Defendant had presented numerous sworn statementsfrom'at least 12 individuals, and items of evidence requesting the recusal of Judge Clarence Cooper and requesting the removal of counsel for conflicts of interest relating to one or more judges i n the record of this case. See and herein incorporate the June 13, 2011 transcript attached as Exhibit A. The recusal was requested under the authorities of 28 U.S.C. §455 and 28 U.S.C. §144 which requires: Whenever a party to any proceeding in a district court makes and files a timely and sufficient affidavit...such judge shall proceed no further therein, but another judge shall be assigned to hear such proceeding" 28 U.S.C. §144 On May 22, 2008, Defendant filed a Motion for Recusal and a Motion to Stay Pending Resolution of Recusal (doc.258) . In c l e a r e r r o r , with p r e j u d i c e to t h i s Defendant, and i n

v i o l a t i o n o f v a r i o u s laws and the U.S. C o n s t i t u t i o n , Judge Clarence

Cooper f a i l e d t o f o l l o w U n i t e d States Code mandates t h a t r e q u i r e d

He has also read several 23 a f f i d a v i t s , including'some that were from people that alleged 24 to have, ex parte qommunicatiphs with you. 1 outside, the fact that he's an o f f i c e r of t h i s court makes him 2 i n a very c o n f l i c t e d po&ition because he has to practice law 3 before you. From what',I understand he said that he's working 4 on a death penalty case 'with you. 5 And a Mr. Jerry Froelich we talked about and he said 6- i t appears that Mr. Froelich i s working hand i n glove with the 7 government and there v!3^s"'ec subpoena order that appears to have 8 come from you. Your Honor, i n regards to t h i s case and 9 Mr, Mendelsohn has agreed he,has no idea how i t could l e g a l l y

10 have been issued to Mr. Jerry' Froelich. I t i s i n the record 11 and he doesn't want to ask the government or you. Your Honor, 12 how that appeared to occur, even though we've agreed that i t 13 doesn't look l i k e i t couldhave been l e g a l l y done. 14 And because ,of his p o s i t i o n as a member of the bar of 15 the state of Georgia he feels uncomfortable and he said that 16 l i k e l y any attorney that: .has to practice before you or 17 Magistrate Judge Baverman would probably be c o n f l i c t e d to the 18 point where they wouldn't, be able to defend these positions. 19 A d d i t i o n a l l y , some of. the f i l i n g s that were brought 20 i n t o the record were f i l i n g s that,he refused to do because they 21 showed a f i n a n c i a l l i n k ^ w i t h i n the t h i r d degree of family to 22 one or more judges i n the^record of t h i s case. And, again, he 23 s a i d that even though-these things are true, and I understand 2 4 that the Supreme Court and the. Eleventh C i r c u i t says that 25 a l l e g a t i o n s contained dm a f f i d a v i t s must be considered as true.

1 i t appears that these -.tiave been completely ignored to date. 2 And one of; the.things in. p a r t i c u l a r was a sworn 3 statement that stated- that Judge Cooper was witnessed as having 4 ex parte communications regards to the m i l l i o n d o l l a r s worth of 5 property that U.S. Magistrate Judge Alan Baverman's family took 6 from me. And t h i s was a sworn statement and i t was witnessed, 7 i t s p e c i f i c a l l y witnessed'you. Your Honor, with Mark Kadish. 8 And a d d i t i o n a l l y there was another a f f i d a v i t that t a l k s 9 about —

10 THE COURT: Mr..' Hintz, I t o l d you I didn't want to 11 get into extraneous matters. 12 THE DEFENDANT:, S i r , I'm t r y i n g to l i m i t i t to 13 j u s t things — 14 THE COURT:, You're going into other things. Is there 15 anything else you might want to say regarding his 16 representation of you with respect, to the pending p e t i t i o n to 17 revoke your supervised release? There's 8 a matter he brought up that I'm t o t a l l y unfamiliar with, i t has 9 to do with a subpoena to Mr'.'Froelich that he's t a l k i n g about. 10 MR. MENDELSOHN: Well, i n the discovery, Judge, there 11 was a — some records from. F i f t h Third Bank that were provided 12 to us from the probatipn'officer. The return on the records 13 were from a subpoena that;were returnable to Mr. Froelich about 14 Mr. Hintz. ~. :,, 15 We don't know where?'that subpoena came from. with Mr. Hintz. The government is not present at this

time.

We are scheduled to hold a preliminary hearing on

the supervised release petition.

Mr. Mendelsohn, Ms. Wade-Childs advises me that

there i s a matter that you wanted to bring to my attention

before we conducted the hearing?

MR. MENDELSOHN: Yes, thank you. Judge.

Mr. Hintz and I have had plenty of discussions

about this case and the direction that we think i t should go,

and are at crossroads i n direction particularly in regard to

a matter,

Mr. Hintz wishes that I c a l l a particular witness,

Mr. Froelich, who has been here watching this and represents

individuals -- an individual i n a c i v i l proceeding, and

Mr. Froelich has provided a letter to Ms. Moore making

allegations against Mr. Hintz that

THE DEFENDANT: His statements of fact, his

MR. MENDELSOHN: Right. And SO Mr. Hintz wishes

that I c a l l Mr. Froelich. I do not wish to do that, and at

that point Mr. Hintz wishes to go pro se on that piece.

THE COURT: Now, Mr. Hintz, you understand this i s

not the -- the hearing --

THE DEPENDANT: Yes, ma'am.

THE COURT: --on this particular -- s i t down.

THE DEFENDANT: I didn't know i f I had to Stand

when I talked.

THE COURT: No.

This i s not the hearing.

THE DEFENDANT: Yes, ma'am, I understand that.

THE COURT: You are not -- and the government has

only got to present probable cause, you know, enough

information to get this matter carried over to the d i s t r i c t

judge on just one, any one of the allegations.

THE DEFENDANT: Yes, ma'am, I understand that.

THE COURT: Okay, I am not going to conduct a

full-fledged hearing

THE DEFENDANT: Yes, ma'am, I do understand that,

THE COURT: --on this matter.

I'm basically -- and I'm not going to get into a

drawn-out lengthy argument or hearing on attorney-client

privilege or anything of that sort. I guess I could only

caution you that i f Mr. Mendelsohn Mr. Mendelsohn may have

very -- and he's probably discussed this with you that

there may be very l i t t l e benefit, i f there are some matters

that you might more effectively present i n front of

Judge Cooper, than giving up -- I don't know.

I mean, Mr. Mendelsohn, I don't know a l l the

details of why, besides just the very things that come to

mind about c a l l i n g an attorney.

But I am not inclined, Mr. Hintz, to allow you to

proceed pro se and c a l l Mr. Froelich and go off into matters

that I'm sure Mr. Mendelsohn probably has very good reasons

for not doing at a preliminary hearing.

This i s not the hearing on this, do you

understand? That's going to be i n front of Judge Cooper in a

week or so.

THE DEFENDANT: Yes, ma'am.

Ma'am, may I ask a question?

THE COURT: Yes.

THE DEFENDANT:, Ma'am, the specific questions,

without going into details, relate to probable cause.

Mr. Froelich, i n his personal capacity and from

what he states i s his personal knowledge i n statement of

facts, his statement of facts or alleged facts is part of the

probable cause.

And this i s the only reason I wanted to question

him, because i t could provide exculpatory evidence for

me. That's the only reason.

THE COURT: I am I mean, I'm sure

Mr. Mendelsohn i s aware of a l l of that and probably has

some very sound reasons for not doing that at this stage

and potentially harming your presentation i n front of

Judge Cooper. That's the judge that's going to ultimately

decide.

There i s very, very l i t t l e chance that I am

not going to send this to Judge Cooper. I mean, the

government would have to basically have no evidence to

present on a claim. This i s Judge Cooper's decision

ultimately.

THE DEFENDANT; If I could

THE COURT: I think the best thing for me to do is

to hear the government's presentation and see whether -- then

perhaps hear from you.

But I'm just not inclined to l e t you proceed

pro se.

THE DEFENDANT: Well, ma'am

THE COURT: That's just not a wise decision. I'm

just going to t e l l you, i t ' s not a wise decision.

THE DEFENDANT: Ma'am, could we go on the record

and state that I was --

THE COURT: Oh, you,are on the record.

THE DEFENDANT: Okay, we are on the record?

THE COURT: Oh, yes. I don't do anything in court

when I'm not on the record.

THE DEFENDANT: That's great.

The one concern I have, ma'am, i s Mr. Mendelsohn

and I have spoke, and you are probably aware of some of the

motions for recusal before this Court.

THE COURT: I have no idea about anything that's

going on except for this.

, THE DEFENDANT: Well, ma'am --

THE COURT: So that's a l l I'm dealing with.

THE DEFENDANT: Yes, ma'am. The reason -- and I

have f a i t h i n my attorney here, complete f a i t h in him, with

the exception of one matter.

And that matter i s we discussed that he, as a

practicing attorney, has to preserve his career and his

career interests here in this thing, and bringing up things

against any kind of judge or any kind of significant attorney

in this town would be not really in his best career

interest.

That's the only reason I have --

THE COURT; Knowing Mr.' Mendelsohn, I have never

seen him put personal interest in front of the interest of

his clients ever, and I can't imagine that's impacting his

decision-making. I just -- I would be shocked.

THE DEFENDANT: Well, I mean, you w i l l admit that

we have had those conversations and that they have been

troublesome for the two of us; correct?

MR. MENDELSOHN: It is true. Judge, there - - i n

Mr. Hintz's 2255 that's s t i l l pending before Judge Cooper,

there was a motion to recuse Judge Cooper that's never been

ruled on, and the 2255 has never been ruled on.

You know, down the road there may be an issue where

Mr. Hintz wants me to push for a recusal issue that I don't

feel l i k e i t ' s appropriate to move forward on. But that's

not the issue that we have before us right now.

THE COURT: No, that's not okay. I mean,

so this i s a l l whether or not;to c a l l you to c a l l a

witness.

MR. MENDELSOHN: Right. And, Judge, what I would

li k e to do --

THE COURT: Okay.

MR. MENDELSOHN: -- is go forward with the

hearing, but do the hearing that I would intend to do, and

then at the end i f Mr. Hintz is s t i l l insistent that we c a l l

Mr. Froelich and i f we are going back i n to where we are

now -- , J

THE COURT: Okay, I was kind of -- that's kind of

my thought processes: Conduct the hearing, and then let you

and Mr. Hintz have a consultation, and i f there i s an issue

at that point we can r e v i s i t this.

THE DEFEITOANT: That's very f a i r , ma'am.

And I realize you don't know a l l the facts, and

I appreciate your candor and, you know, you listening to

me.

Again, I'm not trying to do anything that isn't

appropriate. I just want to defend my constitutional rights,

that's a l l .

THE COURT: I understand. The flavor of this

hearing i s just very different than whatever the f i n a l

hearing i s going to be in front of Judge Cooper or anyone

else on the revocation matter; okay?

So l e t ' s conduct i t , give you and Mr. Mendelsohn a

chance to consult, and then i f you s t i l l want to press with

Mr. Froelich, then we can.r- then we can take that up; okay?

THE DEFENDANT: Sounds f a i r enough. Thank you.
