Pilotprogramm "Patent ProsecutionHighway" zwischen dem Euro-päischen Patentamt und demJapanischen Patentamt auf derGrundlage nationaler Arbeits-ergebnisse

I. Hintergrund

Das Pilotprogramm "Patent ProsecutionHighway" (PPH) zwischen dem Euro-päischen Patentamt (EPA) und demJapanischen Patentamt (JPO) auf derGrundlage nationaler Arbeitsergebnissehat am 29. Januar 2010 begonnen.

Das EPA und das JPO haben nunbeschlossen, die Teilnahmevorausset-zungen zu revidieren und den Versuchs-zeitraum für das Programm "PatentProsecution Highway" mit Wirkung vom29. Januar 2012 nochmals bis zum28. Januar 2014 zu verlängern.

Mit dem "Patent Prosecution Highway"werden die in beiden Ämtern bereitspraktizierten beschleunigten Patent-prüfungsverfahren so gebündelt, dassdie Anmelder schneller und effizienterkorrespondierende Patente erlangenkönnen. Die beiden Ämter können ihrer-seits die Arbeitsergebnisse des jeweilsanderen Amts nutzen.

Diese Mitteilung ersetzt die inABl. EPA 2010, 57 f. abgedruckteVersion.

II. Pilotprogramm "PatentProsecution Highway" zur Nutzungnationaler Arbeitsergebnissedes JPO

Im Rahmen des PPH können Anmelder,deren Patentansprüche für patentierbar/gewährbar befunden wurden, beantra-gen, dass eine bei einem PPH-Partner-amt eingereichte korrespondierendeAnmeldung beschleunigt bearbeitet wird;die beteiligten Ämter können ihrerseitsvon bereits vorliegenden Arbeitsergeb-nissen profitieren.

Wenn die EP-Anmeldung Ansprücheenthält, die für patentierbar/gewährbarbefunden wurden, kann der Anmelderbeim JPO beantragen, dass die dort ein-

I. Background

The Patent Prosecution Highway pilotprogramme (PPH) between theEuropean Patent Office (EPO) and theJapan Patent Office (JPO) based onnational work products was launchedon 29 January 2010.

The EPO and the JPO have agreed torevise the participation requirements andextend the trial period for the PatentProsecution Highway Programmeuntil 28 January 2014, with effect from29 January 2012.

The Patent Prosecution Highwayleverages fast-track patent examinationprocedures already available at bothoffices to allow applicants to obtaincorresponding patents faster and moreefficiently. It also permits each office toexploit the work previously done by theother office.

The present notice replaces thatpublished in the OJ EPO 2010, 57 f.

II. Patent Prosecution Highwaypilot programme using JPOnational work products

The PPH enables an applicant whoseclaims have been determined to bepatentable/allowable to have a corres-ponding application filed with a PPHpartner office processed in an acceler-ated manner while at the same timeallowing the offices involved to exploitavailable work results.

L'OEB et le JPO ont convenu de réviserles conditions de participation auprogramme "Patent ProsecutionHighway" et de prolonger du 29 janvier2012 au 28 janvier 2014 la périoded'essai de ce programme.

Le PPH s'appuie sur les procéduresd'examen accéléré de brevets déjàmises en œuvre dans les deux officesafin de permettre aux demandeursd'obtenir les brevets correspondantsde manière plus rapide et plus efficace.Il permet en outre à chacun des officesd'exploiter le travail déjà effectué parl'autre.

II. Programme pilote "PatentProsecution Highway" utilisantles produits résultant de travauxnationaux effectués par le JPO

Le PPH permet aux demandeurs dontles revendications sont jugées breve-tables/admissibles de faire traiterd'une manière accélérée une demandecorrespondante déposée auprès d'unoffice partenaire du PPH, tout endonnant aux offices concernés lapossibilité d'exploiter les résultats detravaux disponibles.

Lorsque la demande EP contient desrevendications considérées commebrevetables/admissibles, le demandeurpeut demander au JPO de procéder à

gereichte korrespondierende Anmeldungbeschleunigt geprüft wird. Wie die Teil-nahme am PPH-Pilotprogramm beimJPO beantragt werden kann und welcheTeilnahmevoraussetzungen zu erfüllensind, ist der JPO-Website unterwww.jpo.go.jp zu entnehmen.

Wenn die JP-Anmeldung Ansprücheenthält, die für patentierbar/gewährbarbefunden wurden, kann der Anmelderfür die beim EPA eingereichte korres-pondierende Anmeldung beim EPA dieTeilnahme am PPH-Pilotprogrammbeantragen.

Das ab 29. Januar 2012 geltende Ver-fahren und die Voraussetzung für dieBeantragung der Teilnahme am PPH-Pilotprogramm beim EPA auf derGrundlage nationaler Arbeitsergeb-nisse, die auf die Bearbeitung einernationalen Anmeldung im JPO odereiner vor dem JPO in die nationalePhase eingetretenen PCT-Anmeldungzurückgehen, werden nachstehendunter B erläutert und gelten für PPH-Anträge, die ab dem 29. Januar 2012gestellt werden.

Was die Nutzung von Arbeitsergebnis-sen aus der internationalen Phase desPCT (WO/ISA, WO/IPEA und IPER)betrifft, die vom JPO als ISA und/oderIPEA erbracht werden, wird auf dasPCT-PPH-Pilotprogramm der trilateralenÄmter verwiesen.1

A. Versuchszeitraum für das PPH-Pilotprogramm

Das PPH-Pilotprogramm mit den revi-dierten Teilnahmevoraussetzungenbeginnt am 29. Januar 2012 und läuftfür einen Zeitraum von zwei Jahren bis28. Januar 2014. Die revidierten Teil-nahmevoraussetzungen gelten fürPPH-Anträge, die ab dem 29. Januar2012 beim EPA eingereicht werden.

Die Ergebnisse werden vom EPA undvom JPO ausgewertet, die dann ent-scheiden, ob und wie das Programmnach dem Probelauf implementiertwerden soll. Bei zu hohem Aufkommen,

With effect from 29 January 2012, theprocedures and requirements for filing arequest with the EPO for participation inthe PPH pilot programme on the basisof national work products establishedduring the processing of a nationalapplication before the JPO or a PCTapplication that has entered thenational phase before the JPO areset forth below (B) and apply to PPHrequests made on or after 29 January2012.

With regard to the utilisation of PCT inter-national phase work products (WO/ISA,WO/IPEA and IPER) established by theJPO in its capacity as ISA and/or IPEA,reference is made to the Trilateral PCTPPH pilot programme1.

A. Trial period for the PPH pilotprogramme

The PPH pilot programme with therevised requirements will commence on29 January 2012, for a period of twoyears ending on 28 January 2014. Therevised requirements will apply to PPHrequests filed with the EPO on or after29 January 2012.

The EPO and the JPO will evaluate theresults of the pilot programme to deter-mine whether and how the programmeshould be fully implemented after thetrial period. The offices may also termi-

Les procédures et conditionsprécitées s'appliquent aux demandesde participation au PPH présentées àcompter du 29 janvier 2012.

En ce qui concerne l'utilisation deproduits résultant de travaux effectuéspendant la phase internationale du PCT(WO/ISA, WO/IPEA et IPER) par le JPOagissant en qualité d'ISA et/ou d'IPEA,voir le programme pilote PPH-PCT de lacoopération tripartite1.

A. Période d'essai du programmepilote PPH

Le programme pilote PPH révisédébutera le 29 janvier 2012 et seraconduit pendant une période de deuxans s'achevant le 28 janvier 2014. Lesconditions révisées s'appliqueront auxdemandes de participation au PPHdéposées à l'OEB à compter du29 janvier 2012.

aber auch aus anderen Gründen könnendie Ämter das Pilotprogramm auchvorzeitig beenden. Für den Fall, dass esvor dem 28. Januar 2014 beendet wer-den sollte, ergeht eine entsprechendeBekanntmachung.

B. Voraussetzungen für dieBeantragung einer Teilnahme amPPH-Pilotprogramm beim EPA

Eine Teilnahme am PPH-Pilotprogrammbeim EPA ist möglich, wenn folgendeVoraussetzungen erfüllt sind:

(1) Die EP-Anmeldung, für die die Teil-nahme am PPH-Pilotprogramm bean-tragt wurde, und die korrespondierendeJP-Anmeldung müssen denselbenPrioritäts-/Anmeldetag haben. Insbe-sondere ist die EP-Anmeldung (Euro-PCT-Anmeldungen eingeschlossen):

(Fall I) eine Anmeldung, die die Prioritäteiner oder mehrerer beim JPO einge-reichter Anmeldungen wirksam bean-sprucht (s. Anlage, Tabellen A, B, Cund D),

oder

(Fall II) eine Anmeldung, die einen wirk-samen Prioritätsanspruch für die beimJPO eingereichte Anmeldung begründet(s. Anlage, Tabellen E, F und G),

oder

(Fall III) eine Anmeldung, die mit derbeim JPO eingereichten Anmeldung einPrioritätsdokument gemeinsam hat(s. Anlage, Tabellen H, I, J, K und L),

oder

(Fall IV) die EP-Anmeldung und dieJP-Anmeldung sind von einer inter-nationalen PCT-Anmeldung ohnePrioritätsanspruch abgeleitet (s. Anlage,Tabelle M).

B. Requirements for requestingparticipation in the PPH pilotprogramme at the EPO

In order to be eligible to participate in thePPH pilot programme at the EPO, thefollowing requirements must be met:

(1) The EP application for which partici-pation in the PPH pilot programme isrequested and the corresponding JPapplication must have the same priority/filing date. In particular the EP appli-cation, including a Euro-PCTapplication:

(Case I) is an application that validlyclaims the priority of one or more appli-cations filed with the JPO (see Annex,tables A, B, C and D);

or

(Case II) is an application which is thebasis of a valid priority claim for theapplication filed with the JPO(see Annex, tables E, F and G);

or

(Case III) is an application which sharesa common priority document with theapplication filed with the JPO(see Annex, tables H, I, J, K and L);

or

(Case IV) and the JP application arederived from a PCT internationalapplication having no priority claim(see Annex, table M).

B. Demande de participation auprogramme pilote PPH à l'OEB :conditions à remplir

La participation au programme pilotePPH à l'OEB est soumise aux conditionssuivantes :

1) La demande EP donnant lieu à unedemande de participation au programmepilote PPH et la demande JP correspon-dante doivent avoir la même date depriorité/dépôt. En particulier, la demandeEP, y compris une demande euro-PCT :

(cas I) doit être une demande revendi-quant valablement la priorité d'une ou deplusieurs demandes déposées auprèsdu JPO (cf. Annexe, tableaux A, B, Cet D) ;

ou

(cas II) doit être une demande fondantune revendication de priorité valablepour la demande déposée auprès duJPO (cf. Annexe, tableaux E, F et G) ;

ou

(cas III) doit être une demande qui a undocument de priorité commun avec lademande déposée auprès du JPO(cf. Annexe, tableaux H, I, J, K et L) ;

ou

(cas IV) la demande EP et la demandeJP doivent résulter d'une demande inter-nationale PCT ne revendiquant pas depriorité (cf. Annexe, tableau M).


(2) Die korrespondierende(n) JP-Anmel-dung(en) muss/müssen mindestenseinen Patentanspruch enthalten, dervom JPO für patentierbar/gewährbarbefunden wurde.2

3) Die Ansprüche einer EP-Anmeldung,für die die Teilnahme am PPH-Pilot-programm beantragt wurde, müssenden patentierbaren/gewährbaren An-sprüchen in der/den korrespondierendenJP-Anmeldung(en) in ausreichendemMaße entsprechen oder so geändertwerden, dass dies der Fall ist. DieAnsprüche gelten dann als ausreichendkorrespondierend, wenn sie abgesehenvon formatbedingten Unterschiedendenselben oder einen ähnlichen Schutz-umfang haben oder wenn die Ansprüchein der EP-Anmeldung einen engerenSchutzumfang haben als die Ansprüchein der/den JP-Anmeldung(en). In diesemZusammenhang hat ein Anspruch danneinen engeren Schutzumfang, wennein JPO-Anspruch so abgeändert wird,dass er durch ein von der Patentschrift(Beschreibung und/oder Ansprüche)gestütztes zusätzliches Merkmal weiterbeschränkt wird. Als nicht ausreichendkorrespondierend gilt ein Anspruch inder EP-Anmeldung, der eine neue/andere Anspruchskategorie einführtals die der vom JPO für patentierbar/gewährbar befundenen Ansprüche.Umfassen die JPO-Ansprüche beispiels-weise nur Ansprüche auf ein Verfahrenzur Herstellung eines Erzeugnisses, sogelten die Ansprüche in der EP-Anmel-dung als nicht ausreichend korres-pondierend, wenn damit Erzeugnis-ansprüche eingeführt werden, die vonden korrespondierenden Verfahrensan-sprüchen abhängen. Der Anmeldermuss eine Erklärung einreichen, dass

(3) The claims in the EP application forwhich a request for participation in thePPH pilot programme is made mustsufficiently correspond or be amended tosufficiently correspond to the patentable/allowable claims in the correspondingJP application(s). Claims are consideredto sufficiently correspond where,accounting for differences due to claimformat requirements, the claims are ofthe same or a similar scope or the claimsin the EP application are narrower inscope than the claims in the JP appli-cation(s). In this regard, a claim that isnarrower in scope occurs when a JPOclaim is amended to be further limited byan additional feature that is supported inthe specification (description and/orclaims). Additionally, a claim in the EPapplication which introduces a new/different category of claims than thoseindicated to be allowable/patentable bythe JPO is not considered to sufficientlycorrespond. For example, where theJPO claims only contain claims to aprocess of manufacturing a product, thenthe claims in the EP application are notconsidered to sufficiently correspond ifthe EP claims introduce product claimsthat are dependent on the correspondingprocess claims. The applicant isrequired to submit a declaration thatthe claim(s) sufficiently correspondbetween the EP and JP applications.

A cet égard, une revendication a uneportée moins étendue lorsque la reven-dication de la demande JP est modifiéepour être limitée par une caractéristiqueadditionnelle fondée sur le texte de lademande (description et/ou revendica-tions). Par ailleurs, une revendicationde la demande EP introduisant unecatégorie de revendications nouvelle/différente par rapport à celles que leJPO a indiquées comme admissibles/brevetables ne sera pas considéréecomme suffisamment concordante. Parexemple, lorsque les revendications dela demande JP ne portent que sur unprocédé de fabrication d'un produit, lesrevendications de la demande EP neseront pas considérées comme suffisam-ment concordantes si la demande EPintroduit des revendications de produitdépendantes de ces revendications deprocédé. Le demandeur est tenu de

C. Erforderliche Unterlagen für dieTeilnahme am PPH-Pilotprogrammbeim EPA

Zur Teilnahme am PPH-Pilotprogrammbeim EPA muss der Anmelder:

1) einen Antrag auf Teilnahme am PPH-Pilotprogramm einreichen. Das Antrags-formblatt (EPA/EPO/OEB 1009 JP) istauf der EPA-Website unter www.epo.orgerhältlich;

2) eine Anspruchskorrespondenz-erklärung einreichen (entsprechendesKästchen im PPH-Antragsformblattankreuzen);

3) alle amtlichen Bescheide zu jederJP-Anmeldung, in der die dem PPH-Antrag zugrunde liegenden patentier-baren/gewährbaren Ansprüche enthaltensind, in Kopie einreichen sowie Überset-zungen in einer der Amtssprachen desEPA vorlegen;

4) die patentierbaren/gewährbarenAnsprüche der JP-Anmeldung(en) inKopie und als Übersetzung in einer derAmtssprachen des EPA vorlegen;

5) alle in den Bescheiden des JPOangeführten Veröffentlichungen mitAusnahme von Patentunterlagen inKopie einreichen.

Wird dem Antrag auf Teilnahme amPPH-Pilotprogramm stattgegeben, sowird der Anmelder entsprechendbenachrichtigt, und die Bearbeitung derEP-Anmeldung wird beschleunigt. Sindnicht alle oben genannten Vorausset-zungen erfüllt, wird der Anmelder auf diein seinem Antrag festgestellten Mängelhingewiesen. Der Anmelder erhält ein-mal die Gelegenheit, Mängel im Antrag

C. Documents required for partici-pation in the PPH pilot programmeat the EPO

For participation in the PPH pilotprogramme at the EPO the applicant hasto:

(1) file a request for participation in thePPH pilot programme. A request form(EPA/EPO/OEB 1009 JP) is available viathe EPO website at www.epo.org;

(2) file a declaration of claims corres-pondence (tick the appropriate box inthe PPH request form);

(3) submit a copy of all the office actionsfor the JP application(s) containing thepatentable/allowable claims that are thebasis for the request, and a translationthereof into one of the EPO officiallanguages;

(4) submit a copy of the patentable/allow-able claim(s) from the JP application(s)and a translation thereof into one of theEPO official languages;

(5) submit copies of all the documentsother than patent documents cited in theJPO office action(s).

Where the request for participation inthe PPH pilot programme is granted,the applicant will be notified and the EPapplication will be processed in anaccelerated manner. In those instanceswhere the request for participation in thePPH pilot programme does not meet allthe requirements set forth above, theapplicant will be notified and the defectsin the request will be identified. 2) déclaration de concordance desrevendications (cocher la case prévueà cet effet sur le formulaire de demandede participation au PPH) ;

3) copie de toutes les notifications relati-ves à la ou aux demandes de brevet JPcontenant les revendications breveta-bles/admissibles sur lesquelles se fondela demande de participation au PPH, ettraduction de celles-ci dans l'une deslangues officielles de l'OEB ;

4) copie de la ou des revendicationsbrevetables/admissibles figurant dans laou les demandes de brevet JP, et traduc-tion de celles-ci dans l'une des languesofficielles de l'OEB ;

5) copies de tous les documents non-brevets cités dans les notifications duJPO.

Si la demande de participation auprogramme pilote PPH est acceptée, ledemandeur en sera informé et lademande EP sera traitée d'une manièreaccélérée. Si la demande de partici-pation au PPH ne remplit pas toutesles conditions exposées ci-dessus ledemandeur en sera informé par unenotification précisant les irrégularitésque présente sa requête. Il sera alors

Sind einige der unter 3) und 4) genanntenUnterlagen

a) mit der EP-Anmeldung bereits einge-reicht worden, bevor eine Teilnahme amPPH-Pilotprogramm beantragt wurde, somuss der Anmelder diese Unterlagen beiAntragstellung nicht erneut übermitteln.In diesem Fall braucht er lediglich aufdiese Unterlagen zu verweisen und inseinem PPH-Antrag anzugeben, wann erdiese mit der EP-Anmeldung eingereichthat;

b) über das AIPN (Advanced IndustrialProperty Network) abrufbar, so mussder Anmelder keine Kopien einreichen,sondern legt stattdessen eine Liste derabzurufenden Unterlagen vor. Sind dieÜbersetzungen von über das AIPNbereitgestellten Unterlagen unzurei-chend, so kann der Prüfer des Nach-anmeldeamts den Anmelder auffordern,eine korrekte Übersetzung nachzurei-chen. Ist/sind die JP-Anmeldung(en)unveröffentlicht, so muss der Anmelderbei Stellung des PPH-Antrags dieunter 3) und 4) genannten Unterlagensamt Übersetzung einreichen.

Das EPA kann beglaubigte Abschriftender unter 3) und 4) genannten Unter-lagen verlangen.

D. Bearbeitung im Rahmen von PACE

Wird dem Antrag auf Bearbeitung einerEP-Anmeldung im Rahmen des PPH-Pilotprogramms stattgegeben, so wirddie EP-Anmeldung nach dem PACE-Programm3 beschleunigt bearbeitet.

Une fois que la demande de participationau programme pilote PPH a été accep-tée, la demande de brevet EP fait l'objetd'un traitement accéléré au titre dePACE3.

Introduction

These notes explain how to complete form EPA/EPO/OEB 1009 JP (Participation in the Patent Pro secution Highway pilot programme between the JPO and the EPO based on national work products). The form can be obtained from the EPO.

Filling in form 1009 JP

The sections of the form should be completed as follows:

– JP application number: Enter the patent application number assigned

by the JPO. This application has at least one claim indicated by the JPO to be patentable/allowable.

– Filing date of JP application: Enter the ling date accorded by the JPO.

– Corresponding EP application number: Enter the number of the corresponding

European patent application which should be processed under the PPH.

2. Request to obtain documents in 1 via the Dossier Access System: Applicant can either provide a copy of the JPO

of ce action(s) with the PPH request or request that the EPO obtain these documents from the JPO, provided these documents are available via AIPN.

Einleitung

Dieses Merkblatt erläutert das Ausfüllen des Formblatts EPA/EPO/OEB 1009 JP (Teilnahme am Pilotprogramm "Patent Prosecution Highway" zwischen dem JPO und dem EPA auf der Grund-lage nationaler Arbeitsergebnisse). Das Formblatt ist beim EPA erhältlich.

Ausfüllen des Formblatts 1009 JP

Die einzelnen Abschnitte des Formblatts sind wie folgt auszufüllen:

– Aktenzeichen der JP-Anmeldung: Geben Sie hier das Aktenzeichen ein, das der

Patentanmeldung vom JPO zugewiesen wurde. Diese Anmeldung enthält mindestens

einen Anspruch, der vom JPO für patentierbar/gewährbar befunden wurde.

– Anmeldetag der JP-Anmeldung: Geben Sie hier den vom JPO zuerkannten

Anmeldetag ein.– Entsprechende EP-Anmeldenummer: Geben Sie hier die Nummer der korrespondie-

renden europäischen Patentanmeldung ein, die im Rahmen des PPH bearbeitet werden soll.

Remplir le formulaire 1009 JP

Les différentes parties du formulaire doivent être remplies de la manière suivante :

– Numéro de la demande JP : Entrez le numéro attribué par le JPO à la demande de brevet. Cette demande a au moins

une revendication indiquée comme brevetable/admissible par le JPO.

– Date de dépôt de la demande JP : Entrez la date de dépôt attribuée par le JPO.

– Numéro de demande EP correspondant : Entrez le numéro de la demande européenne

correspondante à traiter dans le cadre du PPH.

7. Declaration of claims correspondence The applicant declares that the claims

suf ciently correspond between the EP and JP applications.

– Place: Enter the place of ling of form 1009 JP.

– Date: Enter the date of ling of form 1009 JP.

– Name: Enter the name of the person entitled to sign.

– Signature: If the applicant is a legal person other than an

individual, the form must be signed: – either by a person entitled to sign under the

law or the applicant's statute, articles of association or the like, with an indication of the

capacity of the person doing so (e.g. chairman, director, company secretary) (Art. 133(1) EPC), in which case no authorisation need be led

– or by another employee of the applicant, provided the latter’s principal place of business

is in a contracting state (Art. 133(3), rst sentence, Rule 152(1) EPC), in which case an

authorisation must be led.

oder nach Statut der juristischen Person, ihrer Satzung oder dergleichen zur Unterschrift berechtigt ist, wobei ein Hinweis auf die Un-terschriftsberechtigung des Unterzeichneten zu geben ist (z. B. Geschäftsführer, Prokurist, Handlungsbevollmächtigter) (Art. 133 (1) EPÜ); in diesem Fall braucht keine Vollmacht einge-reicht zu werden;

– oder, sofern die juristische Person ihren Sitz in einem Vertragsstaat hat, von einem ihrer Ange-stellten (Art. 133 (3) Satz 1, Regel 152 (1) EPÜ); in diesem Fall ist eine Vollmacht einzureichen.

– soit par un autre employé du demandeur, à condition que ce dernier ait son siège dans un État contractant (article 133(3), première phrase, règle 152(1) CBE) ; dans ce cas,

un pouvoir doit être déposé.
