Contact [email protected] info By The People, For The People The gemora (Brochos 55a) teaches us that we cannot appoint a leader of the community (“Parness”) against the will of the people. Therefore, the public must rst be asked. This is learned from the pasuk that says “I have asked Bealel to take a position.” (Shemos 31:1,2) The question is obvious: Bealel did not have any real power as a leader, but rather was a public servant, appointed to work as a craftsman to create the mishkan and the vessels that were inside. How then can we learn from this passuk, a law that applies to a leader? I heard an insight from my Rosh Yeshiva, which was based on a terminology in the Rambam. He explained the dierence between a “melech” (king) and a “moshel” (ruler). He said that a king considers his citizenry as the people whom he is representing, and it is his obligation to be concerned for their wellbeing. This could be compared to a father: Even though he is the head of the household, he understands that the responsibility to care for his families best interests, rests squarely on his shoulders. The ruler, on the other hand, obtained his current position by force and uses the citizenry for his own purposes, or taxes them in order to enhance his own personal wealth. His only concern is that the citizenry should be healthy enough to serve him, just as someone who possesses a horse is concerned that his horse is well taken care of. We now understand that there is a relationship between the “Parness” and the citizenry. The Gemora is telling us that we must liken the Parness to the king and not to the ruler. This idea is echoed in Shulchan Aruch, in regards to a shaliach ibur. A person must have the approval of the people in order to serve as a shaliach ibur. Someone who has disfavor in the eyes of the ibur is not ing for that position. The Chasam Sofer teaches us that being that the purpose of building the mishkan was that through the mishkan we should serve Hahsem, therefore even those who are involved in creating the kapara for klal Yisrael must be the emissary of the people. Therefore, we have the right to learn from Bealel to the Parness, for Bealel was not just a craftsman; he was similar to the shaliach ibur because he set the stage for forgiveness from Hashem. By The People, For The People The gemora (Brochos 55a) teach‐

es  us  that we  cannot  appoint  a 

leader  of  the  community 

(“Parness”)  against  the  will  of 

the people. Therefore, the public 

must  first  be  asked.  This  is learned  from  the pasuk  that  says “I 

have  asked Betzalel  to  take  a posi‐

tion.”  (Shemos 31:1,2) The question 

is  obvious:  Betzalel  did  not  have 

any  real power as a  leader, but  ra‐

ther was a public servant, appointed to work as a craftsman 

to create the mishkan and the vessels that were inside. How 

then can we learn from this passuk, a law that applies to a 

leader? 

I heard an insight from my Rosh Yeshiva, which was based 

on a  terminology  in  the Rambam. He explained  the differ‐

ence between  a  “melech”  (king)  and  a  “moshel”  (ruler). He 

said that a king considers his citizenry as the people whom 

he  is  representing, and  it  is his obligation  to be concerned 

for  their well‐being.  This  could  be  compared  to  a  father:

Chessed of the Avos חסדי אבות Rav Chaim Friedlander emphasizes that the Nusach of the Tefila is “Chasdei

Avos”  and  not  “Maasei Avos”  (actions  of  the  Patriarchs),  because  even 

though  in  reality Hashem  is doing Chessed to us by  rewarding us  for our 

good deeds, He considers our Avodas Hashem to be as if we are doing Him 

Chessed by fulfilling His will and Mitzvos. 

Why do we mention at least three times a day “He remembers the Chessed

of the Avos” in our Tefila, as if we are reminding Hashem to remember the 

Avos? Hashem doesn’t  remember  the good deeds of  the Avos by Himself, 

such that we need to remind him? 

The Sifsei Chaim answers that we learn from this an important principle in 

serving Hashem. We won’t merit the mercy of Hashem in merit of the Avos

unless  we  remember  the  Chasdei Avos and  then  remind  Him,  because 

Hashem’s  remembering  the Avos in order  to have  compassion on us, de‐

pends  on  our  “awakening  from  below”  first  in  order  to  bring  about  an 

awakening  in  Heaven.  We  saw  the  same  idea  with  Moshe  Rabbeinu 

(Shemos  32:13)  who  asked  Hashem  to  have  mercy  on  Bnei Yisrael

“Remember  for Avraham,  for Yitzchak,  and  for Yisrael your  servants…”. 

Hashem doesn’t remember  the Avos such  that Moshe had  to remind him? 

Rather, activation of mercy was dependent on Moshe recognizing and men‐

tioning  the attribute. So  too,  in order  for Hashem  to  remember  for us  the 

merits of  the Avos, we have  to  recognize  them and  “remind” Hashem of 

them. That’s why we mention remembering the Avos in our Tefila so many 

times. The more we  recognize  the greatness of  the Chessed of  the Avos, so 

Hashem will  “remember”  their  Chessed in  order  to  bring  upon  us  great 

Chessed. 

And once Hashem remembers the Chessed of the Avos (after we have inter‐

nalized it and reminded Him), He doesn’t only do good to the descendants 

of the Avos, but redeems them even if according to their actions they don’t 

deserve it.

ומצוותיו.

י אבות" וכר חסד ז ו ו אומרים " מדוע אנבתפילתנו, שכביכול אנו מזכירים לקב"ה שיזכור מעשי האבות הקדושים? כך אנו נוהגים לפחות שלוש פעמים ביום. וכי ה' אינו זוכר מעצמו את מעשיהם הטובים וכי עלינו להזכיר לו זאת?

עונה ה"שפתי חיים" שלומדים מכאן יסוד גדול בעבודת ה'. אין אנו זוכים לרחמי ה' בזכות האבות אא"כ אנו זוכרים ומזכירים זאת, כי זכירת ה' אותנו לרחם עלינו תלויה באיתערותא דלתתא שלנו (זאת אומרת אם אנחנו למטה נזכור, אז ה' למעלה יזכור). וכן ראינו אצל משה רבינו שביקש רחמי ה' על ישראל בהזכרת ָרֵאל ּוְלִיׂשְ ְלִיְצָחק ְלַאְבָרָהם ְזֹכר "

" (שמות לב:יג), והרי הקב"ה יודע וזוכר … ֲעָבֶדיךָ את האבות ומעשיהם בלי שמשה יזכיר לו אותם. אלא הפעלת מידת הרחמים של ה' תלויה בהזכרתינו והכרתינו של המידה. כך גם כדי שה' יזכור לנו זכות אבות, עלינו להכיר שמידת ה' תלויה בכך שאנו נזכור ונזכיר. ולכן פעמים רבות בתפילתינו אנו מזכירים את האבות קדושים. וככל שאנו נחוש ונפנים זאת יותר, באותה מידה יתנהג עמנו ה' ויזכור לנו חסדי אבות, ויפעיל עלינו את החסד הגדול הזה.

אחרי ובגלל שהקב"ה "זוכר חסדי אבות" (שזכרנו והזכרנו), הוא לא רק מטיב לבנים אלא גם מביא להם גאולה גם אם לא יהיו ראויים

מצד מעשיהם לגאולה.

Q Mrs. Kaganʹs  home was  sparkling  clean  two  days 

before Pesach, and she outlawed  the possession of 

chometz  in  the  home  by  anyone.  For  dinner,  Yitzchak 

Tzvi made a BBQ and everyone ate  the meats with pita 

bread  in  their  private  backyard. During  the meal Mrs. 

Kagan  saw  that Sruly dropped  a piece of bread on  the 

ground,  and Avrumy  threw  his  leftover pita  at Goldy, 

but missed,  and  the  bread  landed  in  the  bushes. Does 

Mrs. Kagan have  to make  sure all  the bread  is  cleaned 

up, or may she rely on the birds to eat the bread before 

Pesach? 

A Mrs.  Kagan  must  clean  up  all  the  bread  in  the 

backyard. She may only rely on the birds  if she is 

unsure  if  there  is chometz but,  in  this case, she saw  the 

bread there after the meal, so she must remove it and her 

husband must do a bedika of the backyard before Pesach.

Q Dovid and Tamar Berkowitz were  invited  to spend Pu‐

rim and Pesach with Tamarʹs parents, the Brochsteins, in 

Boca. Since  they  left more  than a month before Pesach,  they 

didnʹt do a bedika in their home  in Jerusalem. When  it comes 

time for the bedika in Boca: 1) Is Dovid required to search his 

bedroom and his childrenʹs bedroom? 2) Should Dovid say a 

brocho before inspecting these rooms? 

A 1) It is questionable if Dovid is required to do a bedika. 

However, he may rent the room from his father‐in‐law 

(with  a proper  acquisition/kinyon),  so  that  the  room will  be 

his during Pesach. He may then place his own chometz in the 

room and search for it on the night of the 14th. 

2) No. It is a disagreement amongst poskim. To get out of the 

debate,  he  should  listen  to  his  father‐in‐law  say  the  brocho 

and simply answer ʺamein.ʺ.

בשם בצלאל" אמר לו ' שנא' (שמות לה:ל) "ראו קרא ה הקדוש ברוך הוא למשה, "משה הגון עליך בצלאל?" אמר לו, "רבונו של עולם אם לפניך הגון לפני לא כל שכן". אמר לו, "אף על פי כן לך אמור להם". הלך ואמר להם לישראל, "הגון עליכם בצלאל?" אמרו לו, "אם לפני הקדוש ברוך הוא ולפניך הוא הגון לפנינו

לא כל שכן" (ברכות נה:א)

השאלה ברורה: בצלאל לא מונה כמנהיג, אלא כאומן כדי לעשות את המשכן וכליו בשביל כלל ישראל. א"כ

למה היה צריך לשאול אם הצבור יקבלו אותו?

פעם שמעתי הסבר מראש הישיבה שלי, המבוסס על מאמר ברמב"ם על ההבדל בין "מלך" ל"מושל ". הוא הסביר ש"מלך" רואה את האזרחים שלו כאנשים שהוא מייצג, ולכן חובתו היא לדאוג לכל ענייניהם. בדומה לאב, שלמרות שהוא ראש המשפחה, הוא מבין שהאחריות לאושרם של בני המשפחה מוטלת על כתפיו. ה"מושל", לעומת זאת, קיבל את ממשלתו בכוח, ומשתמש באזרחים למטרותיו, לדוגמא הוא מטיל עליהם מסים כדי להרבות את עושרו האישי. הדאגה היחידה שלו לאזרחים היא שהם יהיו מספיק בריאים כדי לשרת אותו, בדיוק כמו מי שיש לו סוס, שדואג

שסוסו יטופל היטב.

עכשיו אנחנו כבר יכולים להבין יותר את היחסים בין ה"פרנס" לבין הציבור. הגמרא אומרת לנו שהפרנס דומה למלך ולא למושל. רעיון זה גם מוזכר בשלחן ערוך לגבי שליח ציבור. על מנת לשמש כשליח ציבור, אדם חייב לקבל את אישור הקהילה. מי שלא אהוב ע"י הציבור אינו מתאים לתפקיד זה. החת"ס סופר מסביר לנו כי מכיוון שמטרת בניית המשכן היתה כדי לעבוד את ה', כל המעורבים בעשיית אמצעי ה"כפרה" עבור כלל ישראל היו השליחים שלהם. לכן, יש לנו את האפשרות ללמוד מבצלאל לפרנס, כי בצלאל לא היה רק אומן; הוא היה דומה לשליח ציבור, שמייצג אותנו

כדי לקבל סליחה מה'.

אני רוצה להוסיף שהפרנסים של הצבור, אלו שקובעים איך הציבור צריך להתנהג במצבים מסוימים, מלבד חובתם לציבור בכלל, גם מחויבים לחיות את חייהם ברמה רוחנית גבוהה יותר. זה חל גם על כל אדם שעומד בראש משפחה. צריכים לוודא שכל השוכנים איתו יראו אותו כאדם טוב כדי שיקבלו אותו כשהוא

מייצג אותם בזמן שהוא מתפלל לצרכי הבית.

מי ייתן ונזכה למלא את התחייבויותינו.

I would like to add that the Parness of the tzibur, those who 

dictate to the tzibur how to act in certain circumstances, not 

only serves a civic duty, but he also is obligated to lead his 

life on a higher plane. This example  is  true  for each  indi‐

vidual  who  heads  a  household.  He  should  ensure  that 

those who dwell together with him see him in a good light 

in order that he can represent them when he prays for the 

well‐being of his household. May we merit to fill our obli‐

gation.
