographer.Negotiationwiththeofficials formoderationofguidelinesisClient’sresponsibility;AmandaMaePhotographyDesignwilloffertechnical recommendationsonly.

Photograph Copyrights: Untilfinalpaymentforservicesrenderedismade,thephotographsproducedbyAmanda MaePhotographyDesignareprotectedbyFederalCopyrightLaw(allrightsreserved)andmaynotbereproduced inanymannerwithoutwrittenpermission.UponfinalpaymentbytheClient,limitedcopyrightownershipofthe PhotographswillbetransferredtotheClientunderthefollowingconditions:

ThePhotographsarethepropertyofClientforpersonaluseandforthepurposesofthereproductionandgiftingof thePhotographstofriendsandrelatives.

TheClientmustobtainwrittenpermissionfromandcompensateAmandaMaePhotographyDesignpriortothe Clientoritsfriendsandrelativespublishingorsellingthephotographsforprofit.

Model Release and Exhibition: ClientagreesthatAmandaMaePhotographyDesign,itslicensees,orassigneescan usethePhotographseitherseparatelyortogether,eitherwhollyorinpart,inanywayandinanymediumatany time,foranypurpose,includingadvertising.Clientwaivesallrightstoclaimsfordefamation,violationofrights ofprivacy,andpublicity,withoutlimitation.AmandaMaePhotographyDesign,itslicensees,orassigneesmayalter orretouchanyofthePhotographswithoutClient’spermission,priorapproval,orconsent.Clientfurtheragrees thatthePhotographsandanyreproductionsshallbedeemedtorepresentanimaginaryperson,andthatAmanda MaePhotographyDesignoranypersonorpersonsauthorizedbyoractingonitsbehalfmayusethePhotographsor anyreproductionsofthemforanyadvertisingpurposesorforthepurposeofillustratinganywording.Clientunder standsandagreesthatnosuchwordingshallbeconsideredtobeattributedtoClientpersonallyunlessClient’s nameisused.ProvidedClient’snameisnotmentionedinconnectionwithanyotherstatementorwordingwhich maybeattributedtoClient,Clientundertakesnottoprosecuteortoinstituteproceedings,claimsordemands againsteitherAmandaMaePhotographyDesignoritsagentsinrespectofanyusageofthePhotographs.

Limit of Liability:Intheunlikelyeventthatthephotographerisinjuredorbecomestooilltophotographtheevent, AmandaMaePhotographyDesignwillmakeeveryefforttosecureareplacementphotographer.Ifthesituation shouldoccurandasuitablereplacementisnotfound,responsibilityandliabilityislimitedtothereturnofall paymentsreceivedfortheeventpackage.AmandaMaePhotographyDesigntakestheutmostcarewithrespectto exposure,transportation,andprocessingthephotographs.However,intheunlikelyeventthatthePhotographs havebeenlost,stolen,ordestroyedforreasonswithinorbeyondAmandaMaePhotographyDesign’scontrol, liabilityislimitedtothereturnofallpaymentsreceivedfortheeventpackage.Thelimitofliabilityforapartialloss oforiginalsshallbeaproratedamountoftheexposureslostbasedonthepercentageoftotalnumberoforiginals.

Reservation Fee:Intheeventofcancellation,the50%ReservationFeepaidisnonrefundable.

Completion Schedule:OnlineProofingGalleryandCDcreationtakesapproximatelyfourtoeightweeksfromtime ofweddingorfromtimeofclientproofingavailabilityorpost-weddingconsultationmeetingifClientdesiresa post-weddingconsultation.

Payment Schedule: 50%dueattimeofsigningoftheAgreement.Balancepayableinfullonorbeforethewedding day.Ifbalanceisnotpaidbythebeginningoftheweddingday,photographyserviceswillnotberendered.
