    THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACTAPPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATIONSYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM)

    PERMITSThis notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM

    permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under ageneral permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste,discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwaterassociated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided inaccordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P.     For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made atentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reportingrequirements in their current permits, with appropriate and necessary updated requirements to reflect new and changedregulations and other requirements.

    For applications for new NPDES permits and renewal applications with major changes in Section II, as well asapplications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the

  • Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations andother terms and conditions for the permit applications. These determinations are published as proposed actions forcomments prior to taking final actions.

    Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposedNPDES permit actions under the waiver provision in 40 CFR 123.24(d).

    Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office notedbefore an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permitapplication are invited to submit a statement to the regional office noted before the application within 15 days from thedate of this public notice. Comments received within the respective comment periods will be considered in the finaldeterminations regarding the applications. Comments should include the name, address and telephone number of thewriter and a concise statement to inform the Department of the exact basis of a comment and the relevant facts uponwhich it is based.

    The Department will also accept requests for a public hearing on applications. A public hearing may be held if theresponsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will bepublished in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. TheDepartment will postpone its final determination until after a public hearing is held.

The nearest downstream public water supply intake for SaxtonMunicipal Water Authority is located on the Raystown Branch Juniata River, approximately 78 miles downstream. Persons intending touse the Background Standard, Statewide Health Stan-dard, the Site-Specific Standard or who intend to remedi-ate a site as a special industrial area must file a Notice ofIntent to Remediate with the Department. The totalcombined VOC and HAP emissions from the proposedspray booth and existing spray booth will be restricted to2.7 tons and 1 ton in any 12-consecutive month period,respectively.

    The review of the information provided by ColumbiaIndustries’ application indicates that the proposed sourcewill comply with all air quality requirements, includingthe best available technology (BAT) requirements of 25Pa. Code §§ 127.1 and 127.12, pertaining to air contami-nation sources and the emission of air contaminants. Theproposed source will also comply with the applicablerequirements of 40 CFR Part 60, Subpart MM (Standardsof Performance for Automobile and Light Duty TruckSurface Coating Operations) 60.390—60.398. Based onthis finding, the Department of Environmental Protection

  • (Department) intends to issue a plan approval for theconstruction and operation of a spray booth. Additionally,if the Department determines that the source is operatingin compliance with the plan approval conditions, theconditions established in the plan approval will be incor-porated into an operating permit via an administrativeamendment under 25 Pa. Code § 127.450. The followingis a summary of the conditions that the Departmentproposes to place in the plan approval to ensure compli-ance with all applicable regulatory requirements.

    1. The spray booth is subject to 40 CFR Part 60,Subpart MM. The permittee shall comply with all appli-cable requirements specified in 40 CFR 60.390—60.398.

    2. Under BAT in 25 Pa. Code §§ 127.1 and 127.12, noperson may permit the emissions of PM from the exhaustof the spray booth into the outdoor atmosphere in amanner that the concentration in the effluent gas exceeds0.01 grain per dry standard cubic foot. Compliance withthis requirement also assures compliance with the PMemission limitation in 25 Pa. Code § 123.13.

    3. Under BAT in 25 Pa. Code §§ 127.1 and 127.12, thetotal combined VOC emissions from the existing spraybooth and the new spray booth shall not exceed 2.7 tonsin any 12-consecutive month period.

    4. Under BAT in 25 Pa. Code §§ 127.1 and 127.12, thetotal combined HAP emissions from the existing spraybooth and the new spray booth shall not exceed 1 ton inany 12-consecutive month period.

    5. Under 40 CFR Part 60, 60.392, the VOC content ofthe prime coats, guide coats and top coats, as applied inthe new spray booth, shall not exceed 0.10, 0.82 and 0.86pound per gallon of coating solids, respectively, on amonthly average.

    6. The permittee shall keep records of the supportingcalculations for VOC and HAP emissions from the spraybooths on a monthly basis and shall verify compliancewith the VOC and HAP emission limitations in any12-consecutive month period. These records shall beretained for a minimum of 5 years and shall be madeavailable to the Department upon request.

    7. The permittee shall keep up-to-date records of Certi-fied Product Data Sheets that identify the VOC contentand HAP content of each VOC and/or HAP containingmaterial used in the existing and new spray booths.These records shall be retained for a minimum of 5 yearsand shall be made available to the Department uponrequest.

    8. The permittee shall keep records of the supportingcalculations for VOC content for the coatings used in thenew spray booth on a monthly basis and shall verifycompliance with the VOC content restrictions for eachcoating type on a monthly basis. These records shall beretained for a minimum of 5 years and shall be madeavailable to the Department upon request. Compliancewith this requirement assures compliance with therecordkeeping requirements in 40 CFR 60.395.

    9. The permittee shall submit reports to the Depart-ment on an annual basis that include the supportingcalculations used to verify compliance with the VOC andHAP emission limitations for the existing spray booth andnew spray booth in any 12-consecutive month period. Theannual reports shall be submitted to the Department nolater than March 1, for January 1 through December 31of the previous year.

    10. The permittee shall submit reports to the Depart-ment on a semi-annual basis that include the supporting

    calculations used to verify compliance with the VOCcontent restrictions for each coating type used in the newspray booth on a monthly basis. The semi-annual reportsshall be submitted to the Department no later thanMarch 1 (for January 1 through December 31 of theprevious year) and September 1 (for July 1 of theprevious year through June 30 of the current year).Should the records from any month show that one ormore of the VOC content restrictions have been exceeded,the permittee shall submit the reports to the Departmentno later than 30 days following the end of the month.Compliance with this requirement assures compliancewith the reporting requirements in 40 CFR 60.395.

    11. Under BAT in 25 Pa. Code §§ 127.1 and 127.12, thepermittee shall not operate the new spray booth unlessthe booth is equipped with filters that provide at least98% capture efficiency of PM. The PM emissions from thenew spray booth shall be controlled by filters.

    12. Under BAT in 25 Pa. Code §§ 127.1 and 127.12,the permittee shall only use electrostatic coating technol-ogy in the new spray booth. The new spray booth is anin-house manufactured spray booth, rated at 6,000 actualcubic feet of air per minute. The spray booth is use tocoat light-duty truck bodies.
